Q. My home is on the market with a licensed Realtor. I received an offer today that I want to counter. In my counteroffer, I want to exclude our satelite dish. My Realtor tells me I can't do that because it is in the prewritten contract form as an inclusion. Isn't anything negotiable in a conatract between two parties?

Q. My mother in law just refinanced her home, but in order for her to do that she had to have my husband sign some papers in order for it to go through. When I asked him what the papers were, he said that they were for the title of the home and that if anything were to happen to her that he would be responsible for the home, is that true? And doesn't that mean that he has cosigned the loan so if she cant pay the mortgage it falls on us? And can you give me some reasons as to why she would not be able to do this herself?

Q. We purchased a home in alberta to which we discovered within 3 months of living in that their was a leaking roof which had caused structural damage to the framing of the house. Upon roof repairs and an inspection by a structural engineer it was told to us that a) this damage had been an ongoing problem over the course of 5-6 years and it was impossible that the peviouse owners were unaware of the provblem and b) whomever attempted to repair the roof was not a professional, that it looked like someone sat with a case of beer and did not do the repair properly. We are now in the process of taking the previouse owner to civil court, damages are estimated at 12 thousand ten thousand dollars. The judge has asked us to provide legal proof that the homeowner is obligated by law to disclose information pertaining to the damages. Also at pretrail the previous owner stated that they were aware of the leaking roof and staining to the ceiling from water damage and that he had spraypainted this area to cover the marking. As well we were told they has been aware of this problem since 2003. As well as needing to know if their is law stating this information be disclosed we need to know if their is, what is the statute of limitations if any . I need to bring this supporting documentation to court to prove that it is indeed a law if it is. If you could provide this information to me I would gratly appreciate it. Q. We sold our house for the note owed a little over a year ago in Austin, Texas. My husband signed over the deed before he left the house and the keys for the other buyers. Since then we have found the note has not been paid and as far as the bank says we still own the house we have been making all the payments but these people will not pay. We have an attorney on it yet he says that my husband signed the deed over to them it will be hard for us to get the house back. If we don't pay the note the bank gets the house either way and our credit goes bad. The bank tells us that we are the owners so how can we get the deed back in our name and the people out?

Q. My daughter just had a house built with her boyfriend in Fairbanks, GA. The mortgage is in his name but both names are on the deed. He now tells her after four months (Nov. Q. My daughter shares an apartment with three roommates. Their leases are individual. Recently it was time to renew the lease so my daughter and my husband did. However her roommates told her the day after renewing the lease that they no longer wanted to live her. They are partiers, she isn't. What reason! The renewal lease was not notarized, so is it binding? My daughter is twenty years old, my husband is the guarantor. The initial lease my husband signed was notarized, but the renewal lease was not.

Q. My husband and I are retired. We have been looking at manufactured home parks 55 and older. There are land owned and one's where you pay ground rent. Here's the question, we are very confused. In the land owned community the homes are very old and will need upgrading. They are also expensive, $209,000 for a 1983 in very poor condition. The land is appraised at
$95,000 and is on the Mayaka river. We have very little cash flow and we don't know if we should risk the money on this old home.
On the other hand the parks where you don't own the ground are less expensive. For $95,000 we could have a 1996 manufactured home, beauifully kept and on a man maded lake with a beautiful view. The rent is $550.00 a month. That includes upkeep of the grounds, cable tv, and water.
My husband is 57, and is on disability, I will probably get a job where ever we settle. HELP!!!!

Q. Can you list a house with multiple real estate agents? A parent owns a house in Jackso, Alabama. The husband died and the wife not familar with the process wants to sell it. The sister living in that area is deciding to sell the house using multiple local company's and also for sale by owner. The other sisters would prefer to use a more established company.
Jackson is a small rural town about 60 miles north of Mobile, AL. What is the best route to sell a house in a rural enviroment? Will most realitors list open contracts like that? The realtors the sister in Alabama say they will do this for 4%. This is causing a real problem in the family as they multiple local realitors will just prolong the process and the brother-in law involved, who lived in the house for a period of time and really let it go, has cheated the former husband out of money in the past. THe other sisters feel this is just another scam. The husbands wife does not know what to do.
Any help someone could provide would be much appreciated. If there is a number I could call to talk to someone I would be very grateful also. No contracts have been sighed yet.
