Q. I'm from California and going thru divorce. I had left my home to relocate up North 6 months prior, plan was my husband then was to follow us, he changed his mind. He stayed in our home, and lost his job almost going for a year now. He took his retirement to fund his daily needs including mortgage. He refused to move out to rent out the property, I don't want to be bought out either. His girlfriend has now moved in. We had listed the property for sale, we had one offer but he counter offered and lost a buyer. I had lowered the price to attract more buyers, but not seen any yet. How do I sell this property without him as a barrier, can I charge rent as they stay in the property? Thanks..

May I suggest you seek the advise of a real estate attorney and or divorce attorney as these are legal questions.  I do hope your situation improves as it is stressful to sell a home when both owners are not on the same page.

a RE attorney can file a partition action to force a sale or same by the divorse atty.
