Q. I was sold a piece of land that the owner DID NOT reveal he owed money on the land, and now having problems selling my home. Did the original seller commit land fraud sale by not revealing money owed on the land I paid cash for?

Did you use a title company and did they do a lien search?

Submitted 08/08/12 04:07 PM I did not get title insurance, because owner was someone I trusted and claimed to own the land. He did not state that him or his wife owed any money, or that there were any loans to be paid off.

I'm sorry that happened to you, but that is exactly why you should always contact a title company and have a title search performed before you enter into any kind of real estate deal.  The lien would have showed up right away.  The search would have cost you from $100 to $150 and the closing would have ended up costing a few more hundred dollars--it would have been money well spent.

In addition, if you are working with a professional real estate agent, they would always advise you to have a title search performed.  In the long run--you have not saved anything.  You may need legal counsel at this point.   

The other problem you may run into will come up when you try and sell the land with no title insurance policy.  Again, I would advise you to contact a real estate attorney.
