One of our most important jobs as agents is to identify red flags to our clients, document and follow up.
An attorney who taught a class I attended a couple of years ago said you can never completely avoid law suits, but you can minimize potential exposure.

HUD Cracking Down on use of Builder's Preferred Lender? - 10:10 AM
I am curious if this is a nationwide epidemic or something just region specific?
Is HUD finally cracking down on builder's tying incentives (upgrades, freebies, closing costs paid, price fluctuations, house payment paid for one year) to their preferred lenders?
A collegue, Tom Burris, posted this article in a forum about a week ago.  I found it very interesting and wonder how long it will take before builders will heed the call in regards to RESPA violations.
I am not saying all builder's preferred lenders do crazy things but I have not yet had a good experience with a builder's lender!

Don't let Ethics Slide in a Cooling Market - 09:23 PM
I had something happen last week that caught me off guard.  An agent from another company had written an offer on one of my new construction listings.  The offer was contingent on the sale of the buyer's current home.  Needless to say, the builder would not accept the contingency, marked it out in a counteroffer and we returned it to the other agent.  I was totally surprised when I got the contract back fully executed, with the buyer agreeing to purchase with no contingency.  I called the other agent up, asked him point blank - "Can your buyer qualify to purchase … (36 comments)

Unintentional Range Pricing - 08:26 PM
In analyzing the October 2006 data from some of the MLS areas of Colorado Springs, I found that our average Sale Price vs. List Price was 98.85%. What I found to be of particular interest was that the areas that had the fewest "sales" all had SP vs. LP over 100%.
Why would that happen? My guess is that we have run into the issue of "Unintentional Range Pricing."  Range pricing is not something that our area Realtors® practice, but there is always a "price range" that a house falls within. Since joining ActiveRain back in July, I have learned more about Google rankings, SEO, duplicate content, back links, SERPS, Meta tags, key words and so many other things I just didn't have a clue about before. Thanks Mary McKnight. From what I understand, with my limited knowledge of these things, all of these "thingies" are to help drive traffic to my web site. We talked previously about using a seller concession to pay for closing costs. It is a great way to save money or to find money to complete a transaction. There is another thing you can use this concession for. You can buy down the interest rate.
How does this work? Remember in the earlier post on seller concession we talked about the different amounts available based on your down payment? These same funds can be used to pay points that will reduce your interest rate.

Med and I decided to meet here this morning, after taking Sunday off from blogging. Completely. No Posts. No Comments. Nothing.
We spent Sunday discussing the disconnect between the (allegedly) improving economy and what we observe here in the neighborhood. Our neighborhood is an eclectic mix of professional folks, merchants, tradesmen (& women), laborers, and service workers, the majority of whom are employed in some fashion or another. Looks like ActiveRain got a anniversary present - 10:13 PM
As I mentioned yesterday it was just ActiveRain's six month anniversary.  It looks like Google provided a nice little present.  A minor update happened sometime in the last couple days and we started to climb up in the ranking for some competitive keyterms terms.  Not the major jump I'm expecting sometime in the next few months but it is going to add about 1,000 extra visitors off of Google vs. last Monday.  With about 4 hours go (PST) we may break 6,000 unique visitors in a single day for the first time.  Given how new the site is and with age and link age playing … (17 comments)

Squidoo & PubCon - 10:01 PM
One of the things that kept coming up at PubCon was the importance of having links from trusted sites pointing to yours. I think Active Rain certainly qualifies as one, despite being very new. Social networking sites and their importance for drawing traffic and exposure to your website was another topic that kept coming up. Berkshire Lakes - Market Update December 2006 - 08:39 AM
This is a little early for my December update, but I had a call regarding this community and since I had to pull the information together for this person, I thought I would update my stats now.  Berkshire Lakes is one community that I happen to enjoy.  Quiet streets with walkways and paths where neighbors wave when you walk by.  There is a community center with pool, tennis and fishing pier.  This area is a desirable community and not a lot happening in sales.  In fact this is one area that I have seen prices driven down in the past several months.

The Miss Cherokee County 2007 beauty pageant is accepting applications from contestants. The contest is open to women age 17 to 24 who live, work or attend school in Cherokee, Cobb, Pickens, Forsyth, Bartow or Dawson counties. There is no entry fee. Fulton County Gets Partial Flu Vaccine Supply - 12:49 PM
The Fulton County Department of Health and Wellness has received a partial shipment of flu vaccine and will begin offering the $25 shots on Monday, November 27 at each of the County's 12 health centers.
The partial shipment of 5,000 doses will allow the Department to serve the elderly in senior citizen centers and high rises, as well as other priority high-risk groups until the arrival in December of the remaining vaccine ordered for the 2006 flu season.

Sometimes working with buyers that aren't on the same page is challenging.  My buyers were both looking to move, but not into the same house obviously.  Each time I showed them a home, one would like it the other would hate it.
By the third house it became abundantly clear the couple needed some serious time around a table, talking about their expectations.  It was not my job to tell them that, I was hoping they would figure it out soon enough.

Driving to the health club with my lovely bride (of 16 wonderful years now) this morning we were listening to our favorite, local talk radio host, Hallerin Hill (you can listen to Hal live Monday - Friday 5:30 AM - 10:00).
Hal had been downtown this weekend to the ice skating rink set up annually on our Market Square Mall. While there he struck up a conversation with an elderly lady watching the skaters.
She told Hal she was there watching her great, great, great grandson skate, was 92 years old and still very vigorous and involved with life; certainly an example to follow.
