2008 Housing Stimulus Legislation Tax Credit

I am posting this information to make sure anyone that has purchase a home after April 9th 2008 and up to July 1st 2009, and meets the income criteria and property type requirement knows that they may be eligible for the Tax Credit Program.

Who is Eligible:

The $7,500 tax credit is available for first-time homebuyers only.

The law defines a first-time homebuyer as a buyer who has not owned a home during the past three years.

All U.S. citizens who file taxes are eligible to participate in the program.

Types of Homes thatQualify for theTax Credit

All homes, whether single-family, town homes, or condominiums will qualify.

However, there are several conditions:

The home must be used as a principal residence, and

The buyer has not owned a home in the prior three years.

The tax credit includes newly-constructed homes.

IncomeLimits

Homebuyers who file as single or head-of-household taxpayers can claim the full $7,500 credit if their adjusted gross income (AGI) is less than $75,000. (The price of the purchased property must be $75,000 or more to receive the full credit; otherwise the tax credit would be 10% of the sales price.)

For married couples filing a joint return, the income limit doubles to $150,000.

Single or head-of-household taxpayers who earn between $75,000 and $95,000 are eligible to receive a partial first-time homebuyer tax credit.

Married couples filing jointly who earn between $150,000 and $170,000 are eligible to receive a partial first-time homebuyer tax credit.

The credit is not available for single taxpayers who AGI is greater than $95,000 and married couples filing jointly with an AGI that exceeds $170,000.

EffectiveDates for theTax Credit

First-time homebuyers would receive a $7,500 tax credit for the purchase of any home on or after April 9, 2008 and before July 1, 2009. To qualify, you must close on the sale of the home during this period.

Tax Creditis Refundable

A refundable credit means that if you pay less than $7,500 in federal income taxes, then the government will write you a check for the difference.

For example, if you owe $5,000 in federal income taxes, you would pay nothing to the IRS and receive a $2,500 payment from the government.

If you are due to receive a $1,000 tax refund from the government, your refund would grow to $8,500 ($1,000 plus $7,500 from the homebuyer tax credit).

If you purchased the home in 2008, the tax credit is taken on your 2008 tax return. If you buy in 2009, you have the option of taking the credit on your 2008 or 2009 returns.

Payback Provisions

The tax credit is an interest-free loan that must be repaid over 15 years.

The minimum repayment amount must be 15 equal annual installments. For example, if the credit amount is $7,500, then the homebuyer must repay a minimum of $500 each year for 15 years.

A homebuyer must begin repaying the credit two tax years after claiming the credit. For example, if the credit is claimed on the 2008 tax return, repayment of $500 (or less, if the credit amount is less than $7,500) per year begins with the 2010 return.

If the homeowner sells the home for a profit and there is a remaining credit, then the homeowner is required to repay the remaining credit during the tax year of the home sale. The amount of the repayment will depend upon the amount of profit from the home sale.

If the profit on the sale is more than the remaining credit, then the homeowner must repay the entire remaining credit.

If the profit on the sale is less than the remaining credit, then the homeowner must repay an amount equal to the profit on the home sale. The remaining credit payback will be forgiven.

If the homeowner sells the home but did not make any profit on the home sale, then the remaining credit payback would be forgiven.

Gwinnett County Neighborhood Stabilization Program

I have tried to research as much information as possible regarding the " Housing and Economic Recovery Act of 2008 " so it can be disseminated to the public at large and to my fellow Realtors as well.

I am interested to see how our government actions in the end will help solve or alleviate the crisis we find ourselves in. Below are articles regarding Gwinnett County GA as one of the many State and Municipalities that will receive funds to help the neighborhoods recover from all the foreclosures we could possible end up having.

Gwinnett County is one of the cities, counties, and states throughout the nation which has been notified that it will be receiving $10,507,827 from the U.S. Department of Housing and Urban Development to help deal with the problems being created in its neighborhoods by home foreclosures.

The funding is being provided to the County through the new HUD Neighborhood Stabilization Program [NSP] which was created with the passage of the Housing and Economic Recovery Act of 2008.

Funding is provided to grant recipient communities through a formula which includes the number and percentages of foreclosures, the number and percentages of subprime mortgage loans, and the risk of foreclosure and abandonment of homes.

Gwinnett County is proposing to use the NSP funding to acquire/rehabilitate and sell foreclosed properties to homebuyers, through private and/or non-profit organizations. The NSP guidelines do not permit the use of NSP funds for foreclosure prevention.

As required by the NSP guidelines, Gwinnett County has prepared its NSP application [Action Plan Amendment] for submission to HUD by December 1, 2008. The application will be considered by the Board of Commissioners on November 18, 2008.

A notice was published on October 31, 2008 on this Website that draft NSP application is available for review by clicking the following link [Gwinnett County NSP Application].

The announcement of the availability of the NSP Application was also published in the Gwinnett Daily Post on October 31, 2008 and can be reviewed by clicking the following link [Gwinnett County NSP Public Notice].

Additional information on the Gwinnett County NSP will be posted as the operational details of the program are developed. The program will be operational sometime in early 2009 when HUD provides a grant award contract to Gwinnett County.

Program for Countrywide Customers

Nearly 400,000 Countrywide Borrowers Could Benefit After Program Launches December 1

CALABASAS, CA - Bank of America today announced the creation of a proactive home retention program that will systematically modify troubled mortgages with up to $8.4 billion in interest rate and principal reductions for nearly 400,000 Countrywide Financial Corporation customers nationwide.

The program was developed together with state Attorneys General and is designed to achieve affordable and sustainable mortgage payments for borrowers who financed their homes with subprime loans or pay option adjustable rate mortgages serviced by Countrywide and originated prior to December 31, 2007. Bank of America acquired Countrywide July 1, 2008.

"We are confident that together with the Attorneys General we have developed a comprehensive program that provides more solutions than ever before to assist troubled borrowers and put them back on the path to sustained home ownership," said Barbara Desoer, president, Bank of America Mortgage, Home Equity and Insurance Services. "Since acquiring Countrywide in July, we have committed significant resources and developed innovative programs to help as many Countrywide customers as possible stay in their homes."

Countrywide mortgage servicing personnel will be equipped to serve eligible borrowers with new program elements by December 1, 2008 and will then begin proactive outreach to eligible customers. Foreclosure sales will not be initiated or advanced for borrowers likely to qualify until Countrywide has made an affirmative decision on the borrower's eligibility.

The centerpiece of the program is a proactive loan modification process to provide relief to eligible borrowers who are seriously delinquent or are likely to become seriously delinquent as a result of loan features, such as rate resets or payment recasts.

Various options will be considered for eligible customers to ensure modifications are affordable and sustainable. First-year payments of principal, interest, taxes and insurance will be targeted to equate to 34 percent of the borrower's income. Modified loans feature limited step-rate interest rate adjustments to ensure annual principal and interest payments increase at levels with minimal risk of payment shock. Modification options include, among others:

FHA refinancing under the HOPE for Homeowners Program;
Interest rate reductions, which may be granted automatically through streamlined processing; and
Principal reductions on Pay Option adjustable rate mortgages that restore lost equity for certain borrowers.

The program applies to eligible mortgage loan customers serviced by Countrywide and who occupy the home as their primary residence. Under the national program, Countrywide will not charge eligible borrowers loan modification fees, and Countrywide will waive prepayment penalties for subprime and pay option ARM loans that it or its affiliates own. Some loan modifications will be subject to compliance with servicing contracts and some will require investor approval.

"Now more than ever homeowners and home buyers are looking to Bank of America as the lender they trust and as a leader that can renew America's confidence in home ownership," said Desoer. "Combined with our strong track record in responsible lending and previously announced lending practices commitments, this bold new program makes it clear that Bank of America is committed to be the leader in responsible mortgage lending practices."

As part of agreements to resolve outstanding claims against Countrywide by certain states, borrowers in participating states will additionally be eligible to access their share of:

A Foreclosure Relief Program of $150 million on a nationwide basis for payment to eligible Countrywide servicing customers who suffered foreclosure or are currently at serious risk of foreclosure having made only minimal payments since the time their mortgages were originated by Countrywide; and
An additional program, projected to make payments up to $70 million to support customers with loans serviced by Countrywide who face imminent foreclosure, providing financial assistance with their transition from home ownership.

As part of the state agreements, Countrywide is further committing to eligible borrowers in participating states that it will waive late fees associated with a borrower's default in finalizing modifications under the program.

In addition, states that have not yet become participants in Bank of America's program will be provided an opportunity to do so, which would enable their residents to become eligible for these benefits.

"Our program represents principal and interest reductions over time to borrowers on loans Countrywide owns and on loans Countrywide services on behalf of investors," said Joe Price, Bank of America Chief Financial Officer. "By taking projected foreclosure losses and instead directing those funds into these proactive foreclosure prevention efforts, we create a solution in the best interests of both our customers and the investors whose loans and securities we service. Of the eligible loans, about 12 percent are now held by Bank of America. The cost of restructuring these loans is within the range of losses we estimated when we acquired Countrywide."

IS IT ARROGANCE OR STUPIDITY ?

I think that is the question we should be asking the board of AIG, is it arrogance or just sheer stupidity that causes you to spend almost $ 500,000.00 in a executive retreat, just minutes after your sorry asses got bail out by the tax payers of this country.

There is no place for politics when asking questions like this one at a time like now, so I do not ask the question as a Republican or Democrat, I ask the question as an indignant American whose taxes are likely to go up, because of our economic situation, yet we find ourselves reading about AIG raping the tax payers of this country.

This is only my humble opinion.
