This morning the national reaction to Hawaii’s Act 48 was a featured item on Hawaii Public Radio.  They said that Act 48 implements some of the strongest consumer protection for homeowners facing foreclosure in the nation.  However, many lenders are reacting by moving from non-judicial to judicial foreclosures in Hawaii.  Fannie Mae has directed their attorneys to move all foreclosures to judicial foreclosures as well.
 
The result will be an even longer back log in the courts.  According to the HPR report, judicial foreclosures are currently taking 12 – 14 months, although I’ve heard from at least one large law … (0 comments)

We have always presented short sales as the honorable alternative to foreclosure.  A new act signed into law in early May should help to make short sales easier for banks and homeowners (and condo owners). 
 
Under the old law, most foreclosures in Maui were non-judicial foreclosures.  Banks and other lien holders tended to prefer the non-judicial route to foreclosure because it was comparatively fast, comparatively cheap and didn’t involve the courts.  It seems that some homeowners didn’t fight them because they couldn’t make their payments and, if the property was foreclosed, there was very little chance of the lender pursuing … (3 comments)

In today's MLS there were just over 100 listings that noted as either new listings or listings with price reductions.   31 of those were either shorts sales or REO's.  
The properties ranged from lower priced investment condos in Maui's central district to oceanfront condos to million dollar homes on Maui's west side.
