&lt;p&gt;You the JV Participant should have liquid cash on hand.&amp;nbsp; We are not looking for folks who think they will have the cash on hand.&amp;nbsp; You shoul also be an experienced JV Participant.&amp;nbsp; As the JV Particpant you will be responsible for the legal agreement between yourself and my borrowers.&amp;nbsp; I will have a Broker Contract between my Corporation and my Borrower. Taking into account the fact that I will bring you projects ,As the JV Particpant you will agree to structure the deal so that I am at all times the Broker of Record.&amp;nbsp; Basically you will not in any way circumvent or damage my relation with my borrowers, and will simply certify that you are not a commercial mortgage broker/competitor.&lt;/p&gt;
&lt;p&gt;The vast majority of these projects are commercial construction.&lt;/p&gt;
&lt;p&gt;The borrowers are screened and will have an executive summary ready.&lt;/p&gt;
&lt;p&gt;Not all lenders will require a business plan.&lt;/p&gt;
&lt;p&gt;Some borrowers already own the land but need a JV Partner to pay for our Broker Fee, appraisal, engineering report and the basic office overhead that will allow them to professionally command the respect of all particpants.&lt;/p&gt;
&lt;p&gt;JV Participants should have $100,000 to $500,000 cash available and MUST be comfortable with construction projects.&lt;/p&gt;
&lt;p&gt;All these projects are REAL ESTATE based.&amp;nbsp; No funny inventions, MLM stuff or unsecured business projects.&lt;/p&gt;

&lt;p&gt;You are a builder or a developer who has a builder on your team.&amp;nbsp; You call up a bank or commercial mortgage broker.&amp;nbsp; You are concerned about exorbitant fees.&amp;nbsp; You've heard that business owners are being asked to pay fees and then wind up with nothing.&amp;nbsp; What's more is the money in escrow you've handed over for the purchase of the land that you want to build homes on is at stake.&lt;/p&gt;
&lt;p&gt;One thing is certain.&amp;nbsp; Builders can protect themselves by getting the terms and fees in writing.&amp;nbsp; Furthermore, if the bank or broker can not get anything in writing or you are dealing with only one lender then it may be time to deal with a commercial mortgage broker who works with more than one lender...but more specifically works with &lt;em&gt;&lt;span style=&quot;text-decoration: underline;&quot;&gt;more than one commercial construction lender. &lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;That being said, why do some banks charge $25,000 &quot;application&quot; fees?&amp;nbsp; Cost of Money.&amp;nbsp; Most builders and borrowers in general are concerned about rate and terms.&amp;nbsp; That makes sense because that is part of the cost of their construction project.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;An experienced builder understands that the bank has cost as well.&amp;nbsp; IF the bank is using their own money then its opportunity cost..and if its borrowed money (ie from investors, secondary market) then its a ticking deadline for the bank to produce a profit for the investor.&amp;nbsp; The borrower who thinks that the banks are rolling in the money and don't have to charge what they charge will in some way, usually not directly, allow this &quot;you bankers are taking me for a ride&quot; mindset to be exhibited to the broker or the bank loan officer.&amp;nbsp; An experienced builder/borrower knows that everything you say to the bank can determine your loan outcome.&amp;nbsp; As the process moves on the Bank will determine if you are a cooperative borrower or a combative borrower.&amp;nbsp; Bank representatives will conclude if the borrower/builder is trying to dictate the terms without regard to the cost of money and the bank's obligations to their investors.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;Investors are number crunchers.&amp;nbsp; So lets give a simple breakdown.&amp;nbsp; Recently American Cash&amp;nbsp;Solutions Inc obtained an $11.5 million dollar Letter of Interest for a Builder who will construct over 100 singe family residences and over 10 commercial buildings over a two year period or less.&amp;nbsp; From the time a letter of interest is issued to the time an appraisal is done can exceed 30 days(experienced builders know not all $11 million dollar loans will close in two weeks).&amp;nbsp; If a commercial construction lender is going to take on a high risk project then the rate will be over 10%.&amp;nbsp; 10% of $11.5 million is for one year $150,000 which breaks down to about $12,500 a month.&amp;nbsp; so let's say the appraisal comes back with different numbers..maybe the builder padded construction cost...maybe the builder lied about the value of the project...maybe the seller mislead the buyer.&amp;nbsp; A real estate agent once made a very smart comment..you must first sell the price of the property to the buyer and then you must sell it to the lender through and appraisal.&amp;nbsp; Well now&amp;nbsp;loan to cost and ltv are changed by the appraisal's outcome.&amp;nbsp; Both the lender and the Builder must go back to the drawing board.&amp;nbsp; This may take more time.&amp;nbsp; Maybe title issues come up.&amp;nbsp; Then the real nightmare begins.&amp;nbsp; The builder makes a bold and reckless misrepresentation to the broker or bank that the land was not farm land and the lender specifically said they will not touch(bank slang for lend on) farm land.&amp;nbsp; Well know the bank has wasted two months with no loan.&amp;nbsp; Remember that cost of money to the bank?&amp;nbsp; Well $12,500X2 months equals $25,000.00&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;The bank declines the loan and now must rely on its own loan officers or broker connections to get another loan.&amp;nbsp; So if the next loan application is declined due to other reasons then the opportunity cost factor becomes more significant.&amp;nbsp; Imagine if a bank has $200 million of investors' money and has signed legal contracts that obligate the bank to pay&amp;nbsp;a profit to the investors either on a quarterly, semi annual or annual basis.&amp;nbsp; Each day, each month cost the bank money.&amp;nbsp; Obviously if this bank fail to write any loans they would lose investor confidence and if the investors pull out the bank is doomed!&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;Another factor that borrowers/builders don't think about are the loans that were actually made but become nonperforming...the builder fails to pay or produce construction results.&amp;nbsp; Now the bank is stuck with a construction project that they don't want to complete.&amp;nbsp; The bank will be stuck with the cost of selling the property, covering its obligations to its investors and if the property fails to cover the loan amount then the bank has to still pay back its investors or if its their own money then the bank lost out on an opportunity to lend the money to a builder that would have met its obligations under the terms of the loan.&lt;/p&gt;

    <title>Are Hard money Lenders really hard on borrowers or are they less Difficult to deal with?</title>

&lt;p&gt;And they are also declining them!&amp;nbsp; So what's the point?&amp;nbsp; Getting a loan approval depends on meeting the lenders revised guidelines.&amp;nbsp; Private Money Lenders ARE Hard Money Lenders.&amp;nbsp; Today they even try to call&amp;nbsp;themselves &quot;situational&quot; lenders.&amp;nbsp; It seems back in the day, the high interest rates normally associated with &quot;private&quot; money lenders led to the private money community being defined as hard..so why didn't we call good credit lower interest rate lenders &quot;soft money lenders?&amp;nbsp; Perhaps this is a classic example of a business sector's failure to define itself before others did.&amp;nbsp; Hard money can actually do what other banks REFUSE to do..to issue loan approvals that help a building owner out of a problem.&lt;/p&gt;
&lt;p&gt;One example I recent ly encountered is a building owner who has a five year balloon with a national lender that comes due in one year.&amp;nbsp; We all know one year is like a week in terms of dealing with a looming and potentially dangerous&amp;nbsp;balloon&amp;nbsp;commercial mortgage.&amp;nbsp; But what's a building owner to do when the debt to income analysis shows that while the bills are being paid there are too many bills relative to revenue in the eyes of a conventional lender?&amp;nbsp; The building owner is declined by bank after bank and then only upon speaking to a broker, learns from the broker that&amp;nbsp;those&amp;nbsp;conventional lenders won't lend to people with high debt even if the credit scores are&amp;nbsp;between 620 and 650! So now the building&amp;nbsp;owner is getting nervous because the banking crisis is all over the newspaper, internet and people's retirement savings!&amp;nbsp; building owner is worried that banks are tightening up and making credit more difficult to get...and they are!&amp;nbsp; Building owner realizes that this is not just temporary but in many cases a return to pre 9/11 lending standards where underwriters actually&amp;nbsp;get to underwrite a loan file without being harassed by their boss for doing there job!&lt;/p&gt;
&lt;p&gt;Broker says to building owner, I'll go to a conventional lender and see what they say.&amp;nbsp; Broker does and loan is declined.&amp;nbsp; Broker did the right thing for building owner because many property owners are declined because 1)bank they went to on their own is the wrong type of bank for their property type or isn't lending anymore in&amp;nbsp;that part of the state or the whole state! 2)building owner or broker did a terrible job presenting loan to bank and didn't correctly argue the case before the bank and the&amp;nbsp;Broker can then rule out thse possible reasons for a loan declination.&lt;/p&gt;
&lt;p&gt;A reputable Broker will use a &quot;hard&quot;/situational/private money lender as a last resort. Now&amp;nbsp;that Broker sees that building owner is not &quot;bankable&quot; with Main Stream lenders Broker will go to a hard money lender.&amp;nbsp;&amp;nbsp;Most will require an appraisal, some won't but may not lend in the state you&amp;nbsp;own your property in.&amp;nbsp; Broker should put in presentation&amp;nbsp;to hard money lender&amp;nbsp;one very important thing....that the proposed future loan should&amp;nbsp;have some&amp;nbsp;meaningful benefit to the borrower.&amp;nbsp;&amp;nbsp;In this case, the building owner is approved for a hard money loan at 11.9%, no prepayment penalty, NO Lockout clause, five year balloon and the monthly payment is being lowered by over a thousand dollars.&amp;nbsp; Building owner's cross collaterization is removed (which will allow him/her to use those assets for other financing request&amp;nbsp;or possible sale&amp;nbsp;to raise even more cash) and a family member who&amp;nbsp;cosigned&amp;nbsp;will come off the loan(and Broker explains to borrower that&amp;nbsp;family member should never have cosigned since they are not on the property and has no day to day role in the business-of course that bank will tell you otherwise).&amp;nbsp; Building Owner is required to pay out of pocket for appraisal and toxic report.&amp;nbsp; This may take another two weeks to 30 days.&lt;/p&gt;
&lt;p&gt;In the building owner's case above there are enough benefits to go with the loan...oh and did I mention it gives him/her more time to escape the balloon?&amp;nbsp; Building owner tried to get a loan with SBA, spent much time at the SBDC(small business development&amp;nbsp;center) working on a business plan that didn't even result in financing.&amp;nbsp; Building owner gets closure knowing that there are other financing options out there.&amp;nbsp; Building Owner's plan is to pay down the credit cards that were used to renovate/rehab the building and if possible move to a conventional loan with a permanent fixed rate in about a year or two.&amp;nbsp; Building Owner also&amp;nbsp;is consolidating three&amp;nbsp;liens on the property into one thereby reducing default and acceleration into foreclosure by any one lien holder (yes many people fail to realize that this dangerous clause may exist&amp;nbsp;in a second or third mortgage&amp;nbsp;note with regard to the additional second and third mortgage lien that you know is&amp;nbsp;placed on your property!).&lt;/p&gt;
&lt;p&gt;Hope this helps you understand&amp;nbsp;how a hard money loan can be a bridge to&amp;nbsp;becoming &quot;bankable&quot; and&amp;nbsp;adress other problems&amp;nbsp;besides the loan that plague building owners.&lt;/p&gt;

&lt;p&gt;It is inaccurate when media says there is no money...most hard money comes from private money, not Wall Street.&lt;/p&gt;
&lt;p&gt;One of my lenders received a $50,000,000 credit line from a publicly traded bankt hat has beena round since the 1800s.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;I have a lender that is working on my customer's request for $15 million to build homes, mixed use and commercial.&amp;nbsp; This lendr is calling me to schedule the conference call.&amp;nbsp; Media says businesses aren't receiving calls back...that is true but for commercial real estate..that is not the case.&lt;/p&gt;
&lt;p&gt;Wall Street did not go crazy with regards to commercial.&amp;nbsp; Sure some did..but most didn't.&amp;nbsp;&amp;nbsp; Most want 20% or more for downpayment with the exception of construction after value.&amp;nbsp; Commercial properties have less risk when more than one tenant exist.&amp;nbsp; On the residential side for a single family unit all the risk is in the wage earner or reliance on a self employed statement of income.&lt;/p&gt;

&lt;p&gt;The implications of not creating a solution to the mortgage problem is so serious and it is shocking that they did not pass SOME solution on a bipartisan level.&lt;/p&gt;
&lt;p&gt;The failure to solve this banking crisis will lead to massive job losses, failure of banks, and quite possibly a severe recession.&lt;/p&gt;
&lt;p&gt;Small business owners must call there elected leaders and DEMAND a solution.&lt;/p&gt;
&lt;p&gt;The global implications will unfold in a violent and destructive manner that the markets have not seen for over two decades.&lt;/p&gt;

&lt;p&gt;So what about those banks that didn't do bad loans?&amp;nbsp; They did right by their customers and what do they get?&lt;/p&gt;
&lt;p&gt;More business?&amp;nbsp; The chance to take business from banks and investment banks that went belly up?&amp;nbsp; That seems like the case but they don't get a check from the government.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;I am just wondering, maybe more acknowledgement should be given to the banks that did not do so many pay option arms.&amp;nbsp; Maybe those banks that we don't hear about as having bad loans deserve our business because they did not cost taxpayers $700 billion and di NOT watch families go into foreclosure.&lt;/p&gt;
&lt;p&gt;I heard some lady is living out of her station wagon and her friend lets her come to her house to shower once a day.&lt;/p&gt;
&lt;p&gt;Ironically when we get double digit interest rates in the next 5 years, particulary after election day is over, having an adjustable at 16% will be good because the rate will adjust downward.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;For now, it makes sense to have a fixed rate or a 5 or 10 year fixed rate depending on your situation.&lt;/p&gt;

&lt;p&gt;First:It is common for sellers to accept good credit buyers with larger downpayments..maybe a 20% downpayment..but the extensive underwriting, the 30 to 60 day appraisal process and close scrutiny of the debt service coverage may lead to a declination.&lt;/p&gt;
&lt;p&gt;If that happens, then the bad credit buyer may have been a better bet.&amp;nbsp; A Buyer using hard money has to put down 30 to 35% down payment.&amp;nbsp; Debt Service Ratio will be calculated and must make sense next to a look at the last two years tax returns of the buyer by the hard money lender.&amp;nbsp; Some hard money lenders will close in 14 business days and will not require an appraisal(as is the case for one of my lenders whose minimum loan amount is $1 million).&amp;nbsp; One of my lenders does require an appraisal and may even require a toxic report.&lt;/p&gt;
&lt;p&gt;In terms of getting the deal done quickly, if a buyer wants to us hard money and wants the property REALLY bad and the seller NEEDS to sell &quot;like yesterday&quot;, a bad credit buyer using hard money may be the better bet.&amp;nbsp; This is especially true if their have been very few &quot;bites&quot; by the buyers and your seller is getting nervous.&amp;nbsp; If the property is not in the middle of a heavily populated town/city and is located in a small town where word of mouth has not been doing a good job, that one buyer may be your best bet...and in retrospect, may turn out to be your only buyer!&lt;/p&gt;
&lt;p&gt;Hard money lenders may have high interest rates but some of our lenders have no prepayment penalties allowing the loan to to be a bridge to a better loan a year or so&amp;nbsp;after the loan closes.&amp;nbsp; Most commercial property owners refinance after their initial purchase loan so the buyer wins in this case because they get the property, commercial credit history and are not surprised that a refinance will be in order in the next few years (as opposed to refinancing and being put into a loan whose terms will force a refinance.&lt;/p&gt;

&lt;p&gt;The FDIC premiums charged to banks are going to go up significantally and will be passed on to consumers.&lt;/p&gt;
&lt;p&gt;Massive Job layoffs in different sectors will be a question of when, and it is not just a fear factor.&amp;nbsp; The losses caused by massive amounts of bad mortgage paper are NOT eliminated by mergers, and receiverships by the federal government.&lt;/p&gt;
&lt;p&gt;I don't even know how much money the sharholders of AIG have lost, as well as Freddie Mac, Fannie Mae, Lehman Brothers, Bear Stearns and prior companies like New Century etc.&amp;nbsp; But I do know its in the BILLIONS and we are talking about small business and consumers retirement money!&lt;/p&gt;
&lt;p&gt;I wonder how bad the retail industry will be hit this winter holiday season.&lt;/p&gt;
&lt;p&gt;I just had a lender tell me they are going to issue a loan approval on a motel loan tomorrow.&amp;nbsp; so that IS good news.&amp;nbsp; I have heard that Lehman Brothers was to loose --on the residential AND the commercial side.&amp;nbsp; In one of my blogs I had warned that those lenders that became to creative, don't require a downpayment of 20% or more on the commercial side and have rates terms that disregard the payment shock experienced by small business owners will pay a price.&amp;nbsp; It seems that the bad paper Lehman had was enough to discourage some potential buyers...I could be wrong but it seems that was the case.&lt;/p&gt;
&lt;p&gt;If I ever become a commercial lender I will NOT permit my bank to become a &quot;lender gone wild&quot;.&lt;/p&gt;
&lt;p&gt;Small businesses must prepare for tighter lending rules, less credit where credit scores are under 680, and larger amounts of equity required in properties for refinances AND purchases.....and of course higher interest rates comparable to that of the 1980s.&lt;/p&gt;    </content>

&lt;p&gt;Its something that I am expecting on the commercial lending side after the elections are over.&amp;nbsp; I don't know exactly when but I am putting my customers into loans that have rates fixed for the next ten years.&lt;/p&gt;
&lt;p&gt;The ramifications of the recent Ch 11 (reorganization) of Lehman Brothers is shocking.&amp;nbsp; I had received a call from the commercial division some time ago that they were no longer doing commercial loans and that all 600 were out.&lt;/p&gt;
&lt;p&gt;If AIG fails or has to file for BK the lending market will be changed for years to come.&amp;nbsp; If Wachovia goes into receivership by the end of this week it does not eliminate the vast amount of conforming pay option arms that they hold.&lt;/p&gt;
&lt;p&gt;I don't short stocks just so you know.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The gloabl ramifications of this problem, has yet to be factored into the commercial lending market.&lt;/p&gt;
&lt;p&gt;Freddie Mac and Fannie Mae had a big involvement in commercial loan products.&amp;nbsp; It is part of th reason why the government involvement was crucial to saving the US Economy from plunging into a black hole.&lt;/p&gt;
&lt;p&gt;I have received only five hours of sleep last night&amp;nbsp; since being glued&amp;nbsp;to CNBC Sunday Night, and at least tonight I will sleep better knowing the Feds are meeting late into the night as more emergency action will be announced early this week.&lt;/p&gt;
&lt;p&gt;I think property values on the commercial and residential lending side will surely go down alot more.&amp;nbsp; I had predicted this in 2004 but not to the extent of what we will see in 2009&lt;/p&gt;
&lt;p&gt;Lending to consumers for luxury items will tighten even more or in some areas be &lt;strong&gt;eliminated&lt;/strong&gt; completely.&lt;/p&gt;
&lt;p&gt;A friend of mine has a friend that worked at Lehman Brothers for many years and this full grown man was on the phone crying.&amp;nbsp; He is know facing foreclosure and a complete reduction in lifestyle.&amp;nbsp; He didn't create this mortgage mess.&amp;nbsp; You can not blame him.&amp;nbsp; He was not greedy.&amp;nbsp; He has kids like everyone else.&lt;/p&gt;
&lt;p&gt;Greenspan was right when in 2004 he warned Congress tha this would be worse than the Savings and Loans Crisis.&amp;nbsp; Even five years after the S&amp;amp;L crisis began the losses were still being unraveled and the maze still being unraveled.&amp;nbsp; Do not blame Greenspan.&amp;nbsp; He didn't sign the applications that thousands of consumers signed.&lt;/p&gt;
&lt;p&gt;Save your money. Expect more problems.&amp;nbsp; Prepare for the worse case scenario. Expect the lending criteria to become more strict over the next five years.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The bright side?&amp;nbsp; Cheaper properties, office space will become cheaper for small businesses, unprecedented ability ot take over failing businesses may exist.&amp;nbsp; Those that are willing to show leadership and reign in excessive spending will be rewarded-on the consumer and residential side.&lt;/p&gt;    </content>

&lt;p&gt;First, we must never forget the fact that unarmed civilians were brutally murdered.&amp;nbsp; Second,They were unarmed.&amp;nbsp; After 9/11 the taliban and terrorist challenged America claiming that we are cowards because we attack them from the air.&amp;nbsp; That is exactly what they did....and the difference is that the people in the Towers were unarmed.&lt;/p&gt;
&lt;p&gt;I worked at Chase Bank on Long Island.&amp;nbsp; One month prior I had turned down a job offer from another financial company whose office was located at 7 World Trade Center.&amp;nbsp; Of course calling his office phone number was in vain as the only thing that came up was some type of busy signal.&amp;nbsp; 3 days later I received a call that he was fine.&amp;nbsp; Driving on the way to work for some reason I had the AM radio on.&amp;nbsp; I usually have the radio OFF on the way to work.&amp;nbsp; Today was different.&amp;nbsp; A news flash came across the radio that a &quot;small&quot; plane had hit the Tower.&amp;nbsp; I thought , well that's bad, maybe only a few people were killed.&amp;nbsp; I drove a little faster to get to work to see if my boss had the Internet on.&amp;nbsp; I was preparing to open the bank and my Boss called me in.&amp;nbsp; Showed me the computer screen and he said another plane had crashed into the other Tower.&amp;nbsp; I said to him..&quot;That's not an accident..that's some sort of terrorist attack.&quot;&amp;nbsp; He looked back at the screen and said &quot;You know you could be right&quot;&amp;nbsp; When my coworker came in she had not heard of the attack, but it would be impressed in her memory for years to come as the news flash cam across that the Pentagon was attacked.&amp;nbsp; That teller suddenly started crying uncontrollably.&amp;nbsp; She handled a few customers but start crying again.&amp;nbsp; Finally I stepped away from the window and asked my Boss why she was crying...he did not know this and called her away from the Teller window.&amp;nbsp; It turned out her Sister works at the Pentagon where 184 people were killed.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;A plane had crashed in Pennsylvania.&amp;nbsp; It was headed for the White House.&amp;nbsp; Customers cam into the bank crying, pulling out all their money.&amp;nbsp; Another Financial Rep who was usually more strict than all the Nuns from my elementary school combined(today I thank them for that) took the radio from the break room and put it on the counter behind us that were on window duty(we were all Financial Reps but required to have shifts on the Wondow).&amp;nbsp; It was at THAT point the gravity of the situation hit me. Even the strict Rep was standing by the radio listening to every word.&lt;/p&gt;
&lt;p&gt;Our Boss came out of his office, clearly disturbed, spoke in a hushed tone and said that an emergency protocol was being set.&amp;nbsp; i don't remember if their were restrictions on transactions but I do remember the Teller whose sister was in the Pentagon was allowed to work at the Entrance Desk where she frantically kept calling relatives to see if anyone had heard from her Sister.&amp;nbsp; She kept crying and I told her that she must pray and that i would.&amp;nbsp; She smiled and said she wants so badly to hear her sisters voice.&amp;nbsp; I then upon hearng that went to my Boss and said he has to let her go home so she could be with her family.&amp;nbsp; He agreed and let her go home.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;I wondered that day if there was anyone I knew in the Towers and had a feeling that my friend's father was still working there.&amp;nbsp; It turned out that he had changed companies once the Japanese Economy had soured and as a result of that was no longer working in the Twin Towers.&amp;nbsp; He was around the 80th floor and we all know many did not make it from that high up.&lt;/p&gt;
&lt;p&gt;Some of those that did not make it that worked in the higher part of the building had walked the same hallways as me in high school.&amp;nbsp; Sometime shortly after 9/11 Newsday came out with a front page picture that was a tribute tot eh 20+ alumni from my high school that had died in the Twin Towers.&amp;nbsp; As I looked at the 20+ passport sized photos some of the &quot;kids&quot; photos stuck out.&amp;nbsp; There was Jake..he used to sit&amp;nbsp;a few tables over during lunch break in the cafeteria.&amp;nbsp; I remember that other guy...I used to pass him in the hallways on the way to class.&amp;nbsp; There was Mike...he was on my track team, used to live in Lynbrook like me and worked at Cantor Fitzgerald.&amp;nbsp; He never had a chance.&amp;nbsp; We all know how hard Cantor was hit.&amp;nbsp; Two kids still in my high school at that time would go home early that day because their Fathers worked at Cantor Fitzgerald and were killed.&amp;nbsp; My high school has t.v. in each room.&amp;nbsp; I can not even imagine what those kids went through.&amp;nbsp; They had just been in school for only an hour and surely must have heard that the Towers were being attacked.&amp;nbsp; The pain they experienced that day is unspeakable.&lt;/p&gt;
&lt;p&gt;My cousin married a very nice man.&amp;nbsp; He is a business man.&amp;nbsp; He would find out later that day that his cousin, a Firefighter had gone to &quot;Ground Zero&quot;.&amp;nbsp; He would never see him again.&amp;nbsp; I never once asked him about it...and He never talks about it.&amp;nbsp; Another family member tells me they were like brothers and for a long time he didn't go into the city.&lt;/p&gt;
&lt;p&gt;When President Bush made his State of the Union Address after 9/11 he held up a Port Authority Badge.&amp;nbsp; Mr Howard used to own that badge.&amp;nbsp; His mother gave that to President Bush and I am sure today President Bush has that badge as a reminder.&amp;nbsp; Mr Howard was one of those Alumni whose photos appeared on the front page of Newsday's list of 20+ alumni from my high school that died that day in the Twin Towers.&lt;/p&gt;
&lt;p&gt;Today, we must make the most of our lives and pause to remember that many others had their lives cut short.&amp;nbsp; We must remember that family members of the Victims whose lives were also turned upside down because they were Victims of the attack.&amp;nbsp; Their pain and suffering did not end on 9/11.&amp;nbsp; And that is all I can say.&lt;/p&gt;    </content>

&lt;p&gt;I called around to some and its neat..one lady said she owns some franchise hotels and from that also created her own independent hotels.&amp;nbsp; There are so many throughout the country and they are a vital part of the Tourist industry.&amp;nbsp; I am targeting New York but hotel and motel owners across the country are welcome to call me and explain their situation!&lt;/p&gt;

&lt;p&gt;I had been involved with fundraising about $4000 a few years a go with the Huntington's Disease Society of America but have a different strategy that will be focused on motiviating the medical community to finda cure for one of these diseases.&amp;nbsp; The message of this 5013c that I want to form is that the real solution to our HealthCare problems is to find Cures for diseases.&amp;nbsp; I want to raise $1 million dollars! Medicines and prescriptions are vital to our comfort but they are money takers &lt;strong&gt;and cures are money makers!&amp;nbsp; Cures reduces prescription cost, hospital stays, doctor bills and suffering.&amp;nbsp; When was the last time we have had a cure for a disease?&amp;nbsp; Was it Polio?&amp;nbsp;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;We have become a more tehnologically advanced society and have created many useful medicines.&amp;nbsp; Finding a cure for one of these diseases is the next challenge to America..We are still the ONLY country that has reached the Moon and Sen Kennedy is right...our flag still stands on the Moon...but now is the time to change our medical healthcare system that the Politicians can not and never will be able to solve in terms of reducing cost.&amp;nbsp; It is the medical community that will solve the system, they willprovide the Solutions and their is nothing more American than that!&lt;/p&gt;

&lt;p&gt;Are you always on your computer?&amp;nbsp; Are you trying to find a way to measure significant events(both good and bad) of your Company?&amp;nbsp; As far as I know email is here to stay and most of us are on it everyday.&lt;/p&gt;
&lt;p&gt;So here is what you do.....open up the folder section and click on add folder.&amp;nbsp; Label the new folder PROGRESS.&lt;/p&gt;
&lt;p&gt;Whenever something happens email yourself and describe what event happened.&amp;nbsp; Maybe you customized a form that you will use to order&amp;nbsp; a product.&amp;nbsp; Maybe you penetrated a niche market and now have the opportunity to make big bucks.&amp;nbsp; Maybe your Accountant was overcharging you for bookkeeping services and only after ten years have you decided to get a second opinion!&amp;nbsp; Maybe your lawyer is telling you that after a year's nonpayment you need to pay!&amp;nbsp; Maybe a new product threatens your business.&amp;nbsp; Maybe you KNOW on-line sales from competitors are killing your profits but for many reasons YOU are not changing with the times.&lt;/p&gt;
&lt;p&gt;These are only some types of &quot;historical&quot; events that you should be measuring.&amp;nbsp; And remember real estate agents, even if you are not the owner of your company you do run your own unofficial sales business.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;I like the use of email because everything is time stamped and it saves paper.&amp;nbsp; Maybe there are soft wares out there that does this but your email should be free.&lt;/p&gt;
&lt;p&gt;Consult with your accountant about possible contribution of your time put into starting the business relative to payroll.&lt;/p&gt;
&lt;p&gt;Most certainly, keeping a log of the progress of your business above and beyond the numbers certainly helps you and your decision makers look back and look forward with a&amp;nbsp;reference to what is really happening with your company. If you are able to show positive progress through this folder/log it may be used when seeking out Angel or Venture Capitalist or Family as Money Sources.&lt;/p&gt;

&lt;p&gt;For the next 6 months my company will be placing a main emphasis on Independently owned Hotels/Motels.&amp;nbsp; In the commercial lingo they call it hospitality.&lt;/p&gt;
&lt;p&gt;The two scenarios to emphasized will be Rehab/Renovation for Mom and Pop Hotels/Motels and Refinance-Cash Out.&lt;/p&gt;
&lt;p&gt;One example of why a hotel /motel may want to refinance will be the existing loan terms.&amp;nbsp; Perhaps the rate is to high but was high because the lender took a higher risk in allowing the Hotel/Motel Owner to purchase the Hotel.&lt;/p&gt;

&lt;p&gt;Well, here is an interesting time we are in...some banks that gave out home loans are failing and at the same time trying to collect trhough collection agencies and law firms from consumers.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;I wonder, do banks hire employees that have filed for bankruptcy?&lt;/p&gt;
&lt;p&gt;What if a bank files for bankruptcy or is taken over by the Feds? Is it fair for those banks to deny employment to someone who has filed for BK when that business itslef could one day file for bankruptcy?&lt;/p&gt;
&lt;p&gt;Is this a double standard?&lt;/p&gt;
&lt;p&gt;Is denying someone an employment position unconstitutional since there is an assumption of guilt and in other cases discrimination of economic status?&amp;nbsp; Will all people who filed for bankruptcy that work at a bank as a teller or as a financial representative do bad things...event hough the bank may not know what those bad things are?&lt;/p&gt;

    <title>Indymac akeover by Federal Government? FNMA? Freddie MAc?</title>

&lt;p&gt;But there are other construction lenders out there on the residential side.....many builders had a great relation with Indymac and loan officers were encouraged to refer the builders to them...&lt;/p&gt;
&lt;p&gt;Indymac gave lines of credit to smaller mortgage banks to lend and this takeover by the Feds will lead to a very stressful next week for those banks as they scramble to find new funding sources.&lt;/p&gt;
&lt;p&gt;The recent announcement of problems by Fannie Mae and Freddie MAc are far more serious.&amp;nbsp; It is imperative that the spiral effect of a paralyzed FNMA and Freddie MAc be addressed before the end of next week.&amp;nbsp; While talk of a bailout is important, the government will be more concerned this weekend and next week with making sure the mortgage side of the housing market doesn't collapse.&lt;/p&gt;
&lt;p&gt;Imagine real estate agents, attorneys, title agents, and consumers unable to close the loan.&amp;nbsp; While this seems unlikely to happen the Government MUST reassure the public by Wednesday what action will be taken and how that action will keep the residential mortgage industry from failing.&lt;/p&gt;
&lt;p&gt;The continued loss from the residential side of banks has an indirect impact on commercial lending because banks, hi net worth individuals, mutual funds, pension funds and other investors in residential lending may be less willing to invest in commerical lending.&amp;nbsp; This is not investment advice....it is a warning to commercial businesses to get the credit you need now..don't wait for when you need it ..by then your credit report may have lates because some unexpected even happened that caused you to be late...NoBODY PLANS TO PAY THEIR BILLS LATE!!! We all plan to pay them on time.....and banks that lend to businesses, real estate, and residential lending concerns will definitely continue to become more strict by requiring higher credit scores, not lending to certain industries deemed high risk or vulnerable to the recession and making the terms of lending more conservative.&lt;/p&gt;
&lt;p&gt;My sole opinion is that we are in a recession,&amp;nbsp; The housing market is in a severe recession and I hope the government can prevent an all sector wide severe recession.&amp;nbsp; I can't even talk about a depression but my Uncle says that about 1 in 4 people were not working and that cousins, aunts and uncles had to move in with each other because things were so bad.&amp;nbsp; So if we are in fact headed for a depression then we will ALL know it.&lt;/p&gt;

&lt;p&gt;Recent coverage of my comments by Matt at Inman News was fair and objective.&amp;nbsp; He ask a&amp;nbsp; good question that I think we all know the answer to regarding if more real estate agents are sitting in parking lots.....my opinion is yes and no law will ever be able to stop the parking lot kickbacks&lt;/p&gt;
&lt;p&gt;However, one commenter in response to Matt's article says that I am suggesting that RESPA be thrown out the window...that is not my opinion..that is her opinion....just because the truth is that RESPA is being violated over and over doesn't mean I said it should be thrown out the window...so now that&amp;nbsp;I have clarified that I hope Matt ask another question....how come the politicians can accept lobby money but real estate agents can't accept a nice referral fee for finding business for a mortgage company or a home inspection company?&amp;nbsp; If its disclosed to the customer how come its still bad?&amp;nbsp;&amp;nbsp;In many non licensed businesses you can get a referral fee for sending a businss business....obviously its an ethics question.&amp;nbsp; Perhaps a small dsiclosure at the bottom of the real estate ad disclosing that the ad has been partially paid for by the mortgage company is a better reform of RESPA.&amp;nbsp; Is the customer hurt more by forcing agents and banks to do it all under the table?&amp;nbsp;I've never believed secret referrals made illegal&amp;nbsp;protect the customer.&amp;nbsp;Catching the violator is no success..by then RESPA has already been violated and the customer hurt in some cases.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;What would happen if we allowed mortgage bankers, mortgage brokers, inspectors, and real estate agents to legally reward each other for sending each other business and save on advertising, cold callling, time sapping networking etc....perhaps the cost of business would be reduced?&lt;/p&gt;
&lt;p&gt;Is it that the custmers will get hurt?&amp;nbsp; With the recent mortgage crisis RESPA didn't prevent customers from getting hurt...and will more legislation, tainted by lobby interest only be a post crisis reaction in an election year that in the long run will be another useless round of laws that will be outsmarted by the lending and real estate community?&amp;nbsp; Something tells me ten to fifteen years from now we'll be adding a new round of useles rules that fail to acknowledge the majority have&amp;nbsp; good business ethics?&lt;/p&gt;
&lt;p&gt;Its obvious that violations of RESPA are wrong but its also obvious that the violations are already priced into the market and that needs to be included in RESPA &quot;reform&quot; or..... replacing RESPA with simple honest disclosure?&lt;/p&gt;

&lt;p&gt;Back in 1999 when I was at a major stock traded lending bank a lady came in and applied for the job.&amp;nbsp; The manager was so excited at her resume and was basically telling her to start Monday.&amp;nbsp; She was so excited but later in the week word had spread throughout the branch that the Manager was very upset....this lady had been denied employment because she had filed for bankruptcy.&amp;nbsp; We were told that people who filed bankruptcy could not work with mortgages.&amp;nbsp; I kept my mouth shut but deep down inside thought-this lady exercised the right to seek relief under the BK code-a right that ANY American can seek (this isn' t legal advice so seek out a BK attorney ok?).....a right that all citizens can consider yet this lady who was doing the right thing --looking for a job was told NO! The Manager even called HR and some other big wigs and was told NO you can not hire her.....the lady had explained that she had been through a divorce and needed to file the BK.&lt;/p&gt;
&lt;p&gt;Well, wouldn't you know it but several years later the company itslef filed for Bankruptcy!&amp;nbsp; That's when I thought...is this a double standard?&amp;nbsp; How can this coproration tell the working community if you filed for BK don't bother coming to us.....for a job......&lt;strong&gt;when at any time the Company itself could file for Bankruptcy...as have many corporations!&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;How can a financial company assume that someone who files for BK is not worthy or incapable of selling stocks. mortgages, insurance, or working as a teller at a bank?&amp;nbsp; Is there an assumption of guilt in a country that has had an Innocence until Proven guilty culture?&lt;/p&gt;
&lt;p&gt;The quite message that someone who files for BK will steal your money is in my opinion wrong and I believe a federal law should exist preventing corporations from not hiring someone who files for bK.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;On the residential side of lending MANY people who have had BKs discharged have successfully bought homes and paid their mortgage...i fact our own Federal Government has paved the way for them through FHA to buy a home!&lt;/p&gt;
&lt;p&gt;So you can buy a home but not get a job with some companies?&lt;/p&gt;
&lt;p&gt;On the commercial side I can work with people who have filed for BK....&lt;/p&gt;
&lt;p&gt;Perhaps the&amp;nbsp;right to seek relief under BK needs to be extended to Labor Law so that&amp;nbsp;the unspoken fear mongering by&amp;nbsp;those with a vested interest in preventing consumers from filing bankruptcy is squashed AND enforced.&lt;/p&gt;
&lt;p&gt;I have found that the majority of my customers who filed for BK&amp;nbsp;are my best customers...they are down to earth, not arrogant, lack a sense of entitlement to the loan, and are Happier than most of the other&amp;nbsp;customers who are stressed out&amp;nbsp;and have a smile on their face!&lt;/p&gt;

    <title>Major Commercial Lender shut its doors</title>

&lt;p&gt;Well, I won't say which lender but 600 people from the division are supposedly out of jobs and it was before 4th of July.&amp;nbsp; I am working on a&amp;nbsp; 2+ million dollar loan and was going to use them since they have a good program.&amp;nbsp; This company was straight from Wall Street and had double dipped into residential mortgages.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;I have to wonder if this is not the end and am glad that many commercial lenders did not get involved in the residential side of lending.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;There are enough commercial lenders that can survive this mess..but its obvious people are still going to lose their jobs.&amp;nbsp; And once the FHA loans , short sales and loan modifications have all dried up the only thing left will be purchases.&amp;nbsp; The loan officers that really want to make a career out of mortgages will survive because it is what they love.&amp;nbsp; The loan officers that are willing to manage their customers properly will survive.&amp;nbsp; Those that charge to many points and to much on the rate will eventually struggle.&amp;nbsp; Sadly, many consumers who got a good deal&amp;nbsp;didn't go back to the loan officer that gave them a fixed rate and kept the closing cost in check..they made the terrible mistake of going to another bank and wound up getting an adjustable or neg am loan and are now in foreclosure.&lt;/p&gt;
&lt;p&gt;So how come you don't hear about this on the commercial side?&amp;nbsp; And commercial lending is LESS regulated by the government!&amp;nbsp; Is it because of the strong culture that a larger down payment should be required?&amp;nbsp; Is it because of the absence of negative amortization loans in the commercial lending arena?&amp;nbsp; Is it because adjustable rates in commercial lending are quite common and less of a surprise to owners of buildings?&lt;/p&gt;
&lt;p&gt;One thing is clear, &lt;strong&gt;the commercial lending community must never allow the careless, reckless, deceptive and self destructive lending practices of the residential banking community to invade our side of the lending industry.&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;Lastly, blaming the brokers is a waste of time.&amp;nbsp; The banks fund the loans, write the checks and ALWAYS make up the programs that are either solutions or problems.&amp;nbsp; &lt;em&gt;If the banks did not supply the poison then the apple that many people ate would not have been a poisonous one.&lt;/em&gt;&lt;/p&gt;    </content>

&lt;p&gt;OK so I have posted my referral fee table on my website..it is deals that close and fund.&amp;nbsp; My personal opinion is that RESPA is a waste of time in terms of preventing kickbacks.&amp;nbsp; When I first started in 1999 being a loan officer my boss told me that she would meet in a car parking lot to give the cash to the realtor ..she said it was illegal but no one in the company specified RESPA..she said she was nervous everytime she did it..like someone might be watching...so I thought how pathetic that you base your business on if someone is watching instead of basing it on the law...no one is perfect but its what I thought.&amp;nbsp; The Vice President said that when a realtor sends three deals then they will pay for the advertisement in the realtor magazine...now everytime I look at an advertisement with a realtor and a mortgage company it reminds me of what my boss said.&lt;/p&gt;
&lt;p&gt;I think that unenforceable laws are meant to set an example but RESPA doesn't teach the real estate community the desire to do business the right way...in fact if you violate RESPA the crime has already been committed and the customer has already been hurt.&lt;/p&gt;
&lt;p&gt;I think with the recent mortgage crisis increased regulation will do one thing...challenge the rule breakers to figure out how to break the new set of rules!&lt;/p&gt;
&lt;p&gt;Anyway, If I don't blog again before $th of July I wish y'all a Happy Fourth..let's remember the soldiers abroad who are in harms way..Let's remember the founding forefathers and the Women who didn't get mcuh credit for their role in making AMerica more free.&lt;/p&gt;

&lt;p&gt;Commercial construction loans have been around for a long time.&amp;nbsp; I have access to many different programs and one of the areas I most like is construction.&amp;nbsp; As a little boy I used to get so excited when I saw a Tractor or a large truck related to construction.&amp;nbsp; I guess its the creation of something new, even as a little kid my favorite toys were those yellow Tonka trucks.&amp;nbsp; My best friend and I at the age of 8 decided we would dig a hole in the back yard and go as far as we could go.&amp;nbsp; We used the Tonka trucks and sand shovels normally used for the beach.&amp;nbsp; Then over the weekend my Dad at Dinner asked me why there was a big hole in the back yard.&amp;nbsp; He wasn't angry but when I told him that Jeremy and me were going to keep digging he told me we couldn't and that someone might not see the hole and trip and get hurt real bad.&amp;nbsp; Well, that night at my Dinner was a real &quot;Leave it to Beaver &quot;night and I was like &quot;Gee whiz-I never thought of that!&quot;&amp;nbsp; So I called over Jeremy and told him that my Dad said someone could get hurt real bad by tripping on the hole so we filled it in and decided to build a tree house.&amp;nbsp; So when we told my Dad that he ended&amp;nbsp; that one and said that we needed to stick to riding our tricycles!!!&lt;/p&gt;
&lt;p&gt;So anyway, once I get more details on the loan construction programs I'll keep y'all posted.&lt;/p&gt;

    <title>I am looking for Contractors that specialize in commercial construction---small projects and large projects!</title>

&lt;p&gt;I want to have a list of commercial contractors for each state...basically 3 per state and here is what is important:&lt;/p&gt;
&lt;p&gt;If you are a contractor that has five plus years experience in commercial construction on multifamily/apartment and other buildings then youshould email me.&lt;/p&gt;
&lt;p&gt;But here is the catch....if you are VERY expensive and know you are and have a high rejection ratio and settle for a few projects a year please do not contact me.&lt;/p&gt;
&lt;p&gt;I need contractors that price reasonably, and I will know it.&amp;nbsp; How will I know it? I will know it when all my customers start complaining about you and don't use you!&amp;nbsp;&lt;/p&gt;
&lt;p&gt;So once again in any state if you are a commercial contractor/builder please contact me -I will have some criteria if I am going to refer my customers out to you so please know that I will have some questions etc etc.....&lt;/p&gt;
