If a home owner fails to pay the regular mortgage payments, the lender will call for a shot to obtain a court order to terminate the authority over the property. The lender will claim the possession of the property securing the loan in order to sell it. Since foreclosure is at court level, proceedings can be either judicial or non judicial, but depends on many aspects.
The process under judicial foreclosure, the lender must litigate against the owner to get a court order. This order is to foreclose the property but only applicable if there is no such power (2 comments)

The changes will be effective on the 1st day of June 2010. The changes address the income verification of the borrower and set guidance to lending institutions about which documented proof of income should they consider.

I recently had a situation with ING on a short sale where the current appraised value came in on a home at 217,000. The BPO came in at 230,000. I asked the bank to provide me with the comparable used to get the price on the BPO and they refused. The banker also told me that the appraisal is just an opinion. When are they going to start requiring that these negotiators have real estate licenses? Long story short the bank will not honor the appraised value. We are currently escalating to upper management hoping for someone with a little more (8 comments)
