      <title>First time Home Buyer Tax Credit Extended and Existing Buyers too but there are some Catches</title>
      <description>&lt;p&gt;Exciting News!&amp;nbsp; After much debate the tax credit has been extended but there are some catches.&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;Catch 1:&amp;nbsp; Although the Tax credit has been extended through June 30th 2010 you MUST have a signed contract by April 30th 2010.&amp;nbsp; And these transactions will be highly scrutinized by the IRS due to all of the fraud going on with the current tax credit programs of last year and this year.&amp;nbsp; &lt;br /&gt; &lt;/li&gt;
&lt;li&gt;Catch 2: You still must live in the home for at least 3 years or you must pay back the tax credit.&lt;/li&gt;
&lt;li&gt;Catch 3: Documentation requirements are higher.&amp;nbsp; So when you apply to the IRS for the tax credit make sure you keep ALL of your closing docs at hand!&lt;/li&gt;
&lt;li&gt;Catch 4: It is important to note that you cannot purchase a home from, among other family members, your ancestors (parents, grandparents, etc.), your lineal descendants (children, grandchildren, etc.) or your spouse or your spouse&amp;rsquo;s family members.&lt;/li&gt;
&lt;li&gt;Catch 5: Repeat/Existing Buyers $6,500 Tax credit:: Income Limits are the same ans the first time home buyer credit but to qualify as move-up home buyer (&amp;ldquo;long-time resident&amp;rdquo;) as a home owner who has owned and resided in a home for at least &lt;span style=&quot;text-decoration: underline;&quot;&gt;five consecutive years&lt;/span&gt; of the eight years prior to the purchase date. For married taxpayers, the law tests the home ownership history of both the home buyer and the spouse. Repeat home buyers do not have to purchase a home that is more expensive than their previous home to qualify for the tax credit.&lt;/li&gt;
&lt;li&gt;Income limits raised to $225k/year for couples filing jointly and $125k.year for single or couples filing separately.&lt;/li&gt;
&lt;li&gt;Finally, nothing has changed regarding credit.&amp;nbsp; I've had prospective homebuyers contact me needing to work on their credit and this has not changed.&lt;/li&gt;
&lt;/ul&gt;

      <title>First time Home buyer extended another 6 months for active duty Vets</title>
      <description>&lt;p&gt;House passes resolution 416 to 0 to extend First Time Home buyer Credit by another 6 months to veterans that were on active duty for 90 days or more in 2009.&amp;nbsp; This is a telegraph that it will NOT be extended for another 6 months for everyone else.&amp;nbsp; It's not a done deal yet so stay tuned.&amp;nbsp; It's good to see that our service members are appreciated.&lt;/p&gt;
&lt;p&gt;Many people will say that this is only good for VA Loans.&amp;nbsp; NOT True.&amp;nbsp; As with the current Tax credit you may use this on any loan type.&amp;nbsp; That means that USDA, FHA, Conventional, Texas Veteran's land board and VA Loans can get the tax credit!&lt;/p&gt;

      <description>&lt;p&gt;Well probably not so dramatic as that.... however there will be some settling in adjustments as the Real Estate Industry adjusts to the new Reality of HVCC, wheather it's permanent or tempoary is still up for debate.&lt;/p&gt;
&lt;p&gt;Just say the acronym HVCC (insert horrific scream here) today in the Real Estate Community and many who know it's like Count Dracula stepped into the room to suck the life our of your transaction.&amp;nbsp; One thing that should be pointed out is that some appraisals have been done very similuar to this for years.&amp;nbsp; What's that you say?&amp;nbsp; You've never heard of such a thing?&amp;nbsp;&lt;/p&gt;
&lt;p&gt;My response is have you ever had a VA loan in one of your transactions?&amp;nbsp; If yes then you've used HVCC lite.&amp;nbsp; Have you ever done any type of loan in recent years and heard the company called Landsafe?&amp;nbsp; Then you've had a taste of HVCC or the Home Valuation Code of Conduct.&lt;/p&gt;

      <title>How Realtors Get Fired by their Mortgage Professional and Their Clients</title>
      <description>&lt;p&gt;Whoa... what was that headline.... yep.. you read that right.&amp;nbsp; I fired a Referral Partner Realtor and their client recently.&amp;nbsp; I want to say up front that many Realtors are top notch professionals.&amp;nbsp; Once in a while we are all human and what a call the &quot;doofus gene&quot; creeps in.&lt;/p&gt;
&lt;p&gt;I thought I'd go over the three ways that Realtors (and their Clients) get Fired by Mortgage Professionals&lt;/p&gt;
&lt;ol&gt;
&lt;li&gt;On a tight deal demand that the mortgage professional reduce their fees to almost nothing and the Realtor collects both sides of the deal and act like it's the mortgage professional's fault the ratios don't work&lt;/li&gt;
&lt;li&gt;Lie to the mortgage professional to obtain High LTV (96.5 or 100%) financing on a property that the Realtor knows is an investment property for their buyer&lt;/li&gt;
&lt;li&gt;Have the mortgage professional work for an extended time with the borrower and to find a lender or bank that will take the loan and then complain to the mortgage professional is charging $500 or 1/8 of a point too much &quot;in their opinion&quot; and then take the loan to someone who is their &quot;friend&quot; at another lending institution.&lt;/li&gt;
&lt;li&gt;Demand that the mortgage Professional Violate RESPA and release personal information to you.&lt;/li&gt;
&lt;/ol&gt;
&lt;p&gt;I was talking with a Realtor recently who gets it and they said they know that mortgage professionals are the point people in any successful real estate transaction.&amp;nbsp; Needless to say we give each other a lot of support and close deals.&amp;nbsp; I don't try to do their job and question their fees and they don't question me.&amp;nbsp; It is only brought up when the numbers won't work.&amp;nbsp; Deals are fewer and slimmer in this market for everyone.&lt;/p&gt;
&lt;p&gt;For New or inexperienced Realtors the rules are simple&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;Find a bad mortgage professional, run away as fast as possible&lt;br /&gt;&lt;/li&gt;
&lt;li&gt;Find a good one, don't try to do their job.&amp;nbsp; They don't try to do yours&lt;br /&gt;&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;You see in the current market with Realtors and mortgage professionals dropping like flies we all need to work together.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;One of my favorite sayings is something to the effect: If you want to be successful don't worry about who gets credit.&amp;nbsp; If you want to be a failure make sure you get all of the credit.&lt;/p&gt;
&lt;p&gt;Mortgage Professionals I'd very much like to hear your experiences in the current market and how many times you've experienced the &quot;Doofus Gene&quot; in our profession, with realtors (good, bad and ?) and other mortgage professionals (good, bad and?).&lt;/p&gt;</description>

      <title>Owner Finance is not all that it's cracked up to be for the buyer in most cases</title>
      <description>&lt;p&gt;Over the past few months I've been contacted by numerous people wanting to refinance their homes who acquired them through owner financing.&amp;nbsp; While I can say there have have heard a few reports of positive results from this financing strategy the perponderance of the evidence is the exact opposite.&lt;/p&gt;
&lt;p&gt;First lets start with the positive:&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;Owner finance allows for more flexible financing for those who cannot otherwise acquire financing.&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;Ok, I think that pretty much sums up the advantages......&lt;/p&gt;
&lt;p&gt;Here's what I've been hearing borrowers and potential borrowers say&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;Miss a payment by 1 to 7 days and receive a notice of foreclosure and/or eviction within 3 days&lt;/li&gt;
&lt;li&gt;Not being able to sell or refinance the house due to never actually having a clear title&lt;/li&gt;
&lt;li&gt;Never being given the deed to the property and thus never being in an ownership position&lt;/li&gt;
&lt;li&gt;Receiving a foreclosure notice from a bank that you've never heard of only to find out that the &quot;owner&quot; executed what is known as a &quot;subject to&quot; deal by purchasing the property from the original owner leaving the original mortgage in place and then making a few payments and pocketing the money you sent them for &quot;your&quot; mortgage payment and taking your downpayment leaving you to deal with the bank.&lt;/li&gt;
&lt;li&gt;No limit on interest rate and penalties that can be charged in the case of a late payment&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;Part of the problem is that there are virtually no laws protecting buyers from error in the case of owner finance like there are with the highly regulated mortgage broker and banking industry.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;While there are sad stories of someone having a mortgage from a lending institutions let's compare&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;Missing a payment with a normal mortgage you have 15 days or more before you are penalized a % of the payment and even then if you pay the penalty and your normal payment it is very unlikely you will receive a notice of foreclosure&lt;/li&gt;
&lt;li&gt;A lender will not even engage into a transaction unless they receive a clear title policy from a title company.&lt;/li&gt;
&lt;li&gt;In a deed of trust state like Texas you receive the deed with the lien of the first mortgage (deed of trust).&amp;nbsp; &lt;/li&gt;
&lt;li&gt;A lender will not give you a first mortgage unless the old mortgage is paid in full, usually with your new mortgage.&lt;/li&gt;
&lt;li&gt;Interest rates are limited by law.&amp;nbsp; In the case of a foreclosure you are charged late fees, interest and attorney's fees.&amp;nbsp; While not cheap they are low compared to the 30% to 40% I've heard some owner finance victims being charged.&lt;/li&gt;
&lt;li&gt;Ower evicting or foreclosing without notice and without reason keeping down payment.&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;Some Warning signs&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;Seller having you make your down payment check out to them and not a title company, escrow agent or attorney&lt;/li&gt;
&lt;li&gt;Not providing you with a HUD-1 Settlement statement before the closing&lt;/li&gt;
&lt;li&gt;Not closing at a title company or attorney's office&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;I was an investor before I became a Mortgage Broker.&amp;nbsp; The body of law protecting a buyer in the case of a lender are immense and the laws protecting a buyer from a dishonest owner finance deal are sparse and practically non-existent.&amp;nbsp; This is not to say there are not some fantastic highly ethical people doing owner financing.&lt;/p&gt;
&lt;p&gt;So in short while Owner Finance may be a good deal for some people, remember the sea is not full of goldfish but more often than not it's full of sharks.&amp;nbsp; Make sure you bring your own attorney to the table with any owner finance deal.&lt;/p&gt;
