A Strategic Short Sale? The home is usually worth less in the current real estate market than the amount that is owed on the mortgage. Usually, the homeowner is able to afford or continue to make the payments on the property but chooses not to. With the traditional Short Sale, the seller has a hardship such as: loss of income or unemployment, illness, divorce, relocation, etc. A Strategic Short Sale does not involve hardship. The homeowner may think that keeping the home is not a good investment.
Could the mortgage lender approve a Strategic Short Sale? There is never a guarantee that the lender will approve any short sale -- whether there is a hardship or not. However, there is a possibility that the mortgage company will approve a Short Sale that involvies a Strategic default. Every bank is different. The lender usually prefers a Short Sale instead of a Foreclosure. Your Short Sale Agent should assist you with the Short Sale package that will be submitted to your mortgage lender. An experienced and knowledgable Short Sale Specialist will guide you through the process.
Many homeowners are leaning towards the Short Sale of their home to avoid a Foreclosure. In California, we have the SB458 law. In general, the law states that if a lender accepts a Short Sale, they may not pursue the homeowner (borrower) for any deficiency or the difference. This should include 1st, 2nd and HELOC loans. It has been said that the hit on a person's credit score is less with a Short Sale versus a Foreclosure.
