Gated Communities - Barrington Illinois - Tallgrass of Lake Barrington

There are 3 gated communities in Lake Barrington and one of the newest developments is Tallgrass. Located at the corner of Kelsey Road and River Road, it was recently published that the bank has filed a notice of default against 64 of the 71 home sites.

Here is the excerpt from the ChicagoRealEstateDaily online newspaper.

Harris Bank has filed foreclosure lawsuits on vacant lots in two developments in Lake Barrington controlled by luxury suburban residential developer Michael J. Graft Builder Inc. In one suit, filed Oct. 1 in Lake County Circuit Court, the bank is seeking to recover more than $5 million on 64 lots in Tallgrass, a 109-acre development in the northwest suburb. That case was filed after the bank also filed to foreclose on a loan secured by 28 sites in the Enclave of Heritage Estates, a 66-acre development planned for just 32 high-end homes. Michael J. Graft Jr., president and CEO of the Barrington-based homebuilder, did not return a call requesting comment.

Tallgrass of Lake Barrington Site MapThis was set to be one of the nicest gated communities due to it's goal of keeping the area natural and enhancing the landscaping. If you live in Lake Barrington like I do you'll appreciate all the trees and open spaces, conservation and walking paths - Lake Barrington is a Tree City.

The question now is what will happen. There are a few residents in homes already built and currently 2 homes available for sale, both ranch homes. If the property goes into foreclosure, what will the bank decide to do with the 64 lots they will own? Will they look for an investor seeking to buy gated communities to develop, or will they choose to sell off each lot? In this market both of these options are likely to be a tough sell. Very few buyers are looking at either new construction or lots, although getting deals on property in gated communities will certainly have some appeal if the price is right.

There are always a variety of homes for rent in Barrington IL from condos and townhomes to single family homes and even luxury homes. If you are coming to live in Barrington Illinois you might want to consider looking at rentals. Then you can spend up to a year learning more about our beautiful area before you start looking for a home to buy. It will give you plenty of time to find the right home in the right part of Barrington.

Here are some ideas when searching homes for rent in Barrington:

  • Condos of which there is a reasonable supply. There may be availability in the village or in Lake Barrington Shores a gated community.
  • Townhomes. Again there will be availability in the village, Lake Barrington Shores and perhaps limited units in Deer Park.
  • Single Family Homes. Here is where the widest choice will be and over all parts of the Barrington area. Find homes with as little as 2 bedrooms and 1 bathroom. $2500 per month will afford you a sizeable home on an acre lot. More and the quality and size of the home will increase.
  • Luxury Homes. There are a few executive homes for rent in Barrington IL. Some provide large acreage, others large homes in gated communties.

Whatever your needs in Barrington, Deer Park, Tower Lakes and Inverness, there are plenty of homes for rent. Before looking for rentals, here are a few pointers.

  1. Do you have pets? This will reduce the amount of homes available to you. Many owners are more flexible these days but some just do not want to offer homes when pets are involved. Be prepared to pay a larger deposit and maybe some additional rent for eah pet. Also bear in mind that each part of Barrington is different and whilst an owner may allow you to have 4 daogs, the village of the Barrington in which the home is located may have household limits.
  2. What is your credit report and score like? In todays economy we have seen many families lose homes and then need new places to live. Again some owners may be amenable, but others will want perfect redit scores and no delinquencies.
  3. Schools. If excellent schools are important to you, then finding homes for rent in Barrington with consideration to buying in the future is an excellent move. We do have award winning schools. However not every home in Barrington has Barrington schools. Some may go to Palatine, Lake Zurich, Wauconda. If this is crtitcal ask your Realtor to find out, or go to the school and ask.
  4. Location for children. I only mention this from the perspective of subdivisions which are more likely to have other children to play with, rather than a singlle home standing alone on a street.
  5. Location for commuting. Easy access to Metra Line for commuting to Chicago, or lose proximity to Freeways and Interstates.

Deer Park is primarily single family homes and there are no other townhomes for sale here. Other options to consider would be townhomes for sale in Lake Barrington Shores, although these are considerably further north. Inverness on the Ponds has limited townhomes for sale, and there are others in The Shires of Inverness.

While driving today and waiting at the traffic lights a Smart Car passed, and so I wondered, how are these little fuel efficient cars going to fair in a month or two when we are diggiing out from 6, 12 or 24 inches of snow, perhaps dumped on us day after day. My thoughts are they are going to be in trouble and I found this video online.

Of course this was filmed in the UK, I recognise the license plate style. I apologize to any that own a Smart Car, but this was the best laugh I had in a long time. There is barely 2 inches of snow on the ground in this video.

I hope you have a back up for those snowy days!

Barrington Illinois as well as some of the surrounding communities like Invermess, Kildeer, Long Grove is lucky. Or I should say the residents are lucky. Our area is somewhat immune to the the world of mortgage defaults. I am not saying we don't have any, but our rate of foreclosures is very low. The last time I looked up the data we were still under 2%. If I compare this to some areas in California, Florida, Arizona that have foreclosure rates as high as 40% or more, then yes we are lucky.

Barrington is a very popular place to live. With the great school district, lower taxes than some other areas, it is not surprising with all the online and on TV buzz about foreclosures, that buyers have stepped up to the plate and want to buy a foreclosure here. Indeed, this week alone I have receieved 4 requests for a foreclosed home in Barrington. The requirements for those four buyers is almost identical! So how many houses are there to meet the needs of those 4 buyers -ZERO!

So why are there very few foreclosed homes in Barrington. In addition to the low foreclosure rate, it is obvious that homeowners in trouble are taking the pro-active approach and listing their homes as Short Sales. If all the homes in default get listed with adequate time, the experienced listing agents are pricing right, getting offers and negotiating them with the lender, and the sales are closing. So these homes never get foreclosed on, they are literally swept away before the foreclosure buyers ever see them.

Your Requirements. A Palace? If you are looking for a foreclosure in Barrington and start adding all the things you need in a home, one by one the remaining inventory is crossed off your list. Add to that the fact the within 10 days of being listed most of the homes are under contract and you are fighting an uphill battle.

What can you do? First you should consider looking at all the short sales. There are more of these and you are more likely to find a match. Second you should consider looking at all homes available that match your criteria. Prices are probably the lowest they will be and there are always opportunities for getting a great price on a home. If you stick with the foreclosures, then be prepared to:

  • Wait
  • Act Very Fast
  • Be Prepared to be Disappointed.

But I want $100,000 instant eqlow ball offers on barrington homesuity! Don't we all! Low ball offers, should you make them. Please remember that foreclosed homes are already discounted, so you are already getting a deal. Also bear in mind, you are not the only person looking for a bargain. In fact many forelosed homes are now selling above the asking price. Why? Because serious buyers recognize that the home is priced well and that to be sure they get the house they want, offering above asking price is a great way of putting yourself at the front. Making low ball offers on short sales will hit a brick wall. Ask me why!

If anyone is considering bankruptcy, the first thing to do is pick up a phone and speak to a bankrupty attorney.

Commencing a Chapter 13 Case

A Chapter 13 bankruptcy case begins with the filing of the bankruptcy petition.

Upon the filing of the petition an automatic stay arises that prohibits creditors from taking any further action to collect a debt or enforce a judgment.

A Notice of Commencement of Case is electronically served on all creditors who have subscribed to the national database or by mail to all others.

This Notice provides each recipient with the date, time and place of the meeting of creditors and confirmation hearing, as well as the last date to file for a determination of whether debt should not be discharged.

At the time of filing of the petition or within 15 days Schedules of personal and real property, exemptions, priority debt (taxes, domestic support obligations, etc.), secured debt, unsecured debt, income and expenses must be filed.

 

Chapter 13 Trustee and Creditors

Unlike Chapter 7 trustees, Chapter 13 trustees are not empowered to liquidate assets, but rather will evaluate asset values alongside income and expenses to determine if the plan payment is the debtor’s best efforts.

The Statement of Financial Affairs filed by the debtor is reviewed by the Chapter 13 trustee for complete disclosures in response to a series of questions, income over the last 3 years, transfers, repossessions, and seizures made within 2 years (most trustees will ask about over the last 4 years), and interests in any corporate or business entities.

Creditors have the right to object to the Chapter 13, but have no voting rights, as they would have under a Chapter 11 plan.

Mortgage holders and auto finance companies require continue payments for the debtor to retain property rights.  Auto financing entered into within 910 days of the filing of the case cannot have the value of their collateral reduced to the current value (cram down).

 

Who May Be a Debtor and Debtor’s Duties

Chapter 13 is intended to provide a vehicle through which people facing financial difficulty attempt to keep their property while using their Chapter 13 plan to cure payment defaults, typically only to their mortgage lender.

General unsecured debt that is liquidated, matured and not contingent cannot exceed $336,900, and secured debt cannot exceed $1,010,000.  The determination of what is secured and unsecured can be subject to objection and litigation in a Chapter 13 case.

Debtors are required to complete a credit counseling course prior to filing and must complete a financial management course within 45 days of confirmation of a Chapter 13 plan.

Beginning each month after commencement of the Chapter 13, debtors must begin making the regular monthly mortgage payment to the first and the second (until the second may be deemed wholly undersecured), and regularly monthly mortgage payments may now include an escrow for taxes and insurance (thereby increasing monthly payments).

 

The Chapter 13 Plan

Also at the time or within 15 days of the petition there must be filed a Chapter 13 repayment plan that will set forth how mortgage default payments will be cured over a 36 to 60 month period of time, as well as treatment of other debt repayment, if any.  Depending upon the jurisdiction, plans may be proposed for as little as 0% being paid to general unsecured creditors.

Under BAPCPA the period during which debtors must commit to a Chapter 13 plan will be dictated by whether their annualized monthly income is more or less than the median income in their Metropolitan Statistical Area as compiled by the Census Bureau.

Other requirements as a condition to court approval (confirmation) of a Chapter 13 plan include: submitting tax returns, proof of income and proof of monthly expenses to the Chapter 13 trustee, as well as plan payments calculated from disposable income or the curing of default payments. r all plan payments are made during the term of the plan and the total amount required, the Chapter 13 trustee will file a final report upon which the debtors receive a discharge.  In the event the second mortgage is deemed wholly undersecured, it may be avoided from title as prescribed by order of the court.

 

Advantages of Chapter 13

Chapter 13 affords debtors the opportunity to retain their homes, as long as they make regular monthly payments and plan payments.

Wholly undersecured junior mortgages may be removed from title upon entry of Chapter 13 discharge.

Judicial liens may be removed.

Auto loans that were made more than 910 days may be subject to being reduced to the value of the motor vehicle with payments made through Chapter 13 plan.

Foreclosures, seizures, garnishments, levies, and collection efforts are stayed during the course of a Chapter 13 and are permanently enjoined upon entry of the discharge.

Taxes are generally nondischargeable, but may be paid with post petition interested abated upon full payment and entry of the Chapter 13 discharge.

If you are an investor buying real estate in Illinois as an LLC or INC there are some very important documents that are being ommitted by your Realtors 9 times out of 10 when submitting pucrhase contracts.I know this because I have listings that are REO (Bank Owned) and the lower level prices do tend to attract investors that operate as LLC's. On a current listing I have, every contract submitted as an LLC has not had the Articles with it!

You must submit a contract using our usual forms but if the buyer on your contract is entered as your LLC or INC then you must submit the Articles of Incorporation with your contract. 

In addition you should be careful how you sign the contract as the buyer. Depending on how you formed your incorporated company dictates how you sign the purchase contract. You may have members or managers. Your titles should be added to your signatures.

I am not an attorney so if you or your buyers agent has any doubts about how to complete your purchase contract then ask your intended attorney for the transaction. He or she will be glad to make sure you get this important step right from the beginning. After all the delay in getting the documents could cost you the deal!
