Hmmmm...you know what? You are right!!!

So I am sitting here at my desk this morning. My phone is located to the right of my laptop and my coffee to the left. My "To-Do" list is filled out, with logging into my favorite blogosphere being one of the first things I do to start my business day. Pretty normal morning for me. But something is different...I noticed my picture that I use for ActiveRain. The reason for using this picture is the same. It was chosen because I wanted to remind myself of God's beauty with the world we live in and also to symbolize that everything is within our grasp. But things haven't been really working out that way over the last few months. Why?

Well, as I rediscovered my reasoning for this picture, something clicked inside. I don't know what clicked, I just know it did. I have been spending a lot of time in the Word and also reading some books on enlightenment. I am nowhere near this bliss that they discuss, but I can feel that I am just a little bit closer each day.

In our world of Real Estate, whether it is representing the selling/buying of it or getting the financing of it, we have to be on our "A" game at all times. We fall into the traps that we set for ourselves or we simply let our customers beat us down. WE can control this. Yes...we can. We can team up with each other and represent collectively as professionals. Maybe we didn't go to school for 10 years or have a PhD in our title, but we are nonetheless a professional as any doctor or lawyer. Our customers and our communities look to us for expertise in a complex process. Now, more than ever.

I am writing this blog for myself, not necessarily for you. I am finding that the more I write my positive thoughts down, the more they start making sense and work towards becoming reality. I have a TON more to say about all of this, but I find myself becoming less patient and burning with the desire to "get-r-done" today. Yes, I am using a Larry The Cable-Guy voice inside my head :). Join me, my fellow professionals, lets take back our industry!!!

May the "Mod" not become the "model"

So as I promised in my previous blog, here is a video with a bit more information. It is vital that everyone understands that just because the feds create more regulations on an industry, doesn't necessarily equate to an improved scenario for the consumers. While I agree with fixing some of the problems that were occurring in our industry, things are usually taken to far. We need a level of sensibility to correct the problem, not over stepping bounds in order to over correct and create a while new set of problems that inhibit or hinder our clients from obtaining or maintaining the dream of home ownership.

Whose house is being saved by Obama?

NEW YORK (CNNMoney) -- More than half a million Americans have received permanent mortgage modifications from the Obama administration's flagship foreclosure prevention program, the Home Affordable Modification Program.

So who are these homeowners?

To begin with, the reason they are falling behind on their mortgages isn't because their loans are unaffordable, according to a report released Monday by the Treasury Department.

Instead, defaults are stemming from the weak economy and unemployment: In December, 60% of the borrowers who received permanent HAMP mods were facing a loss of income. Just 11% were the result of unaffordable mortgages.

L.A. and New York City have the largest concentrations of these beneficiaries, and their ethnicity roughly reflects the nation as a whole: 33% of borrowers who received permanent modifications were white, while 12% were African American, 18% are Hispanic and 3% are Asian. (The numbers don't add up to 100% because many people did not report ethnicity.)

Median household income for them was just $46,000, well short of affluent. Their credit scores averaged about 570 at the time of modification, which would, under today's lending conditions, prevent them from obtaining loans.

Foreclosure pain index: 10 cities

Their mortgage balances -- after modification -- averaged $232,000. That is about five times median household income, about double what they'd usually be allowed to borrow on income of $46,000.

The help these borrowers receive is substantial, with the typical HAMP modification slashing about 40% off mortgage payments. About 18% of HAMP borrowers were able to reduce their payments by $1,000 a month or more.

Still, receiving a permanent HAMP mod does not guarantee that the borrowers will keep their homes. Of those who received a modification during the third quarter of 2009, more than 46% have already fallen at least two payments behind.

Homeowners with payment reductions of more than 30% were far less likely to become delinquent on their permanent modifications, compared with those receiving a payment reduction of 20% or less.

After 12 months, nearly 60% of borrowers whose loan payments went down less than 20% were at least two payments behind. Only 28% of those borrowers with payments reductions of 30% or more had fallen two payments behind or more.

We continue with our two-part blog talking about which home remodel projects you should tackle first. As we established in the first blog, the kitchen is the most important room in the home that should be the first to receive an update. The return on investment is often around 80-100 percent of the original investment.

This second part of the blog will discuss the second most important room to remodel: the bathroom. Renovating and remodeling this room will greatly boost the value of your home and is a great investment. Bathroom remodels average a return on investment of 80-90 percent. On average, a bathroom remodel costs $15,800 which can dramatically change the look of the room and leave a lasting impression on the rest of the home.

Tackling a bathroom remodel is important, and if your kitchen was recently remodeled, following up with the bathroom will be the best choice. Remodeling a bathroom can vary depending on what needs to be done. If you want simple, cosmetic changes, replacing fixtures and faucets is a great first step. Replacing a vanity and updating lights and mirrors can also create dramatic changes for a lower price.

If you are looking for a complete redesign, there are many different floor plans you can follow. A bathroom is one of the most important places in the home and it needs to feel like it. Taking the time to ensure the bathroom is updated is a worthwhile task, plus it can greatly increase the value of your home.

Verizon's marketing team must have had a pretty easy time choosing an angle for the first iPhone advertisement: million of people have been literally waiting for years for the Verizon iPhone to become real. So it's no wonder than the first ad features people waiting, and clocks ticking, with a climax at the end featuring a firm date (February 10th) when the clocks will "stop clicking". The message is "to our millions of customers who never stopped believing this day would come: thank you". Clever stuff, and certainlyAT&T might be scrambling to create a counter to this message.

In today's day and age, there is a revolution occurring on the Internet. 1 million homes repossessed in 2010

NEW YORK (CNNMoney) -- Foreclosures were at a record high in 2010, and more than 1 million people lost their homes, even as notices started leveling off during the end year.

In total, there were nearly 2.9 million foreclosure notices filed during the year, according to report released Thursday by RealtyTrac. That was a record high, but just 1.7% above 2009.

It most certainly would have been higher had notices not plunged in November and December as banks halted tens of thousands of foreclosures in the face of the robo-signing scandal.

"Total properties receiving foreclosure filings would have easily exceeded 3 million in 2010 had it not been for the fourth quarter drop in foreclosure activity," said James Saccacio, RealtyTrac's CEO. "Many of the foreclosure proceedings that were stopped in late 2010 -- which we estimate may be as high as a quarter million -- will likely be re-started and add to [foreclosure] numbers in early 2011."

For the fourth consecutive year, Nevada led the nation in the rate of foreclosures with one of every 11 households there receiving at least one filing in 2010. Still, that constituted a 5.3% improvement from a year earlier.

In Arizona, one of every 17 households received a filing in 2010, down 4.5% for the year. Florida's 2010 foreclosures (one in 18 households) dropped 6.1% year-over-year, and California (one in 25) fell 8.5%.

Overall, 2010 was a rough one for the mortgage industry. The big news was the robo-signing scandal, which erupted in the fall amid allegations that banks were foreclosing on homes without having read the documentation.

Then, President Obama's efforts to fend off foreclosures foundered as the year wore on and the potential for ever more massive foreclosures ballooned.

At the beginning of 2010, the bloom had not yet faded from Obama's HAMP (Home Affordable Modification Program ) program, and many analysts were optimistic it would help many people save their homes.

By April, it became apparent that the program was losing the foreclosure fight; there were reports of 10 new defaults for every HAMP modification and the projections for the number of borrowers who would actually receive a HAMP mod had nose-dived to 1 million from 4 million.

Then the next shoe to drop came in June, with a report from Fitch Ratings that showed HAMP modifications re-defaulting at a high clip. The company forecast that three-quarters of all HAMP mods would ultimately fail.

The foreclosure prevention program really started to fade by mid-summer: Fewer than 37,000 loans received HAMP modifications in July, down from more than 50,000 a month earlier. Only 435,000 loans had gotten permanent modifications through the program.

The next few years could be difficult. Some industry analysts, such as Laurie Goodman, head of Amherst Securities mortgage group, say that as many as 11 million mortgage borrowers are in potential danger of default.

However, Rick Sharga, RealtyTrac's spokesman, predicted 4 million to 5 million and scoffed at quantifying the magnitude of the potential disaster, comparing it to "taking inventory of deck chairs on the Titanic."

Kiss 4% Mortgage Rates Goobye?

Here is an article from Money.CNN.com that I thought might be worth posting. The fact is, rates will not stay as low as this history making trend has been. It is time for the fence sitter to make a decision on what exactly they are going to do. If you are a Realtor working with a client that isn't prequalified yet and they seem to be unsure of what to do, maybe because they are waiting for the elusive "bottom" to hit, it might be time to send them to your favorite Loan Officer. As a mortgage professional, it is our duty to explain the ins-and-outs of this crazy market we are in. Let's face it, an informed customer is an excellent customer. Good luck out there!!!

NEW YORK (CNNMoney.com) -- The era of near 4% mortgage rates has ended after a quick rate rise since early November. But some industry experts think that may be a good thing for the flagging housing market.

The average 30-year fixed mortgage rate has risen to 4.86% from 4.17%, according to Freddie Mac's weekly mortgage market survey. In the Bankrate.com weekly survey, the rate has risen to 5.02% -- crossing the 5% mark for the second time in three weeks -- after being as low as 4.42% as recently as early November.

Rates haven't been this high since May and forecasters now predict them to remain between 5% and 6% for all of 2011.

"You can kiss those record lows goodbye," said Greg McBride, chief economist for Bankrate.com.

Keith Gumbinger of HSH Associates, a provider of mortgage information said that the market reached a new plateau.

"I don't think we're going back to a 50-year low anytime soon without an economic collapse," he said. "Rates will probably never revisit those levels."

The increase will push mortgage payments higher for homebuyers. When rates rise from 4.25% to 5% it takes away about 9% of buying power, according to McBride.

"That's nothing to sneeze at," he said. "But it's still small relative to the steep drop in home prices over the past few years."

Good for the market?

Higher interest rates may even prove stimulating to the still quiet housing market in which sales volume and prices are scraping near their bottoms.

"The initial phase of an interest rate increase generally does not hurt markets," said Lawrence Yun, chief economist for the National Association of Realtors. "In fact, it can help."

The rapid rise introduces an element of urgency for potential homebuyers. They may now rush to buy before rates spurt even more.

The strength of the economic recovery will have far more impact on the housing market that this relatively modest increase in mortgage rates, according to Yun. If hiring gains momentum, housing markets should revive.

"If we add 2 million jobs as expected in 2011, and mortgage rates rise only moderately, we should see existing-home sales rise to a higher, sustainable volume," said Yun.

Gumbinger said that demand for homes may be tempered somewhat by the increased mortgage costs and so affect home prices a bit but theimproving job picture and better consumer confidence matter much more.

"If the other factors are aligned," he said, "interest rates are not a big thing."

The real mortgage challenge, according to Yun, is to increase the number of loan applicants winning approvals. Too many potential homebuyers are still finding it difficult to qualify for loans.

"The current mortgage market is a unique situation" he said. "It's less about rates than it is about underwriting standards, which are, in my opinion, still too stringent."

"If lenders return to more normal, safe underwriting standards for creditworthy buyers, there would be a bigger boost to the housing market and spillover benefits for the broader economy."

3 Ways to Avoid Legal Trouble With REOs
REO and short-sale transactions are expected to continue to make up a big part of the real estate landscape in 2011. Real estate coach and trainer Bernice Ross offers some of the following tips to avoiding common pitfalls when working with distressed properties.

1. Make sure you have the training. If you lack the experience in handling REOs, short sales, or foreclosures, you need to disclose that fact to your clients. You’re better off not taking on a transaction if you lack the proper training in navigating these complex deals. Instead, a smarter and safer business approach: Refer the business to another agent and take a referral fee, Ross says.

2. Determine if it’s a recourse or nonrecourse loan. You need to determine how many loans the owner of a distressed property has on the property and whether those loans are “recourse” or “nonrecourse” loans, Ross says. With a recourse loan, if a lender forecloses or grants a short sale, the lender can still seize other assets belonging to the defaulting home owner to cover the lender’s loss. With a nonrecourse loan, the lender's only option is to foreclose on the property and they will not be able to seek such a deficiency judgment. It’s possible for an owner to have both recourse and nonrecourse loans on the same property.

Also, make sure your clients are fully informed about any tax ramifications prior to committing to any type of transaction, Ross notes, suggesting you have clients consult a tax professional before making any final decisions.

3. Have an attorney on call. Many lenders use language in their listings and sales contracts that note a “blanket indemnification of the lender." That means if there’s a lawsuit you’ll have to defend yourself and the lender. Have an attorney review all lender listing agreements so that you can remove any blanket indemnification language, Ross says.
