Something Home Buyers Should Consider

Home buyers - thinking about a Move 2 North Georgia or maybe a second home in the cool North Georgia Mountains? Please take a minute and think about this...

As a licensed Realtor in the state of Georgia, I feel it is very important for home buyers to understand buyer representation and give serious consideration to entering into a Buyer's Agency Agreement with a trusted Realtor. Without buyer representation, the default is for the real estate professional to represent the seller (not the buyer) in all dealings with the buyer.

So what is buyer representation and why is it important for the buyer to be represented? I think when I address what buyer representation is, the reason why it is important will be evident.

Buyer representation means that the buyer hires a real estate professional to advocate and work solely on behalf of the buyer to obtain the best deal and terms. The real estate professional no longer represents the seller by default. He/she can assist the buyer in acquiring and interpreting information about a property, its condition and the seller's motivations. He/she can develop a negotiation strategy and assist the buyer in determining a reasonable offer. Buyer representation fosters greater loyalty and frees the real estate professional in a way that seller information can be disclosed to the buyer. A Buyer's Agency Agreement affords the buyer client level services as opposed to customer level services.

How does a "client" differ from that of a "customer"?

Simply put, real estate professionals work FOR clients and WITH customers

Breaking it down... (this list is meant to be used as a sampling and is not all inclusive). This list shows the contrast between buyer client/client level services compared to that of a buyer customer/customer level services.

If the buyer is a client	If the buyer is a customer
Pay full attention to the buyer's needs	Maintain loyalty to the seller's needs
Disclose all the agent knows about the sellers	Tell the seller all that is known about the buyer
Keep all information about the buyer confidential	Keep all information about the seller confidential
Find the best property possible	Get the best offer for the seller
Get first opportunity to view new listings	View new listings after buyer clients
Give advice with facts	Provide only material facts
Compare competing properties to assist the buyer in making a realistic offer	Cannot help the buyer compare competing properties
Attempt to solve problems to the buyer client's advantage and satisfaction	Attempt to solve problems to the seller client's advantage and satisfaction

It is important to note that a real estate professional owes fiduciary duties to both a client and a customer. But the extent of duty owed to a client surpasses that owed to a customer as shown above.

As a home buyer, ask yourself these questions and then decide if you want buyer representation?

Do you want to be told what the lowest price a seller will take?
Do you want help with developing a negotiating strategy?
Do you want to be told if the property is thought to be overpriced?
Do you want to know if the current use of a property is in violation of zoning laws or deed restrictions?
Do you want to be told of any counter offers made by the seller?
Do you want assistance in making an objective comparison of competing properties?
Do you want to know (if known) that the property has been the site of a homicide or suicide?
Do you want advice on what clauses to include in an offer in order to protect your rights?
Do you want to know how long a property has been on the market?
Do you want assistance in determining what to offer based on comparables?

These questions are just a small sampling of what a buyer's representative can do for you. As a home buyer, you are making one of the most serious and probably most expensive purchases of your life, don't go it alone.

Jam sessions for acoustic musicians are held under the trees along the Toccoa River at Horseshoe Bend Park every Thursday evening from 6:00 p.m. until dusk. What a Difference a Little Rain Can Make - Lake Blue Ridge North Georgia Mountains

Lake Blue Ridge, Fannin County Georgia (pictures made May 5, 2008)

Lake Blue Ridge was one of the many lakes in North Georgia which suffered from last year's drought. But oh, what a difference a little rain can make. Lake Blue Ridge is almost full pool now. Many of the locals use the penstock at the dam as a way to measure the lake level. You can see the dark brown ring around the penstock in the picture above. When the lake is full, the brown ring will not be visible. So, in this picture, you can see that the lake is almost at full pool. Thanks to rains that have the upper Toccoa River flowing strong. Last year, much of the shoreline was visible throughout the summer months.

Behind the scenes:

Blue Ridge Reservoir just below the earthen dam was built along the Toccoa River. The river is noted for sunfish, trout and bass. The earthen dam is 167 feet high and stretches 1000 feet across the river. Lake Blue Ridge Dam is one of the largest earthen dams in North America. The powerhouse seems to be a popular place for fishing.

Home Away From Home in the Blue Ridge Mountains of North Georgia

A second home provides an escape from the day to day stresses and that is one of the reasons the second home market is thriving. The Blue Ridge Mountains of North Georgia has become a popular second/vacation home destination in recent years. Since I sell real estate in a second home market and primarily work with second home buyers, baby boomers, future and current retirees, I hope this post will provide a few tips for the potential second home/vacation home buyer based on questions I have gotten from previous buyers.

Climate is important when choosing the location for your second home but so are your personal interests. It is your personal interests that should be the driving factor. Get to know the area, spend some time driving around and mingling in local shops. Check out locations of interest at different times of the day. Subscribe to local newspapers in the area of interest to you in order to become more familiar with the area and talk to local residents and other vacationers when visiting an area. Research as much as possible online. Visit the local Chamber of Commerce or Visitor's Center for additional information about the area such as: events, recreation, amenities, places of worship, hospitals, amenities, pet care, etc. Contact the local police department for information on crime.

How far will you need to travel, can you drive by car, do you have to fly
How often will you use your second/vacation home
Pets and their needs
Taxes and insurance, maintenance and travel costs in addition to the mortgage payment. Consult with a professional tax advisor and the local county's tax assessor's office. In some instances, interest and property taxes on second/vacation homes may be tax deductible as well as, some rental expenses.
What type of property is best for your wants and needs, i.e., single family detached; attached housing; active senior adult communities; town homes, condominiums, studios. Talk to a local realtor about the area and have the realtor explain the types of housing choices in the area and the advantages or disadvantages, whichever the case.
What your financing choices are. Financing terms are changing frequently in today's market so keep in touch with a trusted mortgage broker or Realtor who can refer you to local lenders who will understand the nuances of the area of interest to you. Be sure to calculate the down payment and closing costs and any other additional fees when financing a second/vacation home. Don't forget to include monthly utilities, yard maintenance, and security
Who will care for your second home when not in use? Property management is a great option while you are away.
Resale ! This is an important component that can often be overlooked. You may be purchasing your second home for a future retirement home which will become your primary home at some point in time and you think you will retire and be there from now on. But be sure to consider that life is all about change and the day may come when you decide to sell. Keep these resale factors in mind when purchasing your second home:
Homes convenient to shopping, restaurants, recreation and hospitals may be more desirable but privacy and seclusion is also an important factor to some buyers. However, a property that is too remote could be more difficult to sell.
Easy driving distance may have greater sales potential
Properties that can be used year round or at least more than one season per year will appeal to a greater number of potential buyers
Properties with good rental history will be more appealing to a potential investor
