In a recent ruling the Massachusetts Supreme Court changed how people slipping on ice and snow on your property was handled.  The prior law read that if you, as a home or business owner, chose not to clear the snow or ice off of your property it was ruled as it was an “act of nature” and you were not liable.  Well, that has now changed!
Please read this article:
The law now states that every property owner has a duty to use “reasonable care”.
What does that mean to you as a homeowner with your home on the market?????

Foreclosures are here and in full speed.  We all must know someone that has or is going through financial trouble and is unable to pay their mortgage.  But the story I just read absolutely takes the prize for being the longest pending foreclosure that I have ever heard of.

I recently received an email from a person who was very distraught over the necessity of having to go through a short sale.  The simple fact of needing the short sale was very upsetting to her, but she was also upset over the fact that she was told that she would not be able to own a home again for at least 5 years!!!
I was shocked when she said that to me.
I asked her who told her such a thing?  She informed me that her bank had indicated that to her.

At this very moment I have 23 active short sale files. 
 
I just wanted to let that sentence sink in.  Give it the attention and thought that it deserves.  That is a good number of active short sale files.  Not bragging or looking for accolades just want you to realize how many files I work on at once so that you possibly can see why an agent who doesn't want to listen to how the process is OR an agent who just wants to play "pass the buck" is truly an unnecessary nuisance in this market.

As most of my readers know by now I specialize in short sales. Many agents claim to be an expert but when asked to show their numbers or show professional referrals, they cannot. I handle the short sales for many agents in my office as well as for several local attorneys, and have even stepped in to assist agents in other brokerage firms.
Yes, I now have sufficiently patted myself on the back  )!!!!!

bristol county: Is your homestead act still protecting you??? - 09/11/10 09:47 PM
I received an email earlier today from a past client asking me if the homestead act they had filed when they purchased was still valid after they refinanced.
The answer is NO.
I have heard different attorneys give different answers to that questions, and I had 1 attorney once respond "That there are different schools of thought on this issue......".
The only school I want and am interested in is protection! Real estate agents and attorneys have always assumed that the exemption was subordinate to a pre-existing mortgage, but believed the Homestead otherwise remained valid when a new refinance mortgage was … (1 comments)

I was having a conversation with an agent in another office the other day, and he made a comment that "last year was a really bad year for me, I earned a quarter of what I usually do."!! A BAD YEAR!!!
When did you clue in to the fact that you weren't earning any or enough money....December?????
You had 12 warning signs flashing  across your face along the way....nevermind the 52 chances to ramp it up if your results are less than what you want/need.
Enough ranting!!!!!! That is counter productive (but man that is just irritating).

I have been actively selling real estate for almost 14 years.  In the real estate world that is almost a life time.  You know what I mean....models have a shelf life of 4-5 years as the "Top Model"; actors or actresses are "in" for maybe 10 years.  Well, 14 years in the real estate profession (active and full time)puts you in a very short list of the real estate "elite".  Now before you scream I am NOT saying that "Elite" means that I am right off of the cuff better...it just simply means that VERY few make that length of time … (4 comments)

Why can't I re-negotiate my commission in the offer??

I have to put this down as one of my BIGGEST pet peeves as a listing agent, and also one of the most frequently committed Code of Ethics Violation.
"Hi, my name is Mary and I have an offer for your listing and I don't like what the seller and/or you are paying me so I put into the offer that it is subject to me getting $1,000,000.00 or this is not a deal!"

As I have said before, I negotiate a lot of short sales for homeowners in financially challenging situations. But this recent one really got me all riled up!!  Another agent in my office asked me to co-list the property as he had minimal experience with short sales.
Not a problem!!
A buyer calls him on the home and he shows her the home, a couple of times this happened.
Then he gets an offer on the home from this buyer, but with her Attorney representing her as a buyer's agent.  I know it happens and we just got to suck it … (8 comments)

I do a great many short sales in my area, an unfortunate result of the economic situation.  I am aware of the Mortgage Debt Forgiveness Act http://www.irs.gov/individuals/article/0,,id=179414,00.html
I know I am not a lawyer or a tax specialist and never advise clients on the possible ramifications, I advise them to seek advise from the appropriate professionals and also have a disclosure notice signed that indicates that as well.
It has been brought to my attention recently that a few attorneys are indicating that a foreclosure will not result in tax implications.
