Carrollton Texas Homes http://activerain.com/blogs/bobmccranie Great homes in Carrollton, Plano, Frisco, Richardson, McKinney, Denton & Dallas. en-us http://activerain.com/blogsview/3704302/the-collin-county-assocation-of-realtors-goes-greener The Collin County Assocation of Realtors Goes GREENER <p>After nearly four months of meetings and hard work, the Collin County Association of Realtors (CCAR) has earned the Green Business Certification from the City of Plano.&nbsp; Their building on Coit Road has received several improvements and new policies have been inacted to insure that the organization holds to the standards set by the city.</p> <table> <tbody> <tr> <td> <p><img src="http://activerain.com/image_store/uploads/1/3/1/3/7/ar136675085273131.jpg" height="356" alt="" width="200"></p> <p>Bob McCranie &amp; Charles Dyer</p> </td> <td> <p>There are many steps which had to be accomplished to be certified green.&nbsp; Everything from energy usage, water usage, landscaping needs, kitchen ware, interior lighting, appliances, and electronics are reviewed and inspected.&nbsp;</p> <p>&nbsp;In early November of 2012, Mary Leidy, CEO of CCAR, contacted me about earning this Certification.&nbsp; She had been contacted by Paul Le Roy from the City of Plano to find out our interest in earning the certification.&nbsp; Mary remembered that three years ago I was instrumental in the first green initatives at CCAR and earned the NAR EverGreen Award in 2010 in part for those efforts.&nbsp; It seemed natural to move forward with this program.&nbsp;&nbsp;</p> <p>I jumped at this chance without a second thought.&nbsp; I went to see Mary in December and just by happenstance, Paul called the office while I was there and we cemented our intentions to move forward with this certification.&nbsp;</p> <p>Mary appointed Charles Dyer with CCAR to head up the efforts for staff, and he and Paul and I jumped into the process.&nbsp; The 7 page spreadsheet of requirements for the program was daunting. But like any project we broke it down into small pieces.</p> <p>CCAR has reduced it's electrical usage by installing new light fixtures throughout the building.&nbsp; I got three Solatubes installed from Daylight Rangers and brought them into meet the Plano City staff so they could connect and share business ideas.&nbsp;</p> </td> </tr> </tbody> </table> <p>We already had plumbing fixtures that met code but we had to upgrade our window screening, get rid of Styrofoam cups, bring in reusable silver and plates, remove plastic bags, post recycling policies, encourage use of public transportation and, my favorite, install two hybrid/electric vehicle parking spots.</p> <p>The City used our building recently for their Green Certification meeting to show prospective applicants how it can be done.</p> <p>&nbsp;</p> <p><img title="Hybrid Parking" src="http://activerain.com/image_store/uploads/5/7/1/1/1/ar13669116211175.jpg" height="356" alt="Hybrid Parking" width="200"></p> <p>Hybrid Electric Parking.&nbsp; It's been fun and I've enjoyed being the "Duke" of various businesses.&nbsp;&nbsp;</p> <p>Over the last year or so, a new user has found a way to exploit the system.&nbsp; She has an inordinate number of check-in's and has become the "Empress" of my city.&nbsp;&nbsp; Many of the places I frequent are listed now as hers.&nbsp;&nbsp; However none of the owners or workers in those places know her.&nbsp; The real kicker is the Carrollton Senior Center where I know she doesn't volunteer or attend.&nbsp; It's just so obvious.&nbsp; I'm not sure how she's done it, but it she has.&nbsp;&nbsp; I even wrote YELP and inquired who she could possibly be exploiting their site this way.&nbsp; I didn't get a response.&nbsp;</p> <p>The spirit of YELP seems to be that everyone gets a voice and your best customers rise to the top.&nbsp; I know that it is legal in Texas for the Seller to provide an existing survey and sign an Affidavit that says "that to the best of their actual knowledge" they are unaware of any changes. But in my mind this would be similar to accepting the Sellers previous inspection and having them sign that nothing has changed. It is just a due diligence point for the Buyer to do their own work. <br><br> New surveys turn up lots of issues previous surveys have not found. The technology is much more accurate. If there's a flaw in the new survey, the buyer can sue the surveyor for the issue. If there's a problem with an Existing Survey given by the seller, the buyer has to sue the seller, not the surveyor. Additionally, if a new survey is purchased the title company can be asked to remove the survey deletions off the Title Policy and additionally protect the buyer and seller from confusion. <br><br> <b>Today's Scenario</b><br> I represent the Buyer in a contract set to close next week. The contract clearly states that as part of the contract the Seller will provide a new contract for the Buyer. Both sides agreed to it and the contract was proceeding normally.<br><br> <img src="http://www.texaspriderealty.com/A55656/TexasPride.nsf/SurveySegement.jpg" border="1"><br><br> On Friday the Title Company sent the lender a copy of the Seller's Existing Survey with a signed Affidavit and told the lender it was Acceptable and to use it. I reminded them that the contract called for a new survey and I politely explained why. I thought the matter was handled. <br><br> I few hours later the Seller's agent emailed me asking why we wanted a new survey. In his email he forwarded a <b>snarky</b> email from the Title Company implying that I was trying to cost his client extra money by holding to the terms of the contract. <br><br>I looked up the Title company employee on Facebook and she and the Seller's agent are great friends and their brokerage is the only brokerage she and her boss have LIKED. I was suddenly aware that they were trying to change the terms of the contract to favor their friend's client.<br><br> I copied her boss on my response to the agent again explaining the benefits to both of our clients having a new survey. I explained that I was uncomfortable with the actions of the Title company.<br><br> I got the response today from the boss who stated: <br> <b> * "the survey has also been reviewed by our title plant for accuracy"</b><br> <b> * "The purchase of the new survey is really unnecessary."</b><br> <b> * "There is virtually no risk for your client in regards to the survey"</b><br> <b> * "This is another expense that we deem unnecessary for the seller or buyer."</b><br><br> My jaw is on the floor. Then I called my friends at my favorite title company and had a conversation with their attorney who also had his jaws on the floor. <br><br> * The title company doesn't do a survey and thus can't review it for accuracy. They have no idea what's changed or if the surveyor got it right.<br> * The title company isn't a party to the contract so they can't determine what is "unnecessary" or what is an "unnecessary expense". <br> * And as for being "virtually no risk"...I have to wonder if the risk is that low, why won't the title company insure the existing survey. If they really feel it's that good of a survey, insure it. But they won't. <br><br> In the end we ordered a new survey per the contract. The more I work in Real Estate the more I learn to appreciate the relationships I have with strong ethical lenders and title companies. She lives in the community and makes it a point to tell neighbors how much homes sold for, how many showing they've gotten and how successful she's being in real estate. <br><br> I get it. She's trying to drum up her market by talking up her services. But she's not allowed to distributed SOLD prices (Texas Law) and frankly, I'm not sure everyone should know my client's business when they're selling or buying a home. Confidentiality applies even after the representation agreement end.<br><br> I enjoy working that neighborhood, even though I know she'll casually stop in on my clients and tell them how great she is. She's always walking the dog or jogging by or checking her mailbox at the right time to meet the neighbors, gather the gossip and then spread it to the next block and put it in her newsletter.<br><br> I'm not sure what it will take to get her to stop sharing confidential information. I'm doing my annual review of my income and expenses and I've decided to cancel my EFax account. <br><br> In 2011 I received 42 faxes. <a href="http://www.Efax.com" target="_new">EFax</a> charged me just under $20 a month ($240 annually). Most agents now scan and email documents to me and the addition of DocuSign has really made faxing obsolete. <br><br> If I end up with a customer/agent who must fax I figured I could either start a temporary EFax account or go with a lower priced competitor. <a href="http://www.Fax87.com" target="_new">www.Fax87.com</a> looked interesting at $4 a month for the basic plan. I could even justify spending a bit at my friendly Postnet store if a fax is absolutely necessary. <br><br> What do others think? What solutions are you using? <br><br> -Bob P.S. Within our MLS rules we all agree that we can receive emails from each other. So the list of agents is available to us to use as needed. <br><br> I have had an <a href="http://www.icontact.com" target="_new">iContact</a> account personally for years to send out my client newsletter but I needed to upgrade my account to accomidated the larger list. I spent about 15 minutes using the Support Chat with <a href="http://www.icontact.com" target="_new">iContact</a> to verify that I could upgrade and use this list, because several of my friends had bad experiences with <a href="http://www.icontact.com" target="_new">iContact</a>taking their credit card and then turning off the service because of "list" issues. It seemed like a bait and switch situation and I wanted to clarify, before upgrading, that I was okay. <br><br> The tech on the support chat assured me: <br><br> <i><a href="http://www.icontact.com" target="_new">Maria</a>: Bob, since your purpose is not on a purchased list and the good thing is you have a permission in your association which is likewise,<a href="http://www.icontact.com" target="_new">iContact</a> is a permission-based email marketing. He told me that most of the services that are provided by his brokerage/franchise are unused by the agents and the agents are instead asking that for Electronic Signature software. They would rather have that service for free, than the services that are provided now.<br><br> This is where the conversation turned a bit heated. I corrected him that the services weren't free, there was a hefty monthly fee to each agent. My friend, who is the manager of the branch, said I was playing semantics. That the services were free for being part of the office. I told him that if it was really free, he wouldn't be billing his agents each month. <br><br> Personally I don't think that charging someone and then telling them they're getting something free just don't make sense. To be exact, Version 9.0.8112.16421. <br><br> I'm simply not impressed. Most of the options are now hidden in smaller-than-normal icons, or off on some pull down menu you can't find hiding on the far right side of the screen. Our MLS website, NTREIS.net and my personal websites are all rendering with small glitches now when they worked perfectly in version 8. <br><br> Also sites which launch in new window often come up blank. I have to close the new window and launch again, often several times before it works. <br><br> I'm all for change that makes sense and change that improves the product but IE9 really doesn't seem to do either. Were they trying to have a new release simply because FireFox did?
