When I was with one realty firm I was told that when you give a buyer or seller the brokerage representation forms to sign I should have them sign all 3 forms. The single agent rep form, the consent to transition to transaction broker form and the transaction broker form. This way as long as you don't have a conflict issue you can represent the customer as a single agent. If you run into a conflict situation such as showing a house listed by a co-worker you can easily inform the customer that you now have to transition to a transaction broker. This shouldn't be a problem if you explained the forms correctly when they signed them.  I know there are those of you out there that say "How quickly the customer forgets"!

The broker I work with now has said he is very uncomfortable with this procedure. He feels that we leave ourselves open to lawsuits. Therefore he prefers that we tell the customer that we have to represent them as a transaction brokers only.
