trec: Replace the state's inspector exam? - 03/31/10 06:21 PM
Since the inception of home inspection licensing in Texas in the early 90's the exam taken to qualify for a license has been designed and administered by TREC. Certainly, over the last 10-15 years the test questions have been designed by the Inspector's Advisory Committee to TREC. There is now a motion afoot to replace that proprietary test with one that is referred to as the NHIE (National Home Inspectors Exam). There are certainly pro's and con's of doing such and that's what I'd like Texas inspectors to voice their opinions on. The ostensible reason, explained by a IAC representative, is

For the past 6 years I have attended most all of the TREC Inspector Advisory Committee meetings and reported my observations and meeting notes on the InterNACHI message board as well as my personal company blog, here at ActiveRain and elsewhere. I have also held the semi-official title of InterNACHI Legislative Liaison for Texas (although Regulatory Affairs Representative might be more apropos). I’ve decided it is time to pass the reins on to someone new now. I plan to devote more time and energy to maintaining my inspection business as well as doing a little traveling to visit my kids and

Well, the TREC IAC Subcommittee that is working on the proposed Commentary is planning a teleconference next Tuesday, 2/9. The meeting will be primarily to discuss the Commentary and how to incorporate it into the TREC Rules thereby becoming an 'enforceable' document. The effective result is that the Texas SOP will grow from a huge document to a massive monstrosity. Agenda Item 4. Discussion and possible action to recommend to the Texas Real Estate Inspector Committee posting of sections of the commentary for public comment with the intent to include the commentary sections in the rules of the Texas Real Estate

trec: TREC IAC SOP Subcommittee Meeting - Cancelled - 01/11/10 01:41 PM
The TREC Inspector's Advisory Committee SOP Subcommittee meeting scheduled for this morning at 11:00 am was canceled due to lack of a quorum of the subcommittee members. Members of the full IAC met privately with TREC staff to discuss the logistics of the proposed Commentary and how it might be implemented. The decision has not been reached (at least publicly) as to whether the Commentary will be enforceable or not nor whether it will become part of the existing SOP or if it will be a new Rule or if it will be a stand-alone, non-enforceable, non-rule document for clarification purposes

trec: Attorney General's Opinion - 11/24/09 01:53 PM
In June, TREC requested an opinion from the state Attorney General as to whether TREC has jurisdiction over inspectors who perform inspections for someone other than a Buyer or Seller of real property. The AG handed down his opinion today and the simple answer is No: S U M M A R Y The Texas Real Estate Commission does not have authority under section 1102.401(a), Occupations Code, to take disciplinary action against a person licensed under chapter 1102 if the person has not accepted employment to perform a real estate inspection for a buyer or seller of real property.

The Texas Real Estate Commission has named Texas REALTOR® Doug Oldmixon as its new administrator. Oldmixon, an attorney and founding broker of Spillar Oldmixon Advisors Realty, formerly served as deputy commissioner of the Texas Veterans Land Board. Oldmixon replaces Loretta DeHay who has been acting in the Administrator's position since Tim Irvine resigned late last year. OK, I admit to taking a little literary license with the subject line of this thread. My hyperbole is overstated somewhat (can that be done?) but not by much I don’t think. Here are my notes from the Feb 11th TREC SOP Commentary Sub-Committee meeting: The TREC Inspectors Advisory Committee SOP sub-committee met by teleconference on 2/11/09 to continue work on and drafting of a Commentary to the new 2009 TREC Inspector's SOP. All four of the sub-committee members were in attendance along with four public attendees. The intent of this meeting was to continue agreeing on wording and drafting the Commentary which will then be posted for public comment sometime in the future, probably 4-6 weeks from now or so. Texas Inspectors, The new, 2009 Texas Real Estate Commission Standards of Practice for Home Inspectors states that the inspector shall “Report as deficient…appliances and metal pipes that are not bonded or grounded”. This can be accomplished in several methods. One, the electrical junction box at all appliances like the stove, microwave, range vent hood, furnace, etc, can be located and the cover removed and the ground wire can then be verified. Two, a sophisticated electrical circuit analyzer such as an Ideal SureTest model 165 with the appropriate cord adapters can be used but this method can be cost prohibitive at $330

The Inspector Advisory Committee's SOP Sub-committee met via teleconference on 12/9 to begin the discussions and process of writing a Commentary for the new Inspection Standards of Practice that is due to go into effect 2/1/09. The Commentary will expand upon the language in the SOP, clarify the thinking and intent behind many of the SOP line items and generally attempt to explain, in more layman's terms, what is expected of the Inspector.
