NAR Survey Shows First-Time Home Buyers Set Record in Past Year

First-time home buyers reached the highest market share on record during the past year, according to the latest consumer survey of home buyers and sellers. The study was released here today at the 2009 REALTORS® Conference & Expo.

The 2009 National Association of Realtors® Profile of Home Buyers and Sellers is the latest in a series of large national NAR surveys evaluating demographics, preferences, marketing and experiences of recent home buyers and sellers. Among national surveys, NAR's Profile of Home Buyers and Sellers is unprecedented in size and scope.

Paul Bishop, NAR vice president of research, said several factors have been at play. "Tax incentives, record high affordability conditions and a pent-up demand brought a record share of first-time home buyers into the market," he said. "These buyers are critical to housing and a general economic recovery because the market always heals from the bottom up - they absorb inventory, free existing owners to make a trade and stimulate related goods and services."

The number of first-time home buyers rose to 47 percent of all home sales from 41 percent of transactions in last year's study, and was the highest on record dating back to 1981. The previous high was 44 percent in 1991. "It's interesting to note the last cyclical peak of first-time home buyers was during the last noteworthy economic downturn, with first-time buyers starting the chain reaction that led the nation out of recession," Bishop said.

Ways to fight the Winter Blues

Holidays and Winter Months for some are some of the hardest months to deal with. I know family members that get depressed as winter sets in and the days get shorter and the weather gets gloomy.

I know all of us all of us have lost loved ones and who do we think about during the holidays...well I think of those that have gone on before us, and how much I miss them. Below are some tips I found on Money Pit that will sure help. Enjoy the tips.

And most important is to love those around you, forgive those that have wronged you, pray for those that need our prayers and lastly keep in mind there are far more people less fortunate than us, and do something special to help them. Examples are our countries food banks and homeless shelters have greater demand now than they have had in there history. Lastly take the time to smile and give some praise to a fellow worker ad you never know what that person may be going through.

The long, dark days of winter tend to give project-loving homeowners the blues. But you don't have to wait for spring to arrive or the stock market to soar to get your DIY groove back. A few dollar-wise home improvement projects can spruce up your home and your spirits, and help beat the winter blues.

Best foot forward: Spruce up the front door by polishing door hardware, rolling out a new doormat and making sure porch lights are in order and equipped with fresh bulbs at the maximum wattage allowed by the fixture.
Add color: Plant winter color in porch front containers and strategic spots along walkways or landscape beds.
Inside gardens: Start spring early with planters of forced bulbs or a mini herb garden stationed in a sunny window.
Bright lights: Nothing helps beat the winter blues better than bright lights. Be alert to needs in your indoor lighting scheme, and make additions and adjustments for warm, welcoming comfort throughout your family's waking hours.

Why have good restrictive covenants as well as building design practices on Mountain lands

Below is an article of one of our wonderful communities that I have sold homes in over my 30+ years in the business that now have a legal problem. Interesting when we get buyers to give us a wish list of what they are looking for, I often here I don't want to have too may restrictions, be told how, what and when I have to build, but want a community with character, amenities and an investment that will grow. Naturally everyone that comes to the area wants a long range view, bold flowing creek and level land. We can at times fill this request but more often than not foundation costs can and should be considered when buying.

As many of you may know to build in the mountains can be challenging as not all terrain is as flat as Florida and other parts of the US. In fact we recently sold a home in our company that the foundation costs alone were in excess of $150,000.

Carriage Park in Hendersonville NC, located 40 minutes outside of Asheville has been a successful development geared towards the retirement buyer. Nice location - Hendersonville has repeatedly been noted to be an ideal town to retire to. It has a quaint downtown area with one of a kind shops and restaurants, is close to Asheville and other features of Western North Carolina that are so appealing to many.

The Schaffer Realty Group / Southeast Discovery visited Carriage Park several years ago and made note of the fact they have carried through their marketing promise of putting in amenities and consequently many homes have been built. For those who want an established community with social infrastructure, Carriage Park has been worth a look. Other attributes about Carriage Park that our firm noted was the density of this property. Homes are built up the mountain and lot sizes are rather small making for a tighter neighborhood feel. We also noted that the roads in the neighborhood had some curves to them with homes below.

Creating communities and building homes in Western North Carolina is a bit of an art form. Mountain views are breathtaking but there should be a balance between gentle sloping terrains to get to the home rather than the cliffhanger feels that some properties exhibit. In addition, buyers who are coming from flatter parts of the country need to be aware of build costs that can be hidden in excavation needs necessary to establish a strong foundation for the home to be built correctly if it sits on the side of a mountain. To avoid a surprise down the road, we at Southeast Discovery suggest buyers meet with the developer's preferred builders BEFORE going to contract on their favorite lot choice. Preferred builders that have already built homes inside communities such as Carriage Park are more than capable of giving a verbal estimate of excavation costs which may guide a buyer from choosing one lot over another. Apparently, there are some issues between Carriage Park and a few of the property owners who purchased townhomes to be built within the community. These buyers claim they were not aware of the additional costs necessary for their foundation work. In addition, there has been some challenge on the part of residents within Carriage Park regarding the quality of construction of the homes. We noted when visiting Carriage Park homes built in the community were not comprised of exterior natural materials such as hearty plank woods, stone, and timber beams - attributes of a mountain craftsman style home common to see in higher level communities. Rather, many of the homes at Carriage Park were finished in less authentic materials. Carriage Park's architectural guidelines apparently did not require natural element exterior finishes which allowed home owners to take a less expensive approach ultimately effecting the appearance of the community overall. Some buyers complain that architectural guidelines are too restrictive. However, this is a good example of the benefit of having a well designed master plan and restrictive architectural guidelines for the benefit of the community as a whole. We have contacted Carriage Park for their feedback to this recent news and are awaiting their reply. We would welcome feedback from residents of Carriage Park on their build experience at the community and others who have looked at Carriage Park in consideration of moving to the community. I just returned from a long need vacation (3 years since last one) and loved every minute of it. The 3 ports we entered while on a cruise reminded me why America is the best place in the entire world to live in. At 2 of the ports in Mexico you exit the ship to be greeted by the Mexican military with fully automatic weapons and they looked like they would enjoy using them at any minute. I asked why they needed them from a local and he said they are there to protect us. America is so blessed not be greeted by military at local malls, grocery stores and banks.

At their banks they had at least 2 guards at every bank with shot guns and or American automatic weapons standing outside the bank, and no telling who or what was inside. Once again to protect us?

With this week being Thanksgiving we need to remember why the early settlers risked their lives so they could have freedom. Folks they did this not only for themselves but future generations which we are now one of. The actual first Thanksgiving was is Florida, as when they arrived off the ship they immediately gave thanks for the safe voyage and had a party so to speak, and bringing them to a place where freedom of Worship is allowed. That year around half of them died as life was extremely hard. I ask why do we complain, why are we not thankful? I would venture to say as tough as Real Estate is today with many of our members leaving the business as they can no longer pay the fees to stay in, and some at the brink of loosing there homes and being homeless. What's our excuse for not being thankful for where we live and what God has given us?

I am sure there are many that will read this will almost immediately close it and not read on but for those of us that do, take a minute and be thankful for all that we have. Take a minute and pray for those less fortunate than us, take a minute and ask yourself what I can do to help someone this holiday season, what can I do every day from her on out. I know the income has been awful, expenses of staying in Real Estate continue to go up, but look in your pantry, your closet, your garage at all the stuff we Americans hoard up.

Be kind to others as you never know what they are going through! Empty out those items in your house that you can no longer wear, donate furniture, and donate your time at the food shelters. And most of all take time to thank God for what he has done for you and your family!

What is the qualification of a Primary Residence?

Below is a comment or more of a question to a blog I wrote on the extension of the first time home buyers program and the new credit to entice existing homeowners.

I was asked to remove his comment from my post as he realized it was public and was worried his contact information would be made public, which it wasn't. Gaylord asked an excellent question and in short I fell we all should know this answer to his question. In short he owns 2 homes and which one is his primary residence.

My response was a residence where he lives for greater than 6 months and he should check with his accountaint. What are your thoughts?

Below is Gaylord's question:

You write, "Additionally, the program now gives those who already own a residence some additional reasons to move to a new home. This incentive comes in the form of a tax credit of up to $6,500 for qualified purchasers who have owned and occupied a primary residence for a period of five consecutive years during the last eight years." We hope to clarify an ambiguity.

We have owned A home as primary residence continuously for more than five years and more than eight years, but our present primary residence comprises only the last 3 to 4 years of the period. Thus, our question: When you say "occupied a primary residence" does than require it to be one specific primary residence that qualifies, or can we link two primary residences to satisfy the time standard?

We wish to liquidate present home equity and reinvest a large part of the equity liquidated in a new home, taking out some of the equity to replace our loss incurred in the last 3 or 4 years in investment savings. We are 75 and 70 years of age, without current earnings income.

Our History
     During the 125th anniversary celebration of Transylvania County, NC in 1986, hundreds of people signed a petition encouraging the formation of a county museum. The Jim Bob Tinsley Museum, a non-profit organization, was opened in May 1994 in Brevard, NC. The museum provided free public access to the lifelong collections of Jim Bob and Dottie Tinsley. Artifacts, paintings, drawings, sculptures, engravings, and research materials associated with the ten books Jim Bob Tinsley had published were on display. Bill Tinsley, Jim Bob's nephew, expanded the concept of the museum to include a Family Research Center.
     In 2003, Tony Morrow, Director of the JBT Museum, convened a group of interested individuals and representatives from organizations in Transylvania County, and the Transylvania Heritage Coalition (THC) was formed. The THC, now the ruling body of the Transylvania Heritage Museum, was incorporated by the State of NC and a 501(c)(3) tax-exempt status was received from the IRS. This means donations and other gifts are tax deductible.
     On December 23, 2007, the Jim Bob Tinsley Museum closed, making the space and many assets available for the Transylvania Heritage Museum (THM). Thanks to volunteers as well as Exhibit Planner Anna Fariello of Curatorial Insight, the THM opened in May 2008. It now houses temporary and permanent displays of heirlooms, artifacts, genealogical exhibits, vintage photographs, and other exhibits reflective of the history and heritage of the county.

Home Sales Rise For Record Eight Straight Months

Pending home sales rose again, marking eight consecutive monthly gains - the longest streak since measurement began in 2001, according to the National Association of Realtors®.

The Pending Home Sales is a forward-looking indicator based on contracts signed in September, rose 6.1 percent to 110.1 from a reading of 103.8 in August, and is 21.2 percent higher than September 2008 when it stood at 90.9. The gain from a year ago is the largest annual increase on record, and the index is at the highest level since December 2006 when it was 112.8.

Yun the NAR chief economist said the momentum is understandable. "What we're witnessing is a rush of first-time buyers trying to beat the expiration of the tax credit at the end of this month," he said. "Home values will stabilize sooner rather than over-correcting. That, in turn, will mean wealth stabilization for the vast number of middle-class families and lay the foundation for a durable economic recovery." NAR estimates approximately 3 million renters are now financially well-qualified to buy a median-priced home. "As long as buyers do not overstretch and stay well within their budget, a sizable pent-up demand can be tapped among financially qualified potential buyers," Yun said. "Although the tax credit is greatly reviving the existing home market, new-home sales may continue to struggle as home builders hold back production to drive down inventory. In addition, there remains an ongoing credit crunch for construction loans."

The Pending Home Sales Index in the Northeast slipped 2.0 percent to 83.6 in September but remains 16.9 percent above September 2008. In the Midwest the index rose 8.1 percent to 98.2 in September and is 17.8 percent higher than a year ago. In the South, pending home sales increased 4.9 percent to an index of 109.7 and is 22.8 percent above September 2008. In the West the index jumped 10.2 percent to 143.8 and is 23.7 percent above a year ago.

Yun added that strong near-term reports should not be overstated. "We're clearly not out of the woods because an excess of homes remains on the market despite recent improvements," he said. "Although current inventory is getting closer to price equilibrium, foreclosures will continue to enter the pipeline. An extended and expanded tax credit would help absorb this incoming inventory."

The National Association of Realtors®, "The Voice for Real Estate," is America's largest trade association, representing 1.2 million members involved in all aspects of the residential and commercial real estate industries.

The Pending Home Sales Index is a leading indicator for the housing sector, based on pending sales of existing homes. A sale is listed as pending when the contract has been signed but the transaction has not closed, though the sale usually is finalized within one or two months of signing.

The index is based on a large national sample, typically representing about 20 percent of transactions for existing-home sales. In developing the model for the index, it was demonstrated that the level of monthly sales-contract activity from 2001 through 2004 parallels the level of closed existing-home sales in the following two months. There is a closer relationship between annual index changes (from the same month a year earlier) and year-ago changes in sales performance than with month-to-month comparisons.

An index of 100 is equal to the average level of contract activity during 2001, which was the first year to be examined as well as the first of five consecutive record years for existing-home sales.

A forecast for housing and the economy will be released November 13 at 11 a.m. PST at the 2009 REALTORS® Conference & Expo in San Diego. Existing-home sales for October will be reported November 23 and the next Pending Home Sales Index will be on December 1; release times are 10 a.m. EST.

First Time Homebuyer Tax Credit Extended into 2010 With Additions Favorable to A greater Mass of people! And A New Tax Credit for Certain Existing Home Owners!

It's official. President Obama has signed a bill that extends the tax credit for first-time homebuyers (FTHBs) into the first half of 2010. This program had been scheduled to expire on November 30, 2009.

In addition to extending the tax credit of up to $8,000 through June 30, 2010, the extension measure also opens up opportunities for others who are not buying a home for the first time.

So Who Gets What?
The program that has existed for FTHBs remains intact with the one exception that more people are now eligible based on an increase in the amount of income someone may now earn.

Additionally, the program now gives those who already own a residence some additional reasons to move to a new home. This incentive comes in the form of a tax credit of up to $6,500 for qualified purchasers who have owned and occupied a primary residence for a period of five consecutive years during the last eight years.

Deadlines
In order to qualify for the credit, all contracts need to be in effect no later than April 30, 2010 and close no later than June 30, 2010.

Higher Income Caps in Effect
The amount of income someone can earn and qualify for the full amount of the credit has been increased.

Single tax filers who earn up to $125,000 are eligible for the total credit amount. Those who earn more than this cap can receive a partial credit. However, single filers who earn $145,000 and above are ineligible.

Joint filers who earn up to $225,000 are eligible for the total credit amount. Those who earn more than this cap can receive a partial credit. However, joint filers who earn $245,000 and above are ineligible.

Maximum Purchase Price
Qualifying buyers may purchase a property with a maximum sales price of $800,000.

First-Time Homebuyer Tax Credit - Frequently Asked Questions
Here are answers to some commonly asked questions about the tax credit.

What is a tax credit?
A tax credit is a direct reduction in tax liability owed by an individual to the Internal Revenue Service (IRS). In the event no taxes are owed, the IRS will issue a check for the amount of the tax credit an individual is owed. Unlike the tax credit that existed in 2008, this credit does not require repayment unless the home, at any time in the first 36 months of ownership, is no longer an individual's primary residence.

What is the tax credit for first-time homebuyers (FTHBs)?
An eligible homebuyer may request from the IRS a tax credit of up to $8,000 or 10% of the purchase price for a home. If the amount of the home purchased is $75,000, the maximum amount the credit can be is $7,500. If the amount of the home purchased is $100,000, the amount of the credit may not exceed $8,000.

Who is eligible for the FTHB tax credit?
Anyone who has not owned a primary residence in the previous 36 months, prior to closing and the transfer of title, is eligible. This applies both to single taxpayers and married couples. In the case where there is a married couple, if either spouse has owned a primary residence in the last 36 months, neither would qualify. In the case where an individual has owned property that has not been a primary residence, such as a second home or investment property, that individual would be eligible.

As mentioned above, the tax credit has been expanded so that existing homeowners who have owned and occupied a primary residence for a period of five consecutive years during the last eight years are now eligible for a tax credit of up to $6,500.

How do I claim the credit?
For those taking advantage of the tax credit in 2009, you may choose to either apply for the credit with your 2009 tax return or you may apply for the credit sooner by filing an amended 2008 tax return with Form 5405 (http://www.irs.gov/pub/irs-pdf/f5405.pdf).

Can you claim the tax credit in advance of purchasing a property?
No. The IRS has recently begun prosecuting people who have claimed credits where a purchase had not taken place.

Can a taxpayer claim a credit if the property is purchased from a seller with seller financing and the seller retains title to the property?
Yes. In situations where the buyer purchases the property, even though the seller retains legal title, the taxpayer may file for the credit. Examples of this would include a land contract, contract for deed, etc. According to the IRS, factors that would demonstrate the ownership of the property would include: 1. the right of possession, 2. the right to obtain legal title upon full payment of the purchase price, 3. the right to construct improvements, 4. the obligation to pay property taxes, 5. the risk of loss, 6. the responsibility to insure the property and 7. the duty to maintain the property.

Are there other restrictions to taking the credit?
Yes. According to the IRS, if any of the following describe your situation, a credit would not be due.

You buy your home from a close relative. This includes your spouse, parent, grandparent, child or grandchild.
You do not use the home as your principal residence.
You sell your home before the end of the year.
You are a nonresident alien.
You are, or were, eligible to claim the District of Columbia first-time homebuyer credit for any taxable year. (This does not apply for a home purchased in 2009.)
Your home financing comes from tax-exempt mortgage revenue bonds. (This does not apply for a home purchased in 2009.)
You owned a principal residence at any time during the three years prior to the date of purchase of your new home. For example, if you bought a home on July 1, 2009, you cannot take the credit for that home if you owned, or had an ownership interest in, another principal residence at any time from July 2, 2006, through July 1, 2009.

Can you buy a home from a step-relative and be eligible for the credit?
Yes. Provided the person you are buying a home from is not a direct blood relative, the purchase would be allowed.

Can parent(s) who will not live in the property cosign for a mortgage for their child and the child that is a qualifying FTHB still be eligible for the credit?
Yes.

Can a separated spouse who has not owned a home for four years qualify for the FTHB tax credit if the spouse has owned a property anytime in the last three years?
No. However, the spouse may be eligible for the repeat buyer credit. The best path to take in any situation regarding income taxes is to speak with a professional tax preparer or CPA.
