Let's play the blame game. It's simple. I will give you the scenario, you tell me who is to blame.
Phil is the selling agent on 123 Street. Suzie is the listing agent on 123 Steet. John is the buyer on 123 Street.  John(buyer) calls Phil a year later after buying the house and complains about a water leak. Phil sends a licensed contractor to the house and finds that there is more than just a water leak issue. Realtors are losing deals to low appraisals. That is a problem and a fair complaint in considering the argument. Perhaps we need to look more at the root of the problem to determine the solution.

We knew this was coming, and as it is likely to be just the beginning in response to the continued rise in bank owned properties. We have new disclosures now to be applied to REO properties in California and it will require more from the agents.
Bank owned properties (REO's) are usually a haven for major repair issues, structural damage, and code violations. Disclosures concerning property conditions have been considered loose, at best. Let's just deal with this. Moral fraud might be the hidden crime that nobody knows how to address in the real estate industry. 
In real estate circles legal fraud is often associated with predatory lending and the misleading tactics of banks in persuading investors and potential homeowners to purchase bad loans. Fraud is defined as an intentional deception made for personal gain or to damage another individual.
In order for an act to be considered fraud under common law there are certain criteria that must be met.

An El Nino advisory was issued in California and the wet winter could cause delays in your real estate transactions and slow the real estate market in Southern California even more than currently it is.

I recently came across a unique website. The site features blog posts where people actually submit real life horror stories of less than honest sales transactions. The posts do not mention the organization or people by names, but still can be quite enlightening with details.  They even have a "Hall of Shame" for the worst stories of sales deceit and lies.

Recently, I have been talking to a lot of REALTORS® about the type of services they really want their "repairman/ handyman" contractor to provide. I talked to a REALTOR® yesterday that pretty much summed up what REALTORS® have been telling me with the comment, "Just don't **** up escrow."Some other responses: "...repairs done quickly, so that it does not hold up escrow." inspections: "We Just Open Doors!" Really? - 10/15/09 03:29 PM
I was talking to a Realtor friend about a recent job we did on a balcony deck at a property.  The house was in escrow and the termite report came back with section1 wood rot. The bank called out a contractor to bid the repair. The realtor suggested us for a second bid. When inspecting the deck we noticed that bondo was applied on the deck to “repair” previous damage. We checked the records and exactly one year ago the house was sold and the repair was made likely to cure a section1 item. Why bondo? It's cheaper than replacing the … (2 comments)

inspections: Who is responsible for REO disclosures? - 09/07/09 07:28 PM
I recently had a conversation with an agent regarding their REO listings, specifically, who was responsible for disclosures in regards to the condition of the property. The agent made it very clear to me that they were not a licensed inspector and it was the responsibility of the buyer to get a thorough inspection. After all, “the properties are being sold “as is”, the buyer understands that they are buying an REO and the property will have unknown defects (reiterating) I am not an inspector, that is not my responsibility.”
