liabilities: How to Hand an Inspection Report to a Buyer Blindfolded - 03/19/10 03:11 PM
I was recently at a meeting with a large group of Realtors where the invited guest was an attorney. He spoke specifically about real estate agents and brokers responsibilities in conducting a reasonably competent and diligent visual inspection of a property. He spoke about the agent's professional duties in representing their clients and mentioned the importance of a physical inspection by a qualified home inspector. He covered the anxiety issues that agents have when inspectors come on the property and fears of agents' buyers walking away from potential sales. He said not to worry, once the report comes in, just hand the

liabilities: The Realtor Blame Game... Who is Responsible in a Real Estate Transaction? - 02/11/10 03:54 PM
Let's play the blame game. It's simple. I will give you the scenario, you tell me who is to blame. Phil is the selling agent on 123 Street. Suzie is the listing agent on 123 Steet. John is the buyer on 123 Street. John(buyer) calls Phil a year later after buying the house and complains about a water leak. Phil sends a licensed contractor to the house and finds that there is more than just a water leak issue. It is apparant that the roof was patched improperly, in fact, it is clear that the roof should never have passed a roof certification when the house was

liabilities: Realtors must water the grass of real estate industry. - 11/06/09 06:12 PM
One thing about this market, it brings out the worst side of people," she said. This is a a Realtor's recent comment to me about another Realtor. She was referring to a difficult escrow due to the other agent going back on her word on a verbal agreement. I believe that as in any situation, when stress is applied (and money is involved), the true substance of an individual comes out... for better or worse. "The grass is not, in fact, always greener on the other side of the fence. Fences have nothing to do with it. The grass is greenest where

liabilities: "We Just Open Doors!" Really? - 10/15/09 03:29 PM
I was talking to a Realtor friend about a recent job we did on a balcony deck at a property. The house was in escrow and the termite report came back with section1 wood rot. The bank called out a contractor to bid the repair. The realtor suggested us for a second bid. When inspecting the deck we noticed that bondo was applied on the deck to “repair” previous damage. We checked the records and exactly one year ago the house was sold and the repair was made likely to cure a section1 item. Why bondo? It's cheaper than replacing the

liabilities: Who is responsible for REO disclosures? - 09/07/09 07:28 PM
I recently had a conversation with an agent regarding their REO listings, specifically, who was responsible for disclosures in regards to the condition of the property. The agent made it very clear to me that they were not a licensed inspector and it was the responsibility of the buyer to get a thorough inspection. After all, “the properties are being sold “as is”, the buyer understands that they are buying an REO and the property will have unknown defects (reiterating) I am not an inspector, that is not my responsibility.” I personally know this agent as one who would normally have
