Mortgage Forgiveness Debt Relief Act and What it Means to You

In 2007, Congress passed the Mortgage Forgiveness Debt Relief Act. Due to the number of foreclosures and homes sold as short sales, Congress passed the Mortgage Forgiveness Debt Relief Act so that homeowners facing distressed property sales wouldn't be taxed on the cancelled debt.

What is Cancellation of Debt?
If you borrow money from a lender and the lender later cancels or forgives your debt, you may have to include the cancelled amount in income for tax purposes. The lender is usually required to report the amount of the canceled debt to you and the IRS.

Here is a simplified example: You borrow $200,000 and default on the loan after paying back $100,000. If the lender doesn't collect the remaining debt from you, there's a cancellation of debt of $100,000. This income is generally taxable income to you.

Is Cancellation of Debt income always taxable?

The Mortgage Forgiveness Debt Relief Act expires on December 31, 2012. Therefore, if you are a Seller who may need to sell your property as a short sale, the time to start that process is NOW! Short Sales typically take 4-6 months to process for Lender Approval. While the possibility does exist that the law may be extended, there is no guarantee and time may be running out. As of this writing, your transaction must close on or before December 31, 2012 or you may incur significant tax liabilities.

Tips for Negotiating the Best Offer on Your Home

So, you listed your home for sale and you've received an Offer to Purchase, or perhaps multiple Offers. What is the best way to analyze the Offer? What should your response to the buyer be? Your Realtor can offer you guidance but ultimately the decision is yours to make. In order to help you formulate the best response, below are some helpful tips for negotiating the best offer on your home.

1) Understand how the process works - When you receive an offer, you can accept, reject or respond with a counter offer, which is a modification of the terms they've presented to you.

2) Decide what is important to you - In advance, decide what terms of the sale are most important to you. Perhaps you need a quick closing or maybe you need a certain amount of money to pay off your existing mortgage. Allow yourself to be flexible on as many terms of the Offer to Purchase as you can be. That way, you'll have a higher likelihood of putting the transaction together.

3) Don't take the offer personally - Home buying and selling is an emotional process but put simply, it is a business transaction. If a buyer lowballs and says it's because they need to update the 1940's kitchen and bath, don't be offended. Everyone has different likes and dislikes when it comes to home style, color, flooring, kitchen and bath design, etc. If the buyer is expressing interest in the home, carefully listen to how they've arrived at their purchase price and don't be too quick to discount it.

4) Review all terms of the offer - Often sellers will focus on the purchase price and not carefully consider the other terms of the offer. Is the proposed closing date acceptable? Has a pre-approval letter been attached to the offer so that you know the buyer has the ability to obtain a mortgage? Is the buyer asking for the seller to pay closing costs? Do they want the appliances or drapes? Review the amount of earnest money the buyer intends to deposit in escrow to determine whether it's sufficient to bind them in the transaction.

After reviewing every facet of the Offer to Purchase, determine which ones are acceptable, which ones can be re-negotiated, and which ones are deal breakers.

5) Think outside the box - Let's say you received an offer that is unacceptable. Instead of rejecting it, think about how you can creatively work out the terms of the transaction so that they're acceptable to both parties. Ask questions to help you determine what the buyer needs/wants most from the transaction. Maybe they need to close in a short amount of time. In this case, you might remain firm on your price but offer a quick closing. Perhaps they are moving from out of state and aren't bringing any appliances with them. Offering to include the kitchen and laundry appliances may make a difference. If the buyer was gushing about your custom window drapes, consider including them in the sale but, in turn, stay firm on a component of the transaction that is important to you.

In conclusion, to successfully negotiate the sale of your home, listen carefully to your Realtor, try not to let your emotions get in the way, carefully analyze all terms of the Offer and, most of all, remain flexible and creative!

Pepperell MA - Old Paper Mill Torn Down

After sitting vacant for many years and in very poor condition, the old paper mill, sited on approximately 12 acres in downtown Pepperell, MA, has been torn down. Quite a few proposals have been set forth over the years to develop the site but today's economy has made it a difficult proposition. In hopes of making the site more desirable to investors, the extensive mill site has been reduced to a pile of rubble.

Overlooking the Nashua river and just below a dam on the other side of Main street, the first paper mill was established around 1834 and the Pepperell Paper Company was the final successor to a series of companies that have operated the mills until it closed in 2002.

The Disappearing Closing Gift

This past Friday, I had a closing on a marvelous new construction home located in Groton, MA. This lovely cape style home with 2 car attached garage was built by an outstanding builder, Peter Andrews.

As a closing gift, I got the new homeowner a gorgeous hanging basket for their front porch. They absolutely loved it and the husband immediately went out to buy a hook in order to hang it. You can imagine my surprise when the buyer calls me shortly thereafter and says, "Catherine, did you happen to come by and take the plant with you thinking we might not be here this weekend?" I replied, "No, why?" She then goes on to tell me that someone drove directly across the newly seeded lawn, took the plant off of the front porch, and drove off leaving ruts in their new front lawn. This all happened while she was in the house! Groton is a very quiet rural community with a very low crime rate. Who would have the audacity to drive over someone's lawn and take a plant off of their front porch? It was gorgeous but really folks, what kind of message are you sending to your new neighbor when they can't even keep a nice hanging basket on their front porch? Drive over the front lawn? If you're going to tresspass and steal, can you at least use the driveway?

On a similar note, does every town have a "bulb thief"? I was recently at a property that has beautiful perennial flower beds. While I was being given the tour, we noticed that someone had come onto the property, stolen a rare perennial and didn't even have the decency to re-distribute the soil. They left a huge hole and didn't even try to hide the fact that they had obviously been dug up.

So, I'm ready to take a nice neighborhood drive to see who has that hanging flower basket and reclaim it for my client. What would you do?

The good news is that Groton, MA is a lovely town. Rich in history, it still maintains its rural and agriculturally based roots. I'm sure that my client will enjoy living in their new home for many years to come!

FHA "Bridal Registry" Downpayment Program

Recently, I read a blog by Rebekah Radice, titled "Newlyweds say "I DO" to FHA Bridal Registry Gift Funds". I hadn't heard of this FHA Program before, so I did a little research and found out the following:

The FHA Bridal Registry program was originally introduced in 1996 but it still remains a little known fact when it comes to down payment assistance.

HERE IS HOW IT WORKS

Register with a bank and open an interest bearing savings account prior to the wedding
Then, your family and friends can make gift payments into the account on your behalf
All of the gift funds can go towards the FHA required 3.5% down payment
Anyone with an interest in the purchase cannot be party to the gift funds (i.e. seller, mortgage consultant, realtor, etc.)
There is no requirement that you be married prior to closing on your new home

Rebekah Radice further explains, "Another huge advantage is that there are no gift letters or other documentation required other than proof of your savings account named "bridal registry account." It's that simple!"

So, potential home-buyers, if you're engaged to be married, I encourage you to check out this great, creative way to start saving a down payment on a home by opening a "Bridal Registry Account".

Pepperell MA Farmers' Market - 2011

Pepperell, MA Farmers' Market - 2011

One of the things that I like about Pepperell, MA is their rich history as an agricultural community. In 2007, the Pepperell Agricultural Board along with the Prescott Grange started the Pepperell Farmers' Market as a place for local farms to sell their wares. A large variety of fresh picked produce can be found including heirloom tomatoes, sweet corn, greens and lettuces, fresh herbs, blueberries and apples. You can also find grass fed beef, local eggs, honey, local cheeses, fresh baked bagels, fresh baked breads and scones. Several local artisans also attend the Pepperell Farmers' Market on a regular basis as well as live musicians playing toe-tapping music.

Market days will be held each Saturday Morning, 9:00 to 1:00 on the town field. According to the Farmers' Market Website, there will be one market date in June this year, then a break for the 4th of July, after which the Market will run every Saturday into October. Homestead Act - Changes Take Effect in March 2011

Important amendments were made in December 2010 to the Homestead Act (Mass. General Laws, Ch. 188) and go into effect on March 16, 2011. The Homestead Act gives homeowners protection against subsequent attachment, suit, or bankruptcy to the extent of $500,000 of equity per residence, per family. This legal document, called a Declaration of Homestead, is filed at the registry of deeds, at time of purchase of a primary residence. It's important to note that while a Declaration of Homestead can protect the equity in many cases, tax obligations and child/spouse support obligations are not covered.

One of the most significant changes to the Homestead Act is that homeowners are now allowed to maintain the same Homestead protection on the proceeds of the sale. The protection is available for a period of one year from the time of the sale, or when a new primary residence is purchased, whichever happens first.

If you want to obtain the maximum coverage of $500,000, you need to file the Declaration at the registry of deeds. Otherwise, there will be an automatic coverage amount of $125,000 without filing.

Other changes to the Homestead Act include protection for homes held by a trust, that a new Declaration is unnecessary after refinancing, and it prohibits lenders from requiring a waiver or release of the Homestead. Lastly, four-family homes will qualify for Homestead protection and closing attorneys must inform buyers of their right to file a Declaration of Homestead.

If you filed a homestead declaration prior to March 16, 2011, your $500,000 protection will continue to apply.

Obama Administration Releases Guidelines for Market Recovery

On February 11, 2011, the Obama Administration released housing finance market guidelines for economic market recovery. The report emphasizes bringing private capital back into the market and winding down Fannie Mae and Freddie Mac's investment portfolio. Allowing the private sector to take back a portion of the market share will dilute the "risk aversion" factor and reduce government risk. "This is a plan for fundamental reform to wind down the GSEs, strengthen consumer protection, and preserve access to affordable housing for people who need it," said Treasury Secretary Tim Geithner. "We are going to start the process of reform now, but we are going to do it responsibly and carefully so that we support the recovery and the process of repair of the housing market."

Protecting consumers during this period of finance reformation is critical for full economic recovery to be possible. The plan includes stronger consumer protection, increased transparency for investors and improved underwriting standards. National Association of Realtors (NAR) President, Ron Phipps states, "NAR believes that we cannot have a restoration of the former secondary mortgage market with entities that took private profits while pushing losses onto the taxpayer. The new system must involve some government presence, outside of FHA, USDA, and the Department of Veterans Affairs, to ensure a continued flow of capital to housing markets during economic downturns when large lenders flee the housing market." He goes on to say, "We believe there must be a certain level of government participation to provide middle-class families access to affordable mortgages at all times and in all markets." Strengthened anti-predatory lending protections, improved underwriting standards, as well as stricter mortgage disclosure requirements are part of the Adminstration's plan. The goal is to provide consumers with the best knowledge possible so that they are making sound decisions regarding mortgages.

In addition, the Administration hopes to reform and restructure the role of the Federal Housing Administration (FHA) with measures to support rental housing by offering lending options to the multi family market and programs for smaller properties. "This report provides a strong plan to fix the fundamental flaws in the mortgage market and better target the government's support for affordable homeownership and rental housing," said Housing and Urban Development Secretary, Shaun Donovan. "We must continue to take the necessary steps to ensure that Americans have access to quality housing they can afford. This involves rebalancing our housing priorities to support a range of affordable options, from promoting much-needed financing for quality, affordable rental homes to ensuring the availability of safe, and sustainable mortgage products for current and future homeowners."

Long term reform issues include determining the best course of action and careful analysis of the government's future role in the housing market. Let's hope, that going forward, the proposed finance market guidelines result in economic recovery and affordable mortgage loan options.

FHA Loans: Two Lenders Revise Requirements

According to an article I read by Ken Harney with Inman News, Wells Fargo and Quicken Loans, two of the largest FHA-approved lenders, have revised their lending standards. Purchasers with 3.5% down and a credit score of 580 can now qualify for a FHA loan. Previously, Wells Fargo and Quicken Loans had "overlay" requirements on FICO Scores which were more stringent than FHA requirements. The revised guidelines are now similar to typical FHA loan guidelines.

This is good news for purchasers with credit scores that suffered due to current economic conditions and opens the door to qualifying for a home purchase.

"Desire to Own a Home" Top Motivating Factor for Purchasing a Home in 2010

I recently read a Massachusetts REALTOR® Study Report in which they state that the "desire to own a home" was the top motivating factor cited by home buyers for the purchase of a home in 2010. Below, is a breakdown of survey responses of first-time and repeat home buyers:

While 55% of all homes sold in Massachusetts were made by first time home buyers, only 7% stated it was because of the home buyer tax credit.

The study also showed that the median age of a first-time homebuyer is 32 vs. 30 years old in 2009.

Do home purchasers think that buying a home is a good financial investment?

46% of all buyers thought their home purchase was a better financial investment than stocks compared to 54% in 2009. 31% of buyers think their home purchase was "at least as good an investment as stocks."

According to the Massachusetts Association of Realtors year-end figures, 2010 sales numbers of single family detached dwellings was down less than 2% while the median sale price increased approximately 4.3% from 2009.

Foreclosure vs. Short Sale and What it Means to You

Facing the prospect of foreclosure or short sale on your home is not easy. So many people are struggling with day-to-day expenses, job loss, health issues and, while it's difficult, you may have to consider how to decrease your debt. If you determine that you must sell your home, or risk foreclosure, Integrity Residential Brokerage, licensed in both Massachusetts and New Hampshire is here to help.

Here is a brief explanation of each process:

Foreclosure - In most cases, a lender obtains a security interest from the borrower who pledges the real estate to secure the loan. When the borrower fails to comply with the terms of the mortgage, the lender has the right to foreclose. Foreclosure is the legal process by which a lender obtains a court ordered selling, or repossessing, of real estate. Furthermore, if the promissory note was made with a recourse clause, if the sale does not bring enough to pay the existing balance of principal and fees, the lender can file a claim for a deficiency judgment.

Typically, a borrower whose home goes into foreclosure will not qualify for an FHA home loan for 5 years.
On any future mortgage application, you must answer "yes" to the question "Have you had a property foreclosed upon or given title or deed in lieu thereof in the last 7 years?"
Some borrowers credit will be impacted more than others for the same payment problem. Your credit score is likely to decrease anywhere between 100-300 points.
Employers often run credit checks on potential employees
Depending on the loan type, banks can go after more money from the homeowner if the sale price doesn't cover the mortgage amount due which is known as a ‘deficiency judgment'.
A Foreclosure can show up on your credit history for 7-10 years.

Short Sale - is a sale of real estate in which the proceeds fall short of the balance owed on the loan. When the borrower can't pay the mortgage loan on their property, the lender may decide that selling the property at a loss is better than proceeding with a foreclosure. This agreement doesn't necessarily release the borrower from the obligation to pay the remaining balance of the loan, which is known as a deficiency, but many times it is possible to negotiate no promissory note or deficiency judgment.

Typically, after 2 years, a homeowner whose home is sold in a short sale will qualify for an FHA loan.
There is no question on a mortgage application regarding whether you've ever done a short sale.
Late payments will show up on your credit report but short sales are usually not reported to the credit bureau.
Ask your lender whether they will report the short sale as "paid less on a settled account" vs. "settled/paid in full" as this could affect your credit score.
Usually, it will take approximately 18 months of consistent, on-time credit payments to restore your credit score.

In conclusion, a Short Sale is far less damaging than a foreclosure. The lender will often allow a short sale if they feel the financial loss is lower than that of a foreclosure proceeding. As a borrower, you can avoid having a foreclosure on your credit report and the short sale process is typically faster and less expensive.

"Things Your Burglar Won't Tell You", Integrity Residential Brokerage, Pepperell, MA

One of my clients, Al, sent me the following article titled "Things Your Burglar Won't Tell You". There are a lot of helpful suggestions so I thought I'd pass it along to you.

1. Of course I look familiar. I was here just last week cleaning your carpets, painting your shutters, or delivering your new refrigerator.

2. Hey, thanks for letting me use the bathroom when I was working in your yard last week. While I was in there, I unlatched the back window to make my return a little easier.

3. Love those flowers. That tells me you have taste... And taste means there are nice things inside. Those yard toys your kids leave out always make me wonder what type of gaming system they have.

4. Yes, I really do look for newspapers piled up on the driveway. And I might leave a pizza flyer in your front door to see how long it takes you to remove it.

5. If it snows while you're out of town, get a neighbor to create car and foot tracks into the house. Virgin drifts in the driveway are a dead giveaway.

6. If decorative glass is part of your front entrance, don't let your Alarm Company install the control pad where I can see if it's set. That makes it too easy.

7. A good security company alarms the window over the sink. And the windows on the second floor, which often access the master bedroom - and your Jewelry. It's not a bad idea to put motion detectors up there too.

8. It's raining, you're fumbling with your umbrella, and you forget to lock your door - understandable. But understand this: I don't take a day off because of bad weather.

9. I always knock first. If you answer, I'll ask for directions somewhere or offer to clean your gutters. (Don't take me up on it.)

10. Do you really think I won't look in your sock drawer? I always check dresser drawers, the bedside table, and the medicine cabinet.

11. Here's a helpful hint: I almost never go into kids' rooms.

12. You're right: I won't have enough time to break into that safe where you keep your valuables. But if it's not bolted down, I'll take it with me.

13. A loud TV or radio can be a better deterrent than the best alarm system. If you're reluctant to leave your TV on while you're out of town, you can buy a $35 device that works on a timer and simulates the flickering glow of a real television.

8 MORE THINGS A BURGLAR WON'T TELL YOU:

1. Sometimes, I carry a clipboard. Sometimes, I dress like a lawn guy and carry a rake. I do my best to never, ever look like a crook.

2. The two things I hate most: loud dogs and nosy neighbors.

3. I'll break a window to get in, even if it makes a little noise. If your neighbor hears one loud sound, he'll stop what he's doing and wait to hear it again.. If he doesn't hear it again, he'll just go back to what he was doing. It's human nature.

4. I'm not complaining, but why would you pay all that money for a fancy alarm system and leave your house without setting it?

5. I love looking in your windows. I'm looking for signs that you're home, and for flat screen TV's or gaming systems I'd like. I'll drive or walk through your neighborhood at night, before you close the blinds, just to pick my targets.

6. Avoid announcing your vacation on your Facebook page. It's easier than you think to look up your address.

7. To you, leaving that window open just a crack during the day is a way to let in a little fresh air. To me, it's an invitation.

8. If you don't answer when I knock, I try the door. Occasionally, I hit the jackpot and walk right in.

PROTECTION FOR YOU AND YOUR HOME

If you don't have a gun, here's a more humane way to wreck someone's evil plans for you. (I guess I can get rid of the baseball bat.)

WASP SPRAY

A friend who is a receptionist in a church in a high risk area was concerned about someone coming into the office on Monday to rob them when they were counting the collection. She asked the local police department about using pepper spray and they recommended to her that she get a can of wasp spray instead.

The wasp spray, they told her, can shoot up to twenty feet away and is a lot more accurate, while with the pepper spray, they have to get too close to you and could overpower you. The wasp spray temporarily blinds an attacker until they get to the hospital for an antidote. She keeps a can on her desk in the office and it doesn't attract attention from people like a can of pepper spray would. She also keeps one nearby at home for home protection.

FROM ANOTHER SOURCE

On the heels of a break in and beating that left an elderly woman in Toledo dead, self defense experts have a tip that could save your life.

Val Glinka teaches self-defense to students at Sylvania Southview High School. For decades, he's suggested putting a can of wasp and hornet spray near your door or bed.

Glinka says, "This is better than anything I can teach them." Glinka considers it inexpensive, easy to find, and more effective than mace or pepper spray. The cans typically shoot 20 to 30 feet; so if someone tries to break into your home, Glinka says, "spray the culprit in the eyes". It's a tip he's given to students for decades. It's also one he wants everyone to hear. If you're looking for protection, Glinka says look to the spray. "That's going to give you a chance to call the police; maybe get out."

PUT YOUR KEYS BESIDE YOUR BED AT NIGHT

Tell your spouse, your children, your neighbors, your parents, your Dr.'s office, the check-out girl at the market, everyone you run across. Put your car keys beside your bed at night.

If you hear a noise outside your home or someone trying to get in your house, just press the panic button for your car. The alarm will be set off, and the horn will continue to sound until either you turn it off or the car battery dies. This tip came from a neighborhood watch coordinator. Next time you come home for the night and you start to put your keys away, think of this: It's a security alarm system that you probably already have and requires no installation. Test it. It will go off from most everywhere inside your house and will keep honking until your battery runs down or until you reset it with the button on the key fob chain. It works if you park in your driveway or garage. If your car alarm goes off when someone is trying to break into your house, odds are the burglar/rapist won't stick around. After a few seconds all the neighbors will be looking out their windows to see who is out there and sure enough the criminal won't want that. Remember to carry your keys while walking to your car in a parking lot. The alarm can work the same way there. This is something that should really be shared with everyone. Maybe it could save a life or a sexual abuse crime.

Would also be useful for any emergency, such as a heart attack, where you can't reach a phone. My Mom has suggested to my Dad that he carry his car keys with him in case he falls outside and she doesn't hear him. He can activate the car alarm and then she'll know there's a problem.

True Story: My Daughter was Lured with a Text Message!!!!!

I don't use the text feature on my cell phone much but I do know some people text all the time ~ especially teens. Sarah Moore offers great advice on why "not" to rely on text messages but to always confirm with a phone call. Read this true story about her daughter being lured into a secluded location via text messaging.

Today,everyone has a mobile phone. If you are like most, you LOVE TO TEXT! I will admit that I had not really enjoyed texting until this past year but found out convenient it is!

My teenager daughter texts all the time, to my frustration! Recently her phone stopped working and we had to get her a new phone. Unfortunately...the phone that we got her, an IPhone did not transfer the contacts saved on her SIM card. She took the phone to school and at lunch ask all of her friends to re-enter their information into her phone. (NOTE: She is a senior and he has gone to the same school for 13 years with the pretty much the same kids since kindergarten). So one by one they entered their information. Horray...now she was back up and running without much interruption.

A couple of days later, she was...as usual texting all morning...even caught her texting during church (I knew I should have taken that darn phone)! After church she continued texting all afternoon. Early evening she planned on going to the Rodeo with friends....they had made plans via text. One friend said that he was at a friends house and really wanted to go but had no ride. He offered to give her gas money if she would pick him up.

This also happens all the time within this friend group. She agreed, even though she knew that he lived about 25 minutes away in a neighborhood that alot of her classmates live. He told her his friends address and we mapquested it. She told me she was headed to pick him up and I questioned why she had agreed to go so far. Unfortunately, he did not tell her he was a bit further away and infact the address was over 35 minutes from our house.

With Directions in hand, she headed out telling us she would pick him up and head to the rodeo and be home around 11p.m. About an hour and half passed and she appeared at home hysterically crying....

WHATE HAPPENED NEXT TERRIFIED ME!!!! She went to the address he had supplied, when she pulled into the neighborhood, she realized it was a neighborhood under construction and several homes were vacant, including the one that she pulled up to. She stated it looked finished but she knew it was vacant because there were no window treatments (Must be the daughter of a realtor) and she could see there was no furniture in the home.

Once in the driveway she received a text from her friend and he said, "I gave you the wrong house, I am down the street at the last house on the right". She followed his directions and went to the house as directed. When she pulled into the driveway, she received a text "I'm out back...come back here".

Well, this is where my daughter had a Bit of Stupid.....she got out of the car and headed to the back of this vacant, secluded home....BUT!!!! She got irritated and decided she was not going back there afterall and got back in her car and texted him...."I'm here....quit playing around and get out here or I am leaving you!" He again requested she come to the back of the secluded house. She refused and told him again she would leave if he did not come out.

Irritated she left and headed home!

She was so mad when she left that she texted her friends to tell what he had done. To her surprise, he was with them....YES! He said that he had been with them all day and that HE HAD NOT BEEN TEXTING HER. They argued and finally they realized.....he had put in the wrong number in her phone. When he typed it in he was off by one digit.

SHE HAD BEEN TALKING TO A STRANGER ALL DAY! THE STRANGER HAD ASK HER VERY VAGUE QUESTIONS AND WHEN WE WENT BACK TO HER TEXT HISTORY...HE HAD FOUND OUT QUITE A BIT ABOUT HER INCLUDING HER ADDRESS....HE WAS SMOOTHE...HE HAD GOTTEN HER ALMOST TO THE BACK OF THE VACANT HOME!

We called the Police and they gave me this valuable advise:

NEVER AGREE TO MEET ANYONE VIA A TEXT MESSAGE UNTIL YOU CONFIRM THAT THE PERSON YOU ARE TEXTING IS ACTUALLY THE PERSON YOU PLAN TO MEET. ANYONE CAN GET AHOLD OF SOMEONE ELSES PHONE...FOR EXAMPLE...SOMEONE GETS MY HUSBANDS PHONE AND TEXTS ME....I THINK I AM TALKING TO HIM WHEN INFACT IT IS NOT HIM.

Folks, this is dangerous stuff.. The person who lured my daughter did not know her, was obviously watching her as he knew exactly when she pulled up at each home. I shutter to think what may have happened. I am so thankful that she told me later, she had a bad feeling about going to the back of the house and that is why she got back in her car.

OUR NEW RULE: VOICE CONFIRMATION THAT YOU ARE TALKING TO WHO YOU ARE TEXTING!

Be safe and remember, texting has dangers especially in our business.

Did you know your iPhone can help get you robbed? My past clients didn’t until now!

While I don't have an iPhone, I thought the information that Todd Clark recently shared with me was worth passing along. If you own an iPhone and take pictures with it, read below!

Seems when of my past buyers almost got robbed recently and it looks like it maybe all do to their iPhone and their iPhone camera. Now, they were very careful not to ever use FourSquare at home and they never published their address anywhere. The fact is everything they had via mail went to a PO Box at the local post office.

But, what they didn’t realize was every picture they took with their iPhone that the uploaded was Geotagged and gave the exact location of the photo. So, when someone started watching Twitter and saw they were out and looked at their other pictures, they figured out exactly where they lived by the pictures from inside their home that now gave the exact location on Google.com.

Lucky for them, their neighbor spotted something was unusual and nothing was taken, but a window was damaged and the security and peace of mind have been violated. So, please be careful when taking your pictures on your phone and might I suggest you turn off auto-Geotagging.

Selling Your Home During the Winter Months

Here in New England we are blessed with 4 seasons and we're coming up on winter. Whether you're a REALTOR or the average person, I'm sure you've heard this statement "I'm going to take my house off the market because no one is looking to buy during the winter." Or, how about this? "I'm going to wait until spring to put my house on the market when there are more buyers looking and prices are higher." While on the face of things, these statements may seem logical, let me point out a few reasons why it may not make sense to wait.

Let's take a look at the first statement:

No one is looking at houses during the winter - Interestingly, we aggressively market and sell property year round but Integrity Residential Brokerage closed more homes from October - February than during the spring. I find that serious, well qualified buyers look at housing year round.

Less inventory = Less competition: That means that those "serious, well qualified buyers" that are looking at homes will have less to choose from. Your home will have less competition which may, in fact, result in a better sale price.

Young home vs. new construction: Perhaps you own a young home and you've been competing against aggressively priced new construction. During the winter months, unless the foundation has already been poured, construction of a new home is quite difficult. Your young home now looks mighty attractive for someone who needs to move now!

Relocation Buyers: Statistically, more relocations happen in January than any other month. This is an excellent source of potential buyers that you may be missing, if you're waiting until spring.

Less showings: You may get less showings but the folks viewing your home are likely serious, well qualified buyers, who want to move now.

Now, let's take a look at the second statement:

I'm going to wait until spring when there are more buyers and prices are higher - Waiting until spring to market your home may result in more showings but how many of those are motivated to buy at that time? Typically, in the spring, we'll see buyers who are thinking of moving, have a house to sell, haven't been pre-approved, or want to consider owning vs. renting.

Are prices going to be higher in the spring? Only time will tell but I wouldn't count on it. During the past couple of years, values have been declining markedly. Who Said it was a Buyer's Market?

Who said it was a buyer's market? Often, when I speak with potential buyers, they enter the market expecting to get huge discounts on properties that are being marketed for sale or they're waiting for market values to drop further. Television, newspaper articles, and 'get rich schemes' marketed through the Internet and TV all tout the ease with which a person can buy for "pennies on the dollar".

While a person can sometimes get a good deal, more often than not, in order to move from looking to buying you have to get realistic along the way. Not every "good deal" is a good deal. Let's also consider that in order to purchase a home at this time, you typically need to be a cash buyer, a W2 employee with verifiable income, possess a solid credit history, and have an excellent FICO score.

So, let's take a closer look at what defines a Buyer's market. A Buyer's market is when there are more properties for sale than people interested in buying them. Buyers have more choices and less competition which typically results in lower prices.

There are plenty of bank-owned foreclosures being offered at bargain prices. Does this make it a Buyer's Market? What you may not be aware of is that you are competing against a very large group of purchasers who are just waiting for new properties to become available. In most cases, the absurdly low list price is utilized to generate tremendous traffic on the property which drives the price significantly upwards. Expect that multiple offers will be submitted to the lender - many of which are cash purchasers. Does this scenario match the definition of a Buyer's Market? Nope!

To further analyze the purchase of a bargain basement property, let's also consider that the property is most likely being purchased "as is" and that unknown repair costs could exceed the fair market value. So, proceed carefully and utilize the services of an experienced buyer agent who can counsel you on what constitutes a strong Purchase Agreement, help you compile repair estimates, and determine whether the market value of the home after repair is lower than, meets, or exceeds the expenses you've incurred in purchasing and re-habbing the property.

Well-priced homes combined with outstanding interest rates make this a great time to purchase a property. Don't get caught up in whether it's a buyer's market but focus instead on property that meets realistic goals.

The Chicken and the Egg of Real Estate

Very often, home buyers want to start looking at property prior to speaking with a lender. Read on for reasons why it is so important to speak with a lender before you start looking at homes.

The chicken and the egg. Which comes first? When a potential buyer calls and wants me to show them a home, one of my first questions I ask is are you pre-approved for a loan? The reason for this question is simple. If I don't know what you are qualified for, I will have no idea what homes I can show you.

Buyers, I know this may not be what you want to hear, but you MUST get pre-approved for a loan before asking to be shown homes. Your pre-approval letter contains very important information.

The maximum purchase amount - It makes no sense whatsoever to show you homes that are above the maximum purchase amount you qualify for, unless the home is overpriced. That I can determine by looking at comparable properties that have recently sold nearby.

Whether you have chosen a direct lender or a mortgage broker - If you are using a mortgage broker, I cannot show you HUD-owned homes. HUD requires a pre-approval letter on a direct lender's letterhead.

The type of loan (Conventional, FHA, VA) - If you are qualified for anything other than a conventional loan, buying a condo or a "flipped" home can be very difficult and time consuming.

Loan and/or Funding Conditions - We need to talk about your ability to provide documentation the lender requires on a timely basis.

I understand that you might not want to get pre-approved until you find the right house. Or maybe you won't want to buy a house at all if you find out that $xxx,xxx can only get you a home in need of TLC in a less than desirable neighborhood.

We won't know that until you get pre-approved. In Real Estate, the pre-approval letter must come first. Let's call it the chicken. After that, we can go out together and look for that perfect egg.
