I tend to work with many first time home buyers and I'm finding that in most cases they're saying things like......

  1. My Lender said the Seller pays for Closing Costs
  2. If they didn't want to give up that flat screen maybe they should have removed it before listing the house. You said, what is attached is included, didn't you?
  3. No, I won't pay for the Survey. If the Seller wants to sell the house they should pay for it......

Yadi yadi yadi

Because I represent both Sellers and Buyers, on different transactions, and am a Certified Negotiation Expert, I can safely say all those points are wrong, and to approach from that directive is just begging for disaster.  It should be more like this....

  1. It would be great to negotiate some Closing Costs paid for by the Seller, but I do understand that they are already selling the house for much less than they want to. Can you see if it's within their ability to pay for any of that?  Lenders really should keep out of that part and I'll promise to not quote rates.
  2. I sure like that TV but understand they paid alot for that. Can you ask them if they plan on leaving it and if they'd be willing to sell it outside of the house sale?
  3. Since they are already paying Title and some Closing Costs, I'll chip in and pay for it since after all, it's to protect me.

We have a fiduciary to neogitate the transaction but not to upset the Seller. I try to put myself in other's shoes and think how I'd feel if I was on the other side.

In many markets, Sellers are still near a break even point especially if they did a zero down loan.  People moving often have a means to move their stuff so don't assume its being left behind.  Dogs are part of the family so don't ask for them too.  It doesn't matter if you're paying what you consider or the appraiser considers to be full price, what matters is how each party feels in the transaction because unless they are required to sell, like a relocation, they will just walk away and look for another buyer. There's many out there now and more to come soon as our market contineus to improve and in the end, its the Buyer who loses out because you can always buy a TV later.
