Fort De Soto Park...No New Fees...Yet!

Fort De Soto Park, consistently ranked as a top beach is now a target by the County Commissioners. Apparently, there was a proposal for the 2010 budget to have a new fee at the park. It would cost up to $8 per car or pedestrian to enter the park.

Thankfully, the Commissioner's decided to table the issue until later this year, according to the news report that came out today. Pinellas shelves entrance fees for Fort De Soto and Fred Howard parks. Let's hope that when this issue comes up again, that it does not pass. The park generates its revenues from the campground fees, the shelter reservations, special events that groups hold and the gift shop. We don't need an entrance fee. The joy of visiting county parks such as this, is that they are FREE to the public to enter and enjoy with their family and friends. Let's keep it that way.

The History of Our Independence

Today now marks the 233rd Anniversary of one of our most sacred treasures of liberty. I am of course referring to The Declaration Of Independence.

When in the Course of human events, it becomes necessary for one people to dissolve the political bands which have connected them with another, and to assume among the powers of the earth, the separate and equal station to which the Laws of Nature and of Nature's God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation....

This famous paragraph is just the beginning to our new declaration of independence so eloquently written by Thomas Jefferson during the month of June 1776. On 11 June 1776, Thomas Jefferson, John Adams, Benjamin Franklin, Roger Sherman and Robert R Livingston were appointed to a committee to draft a declaration of independence. Thomas Jefferson presented a "rough draft" for correction before writing what would of course become the final version that we have known and have been taught. We are all too familiar with the beginning of the 2nd paragraph...

"We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness..."

Following the importance of the Declaration of Independence, would be the Constitution of the United States. We all should remember the Preamble to the Constitution, having been taught this in school.

We The People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America....

The first three words are very powerful in their context and meaning. We The People...ponder for a moment what these words are actually saying. The Preamble does not say The Government of the United States, it is...We The People of the United States. It was written as such, since our founding fathers meant our government to be for the people, BY the people. They were also looking for a form of government to include States Rights and a limited centralized government. This is why we fought for our independence, to move away from a form of tyranny, where the people had no voice in what their government was doing to them. Let us all remember what these two powerful and important documents mean to our country and to us as its citizens, as we celebrate with our families today.

Maybe it is time for all of us in this country, including our elected officials, to sit down and reread or read for the first time, both of these documents. Listen to the words that are being spoken. Comprehend their meaning and pass this understanding on to future generations.

While there were other acts in prior years, the timeline leading to our independence started in 1773 with the Boston Tea Party. In 1774, the First Continental Congress was held and thus begins the timeline leading to the 4th of July, our nations Independence Day.

So as we sit with our families, enjoying the parades, the food at the picnic and watching the fireworks...remember to take a moment and reflect upon our heritage as a country and what happened 233 years ago for us to enjoy our freedom today.

And make it one that you're gonna close...

In today's market with the lenders tightening their belts, it seems harder for the buyer to obtain a mortgage. Even with stellar credit and ample income, the lenders seem to find place other obstacles in the way. If you don't want to lend money, tell us right from the start. Please don't wine and dine us, leading us down the romantic road toward a closing only to dump us like yesterdays trash with a denial in the morning!

Lenders are coming up with more creative ways to deny a loan...did they take some sort of creative writing class when we weren't looking? A denial that I heard from one of our agents was, "We are sorry to deny your loan. Our decision was based on the fact we could not approve the community you are purchasing in. After review of the condominium documents, this community falls below our acceptable requirements." Are they joking? They can't possibly be serious...can they?

The condo community they were referencing is a well established community that has been around for about 30 years. They maintain a high enough owner occupancy rate, so this could not be the problem, could it? It wasn't. They are not behind on monthly fees and their reserves are quite adequate, so this could not be the problem, could it? It wasn't. In fact out of the current listings available, of which we have the majority, only 3 listings are a short sale (of which, we only have 1)...it is not a community dominated by such listings, as most owners bought long before the heyday.

So what could they possibly be looking at when denying a loan for a buyer who is purchasing a condominium in a well established community not dominated by foreclosures or short sales? It seems that it just comes down to the fact they simply do not want to lend any money, period! Unfortunately, the reason for the denial, were the short sales. They felt it too risky for them to lend money on a unit where there were several short sales taking place. So no thanks to them, we are still looking for a lender who is willing to take the "risk" and provide the funding to actually have a property sell...which will NOT be a short sale!

When is Mr. Lender going to cooperate with us and help us sell off our inventory? Please stop making it difficult. I can understand there are condo communities out there that are risky...I've seen them, sticking out like a sore thumb, most units vacant due to foreclosure or owners trying to short sell them. But, when you have a well established community, I do not see the reasoning behind denying a loan based on the community. Please give us a better reason for denial...thank you!

Resolved, that the Flag of the thirteen United States shall be thirteen stripes, alternate red and white; that the Union be thirteen stars, white on a blue field, representing a new constellation.

Just what is Flag Day and when did it start? What about the history of the "Stars & Stripes"? Were you aware or do you remember that the 13 stars on the blue background represented the 13 Original Colonies?

According to The History Of Flag Day, the idea of an annual day celebrating the Flag, was first originated by BJ Sigrand in 1885. In 1914, Franklin K. Lane, Secretary Of The Interior, delivered the following at a Flag Day address: "I am what you make me; nothing more. I swing before your eyes as a bright gleam of color, a symbol of yourself." It wasn't until 1916, that an official Proclamation was made by President Woodrow Wilson establishing Flag Day. On August 3rd, 1949, President Harry Truman signed an Act Of Congress designating June 14 of each year as National Flag Day.

We are all familiar with the Pledge Of Allegiance:I pledge allegiance to the flag of the United States of America, and to the republic for which it stands, one nation under God, indivisible, with liberty and justice for all. The first National Flag Conference was held in Washington D.C. on June 14, 1923 and a change to the pledge was made, from "my flag...to the flag of the United States".

During the War of 1812, Our National Anthem, was written by Francis Scott Key. The actual flag that inspired him to write this poem that became our National Anthem, hangs in the Museum of American History in Washington, DC.

Oh, say can you see, by the dawn's early light,
What so proudly we hail'd at the twilight's last gleaming?
Whose broad stripes and bright stars, thro' the perilous fight,
O'er the ramparts we watch'd were so gallantly streaming?
And the rockets' red glare, the bombs bursting in air,

And of course, who could forget one of our most famous women in American History Betsy Ross, who was credited with designing the flag for our country. This is the stuff legends are made of and passed down from generation to generation.

The Evolution of the Flag provides a timeline for what is the symbol of our Nation and will show the changes to the stars from when additional states were added.

Proper Flag Etiquette and the Flag Code say, "No disrespect should be shown to the flag of the United States of America." Section 8

"The flag represents a living country and is itself considered a living thing." Section 8j

Home short sale flips nixed...

I was reading emails from one of the boards our company belongs to and this one caught my attention right away.

This issue has been the talk of the community both here on Active Rain and outside of Active Rain. Recently Richard Zaretsky posted two appropriate blogs on this issue, they are: Short Sale Flips - Title Insurance Prohibited and Short Sale Flip - Questionable Methods.

The news article starts out by saying: It may be a bit tougher now for investors to flip short sales for big profits.

Attorneys' Title Insurance Fund notified its 6,000 member lawyers this week that it will not insure deals made with a popular - but controversial - method for closing flips of short sales. A short sale occurs when a mortgage holder agrees to allow a home to sell for less than the mortgage balance so that foreclosure can be avoided. We as agents need to be aware of what the true ownership of the property is that our buyer wishes to purchase. These types of deals may only cause headaches down the road and that is certainly not what we want in this market. There are ethical ways of selling a home by way of a Short Sale. When I read about this type of scheme, it made the hair on the back of my neck stand up and with good reason...I didn't think it was very ethical (but that is my opinion).

If something just doesn't seem right, then it should be questioned. Get all the facts so that you can ascertain what truly is correct. It is not worth losing your license and career over something like this.

I received a call yesterday afternoon from a past friend & co-worker (when I was in the corporate world). What astonished me, is that we had not kept in touch over the years and it has been about 15 years since we last spoke.

She remembered I do not spell my first name with an "h" in it, as I used to yell at her (good naturedly) for misspelling my name. She needed to locate a realtor for a friend of hers who is looking to sell their home. She went onto the internet and typed my name in...low and behold, the first thing that pops up is my Active Rain blog!

I have been on Active Rain since 2007. And while I took a little time off, I made sure to at least post my listings. It was this activity that brought us back together after all these years and I am more than happy to obtain a listing referral from a friend. She stated that this would be the first of several to come over the next few months and I am extremely grateful to her. She has the trust in me knowing that I will do a good job for her friends that she will be referring.

To those who do not see the benefit of blogging, I can tell you that this is not the first time I have been found due to my Active Rain blog. Even if you post a listing at the very least, you will be found when someone you know types in your name when they need to locate a realtor and remember you're in the business! So if you are new, keep blogging as your day will come and it is truly a great feeling! You just might reconnect with that old friend!

Thank you Active Rain and now I have to go back to work.

Hurricanes and Foreclosures, Who's Job Is It To Protect The Property?

With Hurricane Season starting, who is responsible for protecting the vacant, foreclosed homes? As stated in the following article, Foreclosures add to hurricane hazards, "... no state laws mandate who prepares buildings before a hurricane; even officials from the Florida Division of Emergency Management say that securing foreclosures isn't a concern."

Technically, the legal homeowner would have the responsibility of securing their property prior to a storm. A checklist for Securing your property includes the roof, shutters, doors, windows. These are basic items, but when the legal homeowner is a bank, how would they handle this basic need?

As realtors, we should always make sure that the doors and windows are closed and secured on any listing we have, but how far are we expected to go when it comes to our foreclosure listings? Are we expected to board up windows or put up shutters? Do the banks have guidelines for the protection of their property when it comes to storm hazards?

One point brought up in the article, is the property values in those neighborhoods with foreclosed homes. After a storm, if these properties are damaged, what will happen not only to the value of these property types, but to the value of the surrounding properties?

We would think that all of this would have been contemplated prior to another storm season. After all, we knew that foreclosures were going to last for more than one year. How is it that States/Counties/Cities that are potentially affected by these storms don't have some sort of preparedness in place or are they relying on the banks? Shouldn't the States and the lender's work together to arrive at some contingency plan? I know that some lenders have property management services in place to maintain their properties, so it should probably be the management company's duty to ensure the lender's property is secured properly. But what about the bank's that do not have such services in place? Who then should do this kind of securitization?

Let us hope for a quiet season and are able to sell these foreclosed properties prior to a third hurricane season.

Hurricane Season Is Now Upon Us...Are You Ready?

Another hurricane season starts today. The season lasts from June 1 thru November 30 each year. Are you ready for this year's season?

This close-up view of Hurricane Isabel was taken by one of the Expedition 7 crewmembers onboard the International Space Station. In addition to the station's cameras, NASA satellites provided imagery of the storm, as it approached the eastern seaboard of the United States.

The 2009 Hurricane Season Outlook as stated by the National Oceanic and Atmospheric Administration (NOAA) is projecting a near normal season this year. They are predicting 9 - 14 named storms, 4 - 7 could become hurricanes including 1 - 3 major hurricanes (Category 3, 4, or 5). They state that a normal season has 11 named storms, 6 hurricanes, 2 major hurricanes.

2008 saw 16 named storms, that included 8 hurricanes, 5 of which were major (at Category 3 and above).

For those that would like to track the storms this season, the tracking chart provided by NOAA, will come in handy. This could be an educational experience for your children or grandchildren. Who knows, you just might have a future meteorologist in your family.

The following comprises what you should do prior to a storm hitting your area. Even though technology has improved greatly, the past few years have proven just how unpredictable these storms can be. Preparedness is THE most important thing for Hurricane Season. Even though you may not have been hit with a storm last year, you should not lull yourself into a false sense of security. If you are told to evacuate...DO IT! It is always better to be safe and alive than sorry and a statistic! We need to learn from the past and not become a statistic. Remember things can be replaced, life cannot.

Having a Family Plan is a great way to get everyone involved and learn how to protect yourselves better during storm season.

The Disaster Supply Kit will help you be better prepared should a storm hit your area. Remember, just because you may not be in an evacuation area doesn't mean you cannot get the winds and rain from these storms. You may have your home protected and have a safe place in your home, but you still need to have these items on hand for after the storm.

Remember, if you are told to evacuate...DO IT! During your preparations, you should always Have A Place To Go. This list will help you in your preparations should you receive the evacuation order. Remember not to wait until the last minute...you do not want to be a statistic!

Securing Your Home is important. The list explains the most important areas to have secured as well as mechanisms to utilize in protecting your home, such as shutters. There is even a link to the National Flood Insurance Program in this list.

Having A Pet Plan will help you in protecting those that are unable to protect themselves. It explains what needs to be done prior to, during and after a disaster. It also gives you a supply kit list. Remember to NEVER leave your pet behind!

Are you Pooh, Tigger or Eeyore when faced with a challenge?

After reading Candice Donofrio's blog Got A Pen? (The Art Of Being Cool) the other day in which she tells the story of negotiations between her and another agent, it got me thinking...

We all face challenges of varying magnitudes each day. It is how we handle these challenges that will affect us emotionally, mentally and sometimes physically. It can also affect the outcome of a real estate transaction you are working on. Handled the wrong way, no more transaction and a lot of angry people. Handled correctly, everyone is happy and satisfied.

So, when pressed with a challenge that would get one's blood boiling how do you handle it? Are you like Pooh, Tigger or Eeyore?

Pooh would handle these difficult tasks as any honey seeking bear would...with a clear-eyed wisdom (one of his traits). The happiness and feelings of others are what matter most to him...other than eating honey. I think given his demeanor, he would seek to make the situation not so maddening or difficult in order to have everyone involved have that happy ending we all would enjoy. Pooh in this instance, seems to be the grounded one.

Tigger, on the other hand...is quite impulsive and will speak and act before he thinks (or as the Winnie The Pooh official site would say..."leap before he looks"). This kind of quality, while exhilarating and fun at times, can make the situation even worse. If you are prone to flying off the handle, which is quite easy to do these days, you need to think first before acting on impulse. By thinking first and looking at all sides of the situation, you might be able to come up with a successful conclusion. If not, the end result could be one that you do not want.

And then there's everyone's favorite donkey...Eeyore. Do you approach each difficult situation with the "woe is me" attitude? Is the situation really as bad as the "doom and gloom" you are making it out to be? I know it seems like everyone might be raining on your parade, but if you step back for a second, you might see the rays of sunshine trying to impede and enlighten you. In doing this, you might find a way to ask for help, if you are not able to handle the situation completely alone, and ultimately get the successful conclusion that all deserve.

I know I would like to handle all situations as Pooh. In reality, I can go through each of these emotions before becoming Pooh. There are times that this is the one right from the start. So, who are you when handling a difficult situation?

The TRUE meaning of Memorial Day...

What does Memorial Day mean to you? How many realize what this National Holiday actually means or when it started? Does your town or city hold a parade? Are you aware some have not held a parade in years?

In these times of mass marketing and retail sales events galore, we have forgotten what this "day off" really means. We are to be remembering the lives of those service men and women who gave their lives defending our country. Per the Memorial Day History, "It is about reconciliation; it is about coming together to honor those who gave their all." Spending money in the shopping mall is not honoring these soldiers' memory.

Does anyone know when the National Poppy movement started or why it started? You can get a quick history lesson (and most of us need one) about Memorial Day and when it was officially proclaimed by reading the Memorial Day History.

I remember as child in Connecticut, my grandparents would take me to the parade. As I grew older and could comprehend the meaning of the day, my grandmother explained to me that it was more than just the floats and the candy being thrown into the crowd. The reason the veterans were marching was to show their respect and pay an honor to their fallen comrades during the wars.

So this Memorial Day, take a moment to reflect upon the lives of those soldiers who have fought and lost their lives for this country since our founding. Also remember our service men and women who are unable to be here at home, as they are currently fighting a war, defending our freedoms and protecting our country from invasion.

To you the soldier, I say, "Thank You" for giving me the freedom to write this post and may you come home safely.
