      <title>Don't buy from Strangers!</title>

She informs me that she is looking to buy a property, and that she is very excited (as she should be). She goes on to declare that she wants to work with me and my team (GREAT!), and that she is looking in San Diego.(not my territory)&lt;/font&gt;&lt;/p&gt;
&lt;p&gt;&lt;font size=&quot;3&quot; color=&quot;maroon&quot;&gt;Because it is very important to work with a Buyers agent that is familiar with and knowledgeable with the local community I go into my referral scripts. After having this conversation with her, and going through the benefits of working through a referral it hit me. Referrals really are a win-win-win for all parties, and so much so in today's market that any hesitant buyer should hire their agent through a third party referral. &#160;&lt;/font&gt;&lt;/p&gt;

Even if you've seen the agent working around your area and you think they're qualified; you are better off going to a professional third party (even if out of the area) and have them refer you to that agent. I know it may sound crazy, but I honestly believe that this becomes a win-win-win situation for all parties.&lt;/font&gt;&lt;/p&gt;

      <title>And I almost missed it...</title>
      <description>&lt;p&gt;I belong to my local TEAM Referral Networking Group the West Covina Chapter (Together Everyone Achieves More), I'm actually the President Elect and will take office at the end of this month, but back to the story.&lt;/p&gt;
&lt;p&gt;I did a quick search to find my chapter on-line to get an e-mail for one of our members. I typed in: &lt;em&gt;TEAM West Covina referral networking group&lt;/em&gt;. to be sure that I find my chapter over the National web-site. In my haste to get there I almost missed seeing that my AR profile page out ranked the TEAM chapters page...&lt;/p&gt;
&lt;p&gt;I find this really amusing because our District Representative is always so hyped up about how great their web-site is, how much they do to make sure it shows up high on the search engine results, and how our yearly membership doesn't even cover how much great web presence this web site will bring our business, and on and on. She gets so hyped about it she even starts making up her own &quot;techie&quot; words.&lt;/p&gt;
&lt;p&gt;Now it seems like I've always ranked higher than them against my own target keywords, but I thought it really humorous that we out ranked them at their own keywords.       <title>Be Successful in this market...</title>
      <description>&lt;p&gt;As we are all learning, some harder than others, we have to be fully responsive to the market in order to keep our doors open, let alone have a thriving business in a quickly changing market. Many are missing the keys to success, and this is all to clear as I watch the number of active agents in our office dwindle and spiral further and further down. We have gone from  a thriving 60+ active agent office to the point where I see 3 agents names on the sales board every month.&lt;/p&gt;
&lt;p&gt;(Before people from my office go crazy on me yes there are other names that pop up every now and again, and there are always at least 5 names on the board, but they are not consistent, and that is merely the point I'm referencing. Consistency is key to success.)&amp;lt;&lt;/p&gt;
&lt;p&gt;It is now to the point that the office seems virtually empty every day when I come in. If you haven't guessed it the secret of success for is that the first is one of the lucky few that scored an REO contract and does zero prospecting and can barely keep up with the work load even after taking on 4 additional team members.&lt;/p&gt;
&lt;p&gt;As for the remaining two, it is fairly simple. We are not afraid of short-sales. Of the 5 current escrows my team has open; 3 of them are Short Sale listings we have.&lt;/p&gt;
&lt;p&gt;So if you have no reason to show up to the office consider signing up for some local Short Sale classes with your local Board of Realtors, or sign-up and take the Short-Sale Specialist NAR certificate designation class.&lt;/p&gt;
&lt;p&gt;Now it does take a considerable mind shift to make a business in Short Sales successful. One key sample of this is, we do not call them listing presentations if it is going to be a short-sale. Instead we refer to them as listing consultations, and when I go into them my goal is to &quot;NOT take the listing&quot;.&lt;/p&gt;
&lt;p&gt;Sound crazy? Good. The key to success according to Anthony Robbins is to look where everyone is going and then go the opposite direction.&lt;/p&gt;
&lt;p&gt;Short sales require a lot of hard work, and time.       <title>Top Producer Newsletter Success!</title>
      <description>&lt;p&gt;&lt;font size=&quot;4&quot; color=&quot;maroon&quot;&gt;Top Producer implemented our suggestions! And in a very timely manner too. To catch you up, if you've not been following.&lt;/p&gt;
&lt;p&gt;Every time I contact Top Producer to make suggestions, or report a problem that I'm having I post it to the AR community for support. The idea is if you agree with my suggestion(s) you can submit a similar suggestion, with the idea that if they hear it enough they'll try to implement it.&lt;/p&gt;
&lt;p&gt;At the beginning of August I posted one of my more harsh suggestions entitled &lt;a href=&quot;http://activerain.com/blogsview/620193/The-Farce-of-Top&quot; title=&quot;Top Producer News&quot; target=&quot;_blank&quot;&gt;The Farce of Top Producer's News: Tips and Tricks&lt;/a&gt; you can read the original post to understand why I was disgruntled, but the suggestion went as follows:&lt;/p&gt;
&lt;p style=&quot;padding-left: 60px;&quot;&gt;I would highly recommend that you take your newsletter away from your sales team, and put in touch with your customer service/tech support representatives. Put together a list of the FAQ of that month, or just pick one or two and offer the answer to a frequently asked question. Have the tech guys throw in an article when they fix a glitch that was happening for awhile, or when they make some system functionality improvements. This way I'd actually feel like I received a hint, tip and trick instead of another disappointing sales pitch for a product I sometimes already own.&lt;/p&gt;
&lt;p&gt;I finally opened my latest Top Producer News: Hints and Tips last night and honestly believed I was going to get more of the same (I almost deleted it without opening it, but wanted to see if they listened). My interest was perked when the lead story was an actual tutorial video (not a sales pitch). I was thinking, alright finally a newsletter I don't immediately want to delete as solicitation.&lt;/p&gt;
&lt;p&gt;The first two sentences of the second paragraph (3 sentences in length) there was an announcement of their newest product they just launched, with a brief reference to a current upgrade available that works well with this new product. Yes it is a solicitation, but acceptable because: it is new, they haven't duplicated this message (yet... let's hope we never do though), and the newsletter is designed to keep you informed of new products so I find it completely relevant.&lt;/p&gt;
&lt;p&gt;The third and last sentence of the paragraph is when I jumped up screaming THEY READ IT, AND ACTUALLY DID SOMETHING ABOUT IT, and was running around the office looking for someone to high-five... only to realize the disappointing fact that at 11pm on a quasi holiday I am alone at the office.&lt;/p&gt;
&lt;p&gt;I'm going to quote the 3rd sentence in its entirety (I'll forward the entire newsletter to anyone who wants this one for reference):&lt;/p&gt;

      <title>The Farce of Top Producer's News: Tips &amp; Tricks</title>

&lt;p&gt;Happy Friday 8i Staff Members,&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;I'm writing you today to make a suggestion within your newsletters. Every month I receive an e-mail from Top producer (actually I usually receive it twice, this month 3 times) and every month I open it and for some reason hope to find relevant information.&lt;/p&gt;
&lt;p&gt;I can only recall a few times (actually only one time, but I probably missed one or two others) that you included an article that wasn't designed to sell your product (Meaning it offered actual hints or tips instead of copy and paste of your sales letters). I'm not sure you guys grasped the purpose of a relevant newsletter, but the lead story in a newsletter to current members should not be the sales letter of your base package...&lt;/p&gt;
&lt;p&gt;I can understand, and I EVEN encourage you to keep your sales pitches in the newsletters for the product upgrades, but to have your cover story be the base package... I mean really. What current member would find re-reading this sales letter and valuable hint, tip or trick for using 8i more productively? This would be like my monthly client newsletter continuing to be available properties in their area&#8230; They already bought the house&#8230; they don&#8217;t need to be sold on it again and again, but they may need some maintenance advice, tax benefit tips, design suggestions, etc.&lt;/p&gt;
&lt;p&gt;I would highly recommend that you take your newsletter away from your sales team, and put in touch with your customer service/tech support representatives. Put together a list of the FAQ of that month, or just pick one or two and offer the answer to a frequently asked question. Have the tech guys throw in an article when they fix a glitch that was happening for awhile, or when they make some system functionality improvements. This way I'd actually feel like I received a hint, tip and trick instead of another disappointing sales pitch for a product I sometimes already own.&lt;/p&gt;
&lt;p&gt;I personally, will give you three months to incorporate some changes to your newsletter, and then I will be unsubscribing from your monthly newsletter if you are unable to provide relevant hints, tips, or tricks to using the base package of Top Producer as your main lead off story.&lt;/p&gt;
&lt;p&gt;Thank you for your time and consideration of this concern. I really hope you will see the marketing relevance to this suggestion. You may be surprised how many people actually want to read your newsletter after implementing relevant content, and if you keep those small side stories for your up-sales campaigns I believe your sales will improve.&lt;/p&gt;

      <title>Recourse vs Non-Recourse Loans in California</title>

&lt;p&gt;An important subject in the &lt;strong&gt;short sale real estate industry&lt;/strong&gt; is the difference between recourse and non-recourse loans; which is a completely different issue than tax liability&#8230; Below is a very brief breakdown of the qualifications and repercussions of both types of loans.&lt;/p&gt;
&lt;p&gt;&lt;h3&gt;&lt;strong&gt;Non-Recourse Loans Definition&lt;/strong&gt;&lt;/h3&gt;: the borrower is not personally liable for the loan. The lender&#8217;s only security is the property itself, not the borrower&#8217;s personal assets.&lt;/p&gt;
&lt;ol&gt;
&lt;li&gt;Loans secured by and used to purchase an owner-occupied, 1-4 unit residential property. &lt;br /&gt;&lt;ol&gt;
&lt;li&gt;Primary residence &lt;br /&gt;&lt;/li&gt;
&lt;li&gt;Original purchase loan &lt;br /&gt;&lt;/li&gt;
&lt;/ol&gt;&lt;/li&gt;
&lt;li&gt;Any Seller carry back real estate loan secured by the property being sold. &lt;/li&gt;
&lt;/ol&gt;
&lt;p&gt;Have you ever refinanced your loans since purchasing your house? If the answer is yes, your loan falls into what is called a recourse loan.&lt;/p&gt;
&lt;p&gt;&lt;h2&gt;&lt;strong&gt;RECOURSE LOANS&lt;/strong&gt;&lt;/h2&gt;&lt;/p&gt;
&lt;p&gt;&lt;h3&gt;Recourse Loan Definition:&lt;/h3&gt; the borrower is &lt;span style=&quot;text-decoration: underline;&quot;&gt;personally liable for the loan&lt;/span&gt;. The lender&#8217;s security is primarily the property &lt;span style=&quot;text-decoration: underline;&quot;&gt;BUT also the borrower&#8217;s personal assets&lt;/span&gt;. The lender may file a deficiency judgment if the property forecloses and the loan is not fully satisfied. Likewise, the lender may file a deficiency judgment against the borrower  based on the lender&#8217;s total losses absorbed in a short sale transaction.&lt;/p&gt;
&lt;p&gt;Examples of Recourse Loans = Refinances, H.E.L.O.C.&#8217;s not obtained to purchase the property.&lt;/p&gt;
&lt;p&gt;As most people have refinanced their loans sometime after the purchase of their house this becomes a very disturbing point. Despite doing a short-sale and avoiding foreclosure you may still be liable for the &#8220;lender&#8217;s total losses absorbed&#8221; in the transaction. So now, you may be wondering why bother. This is where the separation between good and great agents comes into play. I say the difference between good and great because anything less than good will never run into this problem. Only good, confident agents can successfully close escrow on short-sales.&lt;/p&gt;
&lt;p&gt;&lt;h2&gt;&lt;strong&gt;Satisfied vs. Released&lt;/strong&gt;:&lt;/h2&gt;&lt;/p&gt;
&lt;p&gt;When recourse loans approve a short sale in writing it is very important to attempt to achieve the verbiage &#8216;satisfied&#8217; or &#8216;satisfaction&#8217;. &#8220;Satisfied&#8221; is a legal term which restricts the lender from pursuing a deficiency judgment against the borrower. The words &#8216;release&#8217; or re-convey simply mean that the lender agrees to allow escrow to close. They retain the right to pursue a deficiency judgment if the word &#8216;satisfied&#8217; or &#8216;satisfaction&#8217; is not used.&lt;/p&gt;
&lt;p&gt;This challenge usually comes into play late in the process and there has already been so much time, energy, persistence and patience given by your agent, a good agent may now be so concerned with all of this being done in vain that they may feel inclined not to argue semantics such as &#8220;release&#8221; vs. &#8220;satisfied&#8221;. Why risk losing the deal? While a great agent will not allow fatigue to compromise their primary fiduciary responsibility to the seller. Even though most banks are verbally claiming they are not going to pursue these rights, it can't feel good to have it on the record.&lt;/p&gt;
&lt;p&gt;I see too many agents discounting the seller as just a signature in the process, and they even seem to try and cut the seller out of the process almost completely. As a seller of a short sale you are still liable for many things, and an agent that looks at you as though you are not a significant part of the equation or looks at you like a discounted part of the equation is probably practicing fiduciary negligence, but this is hardly place to rant and rave on this issue. I will talk later about the fiduciary responsibilities to a short sale owner at a later post.&lt;/p&gt;
