realtor code of ethics: Do You Have Permission to Give Out Your Client’s Information? - 05/14/12 05:30 PM
It is our fiduciary duty to protect the personal information about our clients. We protect our client’s best interests and personal information while representing them in the sale or purchase of their home. It could make the difference in hurting the transaction and your negotiating powers let alone protecting their personal interests.
How often do you read a testimonial or story on someone’s blog or website and wonder if they had written permission to do so?  Even posting pictures of your client’s without their permission is not permissible.
DO NOT GIVE OUT INFORMATION WITHOUT WRITTEN CONSENT!

realtor code of ethics: Shame on You for Crossing That LINE! - 05/03/12 10:21 AM
I recently had a call from a Real Estate Agent from anther state who said his fiancé wanted to sell her townhouse in Hawaii. Would I mind going to preview the property?  Sure, give me her phone number and I’ll make an appointment.
He then starts getting into the price, commission and so forth and while I’m ‘listening’ I’m pulling up the property only to discover his fiancé is still on title with her ‘ex husband’.  I let him know I would be contacting her to make an appointment.
Fast forward a couple of hours. After taking my Sunday morning to whip … (115 comments)

realtor code of ethics: Tips for NOT Cutting Corners With Your Real Estate Business - 04/23/11 01:38 AM
So, you have your Real Estate License and you're thinking about making a go of selling real estate.  You already have the mindset that you will make every effort to be the best you can be in this business. One thing is for certain: If you don't have good morals, beliefs and values in your life every day then all the rules, laws, regulations, code of ethics will not come even close to being something you will follow or adhere to.
There are no cutting corners in real estate when:
You are explaining a contract to your clients or answering any … (51 comments)

realtor code of ethics: You ARE STEALING When You Take MY Content! It's Called PLAGIARISM! - 03/08/11 11:57 PM
I thought I'd do a little Copyscape (Plagiarism Checker - Duplicate Content Detection Software) to check if anyone was STEALING my posts, website content and so forth.
SURPRISE!
Oh goodness! Word for word except substituting San Antonio for Hawaii!  I felt ill to my stomach (for real) and felt like someone just broke into my home and invaded my privacy!  That's what it feels like when you take something from me without my permission.
This post I wrote Top Ten Concerns for the Hawaii Home Seller I originally wrote 08/17/2010 here on ACTIVERAIN and also decided to use it on my … (92 comments)

realtor code of ethics: Ten Ways to Lose Your Lover - 02/21/11 05:00 PM
Hawaii  passed a law to double our Continuing Education Requirements from 10-20 credits for renewing our real estate licenses come 2012.  I rejoiced!  It is critical that we continue to get educated on real estate updates, laws and information so that we may do better as real estate professionals.
In the meantime, most of us know why we don't do certain things because we value our licenses and choose to do real estate ....the right way.
Talk about how that particular neighborhood is in a high crime area....or used to be. (Fair Housing Laws) Move a client into a home that … (12 comments)

realtor code of ethics: Who's Been Sleeping in YOUR Bed? - 02/17/11 08:24 PM
A seller would most definitely want the best representation in selling their home, right? How's about having wonderful pictures on the internet for all to see?  It has to be displayed on www.realtor.com and our local www.hicentral.com site for all the public to see as well as any other sites that we can add that listing to.
I came across a complex and property that I knew my client would be interested in. It had the number of bedrooms, baths,  parking stalls and ammenities to accommodate the lifestyle of this client and I just knew that it could be that ‘dream home … (87 comments)

realtor code of ethics: TOP TEN ATTRIBUTES of a Realtor® That Clients LOVE - 02/27/10 10:47 PM
The TOP TEN ATTRIBUTES of a Realtor® That Clients LOVE came to mind while thinking of the ‘aftermath' of our Hawaii Tsunami scare today.
I woke at 5:45am to a blaring cellular that only rings when family has a concern. Sure enough it was my daughter telling me to get up because the Tsunami was coming! Whaaa?  My first concern was to call my mom at work but my daughter said she already called her. My mom was happy as a clam being at work and at the country club during a crisis anyway.   Family First.
My next concern was to … (56 comments)

realtor code of ethics: Asking Questions Beyond Real Estate Reason - 01/26/10 01:26 PM
I represent the Home Seller OR the Home Buyer and quite frequently I have to step into the other agent's shoes so that I get a better (realistic) view of what circumstances surround the sale or purchase of a property. That doesn't mean I put another agent on the spot.
There are always going to be circumstances surrounding the seller selling and strict criteria for the buyer who's purchasing.   What I don't get is why another agent would ask personal questions to pass on to their client:
Why is the seller selling?  We all know it is confidential info although in … (24 comments)

realtor code of ethics: Online Statements That Last a Lifetime and Beyond - 08/28/09 06:39 PM
Most of us know we have the ActiveRain Guidelines. I mean, all social networks have guidelines to follow don't they?  Common sense tells us that we as Real Estate Industry professionals KNOW that we have to hold ourselves in the highest standard anyway, right?
Well, maybe some don't but I can tell you this:
Most Realtors® abide by the The Realtor Code of Ethics® and though some may ‘forget' let's review what Article 15 is all about. Our Honolulu Board of Realtors® puts out a quarterly update newsletter on the happenings for our Honolulu Hawaii Real Estate Industry including market updates and … (24 comments)

realtor code of ethics: WATCHING OUR LANGUAGE Part I - Advertising Our Listings at What Cost? - 08/25/09 03:07 PM
While perusing the listings for homes for sale (for a client coming in next Monday) my eyes settled on a listing they might be interested in. Hmmm. not bad price and in an area my clients are interested in. We've been working long distance by email, mls site listings sent automatically by criteria and the phone for months now. We pretty much have it figured out what their criteria is, the neighborhoods they are interested in and so forth.
This is how the PUBLIC remarks read describing the property:
Great single family home for first time buyers or buyers looking to move up. … (20 comments)

realtor code of ethics: Keeping Emotions & Opinions Out of That "Family" Hawaii Real Estate Transaction - 08/21/09 07:57 PM
We all would love to save the world wouldn't we? We want to ‘make sure' that everyone knows that we are the professional in the Hawaii Real Estate Transaction and will ‘make sure' everything is done right. Well, we really do have to draw that line when it comes to:
The relative who is giving the buyer the down payment and wants to be the ‘expert' and believes they are more knowledgeable than the licensed agent. The reality is that the buyer is ‘obligated' to listen to the relative because of the down payment. The helpful ‘friend' who tells the buyer that … (22 comments)

realtor code of ethics: Bad Business Indeed! - 08/01/09 04:21 AM
We all have our horror stories to tell when it comes to a transaction gone bad. It may have been a loan where the client wasn't really qualified to a agent that never answers their phone.
How about this horror story for any agent?  Two offers are made on the same property. One  of the offers is an ALL CASH offer. It's a pretty good offer and within the range that the sellers are willing to accept.
There are a few minor details in the offer to clean up so a counter offer is prepared. One of the contingencies was that the Buyer is to provide proof … (75 comments)

realtor code of ethics: Overlapping Real Estate Job Descriptions - 07/25/09 10:01 PM
Over the years I've learned that being a good Realtor Associate® means I know every aspect of our market and all involved in the real estate transaction process.  I know the duties for each and how it's imperative that we all work together as a team to meet a common goal.
A closed transaction.
Escrow is the third neutral party that takes care of all paperwork, monies and disbursements. They can even go as far as schedule termite inspections, surveys, condo docs and so forth. They order the preliminary title report and identify any problems that the clients/Realtors® must know and … (19 comments)

realtor code of ethics: Hawaii Home Buyer | Why They Think They Can Negotiate OUR Commission - 06/21/09 11:51 PM
What a great Open House today!  About 45 people running through and no time to sit down.  No potty break and a good thing I brought my water bottle (which, incidentally, I forgot in the seller's fridge) otherwise I would have shriveled away (yeah, right)
A good turnout and soooo many nice people coming to this great Hampton Court Townhouse listing of Randy Prothero's (he got lucky snagging me today J) Now, there will always be someone to put a damper on a good party or for this matter, an Open House.
I know many of you have heard the … (36 comments)

realtor code of ethics: Are You Really Thinking in the Best Interests of YOUR SELLER? - 05/28/09 01:00 PM
Making decisions for a client and not thinking in their best interests creates some serious thoughts in my head as to what their agenda is. Questioning what we do not know allows us to get an opinion "outside our own thinking" and could possibly save you a slap in the face when violating our Code of Ethics.
When presenting buyers OR sellers in transactions I see both sides of the transaction and act responsibly for each side I'm representing.  Experiencing both sides allows me to step in the other side's shoes and look from a different perspective.
So, I'm calling … (24 comments)

realtor code of ethics: Are Realtors® An Endangered Species? - 05/05/09 07:47 PM

Only on an early Saturday morning will we roam the coastlines of Oahu in search of subjects to snap a picture of.  Something so beautiful that piques the interest of a memorable event to view for years to come.
This past Saturday was one of those times. We stopped at Laniakea Beach on the North Shore of Oahu hoping, wishing and straining our necks to look beyond the trees to the sand below. WooHoooo!  There she was basking in the sun. With cool trade winds blowing and a once in awhile wave that came up on the shore to give … (40 comments)

realtor code of ethics: Why Should I Refer a Client to YOU? - 04/24/09 12:45 PM
Referrals are pretty special to me. It means that a client, friend, family or peer is entrusting me to assist the person in a professional and caring manner.
It means I was chosen because another believed I am a trusted professional.  I did have a referral from Willam E. Johnson, RE/MAX Associates in San Diego, CA. and the transaction closed smoothly and I received praise from both the seller and William.
Kapu (ka poo) means forbidden in Hawaiian and in ancient times it was the Hawaiian laws and regulations.
As professionals in the Real Estate Industry we have our own laws and regulations … (30 comments)

realtor code of ethics: Not All Realtors® Are Bad Apples - 04/17/09 08:53 PM
Goodie! I can write a spinoff of Jeff Corbett's Survey Says...Realtors Suck  Jeff said, "....unfortunately, a few GOOD apples don't ripen the bunch". In other words a few bad apples spoil the bunch. (and pardon the title...I was just counter copying Jeff :)  I changed the title folks...the word 'sucks' was not ladylike (my mom would freak if she saw that lol)
Well, many good apples should be writing a response! Maybe the few good apples are not a minority ...maybe they are. I found out just how bad the tunnel vision of some individuals are about our industry in the … (160 comments)

realtor code of ethics: Building a Reputation Over a Lifetime - 04/08/09 12:33 AM
She packs up loads of books, pamphlets, documents and brochures for her listing appointment. Hmm...she snaps her fingers as a signal that she almost forgot something. The camera and flip video; and she grabs them and places them in her satchel as well.
Hair neatly combed and dressed in a nice pantsuit she retrieves the lint brush from the kitchen drawer and gives her pants a good go over; lest the seller take notice to the little lint balls that accumulated on the knees of her pants. Darn that Gary....he threw a wash rag in with the dark colors when doing the … (31 comments)

realtor code of ethics: The Magic Formula for a Smooth Transaction - 04/02/09 03:07 PM
The Real Estate Industry is a complex industry indeed and there are so many different factors to make a transaction work.  If one party does not do their job or another does not work together with another in a timely manner then that dream of homeownership for a buyer is doomed to fail and the home seller will fail in selling their home.
The Realtor® representing the Buyer, Realtor® representing the Seller, Loan Officer. The Lender, Home Inspector, Escrow Officer, Termite Inspector, Appraiser should all be working together as a team to make the transaction run smoothly. When one party slacks … (23 comments)
