      <title>5 Foreclosure Myths for 2012</title>

&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;"Beginning in 2007, foreclosures rocked the real estate world. Like an out-of-control freight train, they began decimating the market, peaking in 2009. &lt;a href="http://www.trulia.com/blog/taranelson/2010/05/top_10_myths_about_buying_a_foreclosure" title="Top 10 Myths About Buying a Foreclosure"&gt;Myths and rumors&lt;/a&gt; began propagating like mushrooms as consumers struggled to understand the new reality. Although many misconceptions have come and gone, we still encounter five myths on a regular basis.&lt;/p&gt;
&lt;h3&gt;1. There is going to be a flood of new foreclosures to the market.&lt;/h3&gt;
&lt;p&gt;This rumor has appeared every year since 2008 and has been routinely &lt;a href="http://www.trulia.com/blog/carl_medford/2009/09/new_flood_of_reos_to_hit_the_market_not_likely_top_3_reasons_4_implications" title="New Flood Of REOs To Hit The Market? NOT LIKELY: Top 3 Reasons, 4 Implications"&gt;debunked&lt;/a&gt;. However, recent announcements that the Feds reached a settlement over the robo-signing scandal have reignited speculation. The idea is simple: Since the cork is now out of the foreclosure bottle, &lt;a href="http://www.biggerpockets.com/renewsblog/2012/02/08/how-the-robo-signing-settlement-will-affect-you/" title="How the Robo-signing Settlement will Affect You"&gt;we&amp;rsquo;ll soon see another flood&lt;/a&gt; of REOs inundating the marketplace.&lt;/p&gt;
&lt;p&gt;My personal opinion: don&amp;rsquo;t hold your breath.&lt;/p&gt;
&lt;p&gt;Banks have learned that if they control inventory, they can affect local prices. By releasing homes in measured amounts, they realize higher prices than if they released a glut of homes. In addition, they&amp;rsquo;ve learned that if they can mitigate their losses by agreeing to a short sale, everyone wins.&lt;/p&gt;
&lt;h3&gt;2. You can go directly to a bank to buy a foreclosure.&lt;a href="http://pro.truliablog.com/wp-content/uploads/2012/03/iStock_000009107454Small.jpg"&gt;&lt;img title="iStock_000009107454Small" class="alignright size-full wp-image-5843" src="http://pro.truliablog.com/wp-content/uploads/2012/03/iStock_000009107454Small.jpg" height="216" alt="" width="288" style="float: right;"&gt;&lt;/a&gt;
&lt;/h3&gt;
&lt;h3&gt;Every few weeks I&amp;rsquo;m asked how to buy foreclosures direct from a bank. Someone knows a friend being foreclosed on and they want to step in and grab the house before it hits the market. Don&amp;rsquo;t we all? In reality, banks have a simple system &amp;ndash; they first offer properties on the courthouse steps. The rest they assign to asset mangers who then hire local real estate agents to put them on the market along with all the other homes. Want an REO? Pay cash at the courthouse steps or get in line witheveryone else when they hit the local MLS (&lt;a href="http://homebuying.about.com/od/marketfactstrends/qt/0407MLS.htm" title="MLS - What is MLS?"&gt;Multiple Listing Service&lt;/a&gt;).&lt;/h3&gt;
&lt;h3&gt;3. You can get a killer deal by submitting lowball offers on foreclosures.&lt;/h3&gt;
&lt;p&gt;You would think this myth would be dead by now. Unfortunately, like Elvis sightings, it just won&amp;rsquo;t go away. Here&amp;rsquo;s the truth: Banks want REOs sold in 30 days or less, so they typically appear on the market priced slightly under comparable properties. If the property doesn&amp;rsquo;t sell quickly, the bank will lower the price after about 30 days. &lt;a href="http://www.ehow.com/info_7991655_much-bid-bankowned-foreclosure.html" title="How Much To Bid On A Bank-Owned Property"&gt;Lowball offers are ignored&lt;/a&gt; and are, quite frankly, a waste of everyone&amp;rsquo;s time and effort. &lt;a href="http://ebpublishing.com/index.php?option=com_content&amp;amp;view=article&amp;amp;id=2572:buyers-lowball-foreclosure-offers-&amp;amp;catid=7:examples&amp;amp;Itemid=121" title="Buyers Lowball Foreclosure Offers"&gt;You might get a deal&lt;/a&gt; by offering a lower price on a foreclosure that&amp;rsquo;s been sitting on the market for more than 90 days, but remember that there are good reasons it&amp;rsquo;s gone unsold for so long. And even if you have cash, your lowball offer won&amp;rsquo;t be accepted &amp;mdash;seriously.&lt;/p&gt;
&lt;h3&gt;4. You can&amp;rsquo;t use foreclosures when doing an appraisal.&lt;/h3&gt;
&lt;p&gt;Or short sales, for that matter. That is no longer true. In fact, in many neighborhoods, that&amp;rsquo;s all that&amp;rsquo;s there. Therefore, foreclosed or distressed sales represent the actual value of homes in the area and HAVE to be used to appraise other properties. Don&amp;rsquo;t like it? Get over it. Times have changed and the ways neighborhoods are valued have changed as well.&lt;/p&gt;
&lt;h3&gt;5. Foreclosures are only affecting the bottom end of the market.&lt;/h3&gt;
&lt;p&gt;This used to be true. However, while foreclosure rates on the lower end of the market have actually decreased, &lt;a href="http://money.cnn.com/2012/02/23/real_estate/million_dollar_foreclosures/index.htm?iid=Lead" title="786 commentsMillion-dollar foreclosures rise as rich walk away"&gt;they&amp;rsquo;re actually increasing on the upper end&lt;/a&gt;. According to Daren Blomquist, vice president of RealtyTrac, the market share of foreclosed homes under $1 million is shrinking, but those among properties valued over $1 million are rising &amp;ndash; up 115% since 2007. And foreclosures on properties valued upwards of $2 million have increased by 273%. While some well-known jet-setters have melted down and lost everything, others are choosing to &lt;a href="http://en.wikipedia.org/wiki/Strategic_default" title="Definition: Strategic Default"&gt;strategically default&lt;/a&gt;. They see it like liquidating a poorly performing portfolio &amp;ndash; they have enough resources to cut their losses and move on. Historically, banks have been reticent to foreclose high-end homes and absorb a large loss, but defaulters are now forcing their hands and mansion foreclosure rates are moving on up.&lt;/p&gt;
&lt;p&gt;Myths control behavior, and this has never been truer than in the housing market. Savvy agents will work hard to educate their clients, debunk myths, explain market trends, educate with solid facts &amp;ndash; and actually close transactions."&lt;/p&gt;

The market is crazy right now and I am sure we all have a different idea of how our market is doing. Here are some key myths/points for you:&lt;/p&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;Myth #1: the market is not that great. #2: its a buyers market. #3: there are lots of good deals. #4 it's not a good time to list. #5 it not a good time to buy. #6 it's not a good time to invest&lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;Truths:&lt;/div&gt;
&lt;div&gt;*Rental vacancy rates are VERY low: metro area average is 4%, some counties are at 0%!&lt;/div&gt;
&lt;div&gt;renters are struggling to find a place to rent, investors are salivating: supply vs demand&lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;*Rental rates are going up.&lt;/div&gt;
&lt;div&gt;It could be cheaper to buy vs rent&lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;*Metro Denver Inventory (&lt;a href="http://www.housefitz.com/Search.aspx?wID=17703" title="search denver property"&gt;homes for sale&lt;/a&gt;) is down over 40%&lt;/div&gt;
&lt;div&gt;I have buyers waiting for homes to come on the market, Denver needs listings! It IS a good time to list your home.&lt;/div&gt;

&lt;div&gt;Well priced homes are moving! Lots of folks waiting to pounce on good deals&lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;*Interest Rates are still very low.&lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;*Lenders are finally loosing up&lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;

&lt;div&gt;Just announced: HUD just announced that they are increasing the up-front mortgage insurance premium and the annual mortgage insurance premium for FHA loans that have case numbers assigned on or after April 1, 2012.&lt;/div&gt;
&lt;div&gt;The up-front MI payment will increase from 1.0% of the loan amount to 1.75% of the loan amount.&lt;/div&gt;

      <description>&lt;p&gt;&lt;img src="http://activerain.com/image_store/uploads/7/5/3/6/7/ar132146320576357.jpg" height="208" alt="" width="234" style="float: right;"&gt;Inspections are often a "sticky" part of the real estate transaction.&amp;nbsp; Often buyers get bogged down in the details and want to ask for the moon to be fixed before moving on.&amp;nbsp;&amp;nbsp;Hence I find myself talking the buyer down&amp;nbsp;to&amp;nbsp;focusing on the &lt;span&gt;&lt;span&gt;saftey&lt;/span&gt;&lt;/span&gt; issues&amp;nbsp;and big ticket items.&amp;nbsp; Well, thanks to local Denver inspector Darryl &lt;span&gt;&lt;span&gt;Bashline&lt;/span&gt;&lt;/span&gt; from &lt;span&gt;&lt;span&gt;DBInspections&lt;/span&gt;&lt;/span&gt;&amp;nbsp;he has so kindly&amp;nbsp;put into words for us:&lt;/p&gt;
&lt;p&gt;1. What are the top 5 things you don't want to find during a home inspection?&lt;/p&gt;
&lt;p&gt;A: You don't want to find safety of costly repair issues such as:&amp;nbsp;1.&amp;nbsp;Foundation problems 2. Roof/Structural problems 3. Water/wet basement/crawl space issues (they can lead to health/safety issues like mold) 4. Fire hazards/&lt;span&gt;&lt;span&gt;saftey&lt;/span&gt;&lt;/span&gt; issues: &lt;span&gt;&lt;span&gt;HVAC&lt;/span&gt;&lt;/span&gt;, fire or carbon monoxide hazards, Electrical fire hazards&lt;/p&gt;
&lt;p&gt;2. What are the top 5 things you want to learn at a home inspection?&lt;/p&gt;
&lt;p&gt;A: Question #1 in reverse order plus peace of mind.&amp;nbsp; 2. Proper home care and maintenance 3. Roof installation details: roof flashing's&amp;nbsp; 4. Furnace and water heater age and condition 5. proper exterior drainage&lt;/p&gt;
&lt;p&gt;3. Why is radon such a big deal?&lt;/p&gt;
&lt;p&gt;A: Radon is decaying uranium that enters a house by seeping up through the slab or crawlspace. It has been reported that radon is the second leading cause of lung cancer behind cigarette smoking.&amp;nbsp; Radon is heavier than air and will build up at the lowest living space in the house. The EPA says Radon levels at or above 4.0 &lt;span&gt;&lt;span&gt;picocuries&lt;/span&gt;&lt;/span&gt; per liter of air should be mitigated. (mitigation systems typically run $800 to $1200)&lt;/p&gt;
&lt;p&gt;4. What are the most common issues inside an electric panel?&lt;/p&gt;
&lt;p&gt;A: 1. A breaker with a "double" tap. (two wires connected to one breaker) 2. An "over-fused" circuit. (wire size too small for breaker ratings) 3. Scorched or charred wiring or breakers 4. Aluminum branch wiring for general circuits 5. Openings in the dead front cover that a person could put a finger through (there is a reason it's called a "dead" front cover) 6. Out dated panels (Panels that use fuses instead of breakers and a fuse has been replaced with improper fuse rating or the fuse is wrapped in aluminum foil.)&lt;/p&gt;
&lt;p&gt;5. What are the most common questions you encounter? How do you address them?&lt;img src="http://activerain.com/image_store/uploads/9/8/1/3/3/ar13214633189.jpg" height="133" alt="" width="200" style="float: right;"&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;The Federal Housing Finance Agency is seeking unspecified compensation, claiming that these institutions knowingly peddled shoddy deals without informing the investors of the questionable paper....&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;AND:&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;"Securities and Exchange Commission officials are trying to &lt;span style="text-decoration: underline;"&gt;make it easier on themselves&lt;/span&gt; to hold more individuals responsible for wrongdoing during the financial crisis.&lt;/p&gt;
&lt;p&gt;In a major shift from the agency's traditional enforcement strategy, the SEC could file more civil cases in which defendants are accused of negligence only, rather than harder-to-prove charges of intentional wrongdoing or recklessness, according to SEC officials.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;In the past, the SEC sometimes persuaded individuals to agree to narrow negligence charges in order to settle the case, rather than fight the agency in court over more-serious allegations, according to defense lawyers."&lt;/p&gt;

&lt;p&gt;So, pardon me while I chuckle&amp;nbsp;a little bit, &lt;strong&gt;no laugh at the folly of it all!&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;Just what does the Federal Government intend to do, really? NOTHING!&lt;/p&gt;
&lt;p&gt;&lt;img title="SAD, BAD, IT AIN'T SO FUNNY IS IT?" src="http://activerain.com/image_store/uploads/7/0/2/7/9/ar13173446497207.jpg" height="135" alt="IF IT WEREN'T SO BAD, I WOULD LAUGH!" style="margin: 4px 5px; float: left;" width="180"&gt;&lt;strong&gt;Right now there are Billions of dollars being literally thrown at "Green" companies&lt;/strong&gt; that can't find their way in the dark-- or the light....failing companies that don't&amp;nbsp;merit the money to try to survive, especially&amp;nbsp;when the government&amp;nbsp;&lt;strong&gt;&lt;em&gt;knows&lt;/em&gt;&lt;/strong&gt; they won't last!!&lt;/p&gt;
&lt;p&gt;So, the money goes into a black hole---all the while the poor homeowner still suffers from the damage done to the housing market from the fraud perpetrated by huge financial institutions!!!---And the money that was set aside for the homeowner who was put at risk from all the bad loans that were given to people who&lt;img title="I NEED TO LAUGH , SO THAT I DON'T CRY!!!" src="http://activerain.com/image_store/uploads/7/8/7/6/8/ar131734485486787.jpg" height="135" alt="IF I DIDN'T LAUGH, I WOULD CRY!" style="margin: 4px 5px; float: right;" width="180"&gt; could not afford a home???&lt;/p&gt;
&lt;p&gt;Why,&lt;strong&gt; that money is still there&lt;/strong&gt;--not having been spent, because no one knows how to use it to help out the suffering homeowners!!! No, the &lt;strong&gt;homeowners who were given the bad loans are long gone&lt;/strong&gt;---those houses were the first to&amp;nbsp;be foreclosed upon and the individuals who were given those bad loans&amp;nbsp;have moved on--into complete and&amp;nbsp;utter poverty, homeless-ness or even worse!!!&lt;/p&gt;
&lt;p&gt;We are now on the 2nd and 3rd wave of defaults in&amp;nbsp;the aftershock of this fraud--&lt;strong&gt;Now qualified homeowners, who were ok in the beginning, are starting to feel the effects&lt;/strong&gt; &lt;strong&gt;of the massive mortgage fraud&lt;/strong&gt;. This is a peaceful demonstration by some Boston residents but it is a great way to make a point.&amp;nbsp; The volunteer protestors stated the bank should take care of their foreclosed properties. &amp;ldquo;Basically they need to be accountable for their property. They foreclosed on these people, they wouldn&amp;rsquo;t renegotiate their mortgage, they kicked them out, and the place is overgrown and it&amp;rsquo;s a mess. The message is: Take care of your property.       <title>Viewing Homes for Sale Between Denver and Boulder - </title>

This is a sample of what your agent will do each time before you go 'on tour'.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;If you're selling a home between Denver and Boulder reading through this might help you understand why, if you get a request for a showing at a certain time, and you ask them to come at another time, they likely will not come at all.&lt;/p&gt;
&lt;p&gt;Many people seem to believe that agents stack the deck with showings, putting all the 'uglies' up first, then showing the 'pretties', so buyers will be more impressed and make a quicker decision. Well, that might work if you're searching a small area, but most of the people I help find a home are interested in seeing homes spread over a sizable area. So when I set up multiple showings, they're arranged in the best drive order.&lt;/p&gt;
&lt;p&gt;Generally, I've gotten input from my client as to which homes they want to see, what time to start, and how much time they have available. I also like to know how many people are coming along and if any children are joining us. The more people that come, the fewer showings I schedule per hour, so we have time for more conversation during each showing and for drink and/or bathroom breaks.&lt;img title="house hunting colorado" src="http://activerain.com/image_store/uploads/4/6/6/7/4/ar131540722747664.jpg" height="336" alt="house hunting denver to boulder" style="float: right; margin: 12px;" width="225"&gt;&lt;/p&gt;
&lt;p&gt;Once the best route has been determined, I start calling the phone numbers to set the showing for each home. Today I set out to schedule nine showings. &amp;nbsp;That's more than I like to do in one day but the client is moving from out of town and isn't here often, so we've got to pack them in.&lt;/p&gt;
&lt;p&gt;I like to give a 2-hour window because it is difficult to anticipate how long a home buyer will stay in each home, and to estimate delays such as road construction. Home sellers who will only allow a 1-hour window are making it difficult to show their home, and I will often have to call to request a time change anyway. But some sellers have real needs for a shorter window, so I do my best to comply.&lt;/p&gt;
&lt;p&gt;Out of the nine homes I wanted to show today, I was told three are now under contract and are not allowing showings.&lt;/p&gt;
&lt;p&gt;So now we're down to six, a more reasonable number. The thing is, it's likely at least one of these six is also under contract but the agent hasn't informed the showing line yet.&lt;/p&gt;
&lt;p&gt;Out of the original nine, all were vacant but one. Vacant homes are easy to set up but occupied homes can be a problem. Imagine I've planned out a route, starting at the north end of the area and ending at the south end. Home #4 is occupied and they want us to come two hours later than I've planned. Chances are, we won't be able to see that home at all, due to time limitations. &amp;nbsp;In today's case, the client has a plane to catch, so he won't be seeing that house. I don't know right away if there's going to be a problem seeing the occupied home, as I have to wait for the showing line folks to call that homeowner to get their OK.&lt;/p&gt;
&lt;p&gt;Each home has a different type of access to the home, but most are via a code to a lockbox of some kind. Sometimes there is also an alarm to shut off.&lt;/p&gt;
&lt;p&gt;Once I obtain all the access codes I print out showing sheets for my client.&lt;/p&gt;
&lt;p&gt;Then, I spend a few minutes praying that all the codes will actually open the lockboxes, that there will be keys in the lockboxes that will successfully open the door, and that we don't run into someone in the house who says they didn't know we were coming and won't let us in.&lt;/p&gt;
&lt;p&gt;Hopefully, this adventure will result in finding a great home for my client, and another appointment to write up an offer.&lt;/p&gt;

&lt;p&gt;Multiple articles are out this week about the low vacany rates for metro Denver.&amp;nbsp; Two counties even posted a 0% rating (Broomfield and Boulder).&lt;/p&gt;
&lt;p&gt;This is a good indicator for those thinking of investing in the Denver housing market.&amp;nbsp; Rental demand is high which could drive rental prices even higher.&lt;/p&gt;
&lt;p&gt;&amp;ldquo;Both the vacancy rate and the number of days on the market are at the lowest levels recorded since 2001,&amp;rdquo; said Ryan McMaken a spokesman for the Division of Housing.&lt;/p&gt;
&lt;p&gt;1.9% was the highest county wide vacancy rate. Here is a break down according to the Colorado Division of Housing:&lt;/p&gt;
&lt;p&gt;Adams county: 1.9%&lt;/p&gt;

Finally!&amp;nbsp;I just read this article: &lt;a href="http://lowes.inman.com/inmaninf/lowesnewsletter/news/146920" title="Lowes article"&gt;4 ways online real estate valuations fail&lt;/a&gt;.&amp;nbsp; I will add this to my library for&amp;nbsp;refuting the&amp;nbsp;monthly conversation of off-based&amp;nbsp;website property values.&amp;nbsp; I know Realtors are not the only ones&amp;nbsp;putting out this fire, mortgage brokers and appraisers have the same&amp;nbsp;objection:&amp;nbsp; But&amp;nbsp;***** says my home is worth $270,000!&amp;nbsp;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Here's&amp;nbsp;their list of&amp;nbsp;ways&amp;nbsp;consumers could get bad comps:&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;&lt;em&gt;if your home is older and has had a lot of improvements&amp;nbsp;and even additions that are not in the county records, you're likely to get bad&amp;nbsp;comps;&lt;/em&gt;&lt;/li&gt;
&lt;li&gt;&lt;em&gt;&lt;strong&gt;if homes in your area are very different from each other,&amp;nbsp;you might get bad comps&lt;/strong&gt;;&lt;/em&gt;&lt;/li&gt;
&lt;li&gt;&lt;em&gt;if you live in a neighborhood very nearby another&amp;nbsp;neighborhood where homes have a much higher or lower value than your area's&amp;nbsp; (say, because they belong in a better school district or even on the other side&amp;nbsp;of the city limits), you're prone to getting bad comps;&lt;/em&gt;&lt;/li&gt;
&lt;li&gt;&lt;em&gt;if your home is in an area where homes are dense, the&amp;nbsp;algorithm might jump over many very nearby properties to get to a relatively&amp;nbsp;dissimilar one even a half-mile away, and that can give you bad comps.&lt;/em&gt;&lt;/li&gt;
&lt;li&gt;&lt;em&gt;The computer can't necessarily&amp;nbsp;distinguish nuances in a property's condition or aesthetics, nor does it always&amp;nbsp;correct for whether the house two blocks over was a short sale or a&amp;nbsp;foreclosure&lt;/em&gt;&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;(Not to mention where the data comes from or how dated it is.&amp;nbsp; Also look into the sites accuracy rate.)&amp;nbsp;&lt;/p&gt;
&lt;p&gt;"But when it's time to actually list your home, or figure out&amp;nbsp;what it is worth, no computer -- no algorithm -- is as accurate as a living&lt;a href="http://www.housefitz.com" title="housefitz website"&gt;&lt;img title="CMA" src="http://activerain.com/image_store/uploads/9/5/2/8/5/ar131178202358259.jpg" height="200" alt="free market wizard" width="133" style="float: left;"&gt;&lt;/a&gt;,&amp;nbsp;breathing local real estate professional who sees and sells all the different&amp;nbsp;specimens of homes in your neighborhood and sees firsthand what ready, willing,&amp;nbsp;qualified buyers actually pay for them, day in and day out.&lt;/p&gt;
&lt;p&gt;I think it's&amp;nbsp;important for sellers interviewing listing agents to discuss the online&amp;nbsp;comparables with prospective listing agents, but not as a counterargument to&amp;nbsp;what the listing agents recommend you list your home at."&lt;/p&gt;

      <description>&lt;p&gt;&lt;strong&gt;Treasury To Temporarily Penalize Mortgage Companies, Making Good On Old Threat&lt;/strong&gt;&amp;nbsp;&amp;nbsp; 3 of the largest mortgage companies are failing to comply with the&amp;nbsp;MHA program used to help struggling homeowners.&amp;nbsp; The Treasury has been threating for 19 months, yep 19 months, to penalize these lenders for&amp;nbsp;non-compliance and "abusing homeowners".&amp;nbsp;"More homeowners have been kicked out of the program than are receiving assistance."!&amp;nbsp;&amp;nbsp;Really?!&amp;nbsp; I had to share this &lt;a href="http://www.huffingtonpost.com/2011/06/09/obama-administration-temporarily-penalizes-banks_n_874491.html?icid=main%7Chp-laptop%7Cdl5%7Csec1_lnk3%7C215627" title="Huffington Post article" target="_blank"&gt;article&lt;/a&gt; and spread some awareness.&lt;/p&gt;
&lt;p&gt;"Treasury first identified potential mass non-compliance in November 2009, warning the participating companies that those failing to meet their obligations to homeowners under their contracts with the federal government "will be subject to consequences which could include monetary penalties and sanctions." The Obama administration spent the next year and a half defending itself against accusations levied by federal auditors, members of Congress and consumer groups that it was soft on the big banks' abusive behavior due to its reluctance to follow through on that threat."&lt;/p&gt;
&lt;p&gt;What is your reaction to this? The best part is two of the banks are refutting the results and said it doesn't matter to them... BUT it does matter to them to get the market turned around.&amp;nbsp; So, we bail them out and then they&amp;nbsp;turn the screws more?&amp;nbsp;Blatant abuse? Where do we point the finger?&amp;nbsp; We're paying the bills and this is our tax dollars at work.&lt;/p&gt;
&lt;p&gt;The grades are in and they are terrible: "Bank of America, Wells Fargo and JPMorgan Chase, which collectively service about half of all home loans, abused homeowners and violated the rules of the Making Home Affordable (MHA) program, Treasury said. The initiative aims to lower monthly payments, reduce loan balances or enable distressed borrowers to sell their homes before they're seized by awarding a series of incentive payments to banks, investors and homeowners when foreclosures are averted. Treasury is only withholding pay to the three banks.The three were found to need "substantial improvement," the agency said in a statement. Cumulatively, they received $24 million in government incentive payments last month. Last quarter, the three financial behemoths collectively reported about $11.4 billion in net income."&amp;nbsp;&lt;/p&gt;
&lt;p&gt;"Potentially "thousands" of troubled homeowners were denied opportunities to lower their monthly mortgage payments under the administration's program due to servicer errors and inadequate oversight by Treasury, according to a June 2010 audit by the Government Accountability Office (GAO)."&lt;img src="http://activerain.com/image_store/uploads/5/8/0/0/0/ar130956081600085.jpg" height="160" alt="" width="200" style="float: right;"&gt;&lt;/p&gt;

      <description>&lt;p&gt;This too good not to share.&amp;nbsp; This is an &lt;a href="http://lowes.inman.com/newsletter/2011/06/01/news/143947" title="article" target="_blank"&gt;article written to the editor of Inman News&lt;/a&gt; from a real estate agent from Las Vegas.&amp;nbsp;&amp;nbsp;His response is on point.&amp;nbsp; Many folks have opinions on "how" our market is doing, but the truth is, those that are on the front lines have the best reports.&amp;nbsp; The &lt;a href="http://www.housefitz.com/ShowPage.aspx?wID=17703&amp;amp;ID=4ECFB85F67FD992E451AD1634C54410B" title="short sale process" target="_blank"&gt;short sale process&lt;/a&gt;is tricky and often mis-aligned with no clear protocol to follow AND each bank follows a different protocol.&amp;nbsp;Buyers are often mis-informed or uneducated about how the process works. Mr. LeVine makes some very good points on how this could be changed.&lt;/p&gt;

&lt;h3&gt;&lt;strong&gt;Dear Editor:&lt;/strong&gt;&lt;/h3&gt;
&lt;h3&gt;There's one BIG change that would make the recovery faster, smoother and more vigorous. &lt;em&gt;All&lt;/em&gt;short sales should be at preapproved prices. They shouldn't be allowed to go into the multiple listing service until the banks have agreed to the price, terms and conditions -- including and especially how deficiencies and seller contributions will be handled.&lt;/h3&gt;
&lt;h3&gt;Why? Because we have too many willing and able buyers who get their hopes up and then are trapped in a short-sale contract, with slim chances of successfully owning the house. Unless the buyer is in contract on multiple houses, they're out of the market waiting for something that probably won't happen.&lt;/h3&gt;
&lt;h3&gt;Having multiple contracts hurts the sellers, as these buyers are going to drop out as soon as one of their "deals" comes together. Massive time and energy is being spent by real estate agents, with little chance of success.&lt;/h3&gt;
&lt;h3&gt;The strategic default problem would be reduced if the sellers knew that they'd be foreclosed on quickly. They're taking advantage of the prospect of making out better by doing a short sale. They're the most likely to have the banks requesting funds from the seller, or refusal to waive deficiency judgment -- terms that the seller will probably turn down, anyway.&lt;/h3&gt;
&lt;h3&gt;If we knew in advance that the seller was truly qualified for a short sale, that the bank didn't have some other agenda, and was motivated to not get the property back in foreclosure, then I'd be happy to bring my strongest buyers to the short-sale deal. Meanwhile, the real buyers are fighting over the REOs (bank-owned properties), flips and equity transactions, of which there are actually too few.&lt;/h3&gt;
&lt;h3&gt;Prices keep falling because the short-sale agents are listing at 5 to 10 percent below comps in order to try to get an offer, and often are accepting offers at even less. The banks come back at a higher price, and then the buyer walks. The downward momentum has been coming from the short sales, &lt;em&gt;not&lt;/em&gt; from the REO listings.&lt;/h3&gt;
&lt;h3&gt;It would be nice if the banks would just do as I suggested, or the government forces them to do it. The reality is that the real estate community is going to have to tell the banks that we're not going to facilitate their craziness any longer.&lt;/h3&gt;
&lt;h3&gt;We'll take the listings, we'll process the short sale to approval or denial, but we &lt;em&gt;won't&lt;/em&gt;put it on the MLS or tie up a buyer, or spend money to advertize and promote it until we know there's actually a huge chance that a closing could take place.&lt;/h3&gt;
&lt;h3&gt;That was the premise, and the promise of the &lt;a href="https://www.hmpadmin.com/portal/programs/foreclosure_alternatives.jsp"&gt;Home Affordable Foreclosure Alternatives program&lt;/a&gt;(HAFA), but HAFA has been just as big of a joke as the way we do it now.&lt;/h3&gt;
&lt;h3&gt;Let's only sell houses that can actually, really, truly be bought. If the banks can dictate to us that they won't even consider a short sale till there's an offer, then we ought to be able to dictate to them that we won't look for an offer without a preapproval of the sale.&lt;/h3&gt;

&lt;p&gt;I read this &lt;a href="http://lowes.inman.com/newsletter/2011/05/24/news/143466" title="article" target="_blank"&gt;article ranking how quickly markets are moving&lt;/a&gt;.&amp;nbsp; &lt;a href="http://www.realtor.com" target="_blank"&gt;Realtor.com&lt;/a&gt;&amp;nbsp;ranked the top 146 markets across the nation to&amp;nbsp;gauge how quickly the market is moving and Denver came in #1.&amp;nbsp; (California held 5 of the top 10 positions.)&amp;nbsp; This is a great indicator for those that are questioning the Denver market.&amp;nbsp; Still wondering if it is a good time to buy or sell?&amp;nbsp; Here are a couple things to consider:&lt;/p&gt;

&lt;p&gt;Here are some key points:&amp;nbsp; &lt;span style="text-decoration: underline;"&gt;Submit complete paperwork.&lt;/span&gt;&amp;nbsp; Ask your bank what they will need and be sure to write your loan # and name on each page.&amp;nbsp; (There is a good list of required paperwork in the article.)&lt;/p&gt;
&lt;p&gt;&lt;span style="text-decoration: underline;"&gt;Be persistent!&lt;/span&gt;&amp;nbsp; Follow up to make sure they received your paperwork.&amp;nbsp; Call and call again.&amp;nbsp; We you turned down?&amp;nbsp; Ask why!&amp;nbsp; Also refer to the &lt;a href="https://www.hmpadmin.com/portal/programs/index.jsp" title="HAMP and HAFA website" target="_blank"&gt;HAMP and HAFA programs&lt;/a&gt; to ensure the bank is following correct protocol.&amp;nbsp; Do you qualify for these programs?&lt;/p&gt;
