buyers agent: What are the duties of a buyer’s agent in Georgia?

As a real estate consultant, I am often asked what is expected of buyer’s agents in the State of Georgia. And in Georgia, the answer is actually very simple. Because in Georgia all real estate agency agreements MUST be clearly defined in writing. So the buyer and the agent are free to negotiate any duties (or lack thereof) that they wish. This is often defines as “level of service.” The only exception is that the agent must obey all state and local laws, rules and regulations. In Georgia if there is no written agreement, there is no agency. Period.

When I first sold real estate in 1984, buyer’s brokerage was rarely practiced and even more rarely compensated. The theory was at that time that if the buyer wanted an agent to represent them, then the buyer should be the one that pays for it. The actual implementation of the concept usually only occurred in commercial real estate transactions. For whatever reason, business buyers seemed to grasp the notion that the entity deriving the benefit from the service should be the one that pays for it. buyers agent: Why all the fuss about buyer's agents?

When I started selling real estate in 1984, rarely was the term "buyer's agent" ever used. At that time, if a buyer wanted an agent, the buyer had to contract with and AGREE TO PAY the agent representing them. Cooperating agents were sub-agents of the listing agents, and represented the sellers. All of this changed somewhere in the late 80's and early 90's. Buyers DEMANDED representation and in many cases, sued sub-agents for not disclosing their agency status.
