With foreclosure reaching nearly historic levels, the bank is truly not interested in adding your home to the ever growing list of foreclosed properties. The bank is, however, interested in collecting on your loan. The nation is educated now and is aware of the preditory lending techniques used by many brokers and banks to obtain mortgages for those people who should have never received them in the first place, and then were given the loan with the punishment of absurd and unmanageable interest rates adjusting to the sky. With the impending money crisis in America, the banks have graced us all with the possibility of new loan agreements and/or modification of the existing terms of our loans. I guess they have decided its better to collect some money then to become a real estate company in today's market. The banks are willing to modify as many loans as possible, as fast as possible, before the collateral damages bottoms out the median home prices. Each drop in the bucket shrinks the number of future foreclosures.

In mid October, the federal prosecutor indicated that charges will be filed in the coming months in an investigation of the banks and subprime lenders for their role in the nation's mortgage crisis. Hmmmm imagine that ?

Since the year 2000, lenders have made more than 2.5 trillion in subprime loans. Nearly all of these mortgages are going bad as millions of families lose thier homes. A large percentage of these mortgages were sold to those of us with credit scores good enough to qualify for loans with far better terms, but instead, we were given subprime loans by mortgage brokers motivated by favorable commissions using deceptive tactics.

Sorry guys but there is a point to this will finish up shortly.  In the interim, check out www.sitemeter.com it is great for tracking traffic on your website and literally show you each and every page, entry, exit and in between.  Ip addresses, location of ip address, etc., etc.  Actually the only reason you would change your ip address is to disguise yourself.  I have a person who is so infautuated with me that they actually spend hours and hours on my website.  After some time they changed their ip address thinking that I would not know that it was them, but I do.  This person has attempted to break into my Point 2 account among as the most of you stated numerous other ridiculous things, like altering listings.  Seems a little pathetic to me.  It must be they have NO life left.  My computer guy was able to divulge the information to me through a product called site meter.  In any event, site meter is a really great FREE tool which can be added to your website.  Sitemeter provides you with statistics including traffic, to and from hits, search words, referring url and, of course, lastly the identity of certain ip addresses via location if required.  There is a small fee for this information.  In any event, this is great information for those of you who have websites.  Alternately, this is also a little "i SEE YOU" for the person alternating ip addresses and spending endless hours of their pathetic little life on my website.

Recently, I changed Associations.  During my employ with my prior Association,  Long Island Horse Properties, I listed and sold 2 properties resulting in commissions due and owing for these listings.  The closing came and went, The Broker, Sharyn Guzzi, kept the commission due and owing to me.  The behavior indicates the untrustworthy business methods she elects to practice.  Most certainly, her retaining the commissions of an ex-salesperson, thinking she can "get away with it", indicates what her moral standing is.  The Broker is not able to pick and choose whom she elects to pay.  The delineation of payment is set forth in the Listing Agreement.  The disgruntled Broker displays her immature, irrational and greedy business practices.  Be aware of the Broker and Agency you are dealing with!

After researching the situation, I learned that NYS law and rules supersede MLS rules and hired an attorney and took it to District Court in Suffolk County, where the Court system could decide.  Unfortunately, NYS small claims does not exceed $5,000.00, per claim.  The DOS advised me that the listing agreement executed by the listing Agent as representative of the Agency and signed by the homeowner was sufficient and IS THE CONTRACT that will be entertained in the Court Systems.  Providing the percentages are set forth in said listing agreement you will win your case.  They were very helpful and supportive and recognized that this is an ongoing battle with a disgruntled ex Broker who was trying to keep commissions they are not entitled to.  I am sure there are many of you out there who can relate to this situation? Please be reminded that you do not have to stay in a bad situation for fear of losing your commission, just maintain accurate records and copies of all your listing agreements and sales and you too can take your Broker to Court and get the commission you are entitled to.

This is a category of Brokers whose behavior is so egregious it gives all of us, agents and Brokers alike a bad reputation.  One bad Broker ruins the reputation of the rest of us.

One wonders what thought process this Broker goes through retaining commissions due to others?  Either they began by swimming in the lower end of the gene cesspool or they are so sadly desperate in these economic times that their greed overtakes the concern of their moral standing?
