Yesterday I was preparing for my second closing of 2010 and in reviewing the HUD statement I discovered a $4,000 shortfall in my commission from the seller (I represented the buyer). This has been a two month contract where the sellers agent has continued to insist that I take a reduction in commission after the contracts were signed. The answer for her request was that the builder had no money and my choice was to take a reduction in commision or get no commission, however this is rediculous.
I agree with the saying it's better to get a piece of the pie rather than get no pie at all. I work for compensation, not for free. To assist in the closing, I agreed to a $4000 reduction in commission, however on the HUD statement the seller took an $8,000 reduction.
Now the really bad stuff. At 8:00 am on the morning of the closing I was told by the buyers attorney that the listing agents contract had expired two years ago and that there was no active listing agreement. I now have no alternative but to go after the other agent. Real estate could be a lot more fun if only people acted as professionals.
