Yes, it has happened again! I am seeing this happen more with my Las Vegas Short Sales.
Every Las Vegas Short Sale is different but I strive to get my clients the best possible solution for their situation when doing a short sale.
Sometimes the seller may have to make a cash contribution or do a promissory note to make the deal work.
This is not the first time I've received a Las Vegas Short Sale Approval where the Lender Waives Deficiency Right.
Recently we received Wells Fargo Short Sale approval with the lender waiving the right to pursue a deficiency judgment.

New Nevada Disclosure on Energy Use - or Waiver-More Paperwork! New Laws - 01/10/11 01:20 PM
Beginning January 1, 2011, the seller of residential property must provide the purchaser with an evaluation of the energy consumption of the home on a form provided by the Nevada Energy Commissioner. The form must be provided prior to closing the sale, and certain exemptions apply. OR
Note: All residential transactions that close on or after January 1, 2011 must comply with the new law. Either the evaluation form must be completed and provided to the buyer or the parties may waive the requirement by using the waiver form on the bottom of page 4 of the form.

The Home Affordable Foreclosure Alternatives Program (HAFA) - Policy Update of December 28, 2010 has some improvements to the original guidelines that may now pave the way for more short sales to get sold in 2011. Because so far across the nation only approx 700 HAFA Short Sales have been done.

The number of single family home closings during December were... 4,361 These closings are most likely up due to the temporary halt on foreclosures from a few months ago. There were many foreclosure bank owned homes under contract that were due to close in Sept/Oct/Nov, but were halted until the banks verified that the foreclosure was legal and most likely a lot of them were cleared for closing in December to “clear” them out and get them “off” the books. It can be more of challenge here in the Las Vegas Real Estate Market as Las Vegas Short Sales are now a huge part of our market, almost 50%.

It is almost that time of year when all the tax forms, 1099's, etc are hitting your mail box and if you completed a short sale in 2010 you may be getting a 1099-c any day now.
Get with your CPA, Tax Accountant or tax adviser for more information.
