&lt;p&gt;We all know someone that somehow seems to be unhappy with whatever they do or how they do it or actually never happy with us no matter how much we try to please them to make them happy. It could be our mom or dad, spouse, child, teacher, or boss...&lt;em&gt;a home buyer or a home seller&lt;/em&gt;.&lt;/p&gt;
&lt;p&gt;I once had a prospective buyer who was not happy with my services no matter how many 'extra miles' I went for them or how much time I spent with them looking for properties for them online. This included going to the premises and taking more images, acquiring floor plans...&lt;em&gt;can you believe it?&lt;/em&gt; Not that I actually did it but, &lt;em&gt;why did I even&amp;nbsp;think of allowing this predicament&lt;/em&gt;? I was saying yes to my buyer because I felt desperate to &amp;lsquo;sell'. Give me anything, (single-family homes, residential income, commercial properties, bulk REO's) &lt;em&gt;I'll do it&lt;/em&gt;!! Having experience with diversified real estate channels can be a blessing or can it be a curse?&lt;/p&gt;
&lt;p style=&quot;text-align: center;&quot;&gt;&lt;em&gt;The ethical and professional standards for a Realtor are to constantly seek self-improvement on an educational, social, and professional level to better serve their customers. &lt;/em&gt;&lt;/p&gt;
&lt;p&gt;The National Association of Realtors (NAR), the worlds largest professional real estate organization encourages Realtor's to seek additional real estate educational classes and seminars to continuously further their education, and &quot;...promote professionalism and improve ethical standards helping to mark the true professional&quot;. The NAR also discourages Realtors from&amp;nbsp;dealing with specializations that&amp;nbsp;they are not adept to.&lt;/p&gt;
&lt;p&gt;Eradicating the thought that &amp;lsquo;one bad apple does not spoil the whole tree' arises a public morality that categorically defines the failure or success of a real estate professional. Ingenuity however refines an establishment that basically enforces action to act upon our character; otherwise it may become difficult to build our reputation on genuine professional standards including the way we handle our business.&lt;/p&gt;

&lt;p&gt;It may have been written time and time again how the media justifies the real estate industry as a 'remarkable phenomenon' (unlike anything else) that evolves a destructive industrialist pattern in how we deal with buyers and sellers. In the past and until present, some real estate professionals were and are still offering castles in the sky to home buyers on home buying when in actuality most of the buyers from the 2005-2006 real estate/mortgage/financing saga erupted false loan applications. These were buyers where they were not supposed to be given a pen to sign with in the first place...&lt;/p&gt;

      <title>I Refuse to Become Bitter - A Mini Series of the Daily Life of a Realtor: Part One</title>
      <description>&lt;p&gt;One of the biggest complaints of buyers and sellers in the real estate business is that their Realtor (or their Realtor's) does not communicate with them enough, an attribute that Realtor's should acquire from day one of setting foot in the business. In essence, some Realtor's have become desolately bitter from the business. Regardless of the circumstances of today's uncertain real estate market and saga, maybe it is &lt;em&gt;time to quit or, &lt;strong&gt;go&lt;/strong&gt; with the flow.&lt;/em&gt; Uncertainties does not make or break an industry or a market, only individuals who choose to live, act, and think that&amp;nbsp;it&amp;nbsp;does.&lt;/p&gt;
&lt;p&gt;I just wrote on my Facebook status two days ago how rude and cold real estate agents can be and how they have seemingly lost their finesse in the business. One person replied, &quot;Yeah, its true&quot;, and another, &quot;Not at EWM!&quot;&lt;/p&gt;
&lt;p&gt;Not that I discredit the philosophy of any brokerage's agent/client/customer relations. It is not the real estate firm/agency/broker that can shape an agent's business character per se (or so it is), but to me, it is the agent that makes a name for themselves while representing the real estate brokerage firm that they work for.&lt;/p&gt;
&lt;p&gt;Although a broker's business' mission, vision, and philosophy reflects the identity of their business with professionalism, integrity, reputation and respect within a particular company and their agents, the majority of the times brokers have a company policy that helps to personify&amp;nbsp;professional ethics within this industry, a practicality&amp;nbsp;that should remain that way. But not everybody is on the same page of how professionalism and ethics plays an imminent role in the real estate business.&lt;/p&gt;
&lt;p&gt;Our attitudes can make or break a company but most importantly, our reputation as real estate agents. There is one agent that I would NEVER call. &lt;em&gt;My apologies for Mr. / Mrs. Buyer for my indirect/'unprofessional'/'unethical' behavior, but I cannot tolerate the fact that another Realtor has offended me or treated me with so much disrespect that they devalue my persona and discredit the hard working years of experience as a Realtor. I refuse to become bitter...&lt;/em&gt;&lt;/p&gt;

You can receive the &lt;strong&gt;first time homebuyers tax credit&lt;/strong&gt; upfront, but not through the IRS.&amp;nbsp; This would be illegal.&amp;nbsp;Please read : &lt;strong&gt;&lt;a href=&quot;http://www.fhaloansfhamortgages.com/fraud-alert-advice-on-the-8-000-first-time-homebuyers-tax-credit-do-you-risk-it&quot; title=&quot;first time homebuyers tax credit&quot; target=&quot;_blank&quot;&gt;It's illegal to receive your tax credit before you close on your home&lt;/a&gt;&lt;/strong&gt;.&amp;nbsp; &lt;strong&gt;Buyers - BEWARE&lt;/strong&gt;, please read that, because too many people are saying that you can get the money directly from the IRS prior to closing. The IRS &amp;amp; HUD both say no!!!&lt;/p&gt;
&lt;p&gt;So how can you receive this upfront?&amp;nbsp; It can be given to you as a second or a silent second from any Federal, State, or local agencies, and any &lt;strong&gt;FHA mortgagee&lt;/strong&gt; or any &lt;strong&gt;FHA approved non-profit organization&lt;/strong&gt;.&amp;nbsp; People, in layman's terms, this is already acceptable by HUD's standards, except for the lender that is now able to give the monies upfront in a form of a 2nd mortgage.&amp;nbsp;Another terminology is that this can be an advance loan from any of the entities mentioned above.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Summary :&lt;/strong&gt;&amp;nbsp; Essentially, this means that the entities mentioned above, are purchasing this tax credit on your behalf and giving it back to you. The short version of this is that you can use some of the money from the &lt;strong&gt;$8,000 Tax Credit&lt;/strong&gt; as your down payment, but after you put down the first 3.5% of that down payment. Meaning, you have to come up with 3.5% of your own money still. With &lt;strong&gt;FHA loans&lt;/strong&gt;, it can still be a gift from a relative/family member.&amp;nbsp; It also can come from non-profit or government agencies to be used as your initial down payment, but not used through the tax credit. Overall, the tax credit that is advanced, can be used for all closing costs. But you can't receive monies back at closing.&amp;nbsp;&lt;/p&gt;

Usually to put an offer on a house, the realtor would want a pre-qual letter to accompany the offer that they will give the seller's agent. It will usually have a specified loan amount that you are qualified up to in regards to purchasing of your home. This paper doesn't always have the weight that one might think. There are many reasons why to this.&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;There have been some loan officers known to not even check your credit.&lt;/li&gt;
&lt;li&gt;Some lenders just put anything down to get you comfortable, thinking that it's easy as 1-2-3. &lt;br /&gt;&lt;/li&gt;
&lt;li&gt;Some consumers who thought were pre-qualified actually weren't, because the loan officer didn't really know how to qualify. Meaning, they didn't know how to read the credit, came up with the wrong income, etc etc. These mistakes could put you into a new loan program that might have a higher rate. Worst of all, that you wouldn't be qualified period.&lt;/li&gt;

&lt;p&gt;Above&amp;nbsp;is a copy of a &lt;strong&gt;Pre-Approval letter&lt;/strong&gt;, better known as a &lt;strong&gt;Commitment Letter&lt;/strong&gt; or a &lt;strong&gt;Loan Approval Letter&lt;/strong&gt;.&lt;/p&gt;
&lt;p&gt;This type of letter and or approval is very important for several reasons.&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;All of your information has been verified and approved by an underwriter. The only time that this might need to be updated is if there is a change in your income or if the approval has expired. Depending on the type of mortgage program, your credit is good for 45 to 90 days and would be listed on the commitment letter.&lt;/li&gt;
&lt;li&gt;With this approval, you might have a better chance at getting your offer accepted. Why?&amp;nbsp; Because this would supersede any pre-qual letter. I have seen a few clients actually get a lower offer accepted because of this type of approval. This is a more powerful tool than anything else offered.&lt;/li&gt;
&lt;li&gt;Basically, this form states that you are fully approved. Everything except for an appraisal, which would state &quot;subject to an appraisal&quot; and possibly in regards to title insurance also.&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; This commitment letter would show you what is still need to finalize the approval.&lt;/p&gt;
&lt;p&gt;&lt;br /&gt;&lt;br /&gt;As a consumer, you want to be careful on how you shop for your lender. It's recommended to speak to friends, family, and co-workers for a referral of someone that they have used and trusted in the past. Sometimes your realtor has a few trusted lenders that they have worked with over the past several years. If you trust the realtor, this might be your best option.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;One last thing to always keep in mind. When interviewing your loan officer, a very good one would ask you about your &lt;strong&gt;goals&lt;/strong&gt;. He/she would want to give you different options and always be looking out for your best interest. Not just giving you what you want or think might be best for you. Just because your friend received a certain type of mortgage, doesn't mean it might be best suited for you.&amp;nbsp; Remember, there is a&lt;strong&gt; Big Difference&lt;/strong&gt; in regards to the different types of letters.&lt;/p&gt;

      <title>Service Animal Owners: Be Prepared to Show Proof of Documents when Viewing Properties</title>
      <description>&lt;p&gt;I have a lovely couple who wanted me to show them beachfront condo property. Once we met at the property I noticed that they had a dog. We were having small talk conversation while waiting for the gate keys to enter the premises from the seller. I didn't say much about the dog because we were just going to view a condo unit on the first floor which had the windows open; the unit is a furnished efficiency facing the ocean so there wasn't much time to take to see a one room unit.&lt;/p&gt;
&lt;p&gt;Everything was fine until we found ourselves confronted by the property manager telling us not only that we couldn't park in front of the building but that there were no pets allowed on the premises. &quot;Oh, my dog is not just any dog. He is a service dog and I have every right to have him with me&quot;, claims the dog owner.&lt;/p&gt;
&lt;p&gt;But the property manager insisted that they did not care what type of dog it was, &lt;em&gt;just&lt;/em&gt; &lt;em&gt;get out!&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;The buyers went to their car to show proof that they had indeed the proper document to show that the dog is legal and that it serves the owner for medical emergencies.&lt;/p&gt;
&lt;p&gt;We told the property manager that we were only &amp;nbsp;going to be a few minutes to view one unit from the outside. They called security on us and told us to leave the premises because we were harassing them.&lt;/p&gt;
&lt;p&gt;I was a bit surprised that the property manager is not even aware of this situation which clearly screams discrimination. I took the property manager to the side and told them what they were doing and they immediately let us in the premises. No more questions asked.&lt;/p&gt;
&lt;p&gt;Sometimes people do and say things in their professions unintentionally but not only was the property manager not aware of service dog laws, they were plain out rude!&amp;nbsp;&lt;/p&gt;

An unlicensed person imposing as a Realtor may be charged a 3&lt;sup&gt;rd&lt;/sup&gt; degree felony while a licensed Realtor may be fined for aiding an unlicensed person to practice real estate without a license.&lt;/p&gt;
&lt;p&gt;There are large brokerage firms who have an 800 # that when real estate agents call to get showing instructions must give their full identity and their license number to be verified. You must register with these &amp;lsquo;showing' companies before they give you any showing instructions. Shouldn't you do the same?&lt;/p&gt;
&lt;p&gt;In order to show real estate properties in the State of Florida, you must be a current/active licensed real estate salesperson or be a licensed personal assistant.&lt;/p&gt;
&lt;p&gt;If you need to show a listing, whether you are a mortgage broker or are an investor or in any profession alike and posing as a Realtor, do yourself a favor and ask for the licensed listing agent or licensed personal assistant to show you the property. You are better off saving your time by having the Realtor there with you in case you have any questions about the property and avoid criminal charges against you. You never know when FREC will be calling.&lt;/p&gt;
&lt;p&gt;The DBPR conducted an investigation in a rental real estate office that I worked at in my early days of real estate. One of the&amp;nbsp;sales associates was being 'interviewed' by the DBPR and&amp;nbsp;told her to&amp;nbsp;avoid certain areas of certain races.&amp;nbsp;Why did the DBPR do the investigation? I&amp;nbsp;have no clue but the Realtor passed the 'test'. You just never know who is who at the other side of the phone.&lt;/p&gt;
&lt;p&gt;We have enough fraudulent activities with mortgages - Identify yourself just as you are and abolish real estate fraudulent practices; its just not worth the crime.&lt;/p&gt;

      <title>I Love to Blog And It Shows! Here's Why...My Advice to a Homeowner/Tenant Foreclosure Dispute</title>
      <description>&lt;p&gt;A prospective tenant calls me today telling me that she found me on my blog at ActiveRain. Of couse, I always get delighted when consumers find me through my blogs. She tells me that she is a tenant living in a foreclosed home and needed my advice on 'something'.&lt;/p&gt;
&lt;p&gt;Eager to listen to her story, I curiously asked her which blog she was calling me on. &quot;One of the ones that you wrote&amp;nbsp;about foreclosures&quot;, she said. &quot;Oh great! How may I help you?&lt;em&gt; Yes!&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;So here&amp;nbsp;is the scenario:&amp;nbsp;Ms. Tenant&amp;nbsp; received a foreclosure package from the bank, hand delivered, of course, that the house that she is living in is in foreclosure. That was back in November of '08. Apparently, the owner stopped paying for their mortgage back in March '08. Once Ms. Tenant received the foreclosure package, she then decided to stop paying rent. Why pay, the owner is in default with the bank, right?&lt;/p&gt;
&lt;p&gt;Right and wrong! Just because the owner/landlord is in default with their&amp;nbsp;mortgage does not mean that tenant stops paying rent. Whether the tenant chooses to stay in the property after being notified that the property is in the process of being foreclosed on, here are some steps that the tenant might want to take:&lt;/p&gt;
&lt;p&gt;It is true that you don't have to pay one more dime of rent, at least not to the owner. In fact, there are many conflicting stories on this debate and it varies from state to state, county to county, and city to city, and day to day news and laws that are ever changing. I have heard many horror stories of tenants being evicted by the Sheriff's department and there is nothing that tenant/s can do once you get BSO knocking on your door telling you &quot;You must vacate the premises immediately&quot;.&lt;/p&gt;
&lt;p&gt;This may be due to the landlord a) has filed an eviction notice on you because you decided to stop paying rent (after all, it is still considered their property), or b) the property is at that time, a bank owned property which means, get out, for once! Bank owns the propety, not the 'previous owner' or your 'previous landlord'. Banks have every right to change the locks without being concerned about you. Harsh, but true.&lt;/p&gt;
&lt;p&gt;Now, to avoid conflicts with your landlord, and to stay in the home in the meantime the property is in foreclosure process, you can:&lt;/p&gt;
&lt;p&gt;Tell the owner that you want to continue paying the rent if it's absolutely necessary, (you might just have a few long months to stay in the property in the meantime you get ready to look for another place to live), but you will make the payments directly to the bank, or do yourself a favor, give yourself some peace of mind, don't stress out of the situation and find yourself a temporary place to stay or find yourself another place to live.&lt;/p&gt;
&lt;p&gt;For many families, moving out of a foreclosure/bank owned property can be a very devasting event, it's happening in everywhere, you are not alone, you won't be the first and you won't be the last.&amp;nbsp;In Ms. Tenants case, if you have the resources to move then JUST DO IT!&lt;/p&gt;
&lt;p&gt;Ms. Tenant was confused but I assured her that by leaving the premises and avoiding confrontations from a landlord that is threatening to change the locks and putting her stuff on the street without properly and legally processing the eviction is not only illegal from the owner but why argue the point? It is what it is.&lt;/p&gt;
&lt;p&gt;We are going out to see some properties tomorrow - Ms. Tenant could not find better relief in my comforting words when I told her not to stress herself out, it is just not worth it! It's also not fair to go through these situations but sometimes confronting the situation is better than fighting it &lt;em&gt;properly!&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;Owner/tenant scenarios like these vary and are unique in each and every case. I am not a lawyer but can guide you in finding a better situation by finding you another home. Have a similar story?&amp;nbsp;&lt;/em&gt;&lt;/p&gt;

      <description>&lt;p&gt;After everything that has been said and done about the real estate foreclosure crisis, even though the end is not over, you can't say it is over till it is actually over. Andrews, which stated that under the threat of a subpoena, The Treasury Department will be under investigation scrutiny with several major financial institutions with copies of several signed contracts they signed with Wall Street with the $700 billion bailout.&lt;/p&gt;
&lt;p&gt;While the first $350 billion bailout money has already been spent, President elect Obama plans to foresee that the second half of the $700 billion will be to &quot;increase lending and preventing new financial crisis and not enriching shareholders and executives...imposing tough conditions on companies who are getting aid...&quot; And the bailout money really goes out to...&lt;/p&gt;
&lt;p&gt;The article also states that the FDIC will be regulating how the banks are utilizing the bailout government money. In a minuscule comparison, that's like the FDA saying that they will label every toxic ingredient in the packaged foods that we consume. We will see about that - I want to hear and see some action!&lt;/p&gt;

&lt;p&gt;There has been debate over bailing out automakers and what they have to do with the financial crisis. Beside the point, now that automakers are getting bailed out of the financial crisis too, will the pharmaceutical companies or hospitals be next? Think about it - &lt;em&gt;too many uninsured patients going to the doctor because of the financial crises and foreclosure hardships have caused them congestive heart failure and so on, so the hospitals have way too many expenses&lt;/em&gt;...&lt;strong&gt;just a thought&lt;/strong&gt;.&lt;/p&gt;
&lt;p&gt;While we wait for the financial crises to subside we can focus on what is important to us as real estate professionals - make deals, make it happen! Despite the circumstances, I believe that if you want something so bad and put your mind and energy into it, life itself will bring it to you, and if doesn't, it was never meant to be. Use your imaginary button and click NEXT! &amp;nbsp;Just the other day my friend told me, &quot;somethings gotta give&quot; on a plan that I was hoping for. The plan didn't go through, instead, I received something greater&lt;em&gt;.&lt;/em&gt; Life was after all, on my side, I just had to learn to be patient. You have to grab life by the horns!&lt;/p&gt;
&lt;p&gt;Here is an inspirational song - hope you like it! It was inspired to me because it sickens me to see and hear that people are making money out of other people's innocence. There is a lyric to a song that goes something like this &quot;I'd rather you hurt me honestly than mislead me with a lie&quot; can't remember the artist. To me, that's the real estate buyer/seller interpretation of &quot;I'd rather you hurt me honestly by telling me the truth that I cannot buy or sell a/my home at this time than mess with me, my time, and my money and me and you can get along just fine.&quot;&lt;/p&gt;
