&lt;p&gt;Having spent nearly 25 years on Wall Street, most notably with Goldman Sachs and &lt;a href="http://rsfunds.com" title="Robertson Stephens and Company" target="_blank"&gt;Robertson Stephens&lt;/a&gt;, i would like to occasionally offer up some relatively low risk and carefully conceived investment thoughts.&amp;nbsp; I will not use the term advice since i have become sufficiently jaded by many highly successful fund managers&amp;nbsp;from my personal investing experience.&lt;/p&gt;&lt;p&gt;There is a well written article in the December 10th issue of &lt;a href="http://www.forbes.com/personalfinance/forbes/2007/1210/152.html" title="Forbes Magazine" target="_blank"&gt;Forbes Magazine&lt;/a&gt; that i would like to suggest to each of you.&amp;nbsp; The title of the article is, &amp;quot;Shock Absorber Funds.&amp;quot;&amp;nbsp; It lists six funds that are all no load (meaning no up front sales charge), run with reasonable annual expenses and each share two more noteworthy characteristics.&lt;/p&gt;&lt;p&gt;Each one of them has more than doubled the S&amp;amp;P&amp;#39;s return over the past 10 years.&amp;nbsp; And they have done it with less risk as measured by beta and Sharpe ratios.&amp;nbsp; Hey, i know that some of this stuff gets a little technical but-- go have a look and then BUYER BEWARE-- THE PAST PERFORMANCE OF THESE FUNDS IS NO GUARANTEE OF FUTURE PERFORMANCE.&lt;/p&gt;&lt;p&gt;It is my opinion that many of us are so busy we do not scour the financial markets for good stocks (a very risky strategy) or even good mutual funds.&amp;nbsp; So, maybe i can help... slowly and carefully.&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;    </content>

    <title>BUY OR SELL FUTURES TO HEDGE ON YOUR RESIDENTAIL REAL ESTATE</title>

&lt;p&gt;It&amp;#39;s been 18 months now that you can, through the Chicago Mercantile Exchange, trade futures based on house price indexes for each of the top ten largest US cities.&amp;nbsp; You can sell futures, buy puts or sell calls all designed to hedge losses that might be occurring on the value of your home.&amp;nbsp; &lt;/p&gt;&lt;p&gt;&amp;nbsp;Each of these futures contracts are trading on an ongoing basis-- for example, the house price index in Los Angeles is trading with the underlying assumption of an 11.5% drop over the next two years.&amp;nbsp; With that index trading at $57,000, one could hedge the price drop of a $3.0 million home there by selling 52 contracts.&amp;nbsp; You would put up&amp;nbsp; approx. $120,000 on that hedge.&amp;nbsp;The contracts would not cover the full 11.5% drop if it occurred, but would help the participant avoid the full loss.&lt;/p&gt;&lt;p&gt;Please be sure that you and your clients understand that these strategies can go against you such that you can lose money by being half right-- for example, if the LA markedt only dropped 5% in the two year period, it would end up costing more than if you never tried to hedge the dropping home value.&lt;/p&gt;&lt;p&gt;&amp;nbsp;This strategy is detailed in the December 10th, 2007 Forbes Magazine, p. 154, Protect Your Home.&amp;nbsp;&lt;/p&gt;&lt;p&gt;As professional Realtors it is important for all of us, or some of us, to be aware of these financing alternatives and to be able to discuss them when the topic comes up... just be careful.&lt;/p&gt;    </content>

&lt;p&gt;I recently gathered several bids for some work for a listing that i hope to have on the market in January.&amp;nbsp; On the floor coverings bid, as with the other contractors on other jobs, i previewed approximate costs on the phone and got the ballpark figures i was looking for.&amp;nbsp; The floor guy come out, we met at the house, he did some measuring and said he would get back to me.&amp;nbsp; Per his phone converstation&amp;nbsp;ballpark quote, i expected the job to cost $1650 so yes, i was rather disappointed and surprised when the bid came in at $3777.&amp;nbsp; &lt;/p&gt;&lt;p&gt;What happened?&amp;nbsp; Although i asked for the fully installed price during my phone interview, i did not specifically ask about floor prep work... My bad? (as my son would say).&amp;nbsp; Is it fair to get hit with&amp;nbsp;this major discrepancy even when i ask for the full cost, installation included?&amp;nbsp;&amp;quot;Oh, i thought you knew that there would be an additional charge to remove the old flooring and ...&amp;quot;&lt;/p&gt;&lt;p&gt;Ouch-- it hurts even more than usual because i had called the owner and told him the ballpark numbers i expected for the repairs-- double ouch...&lt;/p&gt;&lt;p&gt;So, Be careful out there-- take a lesson from this post and don&amp;#39;t get beat up by the contractors.&lt;/p&gt;    </content>

&lt;p&gt;In case you missed the 7:30 am&amp;nbsp;(PST) broadcast, Secretary of the Treasury, Hank Paulson, described in a fair amount of detail a mortgage bail out plan for those ARMs that are causing so many foreclosures and financial unrest.&amp;nbsp; The proposed solution will not impact those that are handling their payments but will be addressed to those that will be able to show that they will not be financially capable to handle increased payments.&lt;/p&gt;&lt;p&gt;Please look for the deails on &lt;a href="http://www.cnbc.com"&gt;www.cnbc.com&lt;/a&gt;&amp;nbsp;for this story and related houseing market information.&lt;/p&gt;&lt;p&gt;It is difficult to surmise whether this will be the key to fixing our ailing mortgage problems, but the fact that serious attention and high level proposals are being offered is a good sign.&lt;/p&gt;    </content>

    <title>SHORT SALES GROWING AND GROWING</title>

&lt;p&gt;CCAR (Contra Costa County of Professional Realtors) sponsored a panel of speakers that addressed the world of short sales this morning&amp;nbsp;and here are several of the take away messages that i want to share:&lt;/p&gt;&lt;p&gt;1.&amp;nbsp; Approx. 30% of listings in our county are short sales.&lt;/p&gt;&lt;p&gt;2.&amp;nbsp; Closing rate is 2-8 times lower than non short sales.&lt;/p&gt;&lt;p&gt;3. &amp;nbsp;Short sale sellers (and foreclosure candidates) must be very careful to use all the same information on all docs that were on their original loan docs and avoid fraud charges and other legal issues.&lt;/p&gt;&lt;p&gt;4. Technically, a loan can go into default after one missed payment but most often notices of default do not get recorded for many months and many payments after the first one.&lt;/p&gt;&lt;p&gt;5.&amp;nbsp; A seller&amp;#39;s CPA should be consulted to understand specific tax consequences of foreclosing or a short sale.&lt;/p&gt;&lt;p&gt;6.&amp;nbsp; Lenders can come after 401k retirement plans even if they were not listed as assets on the original loan docs.&lt;/p&gt;&lt;p&gt;7.&amp;nbsp; Agents may not want to make short sales part of their future business plans and if they do-- they may want to refer the short sale biz, employ a third party to help or plan on learning a lot more about them and becoming a specialist.&lt;/p&gt;&lt;p&gt;8.&amp;nbsp; It is common for third party&amp;nbsp;specialists to take one half of the commsion for their work.&lt;/p&gt;&lt;p&gt;9. At times (most of the time) it becomes very difficult to get lenders to be responsive to calls and requests for cooperation and assistance once a sale becomes a short sale.&lt;/p&gt;&lt;p&gt;10.&amp;nbsp; These comments and observations are 100% my interpretation and any lawsuits that result from them should be sent to my wife.&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;    </content>

&lt;p&gt;&amp;nbsp;After many hours of discussions with clients and fellow agents it is becoming more and more clear that we are setting up for a market reversal that will be leaving many of us (and our clients) at the starting gate and not at the closing table.&amp;nbsp; The Fed is poised to cut rates on December 11th with consumer confidence dropping over 8 points this past month and housing and financial markets all continuing to drop.&amp;nbsp; The R word (recession) is now much more the concern as opposed to the prospects of any significant inflation.&lt;/p&gt;&lt;p&gt;The key point we need to communicate to our&amp;nbsp;buyers&amp;nbsp;is that an incremental rise in mortgage rates is significantly more costly to them compared to not achieving the&amp;nbsp;absolute bottom price of this market swing.&amp;nbsp; Realizing exactly where and when the housing prices reach bottom is not a productive pursuit as it risks missing the lowest rates we have seen in years.&amp;nbsp; Each of us can run the numbers to give our clients examples of this critical concept and rare opportunity.&amp;nbsp; The savings from a better rate is usually in the hundreds of dollars/month for the more modest homes and can reach into the thousands on the multi-million dollar homes.&lt;/p&gt;&lt;p&gt;Aligning ourselves with lenders and making up flyers&amp;nbsp;for open houses and client lunches are valuable tactics to get this message out.&amp;nbsp; Come on-- let&amp;#39;s run this up the flagpole.&lt;/p&gt;    </content>

&lt;p&gt;Recent gyrations of the stock market seem to resemble the vicissitudes of the stock market.&amp;nbsp; With the stock market dropping hundreds of points in a single&amp;nbsp;trading day, it&amp;nbsp;is starting to get some negative&amp;nbsp;press like the real estate market has been getting over the past year or so.&amp;nbsp; The&amp;nbsp;key point to understand is that the recent, brief correction in the stock market is normal and, in fact, healthy for future price appreciation&amp;nbsp;to take place.&amp;nbsp; The overall market is several percentage points off the all time highs set recently.&amp;nbsp;There are many compensating balances pushing and pulling on equities such that the market remains healthy and likely to resume it&amp;#39;s historical track record of returning approx. 8% on a long term basis.&amp;nbsp;&lt;/p&gt;&lt;p&gt;The real estate market throughout the US has clearly corrected in a significant way. However, when one takes into consideration the price appreciation of the past 5-7 years, the correction becomes more understandable and again, healthy for putting in a more solid foundation for further price appreciation in the future.&amp;nbsp; Whether one measures the stock market or the real estate market, these corrections build bases that can support higher highs&amp;nbsp;that would not be possible without them.&amp;nbsp; &lt;/p&gt;&lt;p&gt;So, let&amp;#39;s keep working on those listings and convincing buyers that the sky is not falling.&amp;nbsp; The pendulum has been swinging in a southerly direction for some time but, it will start swinging to the north sometime soon.&amp;nbsp; If it is anything like the turns in the stock market, it pays to buy in the darkest part of the tunnel-- OK-- enough of the mixing of metaphors-- let&amp;#39;s get back to work.&lt;/p&gt;    </content>

&lt;p&gt;Having asked many buyers, sellers, agents and brokers&amp;nbsp;their opinions of&amp;nbsp;the most important skills to be a successful Realtor, as you might expect, i have received a wide range of answers including - good people skills, attention to detail, knowledgeable about the market, good listening skills, persistence and many others.&amp;nbsp; Anyone who has been in the business for any length of time will tend to have their own formula for the keys to success.&lt;/p&gt;&lt;p&gt;The one overriding skill set that the top Realtors have that set them apart from the others&amp;nbsp;is the fine &lt;strong&gt;ART OF NEGOTIATING&lt;/strong&gt;.&amp;nbsp; The skills of negotiating start early in the lives of these top performers.&amp;nbsp; But trying to keep on the real estate subject, they probably started their&amp;nbsp;ART when they met their manager.&amp;nbsp; They talked and at one level of battle or another, they negotiated their commission splits and probably attained a better split than most others that simply nod when they are told what the rate would be.&lt;/p&gt;&lt;p&gt;Moving on to the client transactions, these &amp;quot;guys&amp;quot; (collective term for all that win at negotiating) articulate carefully and convincingly why they are worth the full rate of commission... and usually get it.&amp;nbsp; If they end up giving up some, it probably takes the client several hours or days to get them to agree.&lt;/p&gt;&lt;p&gt;So, now you have the sense of who we are dealing with.&amp;nbsp; These Realtors will work every angle on every deal everyday to gain the advantage for their clients and themselves.&amp;nbsp; They are rarely obnoxious as they&amp;nbsp;negotiate the finer points of contracts, inspections, repairs, delays, price, terms, dates, and all the other parts of each deal.&amp;nbsp; They are positive, professional, nice (sometimes), creative and dedicated more than all their counterparts that don&amp;#39;t pursue the&amp;nbsp;ART&amp;nbsp;with equal passion.&lt;/p&gt;&lt;p&gt;Very often the other side of the negotiation does not even realize that another part of the deal just got negotiated.&amp;nbsp; These pros are also very good at letting their clients know details of all their winning efforts that have been employed on behalf of the client.&amp;nbsp; &lt;/p&gt;&lt;p&gt;What do you think of the ART OF NEGOTIATING? In most other markets, price declines have been pretty modest.&amp;quot; For example, in Chicago, home prices declined 1.3 percent between August 2006 and August 2007, while posting a 34.2 percent gain for the five-year period between August 2002 and August 2007. &amp;nbsp; Among the 20 markets surveyed by S&amp;amp;P/Case-Shiller, which represent more than 40 percent of the U.S. population, four posted home price appreciation rates of more than 80 percent over the past five years while 11 registered gains of more than 45 percent. &amp;nbsp; Home values in Los Angeles fell 5.7 percent in the last year -- but even with this loss prices in L.A. are up 88.9 percent since 2002. In Miami, home prices dropped 7.8 percent between August 2006 and August 2007 while showing a price appreciation of 89.2 percent during the past five years. &amp;nbsp; The same pattern holds true in Phoenix and Las Vegas, which each posted yearly declines of 8 percent and 7.6 percent, respectively. However, home values surged 80.2 percent in Phoenix during the past five years and 83.2 percent in Las Vegas. &amp;nbsp; While housing is a cyclical business, experience shows that over time, home values will stabilize and then move upward with the next recovery, said Catalde. &amp;nbsp; &amp;quot;To argue that home values will continue to decline and never recover, somebody has to make a convincing case that it will cost less to build a new home five years from now than it does today - and that&amp;#39;s just not going to happen,&amp;quot; said Catalde. &amp;quot;Despite today&amp;#39;s housing slowdown, the cost of land, labor and materials required to build new homes continues to go up.&amp;quot; &amp;nbsp; Furthermore, Catalde noted that the rapid appreciation rates in 2003-2005 were clearly unsustainable over the long-term, and that housing typically increases in value slightly above the overall inflation rate. &amp;nbsp; Homeownership as a long-term investment has a track record that is virtually unmatched by any other purchase in terms of its real benefits, he added. Home owners today have a combined $11 trillion in equity in their homes, against which they can borrow to help pay for college tuition, medical expenses and other needs. &lt;p&gt;Time permits me to finish off the list of items i shared with the group of 30 college people yesterday:&lt;/p&gt;&lt;p&gt;6. WORK ON WHAT WE CAN CONTROL:&amp;nbsp;appetites, passions, study time, self discipline issues all day every day.&lt;/p&gt;&lt;p&gt;7. BEING ACTIVE BEATS BEING INACTIVE EVERYTIME: watching TV vs. something more productive, IPODs can be closed systems and dangerous if overused to&amp;nbsp;avoid social interactions...just go out and do something...as the song says, when given the choice, dance.&lt;/p&gt;&lt;p&gt;8. HAVE FUN BUT NOT TOO MUCH TOO OFTEN: use your creative energies in dating and finding your passion but maintain some balance along the way.&lt;/p&gt;&lt;p&gt;9. PAY DUES AND WORK HARD: at college, one can usually get to all the parties, games, dates, trips, etc, after the hard core studying is completed-- so many of us talk the talk but don&amp;#39;t ... pay the dues.&lt;/p&gt;&lt;p&gt;10. &lt;p&gt;This afternoon i was the invited guest to speak to 30 young college people and here is the top&amp;nbsp;five list that i shared with them:&lt;/p&gt;&lt;p&gt;1. LAW OF THE HARVEST... THE SECRET...LAW OF ATTRACTION: There ae many ways to package it but the truth is we reap what we sow and positive thinking and a positive attitude really make a difference.&lt;/p&gt;&lt;p&gt;2. KNOWLEDGE AND HARD WORK LEAD TO&amp;nbsp;CONFIDENCE AND CONFIDENCE LEADS TO SUCCESS: I learned this business truism from the stockbrokers at Goldman Sachs.&lt;/p&gt;&lt;p&gt;3.&amp;nbsp;FAITH AND OBEDIENCE LEADS TO HAPPINESS: Sometimes happiness may be out farther on the time line than we might like, but this formula is tried and true.&lt;/p&gt;&lt;p&gt;4. CHARACTER AND COMPETENCE LEAD TO SUCCESS: Whether the goal is a job, career, marriage, team or new listing, Buffini has it right.&amp;nbsp; There is no substitute for these pieces of the puzzle.&lt;/p&gt;&lt;p&gt;5.     <title>It's Not What You Know, It's Who You Know</title>

&lt;p&gt;After many weeks of door knocking, calling and emailing people i do not know and that do not know me, flyering neighborhoods near and far, and feeling very light on the business that has come my way as a result of all that effort, i decided to share some of my findings and conclusions:&lt;/p&gt;&lt;p&gt;1. Since many of us have spheres of influence ranging from several dozen to several hundred, we need to recognize that there is gold&amp;nbsp;right there in our own backyard.&amp;nbsp; The impact i have on people that know me is incredibly more profound than the one in a hundred i might bump into where there is no relationship.&lt;/p&gt;&lt;p&gt;2. I know how obvious #1 sounds but we really need to ponder and understand the value of having friends, neighbors, and associates that are not immediately defensive as we put on our real estate hats and talk business. Almost all of our friends and neighbors will be home buyers and sellers someday.&lt;/p&gt;&lt;p&gt;3. Tapping into the vast pool of people we encounter everyday is going to pay much higher returns than going out and expecting our elevator speech or front door pitch to turn heads and result in new business.&amp;nbsp; I have&amp;nbsp;made firm connections&amp;nbsp;with my private&amp;nbsp;banker, landscaper, insurance agent, loan officer, title company officer, handyman, dentist, carpet cleaner, carpet layer, trust attorney, financial planner, stockbroker, and local PTA committee with 8 fellow parents like myself.&lt;/p&gt;&lt;p&gt;4. One major reason for these warm associations leading to more business is that we get to be of service to many of them and help them with their businesses, goals, families, kids, etc.&amp;nbsp; This is a key point.&amp;nbsp; We are generally able to help people we know much more easily than strangers.&lt;/p&gt;&lt;p&gt;5. Lastly, there&amp;nbsp;are no more valuable business friends of ours than past clients.&amp;nbsp; We must carry forward with fresh and caring relationships with every single one of them-- including the ones that have moved out of town.     <title>Real Estate Success through Business to business Referrals</title>

&lt;p&gt;I recently met with my private banker and asked how i could be of help to her in building her business.&amp;nbsp;I&amp;nbsp;found out the size of the accounts she was looking for. &amp;nbsp;I have two friends that need a better banker. Then i met with a friend who is a trust attorney and asked what kind of clients he targets and if i could refer him when i met people that met those parameters.&amp;nbsp; He sent me a cover letter and brief description of the kind of trust work he does.&amp;nbsp; The next day i met with a long time friend doing financial planning and told him i had a client who needed help with his financial affairs and he should call him--&amp;nbsp; i had already talked to my client and got his permission to have my financial planner friend call him.&lt;/p&gt;&lt;p&gt;I have done the same kind of direct referrals with my favorite loan officer, insurance agent, title officer, handyman, carpet cleaner, carpet installer, home inspector, pool mainenance guy and dentist.&amp;nbsp; Each one of them has eagerly given me their email address and cell number since i have become a personal referral source for them.&amp;nbsp; There has been an increased level of energy between us.&amp;nbsp; I have invited all of them on to LinkedIn.com (along with most of my sphere of influence) and have somewhere close to 60 connections as a result of this effort.&lt;/p&gt;&lt;p&gt;It is only recently that i have realized i have only begun to scratch the surface.&amp;nbsp; I have committed to giving a portion of each commission derived from sales of homes within my neighborhood high school boundaries to the parent fund raising group that has raised money for many worthwhile additions to the school.&amp;nbsp;There are&amp;nbsp;eight very appreciative parents on that committee. &amp;nbsp;I already worked on a sale for my landscaper.&amp;nbsp; My dish satellite guy said he is getting ready to move up and i still need to get his email address.&lt;/p&gt;&lt;p&gt;B to B.&amp;nbsp; It really does flow without a lot of door knocking, cold calling and the sense of rejection that accompanies those activities.&amp;nbsp; But i still do those at least two hours each week.&amp;nbsp; What a business!&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;all the best,&lt;/p&gt;&lt;p&gt;douglas moore, alain pinel realtors, walnut creek ca&amp;nbsp;&amp;nbsp; 925 708 8988&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;    </content>

&lt;p&gt;It is a very&amp;nbsp;exciting&amp;nbsp;as more and more agents recognize that seller credits (when used to buy down rates and lower closing costs) are critical parts of the transaction recipe and are responsible for getting the cake, not only baked, but baked on time.&amp;nbsp; It is the closest thing to smoke and mirrors when we can show buyers that with some cooperation and cash from the sellers, our proposed offer is not actually $100k away from the seller&amp;#39;s listed price. And when they buy that house for $1 million, the closing costs and ongoing payments will look and feel like they paid $83,000 less.&amp;nbsp;Said another way, if they qualify for a home purchase of $1 million, they will be able to actually purchase a home priced at $1,083,000 with the use of seller credits.&amp;nbsp;(The above examples are obviously impacted by the dollar amount of seller credits, interest rates on a given transaction, choice of mortgage plan of the buyer and several other related factors).&lt;/p&gt;&lt;p&gt;&amp;nbsp;This is not risky financing.&amp;nbsp; There is no increase in cash to close.&amp;nbsp; There is no increase in monthly payments, even with taxes and insurance.&amp;nbsp; There is no negaitve amortization.&amp;nbsp; And it works with fixed or adjustable loans and even with 100% financing.&amp;nbsp; It may not be the magic bullet of the home buying process.&amp;nbsp; But it sure can help getting deals done.&lt;/p&gt;&lt;p&gt;All the best,&lt;/p&gt;&lt;p&gt;Douglas Moore, Alain Pinel Realtors, Walnut Creek, CA&amp;nbsp; &amp;nbsp;925 708 8988.&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;    </content>

&lt;p&gt;Do&amp;nbsp;I really need Top Producer to run my real estate business or can i do it with the updated version of Outlook?&amp;nbsp; I would like to hear from&amp;nbsp;the Top Producer users out there and learn what it is about that product that can&amp;#39;t be done with Outlook.&lt;/p&gt;&lt;p&gt;Organizing the broadcast emails seems doable with Outlook, and&amp;nbsp;mail merging is not a problem.&amp;nbsp; The Outlook synchs with my Balckberry so what would be the main adantages and features of the Top Producer that makes it worth $45-50/month plus extra one time charges for the extra applications?&lt;/p&gt;&lt;p&gt;Do you use the TP on your listings or do you use your in house software?&amp;nbsp; Calendaring of open houses, inspections and all other perts of the typical transactions can also be handled with Outlook.&lt;/p&gt;&lt;p&gt;Thanks in advance... &lt;p&gt;Several takeaways from the three hour session with rick deluca this past week in walnut creek, ca:&lt;/p&gt;&lt;p&gt;1. the power of the checkmark-- no honey, i did not sell any houses today, no honey, i did not get any listings today and no dearest, i did not close any transactions-- but i checked off 17 of 18 items on my daily to do list and had a great day.&lt;/p&gt;&lt;p&gt;2. opening question on a listing appointment-- what are the three most important things you would like me to cover here today?&lt;/p&gt;&lt;p&gt;3. after selling the client&amp;#39;s house-- call them day after close, one week after close, one month after close, six months after close, one year anniversary and every year after that until one of you dies.&lt;/p&gt;&lt;p&gt;4. increase self confidence-- increase production... when fear outweighs faith, we fail and when faith outweighs fear, we succeed.&lt;/p&gt;&lt;p&gt;5. sorry-- i need to keep this one to myself-- but for a referral in walnut creek ca i would be glad to share it with you.&amp;nbsp; &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;oh by the way...&lt;/p&gt;    </content>
