buyer: Do I Really Need a Hold Harmless Agreement? - 11/11/10 03:38 PM

Do I Really Need a Hold Harmless Agreement?
A Hold Harmless Agreement is where a Buyer and Seller enter into an agreement for the protection of all concerned.
This agreement typically states where one of the parties voluntarily assumes full responsibility for any risks of loss, property damage or personal injury, including death, or loss or damage to a property owned.
This being a written contract, obviously it can be customized for each individual situation.
When a Seller wants to use this agreement, they will typically want to hold over into the property they are selling … (2 comments)

buyer: Beauty Is In The Eyes Of The Beholder - 10/24/10 07:56 AM

Beauty Is In The Eyes Of The Beholder -
I know this title has probably been used on different occasions and we all have our own opinions on the interpretation of that.
My interpretation of "Beauty Is In The Eyes Of The Beholder" is that the Seller of a property has sentimental attachment to the home they are selling.  They have typically put their hard earned money and sweat to make it the way they want it.  However, the way they wanted it and the way John & Mary Q. Public may want it, can and may … (22 comments)

Mr. & Mrs. Realtor, I Respect You
Now that I have been a Realtor for over 23 years, I believe I can be a good judge of Realtors as I have seen so many come and go.  As a client, this is what I would honestly say if I was honest and sensible.
Mr. & Mrs. Realtor, I respect you because you are the heart and sole of keeping the economy stimulated. Mr. & Mrs. Realtor, I respect you because you go the extra mile to make sure that everything goes smoothly and take as much unneeded … (7 comments)

buyer: Lazy or Dumb? - 06/16/10 07:57 AM

Lazy or Dumb?
One of my pet peeves are incomplete MLS sheets.  Are we really representing a Seller very well when we don't have as many details as possible about the house.  The MLS clearly asks for this information and if it not applicable, then so be it.  But if it is, fill out the requirements.
Many agents by pass the required items by just placing a "0" or "xxx" just to go to the next category.  Come on troops, how hard is it to take a few minutes to get the room dimensions with an accutape tape measure … (4 comments)

buyer: Does it All Boil Down to Your Commission? - 06/01/10 09:15 AM

Does it All Boil Down to Your Commission?
Are we doing our Seller a disservice by really not educating them on certain aspects of how we get paid?  Take for example when we take their listing and the commission being negotiable, do you go over the coop portion with them clearly?
I have seen in the computer system that some coop splits are extremely low.  Even though we should not take that into consideration on behalf of our buyer/client, it is common sense we are going to look how we get paid.
We need to explain to the … (11 comments)

buyer: What Do I Get Rid Of? - 04/25/10 07:53 AM

First time homebuyer is pondering, what do I get rid of?
Have you ran across a Buyer that has been in a rental unit for years and have accumulated so much, that they don't know what to keep and what to get rid of.
Typically the Buyer does not have the resources to buy a home with enough square footage to accommodate the furnishings and other miscellaneous items they have accrued.  I don't recommend they go out and sell everything, have a large yard sale or bring an auctioneer in or they will lose their shirt.
Instead, … (5 comments)

buyer: Buyer Agency - 04/21/10 08:04 AM
Does your area have a Buyer Agency Agreement?
My area has a Buyer Agency Agreement that ties the buyer to you for a certain period of time so you are not out representing them and showing properties unnecessarily without protection of your commission.
However, this is a two way street when you have this signed.  You are saying that you will do you due diligence in finding the Buyer a home.  In the same token, the Buyer is saying that they are sticking with you until such time you find a place for them to and go to settlement.

buyer: Is It Worth the Gamble? - 04/06/10 07:44 AM

Is it worth the gamble when a house has just been placed on the market, and you as the selling agent can show your buyers justification of value based on local comparisons, not to have your buyers offer full price?  I don't think so, but in their eyes it sometimes is, as they don't want to part with their hard earned savings.
Many … (1 comments)
