The buyer wanted to know all about the purchase process and the time it takes. It was a call that lasted longer than an hour. The reality was I was being interviewed as a potential agent to help them make a home purchase. That is what the HAMP program was all about and it was a part of the Fiscal Cliff that did get extended.</span></p> <p><span style="font-size: 14px;">B of A was one of the banks that made a big splash that they wanted to do right by people and help them with loan modifications if they qualified.</span></p> <p><span style="font-size: 14px;">Well, B of A you managed to lie to the public once again, and your employees are all well atuned to your tactics.</span></p> <p><span style="font-size: 14px;">You set up a program, and the Robinsons abided by your rules, even by making payments early. Not only were they late on their mortgage payments prior to a Short Sale, they were late on other monthly debts as well.</span></p> <p><span style="font-size: 16px;">FHA and Fannie Mae have different waiting periods for both Short Sales and Foreclosures, and the Fannie Mae waiting periods are normally much longer than the FHA waiting periods.&nbsp; <a href="http://activerain.com/blogsview/3555010/how-foreclosures-short-sales-impact-purchases-on-fannie-mae-mortgages" target="_blank">Fannie Mae waiting periods after a Short Sale or Foreclosure can be as much as 7 years</a>, as opposed to FHA only being 3 years. Though it is possible for a homeowner to qualify for an FHA Mortgage right after a Short Sale if the homeowner did not go late on their Mortgage Payments for 12 months prior to the Short Sales approval.&nbsp; This very rarely is the case with most Short Sales. </span><span style="font-size: 16px;"><span style="font-size: 16px;">Because the Fannie Mae waiting periods are much longer I will focus this blog on just FHA Guidelines.</span> </span></p> <p><span style="font-size: 16px;"> FHA Guideline 402 (l) below is exactly as it is written in the FHA Guideline Reference Book.&nbsp; <br></span></p> <p><span style="font-size: 16px;"><strong><span style="text-decoration: underline;">402(I) Short Sales.</span></strong></span></p> <p><span style="font-size: 16px;">A borrower is not eligible for a new FHA-insured mortgage if he/she pursued a short sale agreement on his or her principal residence simply to.</span></p> <ul> <li><span style="font-size: 16px;">take advantage of declining market conditions, and</span></li> <li><span style="font-size: 16px;">purchase a similar or superior property within a reasonable commuting distance at a reduced price as compared to current market value.</span></li> </ul> <p><span style="font-size: 16px;"><strong><span style="text-decoration: underline;">Borrower Current at time of Short Sale</span></strong>.
