I have been meaning to draft this document for a while, and finally put it together in response to a conversation I had with a potential client last week.
 

My commitment to you:
1. I will be your Exclusive Buyer Agent (EBA). Because our company does not take listings or ever take on sellers as clients, we will never ask you to agree to less than 100% representation.
2. We will not "switch teams" or change allegiance mid-transaction. You will start with an EBA and you will end with an EBA.

I'm currently serving as the Secretary for the National Association of Exclusive Buyer Agents and prior to the upcoming annual conference I'm taking another negotiations course in Texas. The course, titled "Advanced Negotiation Techniques for Buyer's Agents" will help me develop effective negotiations plans for my clients and negotiate more effectively on their behalf.

Have property values declined, not so much as to put you ridiculously upside-down, but enough that your current loan balance may no longer be less than 80% of the current value of your home? If you're in a position where you don't pay PMI now because you didn't need to pay it when you first took out your current loan, or because you didn't need it the last time you refinanced... perhaps you've felt that refinancing wouldn't benefit you, having heard that the cost of PMI has increased significantly over the past few years.

A market analysis not only helps a Buyer understand what the market value of a home should be, but it can also be used to help determine which home (say, out of 3 excellent choices) is a better investment. Usually there is a discrepancy large enough to make a fair determination as to which home is probably the best priced. That doesn't mean that the home is the best fit for you or your family, but knowing which home is the better value can help a client see past some of the emotional attachments they may have toward a certain home.

Being an Exclusive Buyer's Agent and a member of the National Association of Exclusive Buyer Agents (Disclosure: I'm also on the Board of Directors), I was excited to see the following article on FoxBusiness.com:
Buyer Agent Organization Comments on Ummel Home Buying Case
The Association's position is simply that part of a Buyer's Agent's due diligence is to prepare comparative market analyses on properties being considered for purchase. (Certainly before submitting an offer on a property.)

value: Salt Lake Home Prices - To be Lowered? - 01/24/08 02:50 PM

In today's Salt Lake Tribune, "Jillinda Bowers, president of Salt Lake Board of Realtors, said that when homes don't sell, 'our next step is to reduce the price. We have a positive and good market, but with the decline in sales right now, there is a need for more stabilization in the pricing.'"
So, will home prices go down?
Or, in other words, will the actual value of homes go down? Or is she just saying that all of the THOUSANDS of overpriced listings currently on the market will need to lower their asking prices?

Most Utah Homebuyers believe that the appraisal is being done to protect the Buyer. Although it may ultimately do so, the appraisal is really to protect the lender.
Appraisers are hired to protect the Buyer's lender(s). A main part of their job is to determine if there is enough collateral value in the property to protect the lender's lien-holder position.
In some markets, appraisals may be routinely performed before presenting offers. In Utah, it is more common to order an appraisal after a contract price has already been agreed to. In this case, most Buyers will include an appraisal contingency in their offer, allowing them to … (9 comments)
