 Several articles in the real estate community have been about disclosure.  Mostly the articles have been in regards to bank owned properties and the fact that banks somehow think disclosure makes them more liable.   REALLY?   I wonder from whom they are receiving their advice?  Then there are the flippers that seem to be sitting at the feet of these uninformed lenders and insisting that even though they, “have spent X thousands of dollars on fix and repair,” they too have nothing to disclose.  Well you can lead a man to knowledge but you can’t make him think comes to mind … (2 comments)

real estate law: Court Says short sale non disclosure ok? Not so fast. - 10/29/10 10:40 AM
Do brokers representing sellers have a duty to disclose the only way a transaction will close is with approval of a "short sale" from the lender(s)?  One court said Sellers yes but their broker NO!!   ???  Here is a snip of that ruling:
At the hearing on the brokers‟ demurrer to the buyers‟ original complaint, the court asked why the seller had not been named as a defendant in the case.
