Nutshell: Foreclosures and Arizona’s Anti-deficiency Laws - 12/21/10 11:02 PM
In Arizona lenders can recover real property from delinquent buyers in one of two ways: 1) by a foreclosure action filed in the superior court or 2) the foreclosure of a deed of trust by merely mailing and recording notices as required by law. Arizona laws contain special proection for homeowners who may lose their property through either a jducial foreclosure action or trustee's sale. In the even the foreclosed property is sold for less than the amount owed by the bowerer, Arizona's "anti-deficiency laws" may prevent the lender from pursing the borrower to collect the difference.
