Will SB 458 Bring More Closure & Certainty? - 08/12/11 12:06 PM
Last Friday Gov. Jerry Brown signed Senate Bill 458, authored by Senate Majority Leader Ellen Corbett (D-San Leandro) into law.Building upon the protections offered by SB 931, which meant that first lien holder in short sales could not pursue deficiencies after close, SB 458 requires secondary lien holders to also waive deficiencies after close of a short sale. The law became effective immediately.After extensive research and practical application, my feeling is that SB 458 only protects a seller in a short sale after the close of escrow.
