What did we know and when did we know it?

I was going through my old Blogger blog earlier today and came upon this post written almost four year ago (Feb 22, 2005). It was back when I worked in Palm Beach County Florida and referenced a study by National City Bank (now part of PNC Bank) published that month. Unfortunately, the link below will now take you to current study (3rd Quarter 2008) but it is an interesting look at housing values.

There was plenty empirical and anecdotal evidence four years ago that the market could not sustain the growth of the prior few years, but most people in the biz (and the general public) were not ready to believe.

The Housing "Bubblette"

There's been a lot published recently about the possibility of a housing bubble that will burst and leave people with negative equity in their homes. Can it happen? Has it happened before? The answer is yes and yes. Japan has had a slow housing market for the past seven or eight years so any economy is susceptible.

The economics department of National City Corporation, a large financial institution, did a study to try to identify in the 99 largest US markets where single family home valuations are at a premium or a discount. And good old Palm Beach County per the study is 26% overvalued per the benchmarks used. All of the markets that were more overvalued were in California. Also highly overvalued in Florida were the Miami Ft Lauderdale and Sarasota markets. Big markets like Orlando, Tampa and Jacksonville were basically neutral. The most undervalued, Memphis and Salt Lake City.

Mortgage Fraudster Gets Slap on Hand

For several years, I have almost daily read a couple of law firm blogs that deal with mortgage fraud and follow cases and update the reports.

Both of them today reported that a 74 year old real estate broker in Denver that was found guilty of four counts of mortgage fraud in July was sentenced to 36 months probation with 15 months of house arrrest, restitution and forced to forfeit a $44,292 judgment.

Just because I was curious, I checked this person on Colorado's website and found that she was disciplined in 1993 for falsifying information (specifically asserting she had deposits in an escrow account when she did not collect these deposits) and sentenced to a 90 day license suspension, 4 hours of additional continuing ed and a $400 fine (the italics are mine). According to the state licensing site, she still has an active license.

We constantly talk about weeding out people in our respective businesses that operate outside the bounds of good business practices and sound ethics. Unfortunately, the state licensing authority in most states is slow to revoke licenses of people like the broker in the story. You would think that someone who was found guilty by a jury six months ago would not still be licensed.

Remembering The "Mayor of Westgate"

I first met Joe Pitts back in 1998 when I had to attend a training session for the Regional MLS (West Palm Beach) when a new system was introduced. Since we were scheduled alphabetically by last name, I happened to share a computer with an"older" gentleman that I had never met before. We talked a bit and since he was unfamiliar with some of the systems, I tried to help him as best I could to get started, since the new system was going "live in about two weeks.

Over the next couple of years, I'd speak with Joe once in a while, usually setting up showings, but I always asked him how he was doing with the computerized MLS and he always said something like "I'm getting there".

What I didn't know was that Joe had lived in the same neighborhood (Westgate) in West Palm Beach since the age of 6 except for a 20 year career in the Army which included a tour in Vietnam. The Westgate area had been part of the incorporated City of West Palm Beach but the city had de-annexed the area and it had become an area known for drugs, high crime and blight.

When Joe retired from the military, he moved back to Westgate, obtained a real estate license and eventually opened a brokerage. Then he helped to restart the area's redevelopment authority and started working to improve the neighborhood. Among the areas Joe helped improve were having all of the streets paved (most were dirt), getting the county to bring in public water and sewer and having sidewalks added on almost every street. Another major problem had been street flooding and Joe worked with the county engineers to acquire land for retention ponds and storm drains for the entire area.

But Joe's proudest achievement was helping the school district take the local elementary school, which was at double it's capacity with 27 portable classrooms and helping the district acquire surrounding property to built a brand new 900 student school.

Joe was honored in 2000 by the National Association of Realtors as one of the five national Good Neighbor Award winners and the next summer by the Florida Association of Realtors. I spoke with Joe that spring, congratulating him on the award and he was his usual humble self. He mentioned that his recognition came from local residents and long time neighbors who thanked him for his efforts to improve the neighborhood. He also told me he was kind of embarrassed by the attention because he didn't think he did anything special.

Joe passed away in 2005 at the age of 73. He was a good guy

Now They Foreclosed The Country Club

In our current economic situation, it's not just houses that are falling into foreclosure. I have written before about shopping centers and other commercial locations that are being foreclosed but this is a first for me.

The Gettysburg, Pennsylvania Country Club, located in a very historic area, is being sold at sheriff's sale on January 9, 2009. The club has been unable to attract enough new membership to pay off a $2.9 million loan for renovations completed two years ago and actually closed it's doors in May 2008.

The story from the Carlisle Sentinel:

"The 60-year-old Gettysburg Country Club is slated to be sold at a sheriff's sale next month after a rescue of the troubled organization failed.
Susquehanna Banks, which foreclosed on the property, is seeking a minimum of $2.9 million when the property goes up for bid on Jan. 9 at the Adams County sheriff's office.
The club has been unable to pay off the debt from a major renovation in 2006, including a conference room, ballroom, pub and tennis courts.
It officially closed on May 30 this year after the club couldn't attract the membership it needed to pay down the debt.
The 120-acre property is inside the boundaries of the Gettysburg National Military Park."

While the property is located within the Gettysburg National Military Park, so are hundreds of other privately owned properties, including homes, businesses and privately owned visitor attractions. These were built prior to the designation of the area as a National Park. It is not part of the government land which is the national historic park.

Joe Pa To Stay Three More Years

That's right. Joe Paterno, who has been the head football coach at Penn State since like forever, has agreed to stay 3 more years in that capacity.

Joe has been head coach since 1966 and had been an assistant from the early 1950's when he joined his college coach from Brown University, Rip Engle. In the past two years he has had to deal with a broken leg (after a player rolled over him on the sidelines) and hip replacement surgery which occured last month after the last regular season game.

Joe plans to be on the sideline coaching at the Rose Bowl on January 1, 2009 in Pasadena.

I, for one, hope Joe stays another ten years. His activities on behalf of the university as a whole are legendary. He and his wife Sue spearheaded a drive to expand the main library and they were so effective, the building is called the Paterno Library. He has personally donated millions to the academic parts of the university.

Way to go Joe

The Hershey Story Museum To Open Next Month

A new museum dedicated to the Hershey chocolate story will be opening in January right here on West Chocolate Avenue.

The museum is dedicated to honoring and preserving the life of Milton Hershey, the founder of Hershey and innovator of all the sweet treats we enjoy today. Incidently, this is the first large building on Chocolate Avenue, Hershey's main street, in 75 years.

When opened, the museum will include a chocolate laboratory, a museum shop, Cafe Zooka (featuring chocolate desserts and a chocolate tasing area.

In preparation for the opening, the former Hershey Museum closed arounf Thanksgiving so that permanent exhibits could be moved to the new facility. The old museum, located in the middle of the Chocolate World, Hershey Park and HersheyPark Arena area was difficult to get into during the summer season because of the lack of nearby parking.

Judge Orders Lebanon County Reassessment By 2012

In a decision today by Lebanon County President Judge Eby, the Lebanon County Commissioners have been ordered to reassess all properties in the county by the end of 2012.

This is due to a property tax assessment appeal by a local couple in 2006 in which they stated "the county's failure to conduct a countywide assessment for 36 years "has caused a discriminiatory effect of taxation" that harmed them and others."

In effect, if you live in a home built before 1972, your tax assessment is based on the 1972 value. If you live in a home built in 2005 (as we do) our assessment is based on 2005 values.

I don't expect that my taxes will go down, but I expect that people living in older neighborhoods in the county will be paying a more proportionate share of the cost of government.

Congratulations to the Steel-High Class A State Football Champions

This afternoon at Hershey Park Stadium, the Steelton Highspire football team beat the team from Clairton 35 to 16 to win the PIAA Class A Football Championship.

Steel High which encompasses the broughs of Steelton and Highspire (both Harrisburg suburbs) finished with a record of 16-0 and only trailed for a total of 13 seconds in this game. This is the second consecutive championship for Steel-High. And Steel-High record setting tailback Jeremiah Young eclipsed 9000 yards for his career.

Way to go guys!

The Current Economy Is Even Effecting Sports

Some of the current financial meltdown has moved into the professional sports business in the past few weeks,The most recent was this week when the NFL announced there would be layoffs affecting more than 10% of it's employees. And at least one team has cut back staff due to reduced revenue.

One really big sport that has been seriously effected by the current economic situation has been NASCAR. Nascar is highly dependent on automotive sponsorships to fund their programs and race teams and the effect of the poor prospects for automobile manufacturers has trickled down to the sport.

The past few years, NASCAR has consisted of the Big 4, Hendrick Racing (Jeff Gordon, Jimmy Johnson, Dale Jr.), Roush-Fenway (Carl Edwards, Biffle, Kenseth, etc). Childress Racing (Jeff Burton, Harvick and Bowyer) and Joe Gibbs Racing (Tony Stewart, Kyle Busch and Denny Hamlin). The remaining teams have been racing for the crumbs.

Since the end of the season (just 4 weeks ago), several teams have announced they are closing or have cut back to almost skeleton sized staffs due to lack of sponsorship. Dale Earnhardt Inc cut back from three to one team and then merged with another, Ganassi Racing, which cut back to 2 teams. Bill Davis Racing, which lost the Caterpillar sponsorship has basically closed the doors. The Wood Brothers team, whose history with NASCAR goes back to it's beginnings, has announced it will only compete part time due to lack of a full season sponsor. Petty Enterprises, the most storied and famous name in NASCAR history, has cut back to one team, released it's driver and is trying to merge with another team.

NASCAR teams have always depended on sponsorships, not prize money, to fund their operations and pay their employees. And the lucrative sponsorship money in the past decade has forced teams to seek higher and higher dollar amounts to fund their R&D, their race car inventory and pay their employees.

The 2008 racing season will be interesting starting in the 2^nd week. The opening race almost always has plenty of independents trying to qualify for starting positions because the prize money payouts are huge. The 2^nd race is when the payouts drop to normal and fail to cover the costs of racing for most teams. I believe there will be many weeks when less than 43 cars enter and try to qualify for the 43 starting positions. That hasn't happened in NASCAR for a long time.

The National Center for Public Policy and Higher Education recently released their report called Measuring Up 2008 ( http://measuringup2008.highereducation.org/index.php ) which measures the progress of higher eduction overall in the country and on a state by state basis.

While Pennsylvania's numbers have improved over the past two decades, the affordability of higher education in Pennsylvania ranks is one of the lowest in the country. The study shows that the percentage of income, after financial aid, to afford college is very high here, which makes the affordability low.

I'm Tired of Dealing with Tires

Yeah, I'm tired of dealing with tires left in REO properties!

I know we occasionally get a REO property where the owner has left a used tire or two still in the garage. I mean those properties that have stacks and piles of used tires just rotting away.

For instance, we were assigned an REO property back in the spring and upon initial inspection I noticed there were piles of tires visible from the street on different parts of the property. We estimated there were between 500 and 600 tires in different parts of this property. We had a very difficult time finding a property preservation contractor who was willing to handles the tires.

These photos only show a few of the piles of tires left on the property. There were car tires, there were car tires on rims, there were truck tires, there were tractor tires and strangely enough, one pile of tires was 20 inch wide Hoosier dirt track racing tires.

The cost to the lender to clean this out was huge. Generally, tire recyclers charge between $3 and $5 each to take automobile tires to recycle, but they won't take them on the rims. The truck tires are more like $8 and the tractor and racing tires could be even more. And that price is delivered to the recycling facility, which means they have to be loaded and carted to the facility. And since they won't take them on rims, those have to go someone with a tire machine to be broken off, then the wheels need to be disposed of.

Needless to say, the trash out on this property was a long term affair.

After this one was finally cleaned out and closed, I was assigned a property in Lancaster County with a detached two car garage. The entire garage was filled with truck tires. These were, fortunately, without the rims attached and the bank hired their own property preservation firm to clean it out. These guys estimated there were between 125 and 150 truck tires to be removed. We haven't quite figured out why this was full of tires, just happy it is now cleaned out.

And overall, I'm tired of dealing with tires.

Even The Shopping Mall May Face Foreclosure

Now even the local Mall is in default and facing foreclosure

Commerce Bank, which holds the mortgage on the Harrisburg Mall, announced yesterday that mall owner is in default and the bank is seeking possession of the property.

According to the mortgage holder, the mall owner has been in default since August 15. and nearly $50 million is due in principle and interest.

The bank notified all mall tenants to pay their rents directly to the bank.

This mall, located near the intersection of Interstate 83 and Paxton Street was built around 1971. When it opened, it was the first enclosed mall in Central Pennsylvania. The original anchor tenants were Gimbels, John Wanamaker and a large two level J. C. Penney store. It was originally called the Harrisburg East Mall.

The mall lost favor with shoppers in the late 1980's and early 1990's as newer shopping opportunities were built and the area gained a reputation for criminal incidents. A friend of mine was assaulted in the parking lot in 1988 or 1989 and there were numerous reports of armed robbery and assaults in the parking lots.

The current anchor tenants are Bass Pro Shop and Macy's. The third anchor, Boscov's, a regional department store chain, closed this fall as part of a chainwide bankruptcy plan.

It will be interesting to see what happens here. The mall has been making somewhat of a comeback in recent years, with the building of a large theatre complex and additions to the store roster.

The NFL Thinks Harrisburg is a Baltimore Suburb

That's right. The Harrisburg CBS television station was placed as a home market for the Baltimore Ravens since under the NFL rules and television agreement, WHP-TV's viewing area is within 75 miles of the stadium.

Now there is some history here. When the Colts were in Baltimore, they played on Baltimore's north side at Memorial Stadium and there were thousands of Colts season ticket holders that lived in south Central Pennsylvania. The location was a fairly easy drive down Interstate 83 to the beltway and then only a ten minute drive from there to the stadium. There were quite a few busloads of season ticket holders leaving from the Harrisburg area every home game Sunday.

Well, of course, the Colts left town at 3AM on March 28, 1984 thanks to team owner Robert Irsay and his desire for a new taxpayer supported stadium.

In the ensuing years, central Pennsylvanians switched the allegiance to other teams, mostly the Eagles and Steelers and most older fans, like myself, have never forgiven the Irsay family for the move.

Fast forward to 1995 when Art Modell, owner of the Cleveland Browns announced he was moving the team to Baltimore. Part of the agreement to allow this move was that the name and trappings of the Browns would remain in Cleveland, so after some time, a couple of fan contests and some agonizing, the Baltimore Ravens were born. And they played their first games at Memorial Stadium. The same place the Colts said was inadequate.

Of course, the Ravens did move to a new stadium in downtown Baltimore in 1998 and have been happily playing there sense.

But back to my subject, while the Ravens have caught on with Baltimore fans, the former fans from central Pennsylvania have never come back. You can find Eagle and Steelers items in most Harrisburg area stores, but have to go to a sport specialty store to find Raven items. As far as most central Pennsylvanians are concerned, the Ravens are the visiting team.

Yet because of the silly 75 mile rule, if the Ravens are on CBS at the same time as the Eagles or Steelers, we are forced to watch this foreign team rather than the "hometown" Eagles or Steelers.

By the way, driving from Harrisburg city hall to Camden Yards is 78.5 miles and takes about 90 minutes per Google maps. NFL - give us back our Steelers and Eagles

New Airline Starts Flying From Harrisburg International Airport

One of the negatives about living in a smaller market is the lack of transportation opportunities when you just have to get out of town.

The Harrisburg International Airport is a very nice facility converted from the former Olmsted Air Base with a new terminal, very long runways and short security lines. The bad part is that it can be difficult to get anywhere from here.

This week, there were six airlines serving this area; Air Canada (2 flights a day to Toronto), Continental (a few flights to Cleveland and Newark), Delta (to Atlanta and Cincinnati), Northwest (to Detroit and Minneapolis), United (to Chicago and Dulles) and US Air (to Boston, Philadelphia and Charlotte). Almost all of the service is by "express divisions" of these airlines on regional jets or props. American provided service to Chicago and Dallas, but pulled out earlier this year.

That brings me to some good news for the area

AirTran started service yesterday to Orlando. Finally, a way to get to Florida without having to brave the Atlanta Hartsfield subway, the Philadelphia airport kiosks and the Cincinnati airport buses. I only wish they had started last month so out trip to the NAR convention could have been direct.

The airport commission is working hard to bring an additional airline or two into the market to provide service to more markets. Hopefully some more routes will be added by next summer to make vacation travel easier for everyone.

Can Short Sale Get You In Trouble With The State?

Well, it might.

According to an article published Friday in the Pacific Business News, a new law in Hawaii called the Mortgage Rescue Fraud Prevention Act could mean some real estate agents would be practicing as "Distressed Property Consultants" which requires them to abide by a separate set of rules from the real estate codes. http://www.bizjournals.com/pacific/stories/2008/11/17/story11.html .

So some Hawaii real estate brokerages have stopped listing short sale properties as a matter of policy until they receive some definition as to if their involvement in a short sale would fall under this act.

So a law that was designed to protect homeowners from predators has also prevented them from getting help from the true real estate professionals.
