Inside, all the rooms are measured and described. This may provide the most accurate measurement of living space.&nbsp; Living space does not include such things as decks, terraces, garages, basements, and store rooms. The agent, however, will describe these spaces.<br /><br />Other sources of square-foot information include:<img title="square footage" src="http://activerain.com/image_store/uploads/7/4/2/3/6/ar125850017563247.jpg" height="169" alt="square footage" width="100" style="margin: 10px; float: right;" /><br /><br />Builder supplied <strong>floor plan</strong>:&nbsp; Often these can be less than completely accurate because of last minute design changes or owner requested modifications.<br /><br />The<strong> property owner</strong>: Most sellers round the living space upward. Not knowing the rules, they could also be including storage areas. <br /><br /><strong>Public records</strong>: Square footage may not be accurate for homes that have been remodeled or added onto over the years. Some are done without building permits, so these would not be included in public records. <br /><br />An <strong>appraiser</strong>: An appraiser's figure could also be different from public records.<br /><br />Buyers often compare the square footage with the price of a home in order to determine a price-per-square-foot. And, if certain Democrats have their way, we're only thirty days away. But, for the sake of argument let's assume that the CARD Act provisions will wait until February 2010 to become enforceable law.</p> <p>During these last few days of the credit card world's version of the Wild Wild West we should continue to see credit card issuers behaving badly, very badly in fact. The mega-credit card issuers have a shrinking window of opportunity to finish remolding their cardholder base to look more like what they will finally deem as being to their liking. This means consumers will continue to suffer the at the hands of their credit card companies, that is of course unless they employ one or more of the following strategies.</p> <p>1. Don't Not Use Your Card - Ok, the poor grammar was intentional and corny but I think I've made my point. Credit card issuers are in busy to make money and make a profit. They can't do either unless you are using your credit card. And, the best news is that you do not have to carry a balance from one month to the next in order to drop a few dimes in your credit card issuers pockets. Each time you use your credit card the merchant (aka the place you used the card) has to pay the bank a fee. This fee is called interchange. It technically comes out of your pocket because many retailers will build the assumed fee into the price of the merchandise but it sure doesn't feel that way when we buy stuff with our credit cards. So, knock the dust off your cards and use them for modest purchases. Don't revolve a balance and don't get into a position where your balances spiral out of control and you'll be fine.</p> <p>2. Shut Up! - In the past a viable strategy to get fees waived and interest rates lowered was to call your credit card issuer and complain or otherwise plead your case. That's still a decent strategy but beware. Your credit card issuer might turn the tables and start asking YOU questions in order to determine whether or not they still want to do business with you. If you call them and THEY start asking questions about your job status and salary then end the convo and hang up or you might just end up with a closed credit card.</p> <p>3. Open Another Card, NOW - One of the worst strategies I see people employing today is the 1-card strategy. You should have MORE cards, not fewer cards.&nbsp;In the ideal mix of credit model - a consumer should have 3-5 credit cards (personally I endorse 4 or 5 cards).&nbsp;Clearly this is a credit score play as well since having more available and unused credit limits are always good for your credit scores. So, if you have one or two credit cards right now, think about opening at least one more. This gives you options in case one of your credit card issuers starts behaving badly towards you. Nothing is more empowering than saying "I'll take my business elsewhere" and then actually doing it.</p> <p>4. Don't Hide Behind Great FICO Scores - FICO published a study earlier this year and the findings showed that the median FICO score for a consumer who has seen his or her credit limit reduced was 770. A 770 FICO score is fantastic in any lender's book and especially in this credit environment where lenders are gravitating to stronger borrowers. What this means is that just because you have great FICOs it doesn't fully shield you from adverse treatment from lenders.</p> <p>5. Go Small and Go Local - I was speaking with John Ulzheimer, founder of&nbsp;credit dot com&nbsp;and a nationally recognized credit expert and he made an interesting point. He said that we, as consumers and watchdogs, tend to focus on the largest 5-10 banks and tend to forget about the thousands of lenders who are NOT treating their customers poorly. Credit unions are a great example of these lenders. If you are sick of how you're being treated by your Manhattan bank then perhaps you need a local credit union or local bank on your side.</p> <p>6. Don't Exit The System - The blogs are on fire with angry consumers who are claiming to have sworn off credit for the foreseeable future because of how they are being treated by their lenders. "From now on if I can't pay cash for it I won't buy it." Eh, that plays well on the big screen but it's not realistic. Carrying around cash to pay for things is a bad idea. And good luck using debit cards for things like business travel and European vacations. Stay in the system, please.</p> <p>7. If All Else Fails, Litigate - If you're finding yourself saddled with a garbage credit report because of errors and you can't the credit bureaus or lenders to correct your files then think about filing a lawsuit. You certainly wouldn't be alone. There will be over 8,500 credit related lawsuits filed this year. Collections agencies are the targets in most of them but certainly the credit bureaus and lenders are in the cross hairs a fair amount too. Just be sure to hire a lawyer who knows what he's doing.</p> <p>So there you have it, seven solid strategies to hopefully minimize your chances of being treated poorly by your creditors. A few frequently asked questions with answers to go along with all of that:</p> <p><strong>Question: Existing homeowner credit: Must the new house cost more than the old house?</strong></p> <p><em>Answer: No. Thus, for example, individuals who move from a high cost area to a lower cost area who </em><em>meet all eligibility requirements will qualify for the $6500 credit.</em></p> <p><em>&nbsp;</em></p> <p><strong>Question: I am an existing homeowner. On October 25, 2009, I signed a contract to purchase a </strong><strong>new home. I have lived in my current home for more than 5 consecutive years and </strong><strong>am within the new income limits. I will go to settlement on November 20. &nbsp;If </strong><strong>President Obama has signed the bill by the time I go to settlement, will I qualify for </strong><strong>the new $6500 tax credit?</strong></p> <p><em>Answer: Yes. The existing homeowner credit goes into effect for purchases after the date of enactment </em><em>(when the bill is signed). There is no reference to the date of contract for the new credit. The </em><em>provision looks solely to the date of purchase, which is generally the date of settlement.</em></p> <p><strong>Question: I am a first time homebuyer but was not within the prior income limits at the time I </strong><strong>entered into my contract to purchase on October 30, 2009. I will be covered, </strong><strong>however, by the new income limits. If the new rules have been signed into law by the </strong><strong>time I go to settlement, will I be eligible for a credit?</strong></p> <p><em>Answer: Yes. The new income limitations go into effect as soon as the President has signed the bill.</em></p> <p><em>The income limit and other eligibility rules will look to your status as of the date of purchase,</em></p> <p><em>which is the settlement date. So if the new rules have been signed when you go to settlement,</em></p> <p><em>you should be eligible for the credit (or a portion of the credit if you're within the phase-out</em></p> <p><em>range).</em></p> <p><em>&nbsp;</em></p> <p><strong>Question: I am an eligible existing homeowner. Any amount</em></p> <p><em>above $800,000 makes the home ineligible for any portion of the credit. The $800,000 is an</em></p> <p><em>absolute ceiling.</em></p> <p><em>&nbsp;</em></p> <p><strong>Question: I owned my home for 10 years, but sold it two years ago year and have been renting </strong><strong>since. If I purchase a home, will I be eligible for the $6500 tax credit if I meet all the </strong><strong>other eligibility tests?</strong></p> <p><em>Answer: Yes. Because you lived in the home for more than 5 consecutive years of the previous 8, you</em></p> <p><em>will qualify for the $6500 credit. For example, Say John and his wife bought a home in 2000</em></p> <p><em>and lived there until 2008 when he got a divorce. Whether John has been renting or bought in</em></p> <p><em>the interim, he WOULD INDEED be eligible for the credit because he owned a home and</em></p> <p><em>occupied it as his principal residence for 5 consecutive years out of the last 8 years. It's your agent; he/she will be by in an hour with a prospective buyer, have the house ready for showing. <strong><em>Oh, so this is the panic feeling my agent was talking about.</em></strong></p> <p>&nbsp;</p> <p>The good news is there are some simple steps that can keep you and your home "show ready" with a minimum amount of work. So, from the sublime to the rediculous - <strong>here's&nbsp;8 myths of staging to sell - busted!</strong></p> <p><strong>1. Buyers can see past my stuff</strong><br />No - they can't. 95% of house hunters shop with a <em>'what you see is what you get'</em> eye. It's <em>more </em>likely to trigger alarm bells, with many wondering what it is you're trying to hide. Your buyers will be&nbsp;happy with a place that looks and smells clean.</p> <p><strong>3. I'll need to clear everything out to help buyers see themselves living here.<br /></strong>This is only partly true. Wall to wall family photos are distracting, as is your porcelain rooster collection.&nbsp;These things are best put away.&nbsp;But don't go overboard,&nbsp;otherwise you'll end up with a look that feels cold and sterile.</p> <p><strong>4. If it's an original feature - it adds&nbsp;value.</strong><br />Sometimes yes - but often no. Generally a property built less than 50 years ago without being updated is more likely to appear dated, rather than classic.</p> <p><strong>5. My place isn't worth staging.<br /></strong>All homes are worth taking the time to present in a positive light to buyers. Buyers will always prefer to see how a room is used and what will fit in it, rather than be left to guess. Very large rooms can also be too intimidating for some. Even borrowed furniture can&nbsp;help buyers get an idea of scale and give the eye something of interest to focus on.</p> <p style="text-align: left;"><strong></strong><strong>7.&nbsp;Converting a bedroom into&nbsp;a home gym won't be a problem.<br /></strong>Bedrooms are one of the most valuable commodities of the 'for sale' property. Having a home gym set up in&nbsp;a bedroom will prompt buyers to wonder why that is. I remember once looking at a house where this was the case. When I came across the bedroom with the gym in it, I immediately began to question if a bed would even fit. Always give the rooms in your house a purpose.</p> <p><strong>8. No need to worry about wardrobes and cupboards.</strong> <br />Home storage is a big deal to most buyers and is surprisingly valuable. Prospective buyers will open storage cupboards in kitchens and bathrooms, so keep them tidy.
