      <title>$100 MILLION DOLLARS IN PROBATE PRODUCTION IN 2012</title>
      <description>&lt;p&gt;Well I guess the Title raised your interest lol. &amp;nbsp;This is a true statement as in my MLS Board in Alameda County, 1 of a few there was close to $100 Million Dollars in Probate Real Estate Listings Closed during 2012! &amp;nbsp;All I have to say about this is how many did you do in your area as this is typical volume in an large County. &amp;nbsp;Close to 300 &lt;a href="http://www.thediamondfarm.com" target="_blank"&gt;Probate&lt;/a&gt; Listings came through and the interesting fact is no agent had more than 4 listings. &amp;nbsp; Can you see an opportunity! &amp;nbsp;I hope so!&lt;/p&gt;
&lt;p&gt;My GaryDTeam is on fire in 2013 with now 18&lt;a href="http://www.thediamondfarm.com" target="_blank"&gt; probates&lt;/a&gt; sides for the year, several probate offers on the table with executors and a few listings coming our way. &amp;nbsp;This is all Cold Business we developed by following a system. &amp;nbsp;We have expanded to Santa Clara County and will also open San Francisco and San Mateo Counties this year. &amp;nbsp; Just Alameda and Contra Costa Counties alone bring 60-80 New, probate files with real estate each month! &amp;nbsp;Wow! &amp;nbsp;If that doesn't excite you then I'm not sure what will. &amp;nbsp;&lt;/p&gt;
&lt;p&gt;My business is not just flipping and wholesaling as because of the very Hot Real Estate Market in Alameda County we are doing more Double End Sales and earning 4-6% on homes that never hit the MLS. &amp;nbsp;We work under the MLS Radar and if you are a buyers agent I don't have to tell you how frustrating it is out there on the streets writing offer after offer and being outbid. &amp;nbsp;Very frustrating for your buyers. &amp;nbsp;Well soon you will loose those buyers as they will blame you for not placing them into a home. &amp;nbsp; You may want to rethink how you are doing your RE Business if you are in this situation. &amp;nbsp;&lt;a href="http://www.thediamondfarm.com" target="_blank"&gt;Probate Homes &lt;/a&gt;and adding &lt;a href="http://www.thediamondfarm.com" target="_blank"&gt;Probate Agent&lt;/a&gt; to your business card can do this.&lt;/p&gt;
&lt;p&gt;Investors you are having a tough time finding wholesale properties. &amp;nbsp;The TS sales at the court house steps have dried up, REO Agents your business is down 70% or more so that leaves Short Sales which is a pain but I have agent friends who do earn big with SS but are having a tough time keeping their production up. &amp;nbsp; Maybe it's time to open your mind and see if&lt;a href="http://www.thediamondfarm.com" target="_blank"&gt; Probate Real Estate&lt;/a&gt; is for you.&lt;/p&gt;
&lt;p&gt;This week alone we doubled ended a probate home we have and I met with a Administer where I'm double ending their estate home over the next few days. &amp;nbsp;Mix into this a new Oakland Fixer we had developed a relationshipe with the Executor and we are going to bring in our investor for a cash sale as it's a major fixer. &amp;nbsp;Non of this activity has been MLS Based. &amp;nbsp;You do the Math!&lt;/p&gt;

      <title>PROBATE TRAINING: WILLS</title>
      <description>&lt;p style="text-indent: 20px;"&gt;Anyone who has gone through the Probate process understands what a trying time this is for the Executor and the family of the deceased. The deceases private information is subject to public scrutiny and how awful is that. Anyone can access this file if they have the file number and these are published in the newspaper and online. On top of public access if a person passes and has a will or no will, their assets can be frozen and if they are still alive but incapacitated their medical care can&amp;rsquo;t be dictated by the family. Probate Wills are not the way to go but they are what the majority of America does. The wealthier people of America use Living Trusts and everything is set in place so when the time comes the family doesn&amp;rsquo;t have any problems with assets or medical care.&lt;/p&gt;
&lt;p style="text-indent: 20px;"&gt;With Probate Wills, an executor is named who must petition the court to be approved to act as the executor and until approved is called the petitioner. This process can take several weeks and must be done before anything else can happen with the estate. The petitioner once approved by the court then has a shopping list of requirements they must do over a 90-120 day period in order for the probate to clear the courts and go to what is called final distribution.&lt;/p&gt;
&lt;p style="text-indent: 20px;"&gt;With Probate Wills, there is so much red tape especially in California, this becomes a full time job for the executor. In many cases I have seen many executors moving into the estate property since most of the time they are vacant. They have assets to find and inventory, bills to pay and other required acts supervised by the courts which is mind boggling. Why our court systems allow this is beyond comprehension to me.&lt;/p&gt;
&lt;p style="text-indent: 20px;"&gt;As far as my business is concerned (buying and flipping probate property) Probate Wills are my bread and butter because the executor and heirs are in need of someone to help them. Countless times I have been thanked and sent gifts for my help to the executor and the family. This usually comes from me buying the estate home and taking what is usually the biggest headache off their plate. Now this comes at a price as I buy wholesale because I&amp;rsquo;m going to most likely flip the estate property to an end user buyer within 90 days from the time I purchase. This discount which is usually between 15-25% hasn&amp;rsquo;t been a problem with the estate when it works because I&amp;rsquo;m relieving them of a burden and bottom line, this is free money to the heirs. In the typical estate sale which I buy, there are multiple heirs usually between 3-5. So if my purchase is at a discount of $60K to the estate it really only means from $20K to $12,500 discount to each heir. Now if they are each coming out with $75K and the headache is off their plate, you can see why this works.&lt;/p&gt;
&lt;p style="text-indent: 20px;"&gt;In California there are two ways to probate an estate. One is the court confirmation process and the other is through what is called the I.A.E.A. The old court confirmation process is what I have been talking about. Probate Wills have the right to go with either process providing the Probate Will doesn&amp;rsquo;t prevent the executor from using the I.A.E.A. If this I.A.E.A is used, the executor can treat the real estate sale just like you or I would in selling our own home. There is very limited red tape and the only items which have to be address is what is called a &amp;ldquo;Notice of Proposed Action&amp;rdquo; and have &amp;ldquo;Letters of Testamentary&amp;rdquo; which allows the executor to sign the grant deed. That&amp;rsquo;s it, no court confirmation process, no appraisal (which are jokes), no 10% buyer deposit which keeps most retail buyers away, and no &amp;ldquo;as is&amp;rdquo; purchase. This I.A.E.A law has been around since 1987 and it still amazes me why more estates don&amp;rsquo;t use this opposed to the old court confirmation process.&lt;/p&gt;
&lt;p style="text-indent: 20px;"&gt;Probate Wills most likely will always be around as it much cheaper than having a living trust done but the money spent will make the lives of the decease family so much more easier when the time comes. Anyone who is in a will should consider seeking out a Living Trust and researching the benefits of doing so. I have only touched on this subject.&lt;/p&gt;

      <title>PROBATE REAL ESTATE: What are LETTERS OF TESTAMENTARY</title>
      <description>&lt;p&gt;As a &lt;a target="_blank"&gt;Probate Agent &lt;/a&gt;in California there are two &lt;a target="_blank"&gt;Probate &lt;/a&gt;Processes which can be used to sell an Estate Home during Probate. &amp;nbsp;The process we use with the Independent Administration of Estates Act which was enacted in 1987 and allows the estate to take the home out of the court supervision process and sell it almost like a regular sale. &amp;nbsp; Today we talk about one of the Documents you will need to close.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;LETTERS OF TESTAMENTARY&lt;/strong&gt;: &amp;nbsp;This document is prepared by the estate attorney and is certified. &amp;nbsp;This is approved by the court and allows the Petitioner/Executor to do certain functions for the decease within the probate. &amp;nbsp;For our focus which is real estate this L.O.T allows the Petitioner/Executor to sign the contract and more important the Grant Deed when we are ready to close the sale. &amp;nbsp;Keep in mind the Petitioner/Executor is usually not on Title of the &lt;a target="_blank"&gt;probate home&lt;/a&gt; and is still in the name of the decease. &amp;nbsp;In order for the Petitioner/Executor to be able to grant the property over to the new buyer (You or your client) there must be authority and this is what the L.O.T does. &amp;nbsp;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Your title company will ask for this form (Must be certified) in order to issue title insurance and close. &amp;nbsp;We ask the Estate Attorney to petition the court for this if they haven't already and also to provide a certified copy to Title. This can all be done in a week or two and most times the estate attorney will already petitioned the court for the L.O.T as it is needed. &amp;nbsp;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;In&lt;a target="_blank"&gt; Probate Real Estate&lt;/a&gt;, you will need to know about several documents in order to &amp;nbsp;process and close out the &lt;a target="_blank"&gt;probate sale&lt;/a&gt;. &amp;nbsp;This is one of them so take some notes or copy this Blog and place in your notes. &amp;nbsp; If your out of California you will have to deal with the title if the Executor is not on title so he/she can sign for the decease. &amp;nbsp;Ask your local probate file room clerk for the form and also your title company to see how they deal with this if you are not in California.&lt;/p&gt;

      <description>&lt;div style="font-family: Verdana,Arial,Helvetica,sans-serif; font-size: 10px;"&gt;During my &lt;span style="font-size: small;"&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif;"&gt;40&lt;/span&gt;&lt;/span&gt; years in real estate, I came to understand by working a niche around your general real estate business helps when market conditions slow down and hurt your regular business. &amp;nbsp; I think this is wise for any agent to do whether it's&amp;nbsp;&lt;a href="http://thediamondfarm.com/" target="_blank"&gt;Probate Homes,&lt;/a&gt; &amp;nbsp;TS Sales, &amp;nbsp;Short Sales or whatever. &amp;nbsp;&lt;strong&gt;Doing something that the masses don't do will keep you going&lt;/strong&gt; especially when we hit a market like we have had from 2007 through 2012. &amp;nbsp;Now we have a different market,&amp;nbsp;Red Hot, Crazy Market and a new problem has risen. &amp;nbsp;I can't sell anything unless its my listing. &amp;nbsp;Well, listings are increasing but the inventory is still low. &amp;nbsp; If you are a buyers agent you are in trouble. &amp;nbsp;REO's are just about gone, Short Sales are there, loan mods are coming into there own. &amp;nbsp;TS Sales are a joke as bidders are paying retail at the court house steps. &amp;nbsp;&lt;strong&gt;You better think about where you want to work!&lt;/strong&gt;

&lt;div style="font-family: Verdana,Arial,Helvetica,sans-serif; font-size: 10px;"&gt;During the down real estate market (2007-2012) I joined forces with another top agent and we established a REO business which kept me earning great for the entire year. &amp;nbsp; 12 hour days, 7 days a week made me decide to get out of this game&lt;span style="font-size: small;"&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif;"&gt;.&lt;/span&gt;&lt;/span&gt; I was burned out and it wasn't the money it was my quality of life I wanted back. &amp;nbsp;In 2009 I represented a TS Group and handled their resales which gave me my time back to 60 hours per week and kept my income good. &amp;nbsp;That went well until the group decided to save a listing agent's fee and do this part them-self. &amp;nbsp;No worries, it was a good year while many where closing down their offices and leaving the business. &amp;nbsp;2010 I had a a couple of REO accounts and concentrated on my&amp;nbsp;&lt;a href="http://thediamondfarm.com/" target="_blank"&gt;Probate Real Estate&amp;nbsp;system&lt;/a&gt; which has been alive and well although we hadn't been buying and selling since the market was so upside down and unpredictable we couldn't risk our investors money. &amp;nbsp;We just listed and sold probate homes and again had a good year. &amp;nbsp; &amp;nbsp;All along the RE Meltdown, Probates made up the bulk of my business as the market started to slowly turn around. &amp;nbsp;I had a few&amp;nbsp;Probate&amp;nbsp;flips for investors and did well. 2012 on has been the jump start of my&amp;nbsp;probates&amp;nbsp;as my #1 source of business in this crazy market. &amp;nbsp;Let me explain why...&lt;/div&gt;
&lt;p&gt;My current market in the San Francisco Bay Area is on fire and properties are selling in a few days from being listed, with multiple offers (10+) and then selling for as much as $50K over asking. &amp;nbsp; Agents are doing crazy things like having their buyers waive the appraisal contingency clause which in my opinion is playing Russian roulette as one of these is going to back fire and a client is going to loose a deposit and guess who they are coming after. &amp;nbsp;The market is so bad for those agents who represent buyers that they are doing crazy things to have their offer selected.&lt;/p&gt;
&lt;div style="font-family: Verdana,Arial,Helvetica,sans-serif; font-size: 10px;"&gt;I refuse to work under these situations so my choice was to only go after listings &amp;nbsp;OR think outside of the box as I have always done. &amp;nbsp; &lt;strong&gt;What I did was go after buyers for my&amp;nbsp;probate homes&amp;nbsp;which are not listed and double end the sales most of the time.&lt;/strong&gt; &amp;nbsp;This has worked great for me in 2012. &amp;nbsp; Those probates I don't have a buyer for I call on my network of agents who will bring me an offer and we split the commission. &lt;strong&gt;&lt;span style="font-size: small;"&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif;"&gt;O&lt;/span&gt;&lt;/span&gt;ver the last 5 months we have done 18 Probate Sides&lt;/strong&gt; in this crazy market. &amp;nbsp;I market for buyers (Va and FHA as well) then match them to the estate homes I'm tracking. &amp;nbsp;My point is&amp;nbsp;Probate Real Estate&lt;a href="http://www.probate-realestate.com/" target="_blank"&gt;&amp;nbsp;&lt;/a&gt;has been with me all through this down market and has kept my business alive and well&amp;nbsp;with&amp;nbsp;10-15 sides per year. &amp;nbsp; &lt;strong&gt;Maybe it's time you look at this niche and add&amp;nbsp;Probate Agent&amp;nbsp;to your business plan. &amp;nbsp;&lt;/strong&gt;

      <title>Add 6 figures to your production as a Probate Agent</title>
      <description>&lt;p style="text-indent: 20px;"&gt;I have been a icensed real estate agent for 33 years and have enjoyed an above average income but what really made the difference in my income was when I started working with &lt;a href="http://thediamondfarm.com/" target="_blank"&gt;Probate Real Estate&lt;/a&gt;. &lt;strong&gt;This niche can take any real estate agent with the right tools and information to six figures per year.&lt;/strong&gt;&lt;/p&gt;
&lt;p style="text-indent: 20px;"&gt;It is common knowledge in the Real Estate industry that the average agent makes less than $30K per year in the business and 20% of the agents make 80% of the money. This is nothing new but for those in the 80% bracket who want to jump to the 20% income bracket I recommend you look at becoming a Probate Agent.&lt;/p&gt;
&lt;p style="text-indent: 20px;"&gt;Most agents prospect by farming, open houses and sphere of influence to produce leads, to take listings and produce sales. I have done them all and was a major farmer in my early years. Many a doors knocked, magnets passed out, garage sales sponsored, flags on Flag Day and although it did help my income, it didn&amp;rsquo;t really make a serious impact. Farming is still dealing with a small percentage of homeowners who are going to sell and you&amp;rsquo;re hoping they call you when they do. I don&amp;rsquo;t believe farmers do a transaction per month from farming although 4-6 listings per year from farming aren&amp;rsquo;t bad. Agents who farm will also come across a few sales and maybe refi&amp;rsquo;s if they are working loans but the point is, 1 deal per month for most farmers doesn&amp;rsquo;t happen. &lt;strong&gt;For a &lt;a href="http://thediamondfarm.com/" target="_blank"&gt;Probate Agent,&lt;/a&gt; a transaction per month is very probable, I have been doing it for over 25 years.&lt;/strong&gt;&lt;/p&gt;
&lt;p style="text-indent: 20px;"&gt;Let&amp;rsquo;s think about this for a moment. In my Counties in Northern California (Alameda and Contra Costa), I research about 100 new probate files&amp;nbsp; each month which have real estate. In my last 25 years of doing probates I would say somewhere around 50% plus of the heirs are going to sell the probate real estate. This means 50 of those 100 per month are going to sell which means 600 leads per year. If you&amp;rsquo;re on top of your real estate game do you think you could find 12 of those executors to work with (listing) or 12 of those probates you didn&amp;rsquo;t list but had a buyer for. The numbers really get crazy.&lt;/p&gt;
&lt;p style="text-indent: 20px;"&gt;&lt;strong&gt;If you&amp;rsquo;re a full time real estate agent&lt;/strong&gt;, you should be looking at probate real estate and adding Probate Agent to your business card and client services. &lt;strong&gt;I have consistently averaged 12-15 probate transactions per year and I didn&amp;rsquo;t work the listing end.&lt;/strong&gt; I approach the estate from a position of buying the probate (wholesale) and then flipping. I didn&amp;rsquo;t want to take the time to farm and just list because I wanted to cut my work hours down. Working probates cut my work week from 60 hours to 15 hrs during the 90&amp;rsquo;s as I wanted more time with my kids. Now the amazing fact is my income went up. &lt;strong&gt; I earned from 1 probate flip what took 4 listings or sales to earn.&lt;/strong&gt;&lt;/p&gt;
&lt;p style="text-indent: 20px;"&gt;I have been &lt;a href="http://thediamondfarm.com/" target="_blank"&gt;teaching investors and agents&lt;/a&gt; how to do this since 1992 and since 2007 I've conducted workshops, seminars, probate clubs and webinar trainings, for my DF students to learn this system. I have the time now, since I semi-retired from the real estate business after handing over my general real estate business to my son. &lt;strong&gt;I am enjoying the time I spend with my DF students teaching agents how to become a Probate Agent doing a transaction per month&lt;/strong&gt; if they're good and persistent, and to my students who are investors only on how to find, purchase and flip probates. There are also students of mine who are agent/investors like me who want to do both.&lt;/p&gt;
&lt;p style="text-indent: 20px;"&gt;&lt;strong&gt;If you&amp;rsquo;re not earning six figures per year in your real estate business,&lt;/strong&gt; or you want to &lt;a href="http://thediamondfarm.com/" target="_blank"&gt;add another six figures&lt;/a&gt; to what you're doing already you need to look at probate real estate and in becoming a Probate Agent.&lt;/p&gt;

      <title>Probate Agent Designation?  Yes or No</title>
      <description>&lt;p&gt;I have been asked by many agents lately about how having a &lt;a href="http://thediamondfarm.com" target="_blank"&gt;Probate Agent&lt;/a&gt; Designation would help their business. &amp;nbsp;I am receiving many of these questions so I decided to address it. &amp;nbsp; Of course any designation you have is of some help when you are being looked at for a possible listing but in the real world what really counts is the past business with recommendations you have closed. &amp;nbsp;This is really what separates those who do to those who claim they can do.&lt;/p&gt;
&lt;p&gt;In my 25 years of being a Probate Agent I have each time we closed a &lt;a href="http://thediamondfarm.com" target="_blank"&gt;probate&lt;/a&gt; purchase, double end sale or listing, I would ask the executor and estate attorney for a letter of recommendation on my services. &amp;nbsp; I handled every sale with this in mind so when I asked I would receive one. &amp;nbsp;THIS IS WHAT COUNTS! when you are going up against another agent for a probate listing, not that you have some letters after your name because we educate petitioners and executors on what we have done probate wise over the last 25 years and why they should hire us to assist them in either cashing out the house NOW, bring a retail offer NOW, or exposing the estate home to the MLS in hopes of multiple offers. &amp;nbsp;When they read our past letters or recommendation it usually separates me from anyone else trying to pitch for the listing.&lt;/p&gt;
&lt;p&gt;Remember, I earn my living from buying and selling &lt;a href="http://thediamondfarm.com" target="_blank"&gt;probates&lt;/a&gt; but I'm not sure many of those probate marketeers out there can claim the same. &amp;nbsp;They offer some good information, many of them rewriting my course lol, but what really counts is performance so if you where an Executor would you want a Probate Agent who has closed over 300 probates with letters from other executors, estate attorneys, brokers and title officers or would you want to hire a probate agent with a designation as a probate pro but not much experience. &amp;nbsp; Just common sense stuff here.&lt;/p&gt;
&lt;p&gt;Now if you have many years of &lt;a href="http://thediamondfarm.com" target="_blank"&gt;Probate Real Estate&lt;/a&gt; experience with letters of recommendation and also a designation then that would enhance your position but it's not the designation it's the past history. &amp;nbsp; &amp;nbsp; I hope this clears this up for you all. &amp;nbsp;Work on doing Probate Deals. &amp;nbsp;In my opinion if you aren't doing a minimum of 1 probate per quarter (buy, sale or list) then you really aren't a Probate Agent Pro. I have consistently closed 12 to 18 probate sides per year through my entire probate career, earning 80% of my living from probate real estate not books and tapes. &amp;nbsp;This should be the comparison bench mark for anyone looking at a probate mentor.&lt;/p&gt;

&lt;p&gt;Energy is a $600 Billion Dollar per year business and just like when the phone industry was Deregulated in the early 90's, many people will act and benefit financially. &amp;nbsp;Where did Sprint, Verizon, MCI and many of the phone services today come from? Well it was from the Deregulation of the TeleCom Industry in the early 90's.&lt;/p&gt;
&lt;p&gt;&lt;br&gt;We do Real Estate to earn better money than working a job and every month we are closing buyers into homes, have contacts with home owners (Our farm), network with other agents and by adding another revenue source to our RE Business since this topic deals with Homes, we are working smart. &amp;nbsp; I hope you see the big picture.&lt;/p&gt;

      <title>Talking About Probate Law</title>
      <description>&lt;p style="text-indent: 20px;"&gt;I have been doing probate real estate investments (flipping, listing, and buying) for over 25yrs and it&amp;rsquo;s been a goldmine. What I found out over this period of time is attorney&amp;rsquo;s don&amp;rsquo;t study probate law by itself but one of the courses they take in law school. I have heard this comment over and over. Estate Attorneys do Family law which includes Probates and most attorneys I have spoke with consider wills their retirement funds.&lt;/p&gt;
&lt;p style="text-indent: 20px;"&gt;What has amazed me about Probate Law is the fee an attorney receives is based on the gross assets of the estate. So for an example, let&amp;rsquo;s say the deceased had $150K life insurance policies, $50K in the bank, stocks worth another $100K and a home worth $500K, the attorneys fee is based on a percentage of the total gross dollars in assets. In this case $800K. The attorney would receive a fee based on a percentage (sliding amount) which can be thousands. The funny thing about this is they don&amp;rsquo;t take into consideration any of the debt associated with these assets. If there is a mortgage of $300K on the house it doesn&amp;rsquo;t lower the house asset to $200K in this example. I found this very hard to understand.&lt;/p&gt;
&lt;p style="text-indent: 20px;"&gt;Another Probate Law issue I have is there is really no system in place from what I have experienced over the last 25 years doing Probate Real Estate, to assist the petitioner who is going to be the executor. These people for the most part have never undertaken anything like the experience in being an executor in probate. They are usually kept in the dark on the process and when they do speak to someone at the estate attorney&amp;rsquo;s office, it&amp;rsquo;s usually the Para-legal. I can&amp;rsquo;t tell you how many times I have sat face to face with a petitioner who was so confused and unsure of what they were doing. Something needs to be done to help this situation out.&lt;/p&gt;
&lt;p style="text-indent: 20px;"&gt;To make matters more complicated, in California there are two ways to probate an estate. One way is through the Court Confirmation process and the other thru the I.A.E.A. I buy probates through the I.A.E.A process so I can pull the estate home out of the process, &lt;strong&gt;avoid the 10% deposit,&lt;/strong&gt; &lt;strong&gt;the 90% of appraisal rule and the &amp;ldquo;As Is&amp;rdquo; situation&lt;/strong&gt;. This enables me to purchase homes at discount to make a profit when I go to resell. The petitioners love me because I remove a big burden off their shoulders by buying the house. Also, I give them an option to place the house on the MLS since I&amp;rsquo;m an agent, I&amp;nbsp; use my probate expertise and show them how to net more sale proceeds. For the most part, the probates I have purchased over the last 25 years, the petitioner didn&amp;rsquo;t care about the discount as it was more important to get rid of the vacant house.&lt;/p&gt;
&lt;p style="text-indent: 20px;"&gt;Our Probate law has to be revised to treat the sale just like a regular real estate transaction. Under the I.A.E.A in California there are checks and balances to make sure everything is right and the heirs agree, we have no need for the old probate law which involves too much red tape but most importantly hand cuffs the estate from entertaining offers to purchase from retail buyers looking for a home to move into and willing to pay retail. The old Probate Law (calif) usually attracts only the investor looking for a wholesale purchase. I will say I have profited over the years from the probate laws but I still feel we should &lt;strong&gt;only use the I.A.E.A probate procedure&lt;/strong&gt; and better yet, everyone with assets over $250K should be required to have a Living Trust.&lt;/p&gt;
&lt;p style="text-indent: 20px;"&gt;Probate law is necessary to protect the estates but it needs to be revised to have a uniform easy to follow procedure for the executor with the estate attorney who is making these large fee&amp;rsquo;s required to do all the tasks of the executor.&lt;/p&gt;
&lt;p style="text-indent: 20px;"&gt;From having probate investing students all over the Country, I have found all the States are different in some way with their Probate law procedure and California is one of the strictest and most confusing States to probate an estate under. Time for someone to step up and change the system.&lt;/p&gt;
&lt;p style="text-indent: 20px;"&gt;For those intereted in really learning probates and making some serious money. I created a group called the "INNER CIRCLE".&lt;/p&gt;

      <title>PROBATE HOME PURCHASE--WHOLESALE- 3 REALTORS EARNING</title>
      <description>&lt;p&gt;&lt;a href="http://probate-realestate.com" target="_blank"&gt;PROBATES&lt;/a&gt; ARE HEATING UP!&amp;nbsp; The Baby Boomers are coming on strong and taking over Billions of inherited real estate from their parents who have passed.&amp;nbsp; Many of them are selling the properties to divide up the cash to family heirs or whomever the deceased wanted to give a share to.&amp;nbsp;&amp;nbsp; &lt;strong&gt;My business is selling those properties, Retail or Wholesale, and earning a Double Commission on every one&lt;/strong&gt;.&amp;nbsp;&amp;nbsp; In this Hot Northern California Market we are &lt;strong&gt;selling 90% of our own estates&lt;/strong&gt; and earning &lt;strong&gt;4-6% commissions&lt;/strong&gt;.&amp;nbsp; This could be the biggest year of my 25 years of &lt;a href="http://probate-realestate.com" target="_blank"&gt;Probate Home&lt;/a&gt; Production.&lt;/p&gt;

&lt;p&gt;This week our Network brought to us a home (fixer) in an exclusive area in Contra Costa which was in contract.&amp;nbsp;&amp;nbsp; We have our investor in the deal, he wholesaled to our other investor, the network agent who found the trust is receiving a full sale commission, the original investor -&amp;nbsp; a wholesale fee and my Team a big Fee (referral) for netoworking the deal.&amp;nbsp;&amp;nbsp; We're not even on the contract.&amp;nbsp; This is thinking outside the box.&lt;/p&gt;
&lt;p&gt;Again,&amp;nbsp; I always clarify we do what is in the best interest of both seller (estate) and buyer.&amp;nbsp; This home has a upside value of $1.4M even though the buyer paid close to retail (high $700's) for the current condition of the property.&amp;nbsp;&amp;nbsp; From this deal we found another Probate around the corner and will do the same with this one although this one we are direct with the Estate.&lt;/p&gt;
&lt;p&gt;&lt;a href="http://probate-realestate.com" target="_blank"&gt;REO Agent&lt;/a&gt;s your business is all but about gone,&lt;a href="http://probate-realestate.com" target="_blank"&gt;&amp;nbsp; Short Sale Agents&lt;/a&gt; this is going away soon as well.&amp;nbsp; What has been steady for me for 25 years has been &lt;a href="http://probate-realestate.com" target="_blank"&gt;Probate Real Estate&lt;/a&gt; and learing the &lt;a href="http://probate-realestate.com" target="_blank"&gt;Probate Agen&lt;/a&gt;t role.&amp;nbsp; It's about Win/Win and Service BUT even before, it's about knowing how to find&lt;a href="http://probate-realestate.com" target="_blank"&gt; Probate Homes&lt;/a&gt;, how to control and extract the estate from the tough Court Supervision Process &lt;strong&gt;and&lt;/strong&gt; how to control the sale, not be an order taker.&lt;/p&gt;

      <title>$Million Dollar Probate Agent! My Latest Niche Within Probate Real Estate</title>
      <description>&lt;p&gt;Now that my &lt;a href="http://probate-realestate.com" target="_blank"&gt;Probate&lt;/a&gt; Street Team is firing on all cylinders, I have position myself to work in the Million Dollar &lt;a href="http://probate-realestate.com" target="_blank"&gt;Probate Home&lt;/a&gt; niche which will produce $40K+ Fee's since we usually double end our &lt;a href="http://probate-realestate.com" target="_blank"&gt;Probate Homes.&lt;/a&gt; &amp;nbsp; My Team is handling the 60+ probate home leads we receive each month in our County and I have two Top ReMax Seasoned Agents who are handling the Day To Day for the properties from $150K to $1M. &amp;nbsp;Our Goal is a deal each per week for them (4) and 8 for the month. &amp;nbsp;We have done 18 Probate/Trust Sides for the year so we are doing fairly well.&lt;/p&gt;
&lt;p&gt;This week I worked with an Estate in Palo Alto who has the family home with estimated value of $1.4M and they want to sell. &amp;nbsp;I developed a relationship with the Executor who is in Canada by phone and also her Brother who lives at the subject property. &amp;nbsp;We made our offer along with another broker who made his offer. &amp;nbsp;He was first (opps not my style) and was in at $1.425K. &amp;nbsp;We sent in $1.450 but the Executor said they signed that night. &amp;nbsp;I went on to talk to her about the Probate Process and she did not have a clue on how this works. &amp;nbsp;The other Broker did not either. &amp;nbsp;He did not have the Probate Home Offer on the CAR Probate Deposit Receipt which talks about the probate process neither did he have an addendum which referenced the I.A.E.A which can bypass the court confirmation process, or Letters of Testamentary the Executor needs to sign for the offer and Grant Deed when ready to close or even the Notice of Proposed Action which has to be completed. &amp;nbsp; The Executor was a little concerned but regrouped. &amp;nbsp;She said send in your Offer as a backup which we did.&lt;/p&gt;
&lt;p&gt;I immediately called the Estate Attorney (not in, which is usual) so sent her an email about the above facts for the estate home. &amp;nbsp;She emailed me back, also concerned and said she would look into things and get back to me. &amp;nbsp;We had a good talk about probate and what we do so I believe we will be picking up another attorney source for business even if we don't sell this one. &amp;nbsp; &amp;nbsp;My Attorney Liaison will now place this attorney in her rotation of calling on and marketing too so our Machine is running at Maximum. &amp;nbsp;I love this business.&lt;/p&gt;
&lt;p&gt;So now my team tracks &lt;a href="http://probate-realestate.com" target="_blank"&gt;probates&lt;/a&gt; in San Francisco, San Mateo, Santa Clara along with Alameda and Contra Costa Counties so I have the Bay Area covered. &amp;nbsp; Ala/CC we are going after all homes but in the other Counties I'm going after the $1M plus estates and there are many. &amp;nbsp;Yes many in this price range don't have a Living Trust so I can stay busy. &amp;nbsp;My goal is 6 $1M double ends this year.&lt;/p&gt;
&lt;p&gt;Think outside of the box. &amp;nbsp;I want to show my fellow agents how to be a &lt;a href="http://probate-realestate.com" target="_blank"&gt;Probate Agent&lt;/a&gt; and either work alone like I did for 20 of my 25 years doing &lt;a href="http://probate-realestate.com" target="_blank"&gt;Probate Real Estate&lt;/a&gt; or build a Team like I have, everything is commission based so no hard costs, and control an area.. &amp;nbsp;My next niche will to have another network agent work the closed Probates which did not sell and this will be our Farm for future business. &amp;nbsp;See how this works!&lt;/p&gt;

      <title>Probate Court Referee Appraisals==How to Avoid and or Change Them</title>
      <description>&lt;p&gt;Over my 25 years of &lt;a href="http://probate-realestate.com" target="_blank"&gt;Probate Real Estate&lt;/a&gt; I have often had problems with the probate court referee's's appraisal. &amp;nbsp; I'm not sure why this was even started but it's a waste of time and money for the estate and in many cases handcuffs the estate from taking a great offer. &amp;nbsp;If you want to be a Probate Agent you better understand how to get around this bogus procedure and making sure you can bring the sale in under the I.A.E.A which bypasses all this crap.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;First, the assets of the estate need to be appraised while the &lt;a href="http://probate-realestate.com" target="_blank"&gt;probate&lt;/a&gt; progresses and I'm not arguing about this as it's needed. &amp;nbsp;What doesn't need to be appraised is the house if the sale is going through the Independent Administrations of Estate Act (1987). &amp;nbsp;If the probate home is sold then the cash proceeds will be placed in the estate checking account and will count in the total assets of the estate at the time it's needed. &amp;nbsp;The house being there actually hurts the estate as the value is the gross value not the equity. &amp;nbsp;If a home is worth $400K and the seller owed $300K then the real asset is $100K. &amp;nbsp;You can break this number down further if sold with sales costs and possible inspection costs. &amp;nbsp; Then the true asset is placed in the overall assets of the estate and the statutory fee's are based on the true cash asset not a home valued at $400K. &amp;nbsp;I have seen this happen time and time.&lt;/p&gt;
&lt;p&gt;What we do is sell the home and write in the reference to the law which gives the executor the power to sell without court supervision. &amp;nbsp;We liquidated the asset (home) to cash and it goes into the estate checking out. &amp;nbsp;If there is a home unsold then the appraisal will have to be a min of no more than one year old. &amp;nbsp;Also, the court referee is basically a CPA not a certified licensed appraiser and they do not usually go into the home just a drive by (windshield appraisal) and order comparable sales from a comp service. &amp;nbsp;Bogus!&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;CASE EXAMPLE:&lt;/strong&gt; &amp;nbsp;I just brought an offer to an estate which involved 3 brothers. &amp;nbsp;One brother passed and the heirs (his sons) where going into title. &amp;nbsp; &amp;nbsp;The brothers had a certified appraisal performed on the home which came in at $300K. &amp;nbsp;I brought an offer of $344,500 which included a $20K commission to me. &amp;nbsp;We signed the deal but there was a court date coming up that was going to handle the heirs interest and go into title. &amp;nbsp; I told the heirs not to mention we had a sale but they did, they trusted their life long CPA/Attorney who meant well but really blew it. &amp;nbsp; She orders the appraisal from the court referee and it comes in at $550K. &amp;nbsp;This kicked the heirs interest who was looking at probate to $183,333 and placed&amp;nbsp;the son over the $150K exemption which would have avoided probate. &amp;nbsp;The CPA accused me of selling the home way low when in reality I was right on the money.&lt;/p&gt;
&lt;p&gt;The tax rolls showed the subject &lt;a href="http://probate-realestate.com" target="_blank"&gt;probate home &lt;/a&gt;as a 4 bedroom, 2 bath, 2500 s/f with a detached garage and sitting on a 19,000 level lot. Now if you just took the tax rolls and looked for com-parables you would have found other sales in the $550K range so based on this information the CPA was correct. &amp;nbsp;What the Court Referee didn't know or check was that the home was basically a 2 bedroom, 1 bath home about 1300 S/f with a garage conversion to another bedroom (no permit, no closet, no windows so illegal) the 4th bedroom and 2nd back was down stairs and you had to access it from the house by a not to code stair case, then walk through the basement to a door which entered a 1 bedroom, 1 bath, very nice unit although illegal (7.5 ceiling height) below grade with water problems, and not permitted. &amp;nbsp; It was rented and did have a separate outside entrance as well but it was not legal! &amp;nbsp;Had some value but not as a regular, legal 4 bedroom, 2 bath house of 2500 s/f. &amp;nbsp; &amp;nbsp;&lt;/p&gt;
&lt;p&gt;The detached garage built did not have a permit and the city wanted it removed Plus the lot was not split-table after checking. &amp;nbsp;The licensed appraiser brought his appraisal in at $300K after checking all the above and was right on target. &amp;nbsp;I did my CMA and my $350K would hold &amp;nbsp;up because the market had increased since the last appraisal. &amp;nbsp; &amp;nbsp;&lt;/p&gt;
&lt;p&gt;So after calling the CPA/Attorney I provided comps and explained all the above and they still ignored it all and the family went along with a life long friend who has handled all their legal needs. &amp;nbsp; &amp;nbsp;I also had the buyers home listed for this deal only which was a $600K home and another $15K to me so this was a $35K double end sale plus listing which went down the tubes because of a outdated probate procedure that most don't use today.&lt;/p&gt;
&lt;p&gt;The good news is 1 month later I found another buyer interested who wanted to offer $400K and the family now is interested and want me to challenge the court referee's's appraisal so we can get it done. &amp;nbsp; This changing of the appraisal is a easy process if you know what to do and I have done many of these reductions over the years. &amp;nbsp; So keep an eye on the court appraisals if you are involved with a &lt;a href="http://probate-realestate.com" target="_blank"&gt;probate sale&lt;/a&gt; and understand you could actually bypass it with the correct language in your offer and heirs who are prepped and understand what is going on. &amp;nbsp; Know the rules, the two probate procedures in California or your area and be a highly paid probate pro.&lt;/p&gt;

      <title>PROBATE LISTINGS VS JUST GOING FOR THE SALE!  WHICH IS BETTER IN 2013</title>
      <description>&lt;p&gt;Of course the old rule is "List to Last" is more prevalent today in this Red Hot Real Estate Market than ever before. &amp;nbsp; Listings will always be the King but if you are spending all your time chasing listings the maybe you should read through this entire blog and find out what I consider the best farming system you could ever work. &amp;nbsp; This is based on my 39 year real estate career with 25 of those being in &lt;a href="http://probate-realestate.com" target="_blank"&gt;probate real estate&lt;/a&gt;. &amp;nbsp; I'm a &lt;a href="http://probate-realestate.com" target="_blank"&gt;probate agent&lt;/a&gt; working smarter now hotter in a Red Hot Market and so far we have either closed, are in escrow or pending with 18 sides (all probates and trusts) since Nov 2012. &amp;nbsp; &amp;nbsp;How is your biz going? &amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;a href="http://probate-realestate.com" target="_blank"&gt;REO's&lt;/a&gt; are basically dead and several years ago when I left a major REO Team (I was a co parnter) I blogged about how in a few years this market would dry and those agents who where doing 100 to 200 transactions per year would be hurting, cutting back personal, and earning was less. &amp;nbsp;This was because they kept all their eggs in one basket and did not have a Plan B.&lt;/p&gt;
&lt;p&gt;My Plan B has been &lt;a href="http://probate-realestate.com" target="_blank"&gt;Probate Homes &lt;/a&gt;since 1987 and I have always kept my production going regardless of what else I may have been doing at the time with whatever the next hot market was. &amp;nbsp;(REO's, Shortsales, TS Sales, whatever). &amp;nbsp;I have done them all and the only niche which has stood the test of time (consistent) has been my probate real estate homes. &amp;nbsp; Every year like clockwork I would knock out on average 15 sides, some flips, some double ends, some listings and some just sales. &amp;nbsp;It has provided me a Six Figure Income and so everything else real estate wise has been gravy. &amp;nbsp; It is so smart to work where most of your competition doesn't. &amp;nbsp;Don't get me wrong today there are more attempting to work&lt;a href="http://probate-realestate.com" target="_blank"&gt; Probates &lt;/a&gt;than ever before but they all soon leave if they haven't done a deal quick and is the method of operation for many real estate agents and investors. &amp;nbsp; Maybe there is a better way. &amp;nbsp;How is your business going and should you be at least checkign out other niches?&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;FARMING PROBATES&lt;/strong&gt;: &amp;nbsp;I have a wealth of information I have blogged about probates and Probate Home Farming is something all Real Estate Agents should understand. &amp;nbsp; &amp;nbsp;Rather than pick a group of 500 homes (subdivision) to start working, branding yourself, picture, name and copy over a 3 to 6 month period why not do the same thing with Probate Homes, most are Free N Clear and it's Free Money or Equity to the Heirs. &amp;nbsp; &amp;nbsp;This is what we do for future business and how I teach my DF Probate students to do. &amp;nbsp;&lt;/p&gt;
&lt;p&gt;Do you think working a group of 500 &lt;a href="http://probate-realestate.com" target="_blank"&gt;probate home&lt;/a&gt; heirs who are sitting on Free Money and just finished a 7 month on average ordeal which placed their life on hold would be a good group to know and become acquainted with? &amp;nbsp; I will tell you the ones who say NO WE ARE NOT SELLING are the best ones to work for the 7 month probate process then once they take ownership of the property you will know who they are and you can continue to farm them. &amp;nbsp;Sooner or later they will want to sell as the money will just be too tempting, or the family member they moved in is tearing up the house or not paying rent or dealing with tenants has become a Nightmare.&lt;/p&gt;
&lt;p&gt;This is where we live not just the NOW busienss we recevie when we buy a probate home during the probate process. &amp;nbsp; There is so much 95% of real estate agents and investors just don't know. &amp;nbsp; I have tried over the last 20 years providing my &lt;a href="http://probate-realestate.com" target="_blank"&gt;probate&lt;/a&gt; process and how I earn from 5 levels but I have found out that most agents just want to do what the masses are doing. &amp;nbsp; I am happy with the 3000 I have helped over the years (agents and investors) and hopefully before I retire and ride off into the sunset on my Harley that I will be able to help a few more learn how to be a "Six Figure Probate Agent"......&lt;/p&gt; &lt;div class="agent_signature"&gt;

      <title>Real Estate Listings, Sales and Investment Homes Under the MLS Radar</title>
      <description>&lt;p&gt;Greetings, been some time since I blogged as I have been busy with my New &lt;a href="http://probate-realestate.com" target="_blank"&gt;Probate Webinar &lt;/a&gt;Series and also my Energy Business. &amp;nbsp;Real Estate is alive and well and depending on what area you are working in your Market is probably RED HOT like ours in NorCal (Alameda County). &amp;nbsp; 2005/2006 Revisited!&lt;/p&gt;
&lt;p&gt;I am going to explain what we are doing so absorb this game plan then see if it makes sense to you and maybe you will want to learn how to add this to your production. &amp;nbsp;&lt;/p&gt;
&lt;p&gt;1. &amp;nbsp;We Track between 50-80 New &lt;a href="http://probate-realestate.com" target="_blank"&gt;Probate Homes&lt;/a&gt; each month (on a weekly basis) which have been opened by the estate attorney to start the &lt;a href="http://probate-realestate.com" target="_blank"&gt;probate&lt;/a&gt; process for someone who has passed away and his heirs are settling the estate.&lt;/p&gt;
&lt;p&gt;2. &amp;nbsp;We contact the petitioner (Executor to be) and gage his/her interest in selling the estate property now or in the future. &amp;nbsp;We don't care which just that they will allow us to work with them.&lt;/p&gt;
&lt;p&gt;3. &amp;nbsp;We bring offers to them (Retail) because the market is so hot and to bring a wholesale deal and expect them to accept just doesn't make sense in this Hot Market as most sellers know they just need to list and most likely multiple offers with above list price will rain.&lt;/p&gt;
&lt;p&gt;4. At the same time we market for buyers who are frustrated with the MLS hunt and being outbid by all cash and $50K+ over asking prices. We are a breath of fresh air to these buyers plus most of our fellow agents are tired of writing offers they can't place in escrow. &amp;nbsp; Our buyers list is building weekly. &amp;nbsp;We can build in closing costs, work, whatever and still be in control.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;5. We ask the estate if we can bring them offers, there is a way to do this that gives us 100% approval to do so and is part of my system.&lt;/p&gt;
&lt;p&gt;6. &amp;nbsp;On the properties which we place under retail contract many of them fall out because of inspections which show the true value of the estate home and softens the heirs in knowing they don'w have the Best Home In the World For Sale! &amp;nbsp; Sound Familiar!&lt;/p&gt;
&lt;p&gt;7. &amp;nbsp;On the ones where financing will be a problem because of too much work or problems we then bring in our investors who pay all cash, get their price and we double end. &amp;nbsp; &amp;nbsp;We double end either way! &amp;nbsp;&lt;/p&gt;
&lt;p&gt;8. &amp;nbsp;We also have a Fix Up program for the estate if they want to fix the property and reap high retail.&lt;/p&gt;
&lt;p&gt;Our production the last 4 months. &amp;nbsp;All &lt;a href="http://probate-realestate.com" target="_blank"&gt;Probates&lt;/a&gt; or Trust Homes&lt;/p&gt;

&lt;p&gt;9. Offer Oakland: &amp;nbsp;Double Ending at $250K &amp;nbsp;6% &amp;nbsp; End User Buyer&lt;/p&gt;

      <title>2012 ANOTHER PROBATE COURT APPRAISAL CHANGED</title>
      <description>&lt;p&gt;In my 25 years of working &lt;a href="http://www.probate-realestate.com"&gt;Probate Real Estate&lt;/a&gt; from time to time I had to deal with court appraisals when the sale was going through the court confirmation system and not the I.A.E.A. &amp;nbsp; Under the old system the estate home had to be appraised at the value at time of Death and then again every year if lingering on. &amp;nbsp; These court appraisals are done by Court Referree's who are actually CPA's working for Estate Attorneys who offer this service. &amp;nbsp; The referree doesn't go into the subject &lt;a href="http://www.probate-realestate.com"&gt;probate home&lt;/a&gt; and basically do what is called a drive by appraisal. &amp;nbsp;They then have a comparable service give them the sales in the area and this is how they appraise. &amp;nbsp;&lt;/p&gt;
&lt;p&gt;Now the problem with this approach is many times the property is not appraised according to actual condition and when the court referee comes in with a price the estate cannot sell the estate property for any less than 90% of this court referees appraisal. &amp;nbsp; From my experience the appraisal usually come in higher than &amp;nbsp;should be and it blows out any buyer wanting to purchase; a real disservice to the estate. &amp;nbsp; I have found appraisals which listed the home as a 2 bedroom but it was really a 3 bedroom and other appraisals not allowing for an adjustment for condition and inspection reports. &amp;nbsp;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;So what do you do in this situation. &amp;nbsp;Well I just had another probate double end sale I sold to an investor of mine for $225K in a area&amp;nbsp;with comps showing $300K to $350K. &amp;nbsp; The first appraisal was $305K but I didn't really care as this sale was going through the Independent Administration of Estates Act (I.A.E.A) and the appraisals or the 90% rule is not required. &amp;nbsp;The executor can sell for any price they want and all that is needed is what is called a Notice of Proposed Action informing the heirs the executor sold the probate home, price and terms and the heirs have 15 days to object. &amp;nbsp;Very rarely do we have an objection but it can happen and if it does we have to go to court.&lt;/p&gt;
&lt;p&gt;THE PROBLEM: &amp;nbsp;from time to time you may be dealing with an old school estate attorney who will want the appraisal regardless if you are going through the I.A.E.A which doesn't need one. &amp;nbsp;This happened with this sale which I questioned the attorney and he told me we have to have it as the executor could be liable to the heirs if they sold to low. &amp;nbsp; This really wasn't the case and as I mentioned to the attorney we have a Notice of Proposed Action to the Estate so the heirs will know price and terms plus Under Probate Code (Calif) a home appraisal is not needed when selling through the I.A.E.A.&lt;/p&gt;
&lt;p&gt;I had to send all the inspection reports (Key), contractors bid, and a letter form the Executor that he wanted this sale to the referee through the attorney. &amp;nbsp; We&amp;nbsp;got it done and the appraisal came in at $225K. &amp;nbsp; We now close in about 10 days.&lt;/p&gt;
&lt;p&gt;You will come across many situations working &lt;a href="http://www.probate-realestate.com"&gt;Probate Home&lt;/a&gt;s and you must know how to handle these when they come up or you will loose your deal. &amp;nbsp; I learned all this but&amp;nbsp;loosing deals in my early years working probates but you all have the benefit of my experience if you decide to check out &lt;a href="http://www.probate-realestate.com"&gt;Probate Real Estate&lt;/a&gt; working as a &lt;a href="http://www.probate-realestate.com"&gt;Probate Agent &lt;/a&gt;or an Investor.&lt;/p&gt;

      <title>PROBATE SHORT SALE WEBINAR LIVE WITH GARYD</title>

Many of my students are reporting more of these are popping up in their research.&lt;/p&gt;
