In California we have two ways to Probate an Estate.  Both procedures involve an appraisal of the assets of the Estate.  Our focus, the real estate has the home appraised at the time of death of the owner to establish a new basis for the estate.  In the old probate procedure we must use the house appraisal and per the rules the executor or administrator cannot sell for any less than 90% of this home appraisal.

As part of my probate system I recently made an offer for a client  to a PR on a Probate Home which needed much work, repair and updating but was a craftsman home in a Hot East Bay Area.   We couldn't move forward on the sale as the PR was not approved as administrator yet (2 weeks away) but we worked out the numbers and settled on $500K.

probate investing: WHAT IS NOTICE OF PROPOSED ACTION IN PROBATE REAL ESTATE - 12/23/14 03:12 AM
Ok, here in California and many states the Court requires when the Executor/Administrator sell the estate home through the Independent Administration of Estates Act under Full Authority that the Exec/Adm must notify any heirs with interest in the estate home the terms of the sale.   The heirs will have 15 days to contest the sale if they choose and if so the sale stops and the issue must be worked out or taken to court for court confirmation of the sale.
