WIKIPEDIA'S DEFINITION OF A SHORT SALE

A short sale is a sale of real estate in which the proceeds from the sale fall short of the balance owed on a loan secured by the property sold.

In a short sale, the bank or mortgage lender agrees to discount a loan balance due to an economic or financial hardship on the part of the mortgagor. This negotiation is all done through communication with a bank's loss mitigation or workout department. The home owner/debtor sells the mortgaged property for less than the outstanding balance of the loan, and turns over the proceeds of the sale to the lender, sometimes (but not always) in full satisfaction of the debt. In such instances, the lender would have the right to approve or disapprove of a proposed sale. Extenuating circumstances influence whether or not banks will discount a loan balance. These circumstances are usually related to the current real estate market and the borrower's financial situation.

A short sale typically is executed to prevent a home foreclosure, but the decision to proceed with a short sale is predicated on the most economic way for the bank to recover the amount owed on the property. Often a bank will allow a short sale if they believe that it will result in a smaller financial loss than foreclosing as there are carrying costs that are associated with a foreclosure. A bank will typically determine the amount of equity (or lack of), by determining the probable selling price from a Broker Price Opinion BPO (also known as a Broker Opinion of Value (BOV)) or through a valuation of an appraisal. For the home owner, advantages include avoidance of a foreclosure on their credit history and partial control of the monetary deficiency. A short sale is typically faster and less expensive for the lender than a foreclosure. In short, a short sale is nothing more than negotiating with lien holders a payoff for less than what they are owed, or rather a sale of a debt, generally on a piece of real estate, short of the full debt amount.

Neal Patel , an old time friend , has ask me 10 Years ago , what I think of him opening a Restaurant ? At that time , I was an Executive Chef at Royal Lahaina Hotel . Skeptically I have told him ,"Opening a Restaurant is a hard work and lots of risk . But what he had never told me , that he loves to open a Little Indian Restaurant. Indian Food is not at all on this little island on Maui . I remember cooking lots of Chicken Curry for Arab Clients at the Grand Wailea or Hilton in Munich was a delight full taste of many spices and ingredients.

Last week , I was visiting Neal at his first Restaurant , after our discussion 10 years ago and , I could not believe how well prepared all his food has been.

In his Flyer he mentioned : Maui Masala is s vision of two Indian families who have lived on Maui for more than a decade . They were attracted to Maui's lush tropical climate. it remided them of India , they loved the wonderful community and fmiliare fragrnace of plumeria and jasmine. However , one thing was missing from this island paradise " the Masala" , the savory and delectable tastes of Indian cuisine , Why not bring the flavors they love to the place they love for both locals and visitors to enjoy ?

And so , " Maui Masala " was born

Should I re-offer on an REO after being turned down at a Similar Price?

We are finding that REO lenders will indeed look at close offers and that if you have been turned down for a purchase of an REO property it is wise to re-offer again soon.

That being said we find that most times an REO Negotiator would have actually countered your offer to begin with.

Even in a Short Sale we closed recently the lender countered back much higher than the buyer wanted to pay and when the buyer didn't "re-counter" the negotiator actually reached out and asked the buyer to submit another offer. The buyer ended up offering only slightly higher than the initial offer and that offer was approved.

It seems like in today's REO and Shortsale market (at least on Maui) the rules can change just about daily. So we do recommend persistence and patience.

Creating Great Marketing Pieces for your Real Estate Business Part 3 - Marketing with Press Releases

Creating great marketing pieces for your real estate business does not have to be expensive. Yet the impact they have on your real estate business could be invaluable.

This is the third entry in a series discussing various marketing pieces to promote yourself and your product.

Marketing with Press Releases!

While the focus of the previous two entries

Marketing with Newsletters, and

Marketing with Email and E-Reports

was on staying in contact with former and current customers, this article addresses the use of press releases in the overall marketing and promoting of yourself in your real estate business.

Unlike other marketing products that are sent to customers directly in a targeted manner, a press release takes a much broader approach.

Press releases are sent to your local newspaper for inclusion in a special business news section in your community. Look in your local newspaper for the day of the week these announcements appear, there is always a contact name, address, and deadline included by which articles and press releases are to be submitted for printing.

You will not have total control over the actual information that is being printed, so be prepared for the newspaper to edit your article.

What better place is there to announce important advancements or changes in your real estate business?

Do not be secretive about your accomplishments!

You may use a press release to announce a milestone such as celebrating a five-year anniversary as a REALTOR, to inform readers of a new designation, obtaining another license in a related field, or even something such as changing from one brokerage to another. All it takes is a little effort to produce and submit a letter to the newspaper.

Submit your press release on letterhead with your contact information. You may also include a photo, either black and white or color depending on the preference of the paper.

Are you active in the community?

Do you or an organization you belong to frequently participate in fundraisers and other charity events? If so, here is another great opportunityfor publicity that often gets overlooked!. Just send a photo preferably with you included and a short article explaining the event, activity, and organization involved to the social or club news section of your newspaper. While publication of this type of news will not provide direct advertising to you or your real estate business, it will create publicity for you and bring your name to the attention of the public.

Providing information in this manner is effective in reminding your existing customers of you, your services and expertise! And while this is not a targeted or scheduled marketing activity, press releases and community news articles will introduce your name to other people who may be looking for real estate services in the future and call you because your name is familiar to them.

As real estate professionals we often forget about press releases or other publications in newspapers when we should make it part of our overall marketing plan and implement them whenever appropriate. After all, the best thing about press releases is that they are absolutely free advertising!

Well to tell you the truth , if you tell a Bavarian the Vise Versa, he might give you a big Burb and say ,,,,,, My State has been Managed by King Ludwig and it is still today a free State attached to Germany . Thanks to Franz Josph Straus,,,, I can Drive a nice BMW ,,,, and Kick all the Nations Fusball ,,,, with FC. Bayers. Octoberfest is not German ,, its simply , Bavarian ! It is like a "Big County Fest " but Bavarian Style with Haxen, Bratwurst and Brezeln ,,, with Good Beer .

When will Oktoberfest 2009 take place?

On Saturday, September 19th, the Schottenhamel tent is the place to be, if you want to catch the official opening ceremonies. At noontime, 12pm, the lord mayor of Munich will have the honor of tapping the first keg of Oktoberfest beer. Once the barrel has been tapped, all visitors will then be allowed to quench their thirst. It pays to arrive early in order to experience the festivities up close and personal and it's quite common for visitors to come around 9am to secure good seats. The festival will last until October 4th, 2009.

Weekdays: 10am - 10:30pm
Saturdays, Sundays and holidays: 9am - 10:30pm

Daily Tent Closing Time: 11:30pm

The historical background: the first Oktoberfest was held in the year 1810 in honor of the Bavarian Crown Prince Ludwig’s marriage to Princess Therese von Sachsen-Hildburghausen. The festivities began on October 12, 1810 and ended on October 17th with a horse race. In the following years, the celebrations were repeated and, later, the festival was prolonged and moved forward into September.

By moving the festivities up, it allowed for better weather conditions. Because the September nights were warmer, the visitors were able to enjoy the gardens outside the tents and the stroll over “die Wiesen” or the fields much longer without feeling chilly. Historically, the last Oktoberfest weekend was in October and this tradition continues into present times.

How much will a liter of beer (the „Maß” Oktoberfest Beer) cost this year?

The beer price will range between 7.80 and 8.30 Euros per liter - varying in every beer tent. (Previous year: 7.30 to 7.90 Euros)

Are children allowed to visit the beer tents?

It depends on the age: Children under the age of six must leave the tents at 8pm even if they are in the company of their parents. A crowded tent wouldn’t be much fun for either the childern or the parents. For more information, please click on Wiesn tips for families.

What is „Die Wiesn“?

The locals in Munich fondly refer to Oktoberfest as „die Wiesn“ because of its location, Theresienwiese, which was named after Therese von Sachsen-Hildburghausen. To find out more about her, click on Wiesn history.

Is there a program of events to observe during this folk’s festival?

The main highlight of the Wiesn events and an important must-see is the Oktoberfest Costume and Riflemen’s Parade. The parade happens every year on the first Wiesn Sunday.

Other important events are the Parade of Oktoberfest Landlords and Breweries, the Official Tapping of the Keg, the Oktoberfest Mass , „Böllerschießen“ (handheld canon salute) in front of the Bavaria statue and – this year- an agricultural festival.

I hope this post makes it to the top of Google search and stays there. I was the victim of a sleazy scam and I want to spread the word about ORTHOWHITE tooth whitening product.

They will entice you with a $1.00 sample product. They will charge you $1. Then 8 days later they will charge you $78.14. When you call them to complain about this extra charge they will say it's because you didn't cancel your order within 8 days of ordering (not within 8 days of trying the product). They will also continue to charge this every month until you cancel.

ORTHOWHITE WILL RIP YOU OFF.

When I Googled ORTHOWHITE, I found some complaints similar to mine.

From what I understand, here's another thing they will try... sending your product to the wrong address! I guess they think if you don't get the product you might just forget about it and not notice the $78.14 charge EVERY MONTH after. And they get their product back to send to another sucker!

Yes, they got my address wrong - how convenient for them!

Kihei Charter School on Maui Views Changes, Expansion

President Obama has often mentioned the importance of charter schools in his overall plan to improve education in the nation, and Maui will now the one in Kihei will be larger and improved. A nightclub and restaurant space will be converted into the new campus for the Kihei Charter Middle School.

"We're gaining more space and we're decreasing our costs," Kihei Charter Executive Director Mark Christiano explained recently as he toured the space once used by Hapa's nightclub, a Mexican restaurant and the current Title Guaranty Escrow & Title Services offices on Lipoa Street.

Currently, middle school students at the only public charter school on Maui are split in two locations - a Science Technology Engineering and Math Academy in the Maui Research & Technology Park, and an Arts Academy at the Maui Academy of Performing Arts on Market Street in Wailuku.

The opportunity to consolidate into one campus came up during the charter school's attempts to find one site for all of its programs.

There are 72 students in the Science Technology Engineering and Math middle school program, and about 51 in the Arts Academy. All together, Kihei Charter School projects a student population of 460 students.

Meanwhile, the state Department of Education is pursuing the negotiation of nearly 77 acres of property just south of the Kihei Commercial Center to build a more traditional high school.

Four ways to cut your water bill

If you take a close look at your water bill, you might be surprised to learn how much money is going down the drain.

A typical U.S. family of four spends about $820 every year on water and sewer fees, according to the Environmental Protection Agency, plus another $230 in energy charges for heating water.

A few inexpensive changes, such as adding low-flow showerheads and stopping leaks, might cut your monthly water bill by 20% to 30%.

Four fixes to tackle first

1. Install low-flow showerheads. A low-flow showerhead uses 1.5 to 1.75 gallons of water per minute compared with 5 to 7 gallons a minute for an older model. Simply screwing on a new showerhead might save you as much as 2,000 gallons a month, assuming two, six-minute showers a day.

Cost: Low-flow showerheads can be found online for as little as $10, and could trim your water bill by that much in just a month or two.

Tip: Because you'll use less hot water, your energy bill should drop, too.

2. Add an aerator. An aerator is usually a fine metal mesh that screws on to the end of a conventional faucet and reduces water volume to 1 or 1.5 gallons per minute. Older faucets use 3 gallons of water per minute.

Cost: Aerators cost $3 or less, and could pay for themselves in just a month or two.

Tip: Screw on an aerator by hand to avoid scratching a faucet's finish.

3. Develop water-wise habits. Water is so cheap—a thousand gallons of water costs less than a gallon of milk—that it's easy to use carelessly. Developing a few of these water-wise habits may save you thousands of gallons a year:

Turn off the tap when brushing your teeth.
Garbage disposals use lots of water. Start a compost pile instead.
Don't defrost meat with running water.
Clean sidewalks and driveways with a broom, not a hose.
Do dishes in a dishwasher. It uses less water than washing by hand.
Water your lawn in the morning and you'll lose less water to evaporation.
Adjust the sprinkler so you're not watering the sidewalk or driveway.
Run full loads when using a dishwasher or clothes washer.
Take showers rather than baths.

Cost: $0

Tip: You'll need the family's cooperation to conserve. Why not promise to reward them when savings start to materialize? (Ice cream cones, anyone?)

4. Fix leaks and drips. 13.7% of all water used in U.S. households is just dribbling away. To see if you're losing water this way, read your water meter before and after a two-hour period when no water is being used. If the meter moves anyway, here are four prime suspects to investigate:

A running toilet can cost 200 gallons a day. Replacing a single part inside the tank, such as a worn-out flapper, might solve the problem. (Write down the brand and part number before you go to the store to avoid repeat trips.)
A dripping faucet can cost 2,700 gallons a year. If you're handy, you may be able to fix the problem yourself by replacing worn-out fixtures, washers, O-rings, or loose connections.
A pinhole leak in a washing machine hose can waste 170 gallons a day, not to mention damaging your home.
Outdoors, loose-fitting hose couplings can release gallons of water a minute. Give these couplings an extra turn with a wrench or pliers to cut needless loss.

After making repairs, read the meter again. If it's still showing water loss, it's probably time to call a plumber.

Cost: Replacement parts for a toilet tank usually cost less than $20. Plumbers generally charge by the hour, and a house call can easily cost $75.

Tip: To see if a toilet is running silently, add a single drop of food coloring to the water in the toilet tank. If the color shows up in the bowl without flushing, there's a leak.

Longer-term upgrades that can save

Once you've covered the basics, what more can you do to conserve water? Many household products have been redesigned in recent years to conserve water.

A new washing machine or toilet might reduce your water use significantly if you currently have older models in your home. Just keep in mind that because these items are expensive (and will likely require a plumber), it could take years to recoup their cost from lowered water bills.

Here are three items that could cut your water use noticeably if you're willing to make an investment in water conservation:

New toilets use no more than 1.6 gallons per flush, compared with 3.5 to 7 gallons for older models.
Front-loading washing machines can use one-half as much water as older top-loading models, according to the EPA.
Faucets that carry the EPA's WaterSense label use 30% less water than older models. You can find a list of WaterSense bathroom faucetshere.*

Cost: Toilet: $200 and up. Front-loading washing machine: $700 and up. WaterSense faucets: $100 and up.

Tip: Before buying a new appliance, read reviews online to find a make and model that gets high marks from consumers.

New Appraisal Rules that may affect your current transaction

On May 1st 2009, the new Home Valuation Code of Conduct came into force, with major consequences on your real estate transaction.

Here are the main issues:

- appraisals are not ordered directly by the bank or the realtor, but rather through a "clearing house" that uses a roster and a rotation system to decide which appraiser will be completing the appraisal. Even if appraisers have their area of expertise, that expertise wont come into play.

- realtors can not communicate with the appraisers. Realtors can not offer information about the property,suggest comparable properties or dispute/question the result of the appraisal. Since sometimes it is hard to find recent sales in a neighborhood, realtors could help by suggesting comps in areas that may be overlooked otherwise. In the past three months, I have received many calls from appraisers that simply needed to " pick on my brain" in an effort to find comps for a subject property or to learn why a certain unit in the complex would be worth $50,000 more than another one with the same square footage, for instance. Or whether a credit was given to the buyer at the time of purchase and the information is not public.

In a nutshell, if you are a buyer or a seller, here is what you can expect, as a result of the implementation of this new code:

- longer turn around time for appraisals. Estimated time now is 2-3 weeks, compared to 2 to 3 days, previously;

- longer time for a loan to be put together. Typical financing process will require 45 to 60 days;

- longer escrow times, that is 45 to 60 days;

- direct communication with the appraiser, in an effort to make sure that the property is appraised justly. This may be challenging when you are an out of state owner and you may need to do your own research in regards to market values.

- higher appraisal fees, since someone will have to be paid to do the job of maintaing the list of appraisers and ordering the appraisals according to the rotation system.

While I see the need to prevent further abuse and misuse of appraisals in the real estate business, I also think that the code is an exaggerated reaction to what happened in the past. I surely hope that a balance between preventing fraud on one hand and doing business in an efficient way on the othe hand, can be attained.

Trash Your Competition: Bad Idea

I tend to follow marketing people on Facebook as well as ActiveRain, and for the most part they do a great job promoting themselves as experts in their field. Every once in a while however, someone uploads a post that does more harm to their reputation than good. Let me give you an example.

Talk Trash

Recently, one of the marketing people I follow uploaded a post trashing a competitor. She didn’t name the competitor, but she made a big deal as to how unqualified this individual was with respect to teaching a certain subject. It was clear that her intent was to promote her credibility as the expert while trashing the expertise of her competition. Bad idea. In doing so, she lowered herself in the eyes of many of her followers.

This Was My Intent … Really

I’m certain that if you asked her what her intent was with the post, she would tell you that she wanted to warn people not to fall pray to unqualified service providers. Problem was, that’s not how the post came across to me or to most of her readers. It read as though she had an axe to grind with this individual and this was her way of trashing them while promoting herself as the guru.

Now, if you were to read the comments her followers made concerning her post, you would think that she is a goddess who can do no wrong. Unfortunately, the only people who commented on her post where her acolytes who gave here a false sense that what she did was OK. It wasn’t, and here’s why.

Reason 1:

When you’re the recognized expert in your field, people hold you to a higher standard. They don’t expect you to verbally hammer the little guy, even if you don’t call them by name. They will see you as a bully with a big stick. It’s the equivalent of the President of the United States getting on national television and telling the American people that the union or the management of a specific company is evil and greedy. Name calling at that level is just not done.

And they believe that if you’re capable of bullying someone else, you’re certainly capable of bullying them. There’s a reason people cheer for the underdog when the person in power is abusing it.

Reason 2:

When you talk about or write about how bad someone is, you’re associating yourself with that story. I, for example, will always associate this marketing person with this specific Facebook post. If her intent was to tear apart her competitor and built her reputation at the same time, she could have asked one of her acolytes to post the message for her. Had she done that, she would have successfully stabbed her competition in the back while looking totally innocent. P.S. I don’t suggest you do this.

Reason 3:

No one likes a complainer. Complaining about someone else is a sign of weakness and vulnerability. It is not what you expect from someone who is at the top of their game. It does not instill confidence in your capabilities. People will always wonder why you are more concerned about your competition than you are with your own capabilities.

What’s The Solution?

If my marketing friend was really concerned about her customers getting screwed, she could have conveyed that message while building her reputation as a likable problem solver at the same time. Rather than slam her competitor, she could have posted a warning in the form of a tip. For example.

Check their references

Check their reputation

Check bla bla bla

In doing these four things, you will not only protect yourself against fraud, but you will find a service provider that you can trust. If a service provider is reluctant to provide this information, run!

Conclusion

Now, that’s a much better way to provide a warning without complaining and without bullying the underdog. Just as importantly, you shouldn’t be talking trash about your competition even if you are the new guy on the block. It doesn’t wear well on anyone.

We like people who we associate with good feelings and we don’t like people who we associate with bad feelings. Make sure that every conversation you have and every post you upload to the Internet encourages people to associate you with good feelings. It will not only improve your likeability, but it will build your reputation as the expert in your field.
