Can a developer can unilaterally change Restrictions after closing? (!) - 11/03/11 09:28 AM
Turns out if the property is located in Virginia, then the answer is yes. ClientFirst Settlement Services stopped by my office the other day to let us know that a subdivision developer can unilaterally modify, add or remove restrictive covenants after purchases.  Until a case that went to Supreme Court of Virginia on September 2011, it took all owners to agree to change covenants that they relied on when deciding to purchase in a subdivision.
