      <description>&lt;p&gt;Hi All&lt;/p&gt;
&lt;p&gt;I am currently increasing marketing activities to manage more properties. The regular income stream more than helps support overhead and other ongoing expenses. I am trying to find post card vendors to have specific campaigns for property management. In checking, it seems like there are very few . Anyone have experience with or vendors they would care to recommend? Thanks.&lt;/p&gt;

If the U.S. government fails to address their housing problems the heavy burden will bring down more of their families and strain the non-profits that strive to help them. &lt;p&gt;Why have so many wounded veterans gotten into this trouble? Two problems stand out. First, they purchased homes with the reasonable expectation of remaining fully employed as military, or later, as civilians. Unfortunately, severe injuries changed their lives. Their civilian incomes are usually much less, and less certain, than prior military earnings and severe injuries and disorders can make steady jobs rare. Most wounded veterans do apply for compensation for their service-connected injuries. And this income might be viewed as the solution to their mortgage problems. But that would be a huge mistake. Government payouts are surprisingly modest - a veteran with spouse, a single child and a 60% disability rating receives only $1129 a month, and payments typically do not start until four to six months after a claim is filed with the Veterans Administration. This means other Americans &amp;ndash; individuals and businesses - need to step forward and help even more than in the past.&lt;/p&gt;

&lt;p&gt;Having been in this business for many years, I never cease to be amazed at how cavalier some agents are with other people&amp;rsquo;s money and contract rights. It seems like another cycle of &amp;ldquo;sue-the-agent&amp;rdquo; for negligence and unprofessional conduct has begun with no less than four agents being successfully sued in the last six months in my market area.&lt;/p&gt;
&lt;p&gt;Some agents, thankfully a minority, are more interested in closing the deal than preserving a buyer&amp;rsquo;s purchase considerations and in having a full understanding the condition of a property in which they are interested. Just like in the 2000-2005 market when certain agents counseled buyers to forego any home inspections to enhance their offer, in 2008 and 2009, we are seeing a resurgence of this approach in buying short sales and foreclosures &amp;ndash; &amp;ldquo;since the foreclosing lender will only sell the property &amp;lsquo;in as-in condition&amp;rsquo;, if you make your offer contingent on any inspections, they will select another one, even for less money, when it does not include inspections.&amp;rdquo; Baloney.&lt;/p&gt;

&lt;p&gt;Agents are being sued after the dream deal for a discounted property evolves into thousands of dollars of unexpected repairs before the property can be safely lived in. One recently sued agent received a call the day after closing to learn that water was pouring out of the living room ceiling from a burst pipe. Her response was &amp;ndash; &amp;ldquo;Gee I&amp;rsquo;m really sorry, but you did sign the waiver acknowledging there could be problems&amp;hellip;.&amp;rdquo; $4,400 + attorney fees later and poorer, I think the agent may be wondering about her purchase advice.&lt;/p&gt;
&lt;p&gt;When should you advise a purchaser to waive inspections? Never.&lt;/p&gt;
&lt;p&gt;What advice do you provide to prospective purchasers about inspections? What if the buyer really wants the property and doesn&amp;rsquo;t want to do the inspections?&lt;/p&gt;

&lt;p&gt;Time goes by quickly!  I mentioned in a blog last summer that we were starting to tape &amp;frac12; hour TV shows for the Spanish Speaking community in Northern VA and wanted to provide an update. So far we have taped and broadcasted 12 shows on Channel 30, on the Cox Communication Cable Network that services much of Northern VA. The shows have received very good reviews by the local media critic and lots of positive feedback from the Spanish Community. Our general format is to feature community service providers, successful business owners, cultural event representatives and interspersed throughout &amp;ndash; real estate related information - all for the Spanish Community.&lt;/p&gt;
&lt;p&gt;It has been challenging. Sometimes the &amp;ldquo;talent&amp;rdquo; or guests cancel at the last minute, so you&amp;rsquo;re scrambling fill a 5, 7 or 10-minute segment. Sometimes the talent shows up not presentably dressed or guys with really shiny foreheads that they refuse to powder and end up looking like airport beacons&amp;hellip;.  Sometimes, though, we really make a difference in putting critically needed caregivers in touch with struggling families who needed help. We are particularly gratified when we receive that feedback.&lt;/p&gt;

      <title>Is there really any point to having a marketing plan? </title>

&lt;p&gt;Is there really any point to having a marketing plan?&lt;/p&gt;
&lt;p&gt;Having been around this see-saw industry for just a few years less than blogger extraordinaire, Lenn Harley, I have seen more failed attempts at developing a meaningful, achievable and profitable plan than not.  New and experienced agents, with the encouragement of their broker, start each year with a laundry list of all the proactive steps, mailings, networking ideas, calls, web sites, lead generation contracts, farming and the myriad of other ways to generate business. Plan lengths I have seen have varied from one page, to, literally, more than 75 pages.&lt;/p&gt;
&lt;p&gt;Too often, however, well-intentioned brokers and agents get so caught up in developing the plan and systems to implement, that they lose sight of what is most important &amp;ndash; doing the actual business of real estate &amp;ndash; working with buyers and sellers. In their technologically sophisticated, erudite projections, they move away from the basics, immerse themselves in tracking all the required plan steps, input hundreds and thousands of data items in expensive industry software and, oftentimes, just barely make ends meet - if they do meet - after staff, marketing and overhead expenses are factored in.&lt;/p&gt;
&lt;p&gt;There are many reasons that more than 90% of the agents leave this business every four or five years, but mostly, it&amp;rsquo;s because they have more expenses than clients. It really is true that if you fail to plan, you plan to fail, but &amp;ndash; there is a balance.  Yes, you have to have a plan and, just as important, a budget that you will stick to. I will never forget a conversation I had with a high income earner and successful agent back in 1990. Every January, he would take his wife to their favorite restaurant to celebrate his success for the previous year. After dessert, he would pull out a small notepad and write down three things: the amount of money he wanted to earn, the number listings he needed to take and, the number of buyers he wanted to work with over the next year. Those were his goals.&lt;/p&gt;
&lt;p&gt;He then took a second sheet of paper and wrote down the steps he would take &amp;ndash; every day &amp;ndash; to meet his goals. That was his business plan. To this day, he continues to average between $175,000 to $200,000 per year, has one part-time assistant to do the paperwork, no expensive software (just uses Excel to track his business and expenses), no buyer/seller lead generation contracts, no team or other significant overhead expenses and, is very content with his business and income generated.&lt;/p&gt;
&lt;p&gt;There are truly as many different ways to do this business as there are Realtors. You have to decide what the nature of your business will be and what level of consistent daily effort you are willing to put into it to succeed. So, do you really need to have a marketing plan?  I think if you have measureable goals, a budget, personal discipline and a commitment to consistently apply yourself daily - in prospecting and providing quality service - the rest will follow.&lt;/p&gt;

&lt;p&gt;A few days ago, one of my newer agents, James, came into the office beaming! He was so proud. He had taken steps to start his marketing campaign and drive clients to his front door, sorta.&lt;/p&gt;
&lt;p&gt;With each new agent I recruit, I ask them to please check with me before spending their dwindling reserves or maxing out credit cards on marketing/advertising ploys that may or may not give a foothold on establishing a broader base of qualified prospects.&lt;/p&gt;
&lt;p&gt;It seems that James had been miraculously found by one of the pay-per-click purveyors who guaranteed 1st-page-Google, a web page and lots of interested prospects for just $99 per month. James was beside himself and could not get the credit card out of his wallet fast enough.&lt;/p&gt;
&lt;p&gt;James had 1st-page-Google for 3 days, a very bland &amp;frac12;-page site, no photo of himself, no MLS search capability and no prospects. Potential respondents had maxed out his available clicks in 3 days. James is locked into this contract for six months. For additional fees, (nearly doubling his costs) James can have his photo on the site and MLS search capability.&lt;/p&gt;
&lt;p&gt;This is just one example of the technology predators who continue to make lots of money off our &amp;ldquo;independent contractors&amp;rdquo; who really don&amp;rsquo;t know what they &amp;ldquo;don&amp;rsquo;t know&amp;rdquo; about effective ways to build a business.&lt;/p&gt;
&lt;p&gt;If you are a new agent, please don&amp;rsquo;t spend a nickel without checking with your broker or team leader.&lt;/p&gt;
&lt;p&gt;If you are a new or seasoned agent, what are some of the worst marketing investments you have heard about or seen others purchase? If someone is new, but determined to have an individual web presence, what you recommend?&lt;/p&gt;

      <title>Watch Out for Local Association Vigilantes</title>

Fortunately, my local Association (NVAR) has fairly reasonable folks serving on grievance and disciplinary panels. &lt;span style=&quot;text-decoration: underline;&quot;&gt;Unfortunately&lt;/span&gt;, that's not true in all jurisdictions.&lt;/p&gt;
&lt;p&gt;The North Central Board of Realtors (Association) went out of it's way to either make an absurd example or to excessively punish one of their own for an offense that, by their own procedures, merited a much smaller consequence. The Realtor involved had violated some rules the year before and was fined and given a year's probation. Her Broker was fined also for lack of supervision.&lt;/p&gt;
&lt;p&gt;Less than a year later, charges of rules violations were again made against this same Realtor. This time, she was alleged to have improperly input two listings into the Association&amp;rsquo;s multiple listing service (&amp;ldquo;MLS&amp;rdquo;) without the seller&amp;rsquo;s permission. According to the Realtor, the information was input by mistake by an &lt;span style=&quot;text-decoration: underline;&quot;&gt;office employee&lt;/span&gt; on Thursday and Friday, and the listings were removed on the following Monday after the mistake was discovered.&lt;/p&gt;
&lt;p&gt;The Association conducted a hearing into the new allegations and the hearing panel found the Realtor guilty of violating the Association&amp;rsquo;s rules. She was fined $1500 and suspended 45 days from the MLS. This Realtor was also expelled from the Association and fined $5,000. Further, her expulsion had the effect of not allowing any other member of the brokerage to access the MLS until either the Association reinstated her membership or she left the brokerage.&lt;/p&gt;
&lt;p&gt;After the Association upheld the hearing panel&amp;rsquo;s decision, the Realtor filed a lawsuit against the Association, alleging a denial of due process in the hearing conducted by the Association.&lt;/p&gt;
&lt;p&gt;The trial court ruled in the Association's favor. Reason prevailed on appeal. The Court of Appeals of the State of Mississippi reversed the trial court. Looking at existing Mississippi law, the court found that while private organizations are generally free to discipline members who violate prescribed rules of conduct, private organizations must also describe possible punishments which can be imposed for various rules violations, in order to alert the member as to the possible punishments when he/she joins the organization and also avoid arbitrary disciplinary actions by the organization against its members.&lt;/p&gt;
&lt;p&gt;The court ruled that the Association had not followed its own rules in disciplining the Realtor and so had acted arbitrarily, causing the court to vacate the discipline imposed on the Realtor by the Association. The Association&amp;rsquo;s rules require that the seller&amp;rsquo;s signature be obtained before a listing can go into the MLS. Since she had not obtained the seller&amp;rsquo;s signature for the listing that she submitted to the MLS, she was subject to the discipline contained in the Association&amp;rsquo;s rules. While the court found some conflict in the Association&amp;rsquo;s rules and procedures, the main focus of the Realtor's challenge was Sections 7 and 9 of the Association&amp;rsquo;s rules.&lt;/p&gt;
&lt;p&gt;Section 7 set forth a potential disciplinary path for repeat offenders. Section 7 states that a warning is appropriate discipline for a first offense, and a second offense warrants a fine as well as an appearance by the participant before the MLS Committee. A third offense can result in a $100 fine and 60-day suspension; a fourth offense in a four month period should result in a 60-day suspension....&lt;/p&gt;
&lt;p&gt;I am grateful that the Realtor had the tenacity and resources to challenge the egregious treatment by her Association. I hope this ruling will cause other association disciplinary panels to more equitably consider their rulings and responses to Realtor mistakes. Yes, this Realtor made some mistakes and is responsible and accountable for her actions, but there needs to be fairness in applying remedies to acts of real estate that do not conform to published standards.&lt;/p&gt;
&lt;ul&gt;

&lt;li&gt;If you serve on a disciplinary panel, what else might you have proposed? &lt;br /&gt;&lt;/li&gt;
&lt;li&gt;Is this a more widespread problem with the skills and attitudes of people who serve on grievance and disciplinary panels? &lt;br /&gt;&lt;/li&gt;
&lt;li&gt;Rather than who chooses to volunteer, should there be more measured criteria for people who serve on these very important panels?&lt;/li&gt;
&lt;li&gt;Should standards be developed to assess Realtor performance on disciplinary panels that must be reviewed prior to being reappointed for successive terms?&lt;/li&gt;
&lt;/ul&gt;

      <title>New television show for the Spanish speaking community</title>
      <description>&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Hi All&lt;/p&gt;
&lt;p&gt;On June 19, we taped our first two 1/2-hour shows, &quot;Living and Enjoying Life in Northern VA&quot;. They start airing early August; each one will be aired four times on Channel 30, the foreign langauage channel for Northern VA. I have a gorgeous host, who also happens to be one of our Realtors and, we are pleased with how the final edits look. Our plans are to continue taping two shows per month and, to start regional distribution of the shows in the next few weeks (we can't &quot;bicycle&quot; them until they have aired on Channel 10 first).&lt;/p&gt;
&lt;p&gt;For now, it's a talking-head/interview format with guests from government and civic organizations who provide services to the Spanish speaking community. We also feature business leaders/owners and highlight success stories for 1st generation immigrants to our area.&lt;/p&gt;
&lt;p&gt;Upcoming shows will have South American Dancers, musicians and chef's. We are also looking at trying to set up a small audience with some of the presentations/interviews. Once my host gains enough confidence, we may aslo go live for a couple of shows with call-ins.&lt;/p&gt;
&lt;p&gt;Would be happy to trade ideas and share challenges encountered. In both of the first two taping sessions, a key guest did not make it. We were able to expand other segments and, the shows turned out fine. But, it was very disconcerting to say the least. Now, we plan that someone is not going to make it and have people/segments in reserve, just in case they are needed.&lt;/p&gt;

After 6 months of classes and another 6 months of planning, biting nails and snapping at anyone who dared walk by, we planned, produced and taped our first two television shows. They are now in edit and, like an expectant father; I am having difficulty waiting for the final results, an airing of our first two segments &amp;ndash; &amp;ldquo;Living and Enjoying Life in Northern VA&amp;rdquo;. These shows will air beginning in mid-July on Channel 30, the Fairfax, VA foreign language public access channel.&lt;/p&gt;
&lt;p&gt;If you recall, many blogs back, I decided to participate in the growing housing market for Spanish-speaking individuals and families. So I did what any hungry broker would do, I hired four Spanish-speaking Realtors. I also decided at that time to move in a new direction for us and have a television show that addressed issues and information for the Spanish-speaking community in Northern VA.&lt;/p&gt;
&lt;p&gt;If you have your own show or are in the midst of planning one, what ere some of the hurdles you had to overcome to get on the air?&lt;/p&gt;
&lt;p&gt;Whether or not you have a show currently, what community or real estate topics would you suggest?  There is a lot of information to share about getting to this point and, I will do just that in future blogs.&lt;/p&gt;

      <title>Short Sale Contract Language Challenging not just to Foreign-Born Agents</title>

I say &amp;ldquo;sort of&amp;rdquo; because I have difficulty believing they actually expect people to totally surrender any and all purchaser rights in the transaction. I also understand the concept of &amp;ldquo;as is&amp;rdquo;, but if you don&amp;rsquo;t read every line, every word of the addendum, you and your agent could be setting the purchaser up for a financial disaster.&amp;nbsp;&lt;/p&gt;  &lt;p class=&quot;MsoNormal&quot;&gt;This is problem enough for educated American-born agents, but, from what I have experienced, it is a serious problem for those 2&lt;sup&gt;nd&lt;/sup&gt;-language folks who do not understand 20% of the terms used and 50% of the implication of the twisted terms and conditions proposed in the counteroffer.&lt;/p&gt;      &lt;p class=&quot;MsoNormal&quot;&gt;For example:&amp;nbsp;&lt;/p&gt;  &lt;p class=&quot;MsoNormal&quot;&gt;One of my Spanish-speaking agents submitted a 25-page offer for contract on a property being advertised as a short-sale. A week after the offer was submitted, she received a 26-page addendum full of legalese in counter to the offer presented. Essentially, it minimized or eliminated any remaining purchaser rights after he agreed to buy the property &amp;ldquo;as is&amp;rdquo;.&amp;nbsp; One section of the addendum addressed homeowner association documents. It specified that the seller would not provide them and that the Purchaser had 11 days to remove the contingency or forfeit the right to review. In Virginia, the HOA&amp;rsquo;s have up to 14 days, by statute, to prepare and deliver the documents. Hmmm. Something didn&amp;#39;t add up here.&lt;/p&gt;    &lt;p class=&quot;MsoNormal&quot;&gt;On behalf of my selling agent, I contacted the listing agent and asked how they planned to compel the HOA to prepare the documents and provide the purchaser with the Virginia State mandated three-day period of review to accept or decline the documents. After a long pause, he said, I guess we could write in an amendment to extend the timeframe&amp;hellip;. After paying $312, the Purchaser received the documents - one day before closing (There was another provision that the seller could require closing immediately following loan approval). Two of the several reasons you want to see HOA documents relate to dues not paid and architectural committee inspection results. Both convey with the property if not caught by the new lender or remedied by the current owner.&lt;/p&gt;    &lt;p class=&quot;MsoNormal&quot;&gt;We found out that there was a $2,200 dues arrearage and $1,500 worth the exterior maintenance to be completed. Before closing, we required a seller credit for same.&lt;/p&gt;    &lt;p class=&quot;MsoNormal&quot;&gt;This is just one hideous example of what is happening to buyers in short sales. I almost forgot to mention: there was another provision that stated that the seller could terminate the contract at any point prior to closing without cause (like if they receive a better offer). The purchaser would have no recourse and waived all rights to sue for performance or recover fees and expenses paid to date. The only recognition would be to refund the purchaser&amp;rsquo;s earnest money deposit. No reimbursement for any inspections, appraisal. survey and other related fees.&lt;/p&gt;    &lt;p class=&quot;MsoNormal&quot;&gt;Many of these deals are really complicated. A must-read article appeared in today&amp;#39;s Washington Post discussing this growing problem with not a lot of solutions in sight. It&amp;#39;s actually causing some couples to re-think their divorce plans! What many others are finding is that with values going down and rates going up, where two had qualified before, the remaining soon-to-be-ex-spouse is not able to qualify to carry the note alone. Most mortgage companies are refusing to remove or release liability for the departing spouse, putting the mortgage payment continuity at risk plus it&amp;#39;s always better to have two incomes to go after if there is a resulting deficiency judgment.&lt;/p&gt;&lt;p&gt;So, who gets the mortgage? It depends mainly on the remaining spouse&amp;#39;s ability to qualify to refinance the other party off the note, the current property value and the equity position to sustain the refinance. I had a very good agent approach me today with a combination form he was thinking about using for one of his listings. If he had been representing the tenant/prospective buyer, I might have encouraged him to use it. &lt;/p&gt;&lt;p&gt;Over the last 10 years in a range of different markets, I have seen law suits periodically arise over lease-with option-to-purchase contracts, usually over money, price and equity. Many of the suits are a direct result of well-intentioned, but sloppy writing by Realtors and/or attorneys. &lt;/p&gt;&lt;p&gt;In brief, if I were a listing agent receiving an offer of a lease with-option-to-purchase contract, I would counter with two separate documents: a lease for the agreed upon period of time and a sales contract, to be executed whenever the tenant&amp;#39;s financing is approved and ready to close.&amp;nbsp; You can also spell out credits and other terms mutually agreed to, but the tenant must successfully perform on the lease, then purchase the property.&lt;br /&gt;&lt;/p&gt;&lt;p&gt;If I were the leasing agent, I would probably try for the combined document approach and try to lock the seller into as favorable terms as possible. Although, I might not want to lock the price in if the market is still projected to decline. If this were 2000-2005 and I asked the seller to lock the price for 12 or 18 months, he would probably hand me some windex to clean my third eye as he wondered which planet I was from. If the seller agreed to execute an agreement giving my client the option tp purchase, I would also have my attorney record the option in the county land records.&lt;/p&gt;&lt;p&gt;It may be different in other parts of the country, but it is rare for a lease-purchase contract to actually&amp;nbsp; close in the Northern VA market.&amp;nbsp;&lt;/p&gt;&lt;p&gt;How do you handle lease-with-option-to-purchase in your market area? I&amp;#39;m not so sure that Wes&amp;#39; managers ever got that message! One of the reasons I went out on my own was the informal expectation that, while we know you are an independent contractor, we would like you to support out profit structure and use our affiliates. I was amazed at how many different ways they would make the suggestion. And while they were not supposed to retaliate against the non-users, guess who was a top producer in the office and who was passed over for the plum referrals and two-windowed office????&lt;/p&gt;&lt;p&gt;Anyway, what&amp;#39;s your take on broker pressure, informal or otherwise to use company affiliates. As a business model, it makes sense for the owner. For the lazy, brown-nosing agent who wants to be the team player or worse yet - the next sales manager, it leads to unending management gratitude. For independent professionals, it&amp;#39;s better to leave. This report includes all of the newly listed homes, just sold homes, and recently pending homes. Of course, release of this information is subject to your local MLS rules. Home owners absolutely love these reports, and it provides you with an opportunity to show yourself off as an expert in the market area. &lt;/strong&gt;&lt;/p&gt;  &lt;p&gt;&lt;strong&gt;So the next time you lose a listing in your farm, turn that lemon into gatorade!&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;If you farm, have you tried this?
