The uncertainty regarding flaws in the foreclosure documentation practices of a number of banks may have created “clouded” or unclear title issues for the buyers of REO homes. Purchasers offoreclosed homes absolutely should obtain title insurance, preferably working with a local title or real estate attorney.
The only problems I have seen is when the loan is sold between lenders.  The title will show the old lender at the closing, while the pay off check will show the current lender.  This is easily fixed by printing the proper paper work on record at the county assesors web site.  I'm not sure … (3 comments)

Mortgage lenders including Wells Fargo & Co. and Bank of America have raised the minimum credit score on FHA-insured loans that they will buy to 640 from 620. About 6.3 million people are estimated to fall within the 620-640 range, comprising roughly 3.7 percent of US consumers. Requiring a 640 credit score excludes about 15 percent of FHA borrowers, per FHA estimates. These high hurdles for FHA loans, used in about a fifth of U.S. home purchases, add to the challenges in the struggling housing market, especially for minorities and borrowers in communities hit hardest by the economic downturn

Apparently there is some kind of a scam going on in Wisconsin where property owners receive correspondence from the “State Record Retrieval Board” which informs the recipient that it is recommended that every homeowner obtain a copy of the deed to his or her house. The form contains information about deeds and different methods of holding title to properties and warns that it is not from an official government agency. What happens when the old lender is on title and you are closing? - 11/04/10 03:25 PM
This never happened to me before at a closing, but I can see how it will happen again.  Everyone was gathered at the closing when the Title Agent for the Buyer informed them, we could not close.  There was a problem with the title.  The home had been refinanced in June, and the closing was in November.  It takes months for the county to update titles and this was the problem. ABC lender was on the current title.  In June ABC lender assigned the loan XYZ lender.  This was a short sale and XYZ lender issued a letter agreeing to accept … (2 comments)

Earnest Money Held by Another Party - 11/04/10 03:00 PM
This never occurred to me until I had a buyer and seller agree to have the earnest money held by another party.  Note, this was on a short sale.  The asset company wanted the earnest money to be held by an attorney.  No problem, buyers agreed in writing, the check was delivered on time, Selling Agent provided a copy of the check, and I eventually received a receipt.  In this particular instance the check was not deposited, but forwarded to a number of companies during the process.  Days before closing the check was missing.  Buyers canceled the check, issued a new … (1 comments)
