New Legislation

New legislation, the Worker, Homeownership and Business Assistance Act of 2009, which was signed into law on Nov. 6, 2009, extends and expands the first-time homebuyer credit allowed by previous Acts. The new law:

  • Extends deadlines for purchasing and closing on a home.
  • Authorizes the credit for long-time homeowners buying a replacement principal residence.
  • Raises the income limitations for homeowners claiming the credit.  

For the first time, long-time homeowners who buy a replacement principal residence may also claim a homebuyer credit of up to $6,500 (up to $3,250 for a married individual filing separately). They must have lived  in the same principal residence for any five-consecutive year period during the eight-year period that ended on the date the replacement home is purchased.

People with higher incomes can now qualify for the credit. The new law raises the income limits for homes purchased after Nov. 6, 2009. The credit phases out for individual taxpayers with modified adjusted gross income (MAGI) between $125,000 and $145,000 or between $225,000 and $245,000 for joint filers. The existing MAGI phase-outs of $75,000 to $95,000 or $150,000 to $170,000 for joint filers still apply to purchases on or before Nov. 6, 2009.

Einstein the Kitty talks about why mortgage rates go up and down.

Most mortgages are put together in pools and sold to investors through securities backed by the pooled mortgages.  These securities offer a rate of return similar to a bond.  Those investments are competing in the market place with other investments like stocks or bonds.  Stocks are higher risk whereas bonds offer less risk but a lesser rate of return. 

Investors will balance their investments based on how much risk they want to take, and their perception of the overall economic health of the country (similar to consumer confidence).  If they feel the economy is doing well, stocks will go up and more money will be placed in stocks and less in bonds and mortgage backed securities.  These investors may also believe that the stock market is a good place to put their money in if they believe a company is improving their bottom line by trimming costs.  As a result, a strong economy in a basic sense means higher interest rates, and a slower economy means lower interest rates.

Today's economy has some economists seeing deflation as a concern.  Other economists see inflation as a concern on the horizon as a consequence of the federal government essentially borrowing money from themselves to attempt to affect the economy.   If inflation does kick in then this means the cost of goods will go up and the dollar's buying power will go down.  If the dollar is worth less, a higher return on investments will be required by investors, which in turn will mean higher interest rates.  Today's interest rates at record lows is not the norm, unfortunately today's buyers think this is normal.  We can easily see 7 percent rates and higher.  If you are a buyer now is the time to buy to lock in your home (asset) with today's low cost of financing.
