    <title>New 2009 changes for 1031 exchanges</title>

&lt;p&gt;It's almost that time again, you know the end of the year and all of the changes that come with it. We had our first snow here in &lt;a href="http://www.ski-homes-summit.com/" title="Summit County Real Estate" target="_blank"&gt;Summit County Colorado&lt;/a&gt; last week. In fact it was flurrying when I got to the office this morning. I began to think about the coming winter, the ski season and realized Christmas and the New Year are just a few short months away.&lt;/p&gt;
&lt;p&gt;I had a couple that I showed&amp;nbsp;vacation homes&amp;nbsp;to this weekend and after thinking about them and the rapidly approaching new year I was reminded about all the questions they had in relation to buying their first second home / investment property. They began to ask me many questions&amp;nbsp;which invariably led to &lt;a href="http://www.ski-homes-summit.com/1031_Exchange/page_2093487.html" title="1031 Exchanges" target="_blank"&gt;1031 exchanges&lt;/a&gt;.&lt;/p&gt;
&lt;p&gt;&lt;img title="Summit County in the Fall" src="http://activerain.com/image_store/uploads/1/2/3/5/2/ar122392418325321.jpg" height="240" alt="Summit County in the Fall" width="395" style="float: left;" /&gt;I realized that I had not yet done an update to our blog about the changes coming&amp;nbsp;to 1031 exchanges for the 2009 year. Our blog has previously covered 1031 exchanges (see &lt;a href="http://activerain.com/blogsview/172921/How-to-do-a" title="1031 Exchanges" target="_blank"&gt;How to do a 1031 exchange&lt;/a&gt;) so we will not deal with the entire 1031 process in this entry but focus on new changes that may impact you for 2009.&lt;/p&gt;
&lt;p&gt;An owner of a property would typically use a 1031 exchange to defer gains and other tax payments&amp;nbsp;upon the sale of an investment property. To defer these taxes, the seller of an investment property buys a replacement property of equal or higher value.&lt;/p&gt;
&lt;p&gt;The seller has to satisfy timing requirements and other rules, but if those are met, he or she is able to sell an existing investment property and then buy a new property without having to pay the IRS any taxes. One of these requirements is that the new property purchased must be used for investment purposes.&lt;/p&gt;
&lt;p&gt;for 2009 there is a new limit on excluding a gain when converting an investment property to a primary residence.&lt;/p&gt;
&lt;p&gt;The Housing Assistance Tax Act of 2008 signed by&amp;nbsp;President Bush and pushed by congress&amp;nbsp;became law on July 30, 2008. It includes a provision which limits the amount of gain that can be excluded when you sell a house used as a primary residence if you also used the house for another purpose, such as a rental.&lt;/p&gt;
&lt;p align="left"&gt;Under the rules of Section 121 of the Internal Revenue Code, you will not owe capital gain taxes up to $250,000 of gain, or $500,000 of gain if you are married and filing jointly, when you sell a house used as a primary residence for two of the previous five years. The two year period does not need to be consecutive to qualify for the exclusion.&lt;/p&gt;
&lt;p align="left"&gt;Under the new law and as of January 1, 2009, the amount of gain that you can exclude will be reduced to the extent that the house was used for something other than a primary residence during the period of ownership. The exclusion is reduced by pro-ration by comparing the number of years the property is used for non-primary residence purposes to the total number of years the property is owned by the taxpayer.&lt;/p&gt;
&lt;p align="left"&gt;Ok,&amp;nbsp;lets try to make all that easy to understand by using an example in the real world. A coup&lt;img title="Frisco Colorado" src="http://activerain.com/image_store/uploads/9/6/9/7/1/ar122392430217969.jpg" height="292" alt="Frisco Colorado" width="390" style="float: right;" /&gt;le that is maried&amp;nbsp;uses a 1031 tax deferred exchange to acquire a house for $500,000 they plan to use as a rental in 2009. The couple rents the house for three years, and then moves into it and uses it as their primary residence for the next three years. The couple decides to sell the property at the end of the sixth year for 1 million dollars, netting a total gain of $500,000. Under the new rules, instead of being able to exclude the entire $500,000, the couple will not be able to exclude some of the gain based on how many years they used the home as a rental. Since they rented it for three years out of six, 50% of the gain, or $250,000,&amp;nbsp;will not be able to be excluded from their tax liability. Because of this new limitation, the couple will be able to exclude $250,000 of the gain rather than the entire $500,000 under the rules before 2009.&lt;/p&gt;
&lt;p align="left"&gt;There are several exceptions to this new restriction that I believe buyers and investors today must know. Any periods where the&amp;nbsp;property is used other than as a primary residence that occurs prior to January 1, 2009 will not reduce the excludeable gain. Using the example above, if the three year rental period occurs prior to January 1, 2009, the exclusion would not be reduced and the couple would be able to exclude the full $500,000. In other Words if you have a second home now and plan on using it as a primary residence in the near future you may want to consider doing so before January 1, 2009.&lt;/p&gt;
&lt;p align="left"&gt;Another important exception is that property that is first used as a primary residence and later converted to investment property will not be affected by this new law. For example, you own and live in a house for 18 years. Subsequently, you move out and rent the house for two years before&lt;/p&gt;
&lt;p align="left"&gt;selling it. Because your investment use occurred after the last day of use as a primary residence, all of the gain accumulated over your 20 year ownership of the property can be excluded, up to $250,000, or $500,000 if you are married and filing jointly.&lt;/p&gt;
&lt;p align="left"&gt;As always consult your tax or legal professional for advice related to investment properties. But these new rules will give you something to think about before the new year.&lt;/p&gt;

&lt;p&gt;I know much has been written already about the new outside blogs at Active Rain. I just wanted to take a moment and thank everyone at&amp;nbsp;the Rain for doing this. For months I have been duplicating Our blogs to our non-AR blog. It has been time consuming and lately not always getting done.&lt;/p&gt;

    <title>Fighting Pine Beetles</title>

&lt;p style="text-align: left;"&gt;Well I thought we escaped the Pine Beetle again this year. Many &lt;a href="http://www.ski-homes-breckenridge.com/" title="Colorado Vacation Homes" target="_blank"&gt;Colorado mountain&lt;/a&gt; towns have been devistated by the beetles and Summit County is no exception. We spray every year and make sure we do everything to maintain our wonderful pines. Last month Deanna and I were discussing how we saw no marks on our trees or any browning on them.&lt;/p&gt;
&lt;p&gt;&lt;img title="Pine Beetle" src="http://skyblu.files.wordpress.com/2006/11/mt-pine-bark-beetle.JPG" height="260" alt="Pine Beetle" width="429" style="float: left;" /&gt;Well my folks decided to visit last weekend and the first thing my Dad said did you see that brown tree in your yard. I was in such shock I almost called him a LIAR! So I rushed to the window and looked out. I could not see the tree and everything looked healthy and green. Dad strolls over as I continue to frantically look for the elusive dead tree. He points up and says look at the top. Sure enough the whole top of the tree was brown.&lt;/p&gt;
&lt;p&gt;I love my trees and many are very mature and beautiful. I almost get downright protective of them. I felt the Beatles had violated my space. I cannot imaging my home without their shade and greenery. Luckily I also live in the middle of an Aspen Grove.&lt;/p&gt;
&lt;p&gt;So now I have declared all out war on the Pine Beetles. I have sprayed again this year but I am not a particular fan of chemicals but feel it is necessary to help save our trees. Spraying the trees contains a chemical called seven which also can kill bugs that are vital to our forests and waterways.&lt;/p&gt;
&lt;p&gt;In my research I have come across a product that we are trying this year called Beetle Block from AG Bio.&lt;img title="Lake Dillon" src="http://www.coloradovacation.com/colife/skiing/skisummit2.jpg" height="261" alt="Lake Dillon" width="400" style="float: right;" /&gt; The research looks promising as they have studies to back up the science.&lt;/p&gt;
&lt;p&gt;Beetle Block contains a type of Verbenone, and&amp;nbsp;verbenone is a natural pheromone that beetles emit when the population of a tree has reached a high level. The pheromone is a signal to adult beetles to stay away because the tree cannot support full development of the population that has already infested the tree. Beetles turn away and seek another food source. The verbenone in Beetle Block is an exact mimic of the verbenone naturally produced by beetles.&lt;/p&gt;
&lt;p&gt;Beetle Block has been used commercially in Montana, Wyoming, &amp;amp; Idaho by the forest service and other agencies. &amp;nbsp;This year a couple of our local towns have purchased it for testing on some areas. &amp;nbsp;If any of you have used the product I would love to hear your results.&lt;/p&gt;
&lt;p&gt;One positive note Aspen trees seem to be proliferating where pine trees have been cut or have completely died out. In the comming years Summit County will have a very healthy forest for us and future generations to see.&lt;/p&gt;

    <title>Summer Concerts at the all new Riverwalk Amphitheater, Breckenridge Colorado</title>

&lt;p&gt;&lt;img src="http://www.breckenridgemusicfestival.com/images/events1082.jpg" height="243" alt="Breckenridge Music Festival" width="345" style="float: left;" /&gt;One of the most popular things&amp;nbsp;to do during the summer here in Summit County is to visit a couple of concerts at the Breckenridge Riverwalk Amphitheater. It's a great place to see The Blue River run by as you are watching one of the summer concerts.&lt;/p&gt;
&lt;p&gt;This year should be one of the best as the amphitheater has been remodeled. A roof and walls were erected over the existing amphitheatre structure and other improvements were made as well. The project substantially enhances the experience by improving the acoustics, temperature control and lighting within the facility. The unique connection I spoke of to the outside environment has been maintained with six large clear doors that fold open to the Riverwalk Center lawn. Nights can be cool so bring a jacket and blankets if you want to stay warm.&lt;/p&gt;

&lt;p&gt;The NRO is a nonprofit organization that provides an 8 week fellowship program for the most promising &lt;img src="http://www.breckenridgemusicfestival.com/images/events1081.jpg" height="248" alt="Breckenridge Music Festival" width="346" style="float: right;" /&gt;young orchestral musicians. Alumni currently perform in virtually every major orchestra in the US and in orchestras world-wide.&amp;nbsp; Each summer, 89 musicians are chosen in a nationwide audition tour to participate in an intense symphonic orchestral experience.&lt;/p&gt;
&lt;p&gt;The NRO performs two full orchestra concerts each week in the Riverwalk Center between&amp;nbsp;mid-June and early-August. In addition, members of the NRO take part in smaller chamber concerts during the festival, and the full orchestra plays at several other locations in the state. Throughout the summer a full range of symphonic literature is performed; the equivalent of a full symphony season!&lt;/p&gt;

    <title>Colorado still the leader in overnight ski visits - Breckenridge tops!</title>

&lt;p&gt;&lt;img title="Breckenridge Colorado" src="http://activerain.com/image_store/uploads/9/8/0/1/3/ar12139798031089.jpg" height="278" alt="Breckenridge Colorado" width="360" style="float: left;" /&gt;Colorado continued to be the number-one overnight ski destination in the U.S. for 2007 despite increasing competition from other states, according to the report commissioned by the Denver Metropolitan Convention and Visitors Bureau and the Colorado Tourism Office.&lt;br /&gt;&lt;br /&gt;Overall statewide numbers broke records - with 28 million Americans making overnight visits to Colorado in 2007, up from 26.9 million in 2006.&lt;br /&gt;&lt;br /&gt;Travel spending in the state reached new heights as well, with domestic visitor expenditures reaching a record $9.8 billion in 2007, up 10 percent from 2006. &lt;br /&gt;Colorado was the destination of 20 percent of all domestic overnight ski trips in 2007, down from about 23 percent in 2006, the report found.&lt;/p&gt;
&lt;p&gt;The report found a significant drop in the numbers of visitors from the upper&amp;nbsp; Mid-western states of Indiana, Ohio and Michigan. May of which chose closer eastern destinations as they also fared well with snow and the economy and gas prices were also&amp;nbsp;sighted as another possible reason.&lt;/p&gt;
&lt;p&gt;The final ski area numbers are to be released in October. However an estimated 12,535,913 skier visits during the 2007-08 ski season. This is the third consecutive season that skier visits have topped more than 12 and a half million and will now rank as the second best season for skier visits on record in the state after the 2006- 2007 record year last year. Early reports show &lt;a href="http://www.ski-homes-breckenridge.com/about-city.php" title="Breckenridge Coloarado" target="_blank"&gt;Breckenridge &lt;/a&gt;Colorado should continue to retain its title of most visited resort in North America.&lt;/p&gt;

    <title>Colorado Resort Real Estate Update January - April 2008</title>

&lt;p&gt;Wow what a great year so far. Summer has finally arrived. The flowers are in full bloom, and Lake &lt;a href="http://www.ski-homes-breckenridge.com/summit-county-cities.php#dillon" title="Dillon, Co" target="_blank"&gt;Dillon&lt;/a&gt; is almost full. By the 4 of July with the current runoff it should be at capacity. I can't wait to see all the sail boats out on the lake for this year'&lt;img title="Upper Blue" src="http://activerain.com/image_store/uploads/5/8/5/6/7/ar12139779476585.jpg" height="337" alt="Upper Blue" width="464" style="float: left;" /&gt;s regatta. It should be a blast.&lt;/p&gt;
&lt;p&gt;The realignment of the gondola in &lt;a href="http://www.ski-homes-breckenridge.com/keystone-colorado.php" title="Keystone Colorado" target="_blank"&gt;Keystone&lt;/a&gt; is on track and should be ready in time for the 2008-2009 ski season. I have seen some of the future development plans and it looks to be ambitious. This summer there may be some investment opportunities available in older units that will be directly impacted by the new Gondola. The move looks to add additional ski in/out capacity to some of the older buildings.&lt;/p&gt;

We update the blog regularly so check back often for the latest updates including monthly real estate numbers for the County.&lt;/p&gt;
&lt;p&gt;Well it ceases to amaze me but &lt;a href="http://www.ski-homes-breckenridge.com/about-summit-county.php" title="Summit County Colorado" target="_blank"&gt;Summit County&lt;/a&gt; &lt;a href="http://www.ski-homes-breckenridge.com/" title="Real Estate Summit County CO" target="_blank"&gt;Real Estate&lt;/a&gt; continues to buck the National trend. I will attach January - April's Colorado resort market index so take a look. As a whole the market remains strong. The major resort markets tend to be somewhat insulated from the housing bubbles that can bless or plague parts of the country. We are still averaging double digit appreciation, however days on market and inventory is up slightly from this time in 2007. We attribute this to tighter lending practices versus the last 3 years. Transaction dollar volume continues to rise as the total number of transactions fall. If any of you read the blog or have received our updates before you'll know this has been the case for several years. We see this in every major resort market, as housing prices increase the total amount of purchases fall.&lt;/p&gt;
&lt;p&gt;Summit County new construction remains robust. For the first 4 months&lt;img title="breck Golf" src="http://activerain.com/image_store/uploads/5/1/7/8/5/ar121397806558715.jpg" height="266" alt="Breck Golf" width="510" style="float: right;" /&gt; of the year we produced nearly a 8% increase over 2007, while nationally new construction was down nearly 21% during the same period. Appreciation is still on the rise with the average single family home selling for $40,000 more than in 2007. &lt;a href="http://www.ski-homes-breckenridge.com/" title="Summit County Properties" target="_blank"&gt;Summit County real estate&lt;/a&gt; appreciation for the first 5 months of the year increased by 5.5 % while nationally we saw a loss in value of about 5%.with some west coast cities fairing much worse.&lt;/p&gt;
&lt;p&gt;As you can see Summit County not only is a great place to be but we continue to outperform the rest of the US. Land to build on is still available for your dream home especially in the Highlands just north of &lt;a href="http://www.ski-homes-breckenridge.com/about-city.php" title="Breckenridge Coloarado" target="_blank"&gt;Breckenridge&lt;/a&gt; and a new development in Silverthorne called Anglers Mountain Ranch. There are a couple of great values on vacant land if you're interested e-mail us and I'll send them over to you. We are still projected for total build out in the next 5-9 years. Frisco is rapidly approaching build out with only 7 lots currently available.&lt;/p&gt;

    <title>Copper Mountain Resort in Summit County Colorado to unveil new area plans.</title>

&lt;p&gt;&lt;a href="http://www.ski-homes-breckenridge.com/summit-county-cities.php#copper" title="Copper Mountain" target="_blank"&gt;Copper Mountain&lt;/a&gt; in &lt;a href="http://www.ski-homes-breckenridge.com/about-summit-county.php" title="Summit County Colorado" target="_blank"&gt;Summit County&lt;/a&gt; Colorado will present its plan to shift about 590 units of&amp;nbsp;yet to be built&amp;nbsp;housing within the resort's base area and add a large condo-hotel project to the mix during a&amp;nbsp;two-day hearing this week in front of the Tenmile Planning Commission.&lt;br /&gt;&lt;br /&gt;Copper also wants to eliminate 42,000 square feet of&amp;nbsp;set aside commercial density and relocate another 72,000 square feet of commercial space for shops, restaurants and service facilities to areas that will be closer to current uses and walk&lt;img title="Copper Mountain" src="http://www.themountainsusa.com/images/lodgingImages/Copper%20MountainResortPhotoMainLg.jpg" height="274" alt="Copper Mountain base area" width="350" style="float: left;" /&gt;ing paths. The plan anticipates about 1.5 acres of wetlands at the resort to be effected. This has been and can be a deal breaker in the past, but Copper will be restoring an additional 3 acres of wetlands to meet the 2-1 ratio required.&lt;/p&gt;
&lt;p&gt;A few key changes have been made since the county commissioners last looked at the master plan amendment in a work session in December 2007. As part of a community benefits package, Copper proposes to redirect part of an existing real estate transfer assessment to community purposes including affordable housing, open space and early childhood care.&lt;/p&gt;
&lt;p&gt;The resort currently&amp;nbsp;charges a 1.5 percent real estate transfer assessment on all residential property within the resort. Under the latest proposal, .25 percent of&amp;nbsp;the current&amp;nbsp;assessment would be&amp;nbsp;designated&amp;nbsp;to community purposes which could raise as much as 1 million dollars annually. The assessment fees would apply to all as-yet undeveloped density at Copper. Copper officials are selling the proposal as a balanced and well thought out plan.&lt;br /&gt;&lt;br /&gt;The latest version of the plan also speeds up the timing of a proposed employee housing development at East Lake, requiring construction of all the units within 42 months of the effective date of the approval for the base area redevelopment. Under the old plan the employee housing would have been phased in over &lt;img title="Copper Ski" src="http://www.ski-epic.com/breck_cop_key_images/copper2_500x400.jpg" height="278" alt="Copper Ski" width="315" style="float: right;" /&gt;time.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;A condo-hotel that was originally proposed for a floodplain location along Tenmile Creek would now be relocated to the Union Creek area.&lt;/p&gt;
&lt;p&gt;In 2007 Copper officials got the green light from the commission only to be sent back to the drawing board by the County Commissioners. Copper is looking for to get a go ahead from the commission and could then go to the Board of County Commissioners later this summer for final approval.&lt;/p&gt;
&lt;p&gt;Copper has been looking to make major changes to the base area plan since 2001, when the resort submitted what was then called a comprehensive development strategy that would have included significant amounts of new density to the resort base area. The Tenmile Planning Commission recommended approval in 2003, but the county commissioners denied the application in July 2004.&lt;/p&gt;

&lt;p align="left"&gt;At&amp;nbsp;the March 26, 2008, Council Meeting, the &lt;a href="http://www.ski-homes-breckenridge.com/summit-county-cities.php#silverthorne" title="Silverthorne CO" target="_blank"&gt;Silverthorne&lt;/a&gt; Town Council approved an agreement to partner with Red Mountain Village, LLC, to provide a mix of affordable and market rate housing on a 51 acre site commonly referred to as the Smith Ranch. The Town is currently negotiating with Red Mountain Village to craft a development agreement which will provide a mix of affordable and attainable market rate housing, all of similar size and design. If a development agreement is agreed to by June 30, 2008, the Town will then negotiate an acceptable planned unit d&lt;img title="Red Mountain Village" src="http://activerain.com/image_store/uploads/4/5/8/8/9/ar121278458498854.jpg" height="307" alt="Red Mountain Village" width="428" style="float: left;" /&gt;evelopment agreement, as well as an annexation agreement to bring the development within Town limits.&lt;/p&gt;
&lt;p align="left"&gt;Silverthorne's Town Council has always envisioned this land as an affordable neighborhood for full-time residents, and this agreement secures the property for that purpose. The approved agreement outlines a process by which Red Mountain Village can work in partnership with the Town to bring an affordable housing development to Silverthorne," stated Mayor Dave Koop. Mayor Koop added, "We are looking forward to getting public input on this topic. Once the Town has negotiated an acceptable development agreement, we will begin our development process review which provides many opportunities for public input."&lt;/p&gt;

&lt;p align="left"&gt;A &lt;a href="http://www.ski-homes-breckenridge.com/summit-county-cities.php#silverthorne" title="Silverthorne CO" target="_blank"&gt;Silverthorne&lt;/a&gt; Colorado community garden board has been established and planning is underway to bring to fruition the community garden concept proposed by the Economic Development Advisory Committee's WOW Sub-Committee. One of EDAC's goals is&lt;img title="Silverthorne Garden" src="http://activerain.com/image_store/uploads/4/6/6/0/1/ar121278307510664.png" height="397" alt="Silverthorne Garden" width="320" style="float: left;" /&gt; to provide recommendations on beautification options in Silverthorne, and a community garden was determined by the WOW subcommittee to be one such option. EDAC members Larry Lunceford, Eddie O'Brien, and Marc Hogan initially brought forth the concept of a community garden in April 2007. Town Council indicated in June 2007 that if community leadership and administration, private funding, and an appropriate site plan could all be established the garden concept should be given consideration through the Town's site plan process.&lt;/p&gt;
&lt;p align="left"&gt;Community members have begun diligently working toward this goal. Co-coordinators Linda Hrycaj and Marie Orlin are leading the garden board in their mission to create a working community garden that invites individuals and families from all backgrounds, regardless of gardening experience. The goal is to develop a hands-on garden that integrates education, creative expression, cooperation, and community spirit.&lt;/p&gt;
&lt;p align="left"&gt;The proposed garden site is the grassy area at the southeast corner of Rainbow Drive and E. Fourth St.,across from the Silverthorne Recreation Center.&lt;/p&gt;

&lt;p&gt;After&amp;nbsp;rapidly lowering&amp;nbsp;for the last several weeks to make room for snow runoff, water levels in &lt;a href="http://www.ski-homes-breckenridge.com/summit-county-cities.php#dillon" title="Dillon, Co" target="_blank"&gt;Dillon&lt;/a&gt; Reservoir in &lt;a href="http://www.ski-homes-breckenridge.com/about-summit-county.php" title="Summit County Colorado" target="_blank"&gt;Summit County&lt;/a&gt; Colorado will begin to rise again this week.&lt;br /&gt;&lt;br /&gt;&lt;img title="Boating on lake dillon" src="http://www.colorado.com/data/businesses/dillon-marina-2.jpg" height="264" alt="Boating on lake dillon" width="346" style="float: left;" /&gt;Denver Water announced Thursday that it's dropping outflow to the Lower Blue from 800 to 500 cubic feet per second.&lt;br /&gt;&lt;br /&gt;The main reason for the change is that the runoff from the South Platte drainage has been considerably less than projected. The snow seems to be melting at a slower pace than originaly anticipated.&lt;/p&gt;
&lt;p&gt;Denver water has reported that as a result it may have to bring more water through the Roberts tunnel than previously thought.&lt;br /&gt;&lt;br /&gt;The change will improve fly-fishing conditions in the Blue River below the dam and bring water levels up at the Frisco marina.&lt;/p&gt;
&lt;p&gt;Local outfitters said the decreased outflow won't affect commercial rafting trips on the Lower Blue.&lt;/p&gt;

&lt;p&gt;It's back! The wacky and fun &lt;a href="http://www.ski-homes-breckenridge.com/about-city.php" title="Breckenridge Coloarado" target="_blank"&gt;Breckenridge&lt;/a&gt; outhouse races representing the hardships faced by our forefathers, bringing back a quirky event that combines a glimpse of the past in the spirit of today. The second annual Breckenridge Outhouse Races will take place in downtown Breckenridge on Sunday, June 15 and visitors and residents are again invited to put on their creative thinking caps and start building their Outhouse Race entries.&lt;/p&gt;
&lt;p&gt;&lt;img title="Outhouse race" src="http://www.gobreck.com/site/static/images/kingdomdayspics/finishline.jpg" height="266" alt="Outhouse race" width="400" style="float: left;" /&gt;The race course will span one Breckenridge block on Ridge Street from Lincoln to Washington Avenues. The course will be divided into two lanes. Teams will race in heats of two. The winning team will advance to the next round and the losing team will be eliminated. the event will not be times and has no set time limit.&lt;br /&gt;Each team can have up to five members with one person mandated to ride inside the Outhouse. Helmets are recommended for the racers, but mandatory for the team member on board. There are no weight limits, but you must be at least 13 years of age to participate.&lt;br /&gt;&lt;br /&gt;All entries must be pulled or pushed. No motors or pedal propelled mechanisms allowed. New this year, bicycle parts and pieces permitted, but no in-tact bicycles allowed. Each Outhouse must have a seat with a hole that one team member sits on during the race. The seat must be securely attached to the outhouse. Each outhouse should have its name or theme displayed&amp;nbsp;bold and proud&amp;nbsp;on the outhouse.&lt;br /&gt;&lt;br /&gt;Outhouses may be built of any solid material, as light as cardboard or as heavy as plywood. All Outhouses should have four sides, a roof and a doorway. The door is optional. Windows are allowed, but no glass may be used. Any number and size of wheels may be used. &lt;p&gt;The Marina at the&amp;nbsp; lake may still be closed, but Friday marked the opening of ballfields, the disc golf course and the skate park at the peninsula recreation area.&lt;br /&gt;&lt;br /&gt;Skate park improvements are scheduled for late July or early August. The park will be closed for one week this year due to these improvements but they should really enhance the Skate Park.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Rules&amp;nbsp;&amp;amp; hours of the park are:&amp;nbsp;Dogs must be on a leash; pack out all trash; the peninsula hours are 6 a.m. to 10 p.m, seven days a week.&lt;/p&gt;

    <title>Discount Real Estate, The Web, &amp; The Court ruling does it impact you?</title>

&lt;p&gt;I'm not sure if you caught this yesterday it was a bit buried but &lt;strong&gt;NAR settled a lawsuit &lt;/strong&gt;brought on by the government. In a nut shell NAR, its member organizations, and members&amp;nbsp;were not allowing access to all of its listings to web based and discount brokers. The lawsuit was filed in 2005 by the&amp;nbsp;justice department in&amp;nbsp;what seemed to be by the prodding of Zillow, Cyber Homes and a few&amp;nbsp;web based&amp;nbsp;Internet brokers. They claimed an unfair playing field by not having access to the entire database of NAR's MLS listings and the complete data of each listing.&lt;/p&gt;
&lt;p&gt;By settling they allowed all discount &amp;amp; web based brokers full access to all listings. However it was not a complete victory for web brokers because NAR will still be allowed to limit comments and some price comparisons.&lt;/p&gt;
&lt;p&gt;So what do you think? Is this good or bad for your business? Will traditional brokerages be affected? What will this do to the individual Realtor? What do you see as the future of real estate?&lt;/p&gt;

Buyers will still recognize a scene set with picnic table and chairs and respond positively to it. Cover your picnic table with a fringed, red-and-white checked cloth, set out some plastic plates and glasses, bring out the barbecuing equipment, and buyers will almost smell the hot dogs cooking!&lt;/p&gt;
&lt;p&gt;43.&amp;nbsp;&amp;nbsp;&amp;nbsp; Virtually any entry hall will benefit from a well-placed mirror to enlarge the area.&lt;/p&gt;
&lt;p&gt;47.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;Place something colorful on the mantel, but don't make it look like a country craft store.&lt;/p&gt;
&lt;p&gt;53.&amp;nbsp;&amp;nbsp;&amp;nbsp; Avoid clutter! Clean counters of small appliances and store whenever possible to maximize the appearance of work space.&lt;/p&gt;
&lt;p&gt;72.&amp;nbsp;&amp;nbsp;&amp;nbsp; Large master bedrooms are particularly popular among today's home buyers. Make your bedroom larger. Paint the room a light color, remove one of the bureaus if the room is crowded, and minimize clutter to maximize spaciousness. Aim for a restful, subdued look.&lt;/p&gt;
&lt;p&gt;84.&amp;nbsp;&amp;nbsp;&amp;nbsp; Remember to appeal to a wide range of buyers. Play down dominant colors with contrasting neutral colored towels and accessories. If your bathroom is mostly white or neutral, add a few cheerful accents of color: use towels in the popular new shades. &lt;p&gt;A few years ago we came up with document titled "90 ways to sell your home faster and for more Money" to help &lt;a href="http://www.ski-homes-breckenridge.com/" title="Summit County Colorado" target="_blank"&gt;Summit County Colorado&lt;/a&gt; Sellers prepare their homes to sell. It is broken down into 6 categories:&lt;/p&gt;

&lt;p&gt;I decided to put&amp;nbsp;a sample&amp;nbsp;of it on our blog in the hope it will help sellers not only here in&amp;nbsp;the Rocky Mountain Resort region but nation wide. It will be posted in a 6 part series.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Part&amp;nbsp;6 Staging:&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;22.&amp;nbsp;&amp;nbsp;&amp;nbsp; Study magazine ads, furniture showrooms, &amp;amp; &amp;nbsp;model homes to see how small details can make rooms more attractive and appealing. The effect of a vase of flowers, an open book on the coffee table, a basket of birch logs by the fireplace, etc., can make the difference in a room.&lt;/p&gt;
&lt;p&gt;24.&amp;nbsp;&amp;nbsp;&amp;nbsp; Soften potentially offending views, but always let light into your rooms. Replace heavy curtains with sheer white panels. Never apologize for things you cannot change. The buyer will either decide to accept or reject the property regardless of the words you say. Just present the home in the best way possible with complete honesty.&lt;/p&gt;
&lt;p&gt;27.&amp;nbsp;&amp;nbsp;&amp;nbsp; Color has the power to attract. A tub of geraniums, a pot of petunias, or a basket of impatiens on the front steps is a welcoming touch. Buyers love color!&lt;/p&gt;
&lt;p&gt;30.&amp;nbsp;&amp;nbsp;&amp;nbsp; Check to see that all doors and windows are in good working order. Give special attention to your home's exterior doors and front entry. Clean and paint doors if necessary. Remember, first impressions are likely to color the remainder of the house tour.&lt;/p&gt;
&lt;p&gt;Deanna and I have sold many homes and have found the first impression a buyer sees sets the mind set for the whole home tour. Check your planters for weeds and stage the front door area with color and in winter use a colorful dried flower wreath.&lt;/p&gt;
