Its easy to dismiss Title Insurance as just one more mysterious charge on the closing statement. After all, some say, with all the online records what mistake in the chain of title could possibly be overlooked? Below is a comprehensive list of many title problems that may not be discovered during the pre-closing title search - any of which could be expensive to defend and ultimately settle.

Sounds scary, but if you've purchased Title Insurance at closing, you're protected. Your Title Policy is a commitment to defend claims against your title, and if necessary to compensate you for your loss if the other party prevails.

Can a Buyer get out of a contract if they find a better home to buy?

Entering into a contract is both a legal and a moral issue, in my opinion. The legal side should be obvious - if you break a contract there can be serious repurcussions. From a moral standpoint, I start with the golden rule. Do unto others as you would have them do unto you - and the equally important "do NOT do unto others what you would not want done to you".

Getting to binding agreement is an exciting moment for buyers AND sellers - it sets up the expectation that a closing is imminent, as long as there are no insurmountable obstacles encountered with inspection or appraisal. Binding agreement is a two way commitent. Don't enter into binding agreement unless you're, well, COMMITTED.

A Buyer called looking to hire a BUYER BROKER who was looking to purchase a Home in the Manchester NH area. They said they wanted the BEST Agent who would work hard for them. They needed to buy a home right away, they are pre-qualified, they have nothing to sell and have a large down payment to put down. Their key question was "If once they found a home, made an offer, got it accepted... if I was willing to assist them in GETTING OUT of that contract if a BETTER HOME came on the market that they wanted more."

Simply put, they want to go through the motions of Buying a home, pay for an inspection, an appraisal, but then want tio stop it in their tracks and start over if a new listing peaks their interest more?

I had to ask where they would get this idea. They told me an agent from a "national company" told them because they needed to purchase right away and there was not many listings for sale, they could simply switch if a news listing came on the market they liked more.

Next question was why did you not hire this "national company" Buyer Broker? They replied they did, but they did not have time to show them anything and kept sending assistants. They wanted the best and that was not it.

I told them "For me to be the best, I have to provide the BEST advice and this would not be it. That once an offer is accepted and signed and becomes a contract. you can not JUST switch from Buying one home to another. it would be costly, time consuming and could even lead to a lawsuit."

The Buyer asked for clarification where I outlined what it takes to buy a home and what it takes to be released from a contract. The BEST advice is "To take the time to only look at homes that suit their needs and wants, then purchase the right home the right way the first time.

As i was ready for a backlash, ready to bit them farewell, Their answer was priceless. " Well the idea of backing out of a contract to find a new home did sound like the dumbest idea we ever heard, but it came from a professional we thought. Mr. Godzyk your idea sounds like a great plan, that is why we wanted to hire the BEST. Please help us find our dream home." they asked.

The lesson here is that the FIRST THINGS for anyone Looking to BUY A HOME should be to get pre-qualified by meeting with a LOCAL and TRUSTED LOAN OFFICER. The process is usually at no cost and can easily tell you what mortgage programs may be available for you and what you can afford.

The next and perhaps the most important part is by hiring a Buyer Broker who will provide REAL guidance through each step of the buying process. The key is identifying homes when they come on the market, see them quickly and make a good offer the first time. Know that All agents are not created equal. You have a choice and making a good choice equals a good home buying experience.

1. CHOOSING THE RIGHT BUYER BROKER: As a home Buyer in this market you need every advantage you can to get find, buy and close on your DREAM HOME. It starts with choosing the right agent.

a. Using a Full time agent whose sole job is in Real Estate.

b. Using a Full service agent who will guide you through each step of the BUYING process. Discount brokers often equal discount services.

c. Using a Local agent who knows your neighborhood and is readily available when you need them is a must. Out of town agents can leave you high and dry in your time of need.

d. Using a well experienced Buyer Agent can give you the advantages you need when Buying your home. Not all agents are created equal. Choose only the best..

2. GET PRE-QUALIFIED: Before even looking at a home you should get pre-approved for a loan. Few Sellers will look at your offer without it. Meet with a local and trusted mortgage broker, they can prequailify you at no cost, they will look at your credit plus your financials and let you know if there are any mortgages that you may qualify for. You should then tell them you are looking at bank owned homes so they can provide you with a list of what condition the property needs to be in for you to be able to get a mortgage.

3. STARTING YOUR HOME SEARCH: After you have found a full time local agent to work with, you got pre-qualified and now you have the price range you should be looking in. You should by now have decided what town/city you are interested in and what neighborhoods you like or do not like.

a. Prepare a list of the towns/cities you like.
b. Prepare a list of any specific neighborhoods you want to move to.
c. Furnish your agent with a list of what condition you would like the house such as in new, good, average condition or can need work etc.
d. Furnish your agent any must have features such as a garage.

Once you get a list of the homes that meet your criteria, my suggestion is to drive by them before you go inside. Narrow down the list to go inside only the homes that meet your needs.

My best tip is to act quickly when needed, area's such as Manchester are experiencing a decrease in listings and an increase of sales. Homes coming on the market are often out under contract very quickly.

4. MAKING AN OFFER: Now that you have found your dream Home, you are ready to make an offer. In a market such as ours with a decrease of homes on the market and an increase of sales, you want to make the best offer possible.

a. WHAT PRICE TO OFFER: You need to assess what the home is worth in todays market and subtract for any needed repairs. Never make an offer using a specific percentage off an asking price as the price may already be well below market value, at market value or priced way too high.

c. ARE THERE ANY OTHER OFFERS? if there are other offers submitted you may only have 1 shot to make your best offer to get this home.

d. CONTINGENCIES: Sellers hate offers with contingencies, strengthen your offer by only including a 7 day home inspection and a mortgage contingency.

As the market here in New Hampshire is stabilizing, the time for Low ball offers is over, your offer should be well written and to the point. Include a copy of your pre-qualification letter to let that seller know you are ready, willing and able to purchase.

IN CONCLUSION: There is a lot of behind the scenes work going on with the purchase of a home. If you did not notice most of these steps, I did a great job. With the decrease in Listings, there is pressure on Agents to provide more service. For agents who have been providing a great service to their clients throughout the last 4-5 years they are being rewarded as home sellers and buyers talk, they let each other know who did the great job or who dropped the ball. As you see it is no accident a home sells. It is through the hard work of the agent.

As a consumer you have a choice. Avoid the thinking that bigger is better. You deserve the Best and that is having some one guide you through each step of the Buying process. "Why do you DO Short Sales ?" Asked the Distressed Seller

Why DO you do Short Sales ? That has to be a question that every agent who does them....has to ask some days....the days that the file is "lost"....the "negotiator" wants to add one more word to an already signed legal offer to purchase...the Selling agent "knows" you can close in 30 days.....and the list continues. Yes...there are days when you wonder why you have chosen that niche as a part of your practice.

That was then....this is now....and we have to help him do the best thing that can be done for several generations to live the best lives possible.

     WHY do we do short sales....let us count the ways....saving one family at a time from foreclosure.

How Do You Wear Your Big "S"..We Were All Born With It..Needed In Life

Earlier in my career, I was a Buyer for a prestigious department store. I always said that I'd hate to have to feed my family by waiting for other people (Buyers) to make a decision. And I must say that 95% of the Salesmen that crossed my path would just present their lines and sit back. But... the other 5% got engaged in MY business and worked creatively to help me reach MY goals. So yes, I'm comfortable with the big old S on my chest now, because I've followed the 5%.

What does it cost to build a home in Madison, Georgia? It depends!

Because I sell land and farm properties, many of the buyers I talk to want to know "what does is cost to build a home in the Madison and Lake Oconee area"?

Cost to build a home depends a great deal on the plan. In my market, I'm seeing good quality "efficient" designs built for $100/sf, many built for $120-$130/sf, and some go much higher. The problem with average cost for custom homes is that most are built around personal preferences - so none in a sense are "average".

Another factor to consider is that the cost to build a home is based on fees charges by sub-contractors, and the first time they work on any particular plan they will likely charge more than the second, third, etc. That's because a quality home builder will require them to stick with their initial quote, and so they would rather "plan high" than eat the costs of under estimating the time and materials needed. Thats one reason why a large builder in a subdivision can offer "more home for the money" than a true custom home builder - their team has found the most efficient way to build each plan they offer.

Joey Daniel and Ryan Taylor are two local builders used with rave reviews by people I know - they both build high quality custom homes, and deliver them at lower costs than many other local custom home builders.

Three aspects really affect price:

design - most sf for the money would come from a 3 level home with a fairly uncomplicated roof line. Main level with a bonus above the garage and a finished terrace level. Some outdoor covered space, but not much (porches)

construction choices - windows, roofs, insulation, siding for example

interior finishes - flooring, kitchen and bath cabinets, trim, appliances

How those three areas are balanced can make a significant swing in the cost to build a custom home. Good custom home builders like Joey and Ryan will be willing to speak candidly with you and help you figure out how to get the right balance for your tastes and budget.

Improvements Done Without Permits Don’t Have to be Deal Breakers

Excellent observation by an experienced Realtor. Throughout my career, my ability to SOLVE problems has mattered, not my ability to IDENTIFY them.

Whether you're a buyer who has found a home you love, or a seller under contract with a qualified buyer - don't focus on the blame game when problems arise. Focus on finding solutions that allow all parties to move forward. Remember to keep your biggest goals in mind as you consider remedies, and be prepared to meet the other party half way.

Remember - having an experienced Realtor on your side gives you a huge advantage in tackling the variety of obstacles that may lie between you and your personal goal post.

Improvements Done Without Permits Don’t Have to be Deal Breakers

Lately, I’ve seen several posts on Active Rain about homes going on the market with repairs that were done without the benefit of a building permit or inspections – with less than happy endings to them. And these posts reminded me that there could be solutions to these types of problems that work for everyone involved.

In Washington, the departments running city building permits and inspections have been pretty lax for decades. So many people don’t bother that many contractors will quote two prices, one with building permits and one without. But recently our city leaders have figured out that the fees for permits are a cash cow. So they’ve begun to tighten up.

So how will this impact buyers and sellers? Maybe not a whole lot.

In one case, I had a high profile buyer who was purchasing a home with a basement rental unit. The sellers (like most Washingtonians who rent out their basements) hadn’t bothered to obtain what called a “certificate of occupancy”, nor had they gotten the proper permits needed to change their basement into a proper living space.

Before declaring the deal dead, it occurred to me to see if there was a way to get the place inspected after the fact. After all, the work looked like licensed workers did it properly. So I checked it out.

This situation had a happy ending for several reasons:

Both buyers and sellers wanted to make the deal work.

The sellers hired high end licensed contractors to do the work, and it was up to the current codes.

We managed to connect with some competent, helpful city employees who were able to schedule the inspections prior to settlement.

So where am I going with this one?

Identifying potential problems that could come up in a transaction is important. Focusing responsibility to an agent, a seller a contractor or whoever, isn’t real important.

What is?

Being ready to solve whatever the issue might be – this is why we earn the big bucks.

Carlsbad Buyers, Are YOU Prepared for Your Home Inspection?

Madison and Lake Oconee area buyers take note - this advice from an experienced Home Inspector is an excellent reminder of what to expect during the home inspection process. Even well maintained homes will have a "honey do list" as a result of the inspection, and how you respond is up to you. If you've negotiated a great deal, and the items reporrted are things you can easily take care of - you may want to shrug and move on to closing. If you were expecting a home in tip-top shape, you may ask the seller to take care of some things. The main purpose of a home inspection is to uncover hidden problems that could be expensive to fix - roof leaks, poorly functioning HVAC systems, mold or radon for example. Keep a cool head when you read your home inspector's report, and discuss possible responses with your Realtor. Remember you've chosen this home for a reason, and seek out solutions that will allow you to move in to your new home with a clear heart.

The home inspection is a critical part of the real estate purchase process for the buyer, one which often causes a great deal of anxiety.

While a home inspection is not required, it is highly recommended for buyers of Carlsbad homes, and generally buyers make their offers contingent upon a home inspection as part of their overall property investigation. We are, in this market, seeing some buyers willing to forgo an inspection in hopes of making their offers more appealing, or in the case of some investors.

As a Carlsbad home buyer, the more prepared you are for your home inspection, the easier it will be.

First, realize that even in a new home, or one that is meticulously cared for, a home inspector will find defects. It may come as a surprise and disappointment, but the chance of buying a home that is in perfect shape is almost nil. But every inspection will reveal some issues, even in newly built homes. Some homeowners are insulted the inspection reveals so many. Know that this IS the inspector’s job – it’s what you are paying for after all.

The home inspection can easily take 2 hours (for a smaller condo) or more depending on the size of the home, the issues, and the inspector. The typical inspection I have sen is 3 to 3.5 hours. You may want to be there for the entire time or wait until the inspector is nearly done so he/she can review the inspection with you. This may depend on what works for you, your interest, and how the inspector works. You certainly have the right to be there to learn about your new home and to ask questions.

The inspector will test all the appliances, including the dishwasher, oven, stove, washer and dryer, unless they have been removed or are not part of the contract. The good news is that you find out if the appliances are working as they should, or not.

During the inspection water will be run in sinks to check for leaks as well as water pressure and temperature. Toilets will be flushed, showers will be run to check pressure and temperature, bathtubs will be filled to check drainage.

The inspector will run your heating system, as well as the central air if the home has it, to check efficiency and other matters. More and more inspectors are also using thermal imaging, which relies on infrared technology, a non-invasive procedure that allows then to check for hidden leaks behind the wall. The list goes on.

The home inspector will provide a multi-page report, in most cases computer-based in pdf format, to provide the buyer with all the details and recommendations regarding defects, needed repairs, and maintenance. Inspectors will usually take photos to illustrate problems they uncover.

Once the inspection is complete and the offer is in hand, you may or may not decide to request that the sellers make repairs based on the inspection. This will be done on the Request for Repairs form; the sellers can respond to this is a number of ways. More on that in another post.

Be aware the home inspectors typically do not test irrigation systems, pools or hot tubs, climb on tile roofing and certain other exception. You may want to have other professionals into perform these inspections as part of your due diligence.

Waterstone Farms on Lake Oconee - putting down roots

I'll admit it - its personal.

The land that has become Waterstone Farms on Lake Oconee adjoins my own lakefront farm, and the opportunity to market the community means I'm responsible for finding my own neighbors!

The quiet north shore of Lake Oconee is not for everyone. When people think about living on or near Georgia's second largest lake, most of them look to the acclaimed gated golf communities that dominate the mid-lake. They may enjoy power boats and jet-skies, and being close to lakeside restaurants. My first encounter with the lake was a boat ride with a Realtor, and the focus was on the mid-lake.

But my own idea of lake life was shaped by my childhood days on Cossayuna Lake in the foothills of tha Adirondacks in upstate New York. It was low key, with modest cabins and row boats. I learned to ski on a small boat powered by a 35HP Johnson motor. Five generations of my family have known the pleasure of "going to the lake" - my grandfather and father taught me to fish as a toddler and I look forward to fishing with my grandson in the years to come.

I asked the Realtor if there was a part of Lake Oconee that was more like "On Golden Pond", and he suggested we look at the north end of the lake, and suggested I check out Madison. Game over! I found a scraggly piece of land that wrapped around Goose Creek Cove, and overtime have made it my home. Its a work in progress, with some pasture and a blueberry patch and plenty of trails. My dogs and cats have learned to co-exist with deer and bunnies and turkeys and my neighbors chickens, They're less than crazy about armidillos, and the ducks that patrol the shoreline. Its a peaceful place, and my heart sings every morning when I greet the sun rising over the lake.

I feel blessed to have found land that soothes my soul.

When the original developer created Waterstone Farms on Lake Oconee, he believed me when I said that people were seeking some of the same things that I was. Elbow room, walking trails, wildlife habitats, and access to the lake. He created covenants that ensured quality development, while remaining farm friendly - horses, chickens, and other critters are welcome, and barns can look like barns! The concept was right, but the market took a dive. Waterstone Farms has a new owner and reduced prices, and families are re-discovering the community.

You Think YOUR Neighbors Are Loud? Meet Mine!

Life in the country brings its own delights. My farm wraps around a cove on the quiet north end of Georgia's Lake Oconee. This week, my otherwise brave dogs are staying very close to the house because a papa duck is guarding mama duck and the young un's lakeside. I encountered another watchful papa duck a couple of weeks back - he stood like a sentinal while I bush hogged a lakeside field - but not TOO close to his family nest. My neighbors rooster has started roaming again, and he's likely to greet me as I leave for work. This is one of the ducks on patrol in my cove at daybreak!

One of the benefits we were looking forward to in moving outside the city was quiet…blessed peace and quiet.

Oh, sure, you would be surprised at how used to noise you become when you’re living between the Metro and the Highway…but if you crave privacy and quiet, you do envision living in a perfectly quiet environment, surrounded by green grass, trees and nature.

Except – “nature is loud” – as one of my clients exclaimed a year or so ago when we were looking for her new Stafford County home. This was her response after a rooster crowed in the neighbor’s backyard, taking her quite by surprise. As an owner of a very proud – and loud – rooster, I can attest to just how loud they can be.

Indeed, yes, Nature is loud. As I sat on my front porch earlier this week, I could hardly concentrate on reading my incoming email for the sounds of nature.

A pair of nesting geese (Fred and Ginger), who are hovering over a nest and 7 eggs, were most unhappy with the new interlopers that had arrived the day before…3 very new goslings and their parents…although our lake is big enough for both families. Anyway, they were miffed and showed it.

And everyone knows just how loud geese can be, particularly when defending their territory and their families.

Three eagles were perched on branches just above my head, just chattering away, and quite loudly. If you have never heard the chatter of a Bald Eagle, check out their calls on the Cornell Lab of Ornithology website. While I find it almost like a “chirp” (like a loud cardinal, really) and not the soiund I expected from a Bald Eagle, make no mistake, it is LOUD.

This afternoon, as I was walking around the lake, I startled two Great Blue Herons, who came flying out of the trees, just squawking. Until we had Herons for neighbors I had no idea how much noise they make…it took us a while to understand all their different calls and squawks.

So, while I wouldn’t trade all my wildlife for traffic noise, the fantasy of a perfectly quiet life has gone by the wayside. Nature is, indeed, loud.

Do You Believe? Or Should You...

I remember the first day I visited Lake Oconee - it was Sunday of Memorial Day weekend in 2000. And I remember seeing Madison for the first time just a few weeks later. After 2+ years of wandering around North Georgia, searching for a community that "fit" me and would be a good candidate for a second (and possibly retirement) home - I knew that Georgia's Lake Country was IT!

Now that I'm a Realtor, and have the pleasure of introducing people to my chosen community, I have the task of helping them see this place through my experience. I never grow tired of helping them discover whether this could also be their chosen home.

You see - I BELIEVE in Georgia's Lake Country, and it shows.

I recently wrote a blog post about a local community here in Alpharetta, The Enclave at Milton Park.

I wrote it because as soon as I saw it, I fell in love. I was excited about it and wanted everyone to know about it because eventhough it sits on a major street, it is unlikely you would think it was a townhome community and highly likely that you would ride right past it. I have done it myself so many times and when I found it, I actually stumbled upon it.

BUT...

This isn't another blog about that community, it is actually a blog about believing what we are writing about the homes we list and the communities we market. Are we writing for marketing sake because it is our jobs to do so or are we really BELIEVING what we are writing? Are we really excited about them or are they products and we are doing what we need to do to fulfill our duties to our clients? I ask because of a comment I received on the post this morning. The commenter said she wanted to visit there. I was excited because I want her to. I want EVERYONE to visit. I happen to think it's a cool place.

I'm a writer. I'm more of a poet than anything. My facebook friends love my stats because they invoke thought and conversation. Someone told me yesterday I should be a blogger (this let me know I'm not doing a good job at it because she didn't know that I did blog, lol). My point here is that when we invoke emotion and thought, we keep readers engaged. Listing the facts and showing what we know is great but actually leaving a reader salivating and waiting for the next line is a good feeling and I think it actually does great things for business.

I believe SEO is great. Getting the facts out and showing the public that you know your stuff is great as well but what put the icing on the cake is actually BELIEVING and being excited about what you're marketing.

Latest Trends in Home Design and what is in and out

In the Madison and Lake Oconee market, what my buyers are looking for includes:

master on the main, with large closets and spa-like bath

hardwood floors, with tile in the bathrooms

screen porches and great outdoor cooking/entertaining spaces

9ft+ ceilings with detailed trim

energy-efficient features, like foam insulation, high-seer heat pumps, and good windows

yard size splits two ways - some want low maintainence, others prefer privacy and room for a garden and a few chickens

Less popular features:
1. Fireplaces: Numbers of fireplaces in homes have been on the decline in the past few years, one or maybe two is enough for most people.
2. Carpet: Hardwood flooring seems to be the number one request by buyers in terms of flooring. 17% of new homes contain carpet throughout the entire home.
3. Living rooms: As long as there is a space for gathering, such as a family room, living rooms are being wasted or extra space, and not needed as often as they once were.
4. Desks in the kitchen: Spaces like this can become cluttered too quickly. Consumers are preferring their own office space or larger desks near the family room where they can watch their kids.
5. Skylights: Only 10% of new homes built will contain skylights in the coming year.
6. Updated kitchens: I was surprised to learn that granite counters are becoming less desirable everyone has them and there are more choices out there now.

And so what seems to be the newest trends in home design? These items are becoming more popular.
1. Lighting used as art: Lighting can be both functional and decorative. View some examples of great pieces at Lightcrafters.
2. Outdoor living space that is an extension of the indoors: Some patios go so far as to include fireplaces, TVs, audio equipment, and artwork.
3. Decorative “natural” pieces: Since so many consumers are concerned with saving the environment, a lot of design and artwork is focused on tree designs, for example.
4. Going green: Water-efficient appliances like dishwashers and washing machines are becoming more and more trendy. Other examples include LED lights under kitchen cabinets.
5. His and hers: Forget just closets and vanities. Some homes are offering his and hers garages!
6. Car lifts: With lot sizes becoming smaller, consumers are looking to get the most out of their space by storing one car on top of another or descending one into a basement space as you need it.
7. Large windows: Aside from adding in natural sunlight and decreasing energy costs, large windows can serve as the focal point of a room.
8. Wood: I love seeing homes with original woodwork that has been around for hundreds of years. Wood in both light and dark stains is becoming more popular around doorways, baseboards, and even on ceilings.
9. Electronics: You can’t turn around without a new electronic device on the market these days. You’ll find iPod docking stations in kitchens and baths now. TVs of all sizes can be found throughout the home, many of them mounted in the space.

Why Zillow is Usually Wrong

Are you confused by Zestimates? In the rural and resort community where I work there are three big reasons why Zestimates fall short of reality:

a) lakefront - Zestimates tend to average sale prices of lakefront homes with nearby off-water homes, making them inaccurate for both types.

b) homes with acreage - Zestimates tend to assume every home is on a "lot", so homes on 2 acres may get averaged with homes on 20 acres.

c) historic homes - Zestimates don't understand things like historic districts and ante-bellum, or restored vs updated.

If you really want to know what a property is worth, contact your local real estate professional. We're here to help you make great choices, and that starts by really knowing the true market value of property.

This blog was inspired by a cartoon which shows a couple sitting with a real estate agent. The agent says: “Based on comps, I suggest listing at $350K.” Wife: “But we paid $650,000 for it!” Husband: “And Zillow says it’s worth $675,000!” I found the cartoon on Facebook and reposted. The sad truth is that most consumers do not understand Zillow—or House Values, or even their county assessment office—all of which use Automated Valuation Models (AVMs) to price property.   The boring stuff first: AVMs use mathematical formulae, including multiple linear regression, to assign values to certain features of houses to come up with a value. As with any program, GIGO applies (Garbage In, Garbage Out). The AVMs out there for use today by consumers, of which Zillow is probably the best known, rely on reported and recorded sales data. This is why, if you live in one of the fourteen states in the US which does not record sales prices, the information you find may be sketchy, and derived from Multiple Listing Services (MLS). You may be thinking: “Well, what’s better than that? A recorded sales price tells me what that house down the street sold for.”

                Well, yes and no. A recorded price will tell you the amount they put in the deed as the transfer amount. It will not tell you:

If there were any “side deals” or cash under the table

If the seller paid closing costs or other fees on behalf of the buyer, known as “seller concessions”

If it was an “arms-length sale”, or one under duress, or between related parties, or any other sale which an appraiser would not usually consider

This is where the AVMs fall apart. As I always say when teaching pricing and valuation: “All comparables are sales; all sales are not comparables.” Here’s what I mean: in order for any real estate professional to use a comparable (“comp”) to compare to your home to establish a price or value, it needs to have sold. Houses that are listed and don’t sell indicate what the market won’t pay. Houses that are listed and sold indicate what the market will pay. However, not all sales are comparables. Here are some examples of houses I would not use for comps, as an appraiser:

The sale between two parties with the same last name, and it is verified that they are related by blood or marriage

The sale between two parties with different last names, but verification of the data revealed that the party selling the property was acting as executor of her mother’s estate, selling the 2/3 interest she and her sister had to their brother, who already owned a 1/3 interest

The property that did not sell at auction, and the next week the owner sold it for 20% below my appraised value to a neighbor, who was a friend

The property that sold for at least 20% higher than market, and upon verification, the buyer was not represented by an agent, was from out of town, and was unfamiliar with the market

You will notice the same word in all four scenarios: “verification”. As an appraiser, I verify data. I’m required to. But any real estate professional who is good at his or her profession will verify data, and will only use data which is germane and pertains to the property. Zillow, and other AVMs, don’t verify data. They throw it all into the mix. Some is high, some is low, and some is just irrational.   So, before you decide to sell your house based on a “zestimate”, do yourself a favor and get an opinion from a qualified real estate professional.

Before you Price and Sell Your Home, Consider Your Potential Audience

This is an excellent reminder that the most important first step for any seller is to "think like a buyer". Pricing is just one component, albeit the most significant one. But also consider taste (a dated home must be discounted appropriately), condition (your 12 yr old HVAC may be working, but it will need replacing soon and is certainly not as efficient as it could be), and competition (is your home really the best choice in a crowded market?)

With the generational shift, boomers who get ahead of the curve by updating and selling their larger dated home before their fellow boomers flood the market should be rewarded - even if it doesn't feel that way in the moment.

Before you Price and Sell Your Home, Consider Your Potential Audience

A 2012 article in The Atlantic magazine referred to the Millennial Generation somewhat uncharitably as "The Cheapest Generation". While the authors could have chosen their words better, the point of the article was that Millennials aren't buying houses and automobiles, at least not to the extent that previous generations have.

A slow recovery from the meltdown and financial crisis of 2008 deserves a share of the blame for the caution among consumers in their twenties and thirties. But it's important to remember that those millennial consumers are our future homebuyers.

The article goes on to remind the reader that young buyers are cautious and they are searching for value in everything they buy. Slow job growth, high student loan debt and a lack of financial resources will do that to you.

The elephant in the room is the pile-up of homes (including lots of vacation homes) poised to hit the market in the next decade and beyond. Most of those homes are owned by Baby Boomers, looking for younger buyers to cash them out.

Boomers tend to be sellers, not buyers. That trend will accelerate as time goes on. Many Boomers are retiring now, while others are rapidly approaching retirement age.

Who will buy your vacation home? How much will they be willing (or able) to pay?

Market Report – Q1 2013 – Madison-Morgan County, Georgia

With the Atlanta market heating up, it’s time to check out what’s happening locally in Madison and Morgan County, Georgia.

Residential sales are steady, with 39 homes sold YTD compared to 40 for the same period last year.
Median home prices are on the rise - $150,000 this year compared to $131,000 for the same period last year.
Affordable homes are getting scarce! Overall inventory looks high at 10+ months, but a closer look reveals a shortage of inventory in the affordable range – we have about a 90 day supply at the median sale price of $159,000 or less. Homes listed between $160K and $299K have a 10.5 months supply, while homes listed between $300K and $499K have a 17 months supply. Above $500K its hunt and peck – the most expensive home closed this year sold for $400,000 and there are 34 homes currently listed above $500K. I do have one farm closing next month above the $500K benchmark, but the other 21 homes currently pending are below.

What’s the message:

Buyers - if your budget is $150,000 or below – be prepared to make a strong offer when the right home comes along, because you’re likely to have competition and prices are rising.

Sellers – if your home is listed between $160,000 and $299,000, price to sell. There are buyers, but the competition from other sellers is intense

Buyers and Sellers in the upper brackets – be patient and shop for the right deal. Don’t be distracted by excessive days on market – with so few buyers, most every property has that.

This post does a terrific job explaining the process of re-finishing your hardwood floors - what to expect from the contracter you hire. When planning a hardwood floor refinishing project, don't just shop for the lowest priced contractor - be sure you are getting a quality job!

Refinishing hardwood floors in Westchester NY - Everything you ever wanted to know about sanding your floors.

Refinishing your hardwood floors can have a huge impact on your Westchester County home. You will be amazed at how refreshed your home will look...and the floors will look good as new. Many don't realize that when you sand and refinish the floors, you have the option to change the color - you can go from dark to light or light to dark or anywhere in between.

If you have hardwood flooring underneath your carpet, you are in luck. Usually, refinishing and restoring the hardwood will cost LESS than recarpeting. And, most homeowners prefer the look and feel of hardwood. Not only will it improve your home's value, but they are much easier to clean and maintain.

How does the hardwood refinishing process work?

First, all the furniture and all items need to be moved off of the floor. Sometimes, our customers move the furniture; other times they prefer to have us move it. If there is carpet to remove, we take care of that as well. We put plastic around all of the areas that will not be sanded. We then sand the floors 3 times...each time with finer and finer grits so that the wood looks like raw hardwood again and the pores are open to accept the stain and polyurethane. We use edgers to help around the edge of the room.

From there, we apply a stain (if you want to stain the floors) or if you are going natural, we add on a coat of polyurethane. After this has dried, we add on another coat of polyurethane, and after that has dried, we buff the floors and add on another coat of polyurethane. During that entire time, you can not walk on the floors nor have any furniture on the floor. For this reason, it's ideal to do this work either BEFORE you move in or while you are away (not to mention that it is messy and it smells). See below of for a link on how long the process takes as well as the different types of polyurethane (the different types have different drying times and it's important that you plan ahead).

The sanding machines have bags attached to capture most of the sawdust (similar to a lawn mower), and we vacuum in between each coat. It's important that while the refinishing process is going on and it's drying that no other work is happening elsewhere in the house. If so, dust created by other workers can easily settle in the stain and polyurethane.

If you have pet stains (or water stains) on your hardwood, we can help you fix that. Usually, the hardwood can be replaced and woven in, and after you refinish the hardwood floors, it will look good as new.

Many of our customers prefer the dustless refinishing as it's much cleaner and neater. It's especially good if you are already living in your home, and if one of your family members is sensitive to dust or has asthma. Dustless sanding does cost a bit more than the standard method, so we will often price out both options for our customers.

We help our customers choose colors by providing guidance on colors that are in style and will go with your overall style and decor. We usually test 3 stain colors for our customers so that they feel comfortable with the decision. It's much better to test the stain on your own floors...the same stain color can look different in different homes, pending on the species of hardwood, the grade of wood as well as its age and based on the lighting in the home. Wood naturally has color variation, so some boards will come out lighter and some darker, so going off a single stain chip can be misleading...it's much better to see it on a larger section of your own floor.

How Not to Buy & Sell Homes - The Bridge Burning Technique

Why do people burn bridges? Simply put, I think because it’s satisfying. There are definitely two camps on this issue as far as real estate agents are concerned, some are definitely anti-burning and some are definitely pro-burning. Both camps can seem ridiculous at times. The agent who believes in continuing the conversation no matter how futile, or the agent who negotiates with a Zippo in one hand and lighter fluid in the other.

I won't pretend I've never burnt a bridge... I have. And, it certainly has been gratifying. Sometimes you burn a bridge because you want to guarantee that you won’t use it again. And it is an effective technique for sending a message. When I decided I didn’t want to work another law firm job, I told a legal recruiter that I rated those positions right up there with “Puppy Assassin” in terms of desirability. That did the trick, no more calls or emails from her.

When potential buyers and sellers start setting things on fire, I do start to wonder though. After all, it’s hard to pretend you don’t want a property when you offered to buy it, and it’s hard to pretend you don’t want to sell a property, when it is listed for sale. So why all the ceremonial torching? Some people view bridge burning as a type of negotiation; they actually burn the bridge and expect the other party to swim across. I must admit, I haven’t experienced that one yet.

I have seen those same arsonists out in the middle of a lake trying to reconstruct a burnt bridge or two. In my experience, it’s painful to watch and very expensive indeed. And, I have also heard the pangs of regret months later, from many a reformed flame thrower. Regret is also expensive, and also painful to watch.

Typical offenders in this market? Sellers who draw a line in the sand and then don’t listen to the market, investors who love their spreadsheet more than reality, and buyers who thought they would be in the driver’s seat forever. Ships do sail and bridges do burn and we see it every day in this business.

Once lit, whether slow burning or fast and chaotic, that bridge will burn, and when its gone, its gone.

Buyers or Sellers market? - Lake Oconee Georgia

Is it a Buyers or Sellers market at Lake Oconee?

It depends on what type of home you are looking for.

Private lakefront homes on Lake Oconee are oversupplied, with 208 currently on the market and just 14 sold year to date. In fact, lakefront homes represent 50% of the single family home inventory and 33% of the sales.

Homes under $200,000 represent 25% of the sales, but just 10% of the inventory - so buyers should be prepared to move quickly when they find a home of interest.

Homebuyers with more than $1,000,000 to spend have plenty of choices, with 71 homes on the market and just 5 sold year to date. Buyers can pick out their top three choices, and find the most motivated seller.

Whether you're a buyer or seller (or both!) - make sure you're working with a local market expert. Markets shift, and you can't afford to be making decisions with outdated information.

We are in the midst of some of the cheapest money we will ever see.

Those of us who bought our first homes, like Alan, "in the Jurassic period" marvel at the current opportunity to lock in 3-4% rates for 30 years! Whether or not its a great time for you to buy depends on more than just low interest rates, of course. But 3-4% is a LOT easier on your family budget than 8-9%, for sure!

We are in the midst of some of the cheapest money we have ever seen, and will likely ever see in our careers. Our mortgage guy, Greg Schneider of PHH Mortgage, tells us, just this morning, that rates have turned back down... and we're seeing conventional money in the mid 3%'s... (like 3.5%)...and jumbo money in the mid 4%'s (4.5%)... dependent, of course, on the borrower's credit.

That's some cheap money, folks.

When my wife and I were first married, and bought our first condo, (back in the Jurassic period), we had a couple of choices... we could get a 30-year-fixed, 8.75% mortgage.... or we could opt for a 30-year-fixed 8.75% mortgage (just like Henry Ford... you could have any colour we wanted... as long as it was black!).

Cheaper money means that our buyer's mortgage payments will be lower, or that they can afford to reach a little higher, and purchase a property with a higher purchase price.

Does that translate into "This is a great time to buy?". Well, that depends entirely on the situation of your buyers... but we're not going to see money this cheap for a long, long, time. And we're starting to see prices rise, and how far behind that, do you think, will we start to see interest rates begin to rise?

We owe it to our clients to pass on this information. While our clients are smart people (well, most of them), and they read the papers, and watch the news... they may not be as aware of these historically low rates as we are, because we are immersed in it, day after day. Spread the news, folks.
