    <title>PA's Real Estate Transfer Tax</title>

&lt;h2&gt;Realty Transfer Tax- Post written by the Suburban Realtors Alliance&lt;br /&gt;&lt;/h2&gt;
&lt;p&gt;&lt;strong&gt;Background:&lt;/strong&gt; A real estate transfer tax is a state  and local tax assessed on real property when ownership of the property  is exchanged between parties. All types of real property, including  residential, commercial, and agricultural, are subject to the transfer  tax. Although the tax is generally levied on the value of the property,  it is assessed only on the sales transaction instead of on an annual  basis like the general property tax. Transfer taxes may be assessed on  either the buyer or the seller, but both are usually jointly and  severely liable for the tax.&lt;/p&gt;
&lt;p&gt;In many states, the realty transfer tax is used to fund programs  designed to preserve open space in residential or commercial areas and  to fund housing programs for low-incomes residents. Pennsylvania  currently imposes a 1% tax, with an additional tax levied by school  districts and municipalities. Generally speaking, the local transfer tax  equals an additional 1%. &lt;p style="margin-bottom: 0pt;"&gt;&lt;strong&gt;Recent Developments:&lt;/strong&gt;&lt;/p&gt;
&lt;p class="style1" style="margin-top: 0pt;"&gt;&lt;span style="font-family: times new roman;"&gt;&lt;span style="font-family: arial;"&gt;In   June of 2007, the Pennsylvania General Assembly considered  options to  fund the Commonwealth's ailing mass transit systems. One prospective  option would have increased the statewide realty transfer tax (RTT) from  1.0% to 1.9%, with the additional 0.9% dedicated to mass transit  funding. Another option would have given county governments the  authority to increase the local RTT and dedicate the additional  percentage to mass transit.&lt;/span&gt;&lt;/span&gt; &lt;span style="font-family: times new roman; font-size: 16px;"&gt;&lt;span style="font-family: arial; font-size: 12px; color: black;"&gt;The  final bill did not include a local option to increase the realty  transfer tax. Thank you to all the REALTORS&amp;reg; who used the PAR  Legislative Action Center to send a letter to your legislator. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p class="style1"&gt;&lt;span style="font-family: times new roman;"&gt;&lt;span style="font-family: arial;"&gt;PAR  and Suburban REALTORS Alliance believe that the RTT makes housing less  affordable for everyone, from first-time homebuyers struggling to put  together a down payment to senior citizens having to give up a portion  of their equity to taxes when they downsize to a smaller home. In  addition, we believe that RTT is poor public policy, especially when  used as a tool to fund mass transit. Quite simply, there is no  relationship between mass transit and real estate transactions.  Homebuyers and sellers should not have to carry the burden of funding  mass transit.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Suburban REALTORS Alliance Position:&lt;/strong&gt; The Alliance is opposed to increases in the current transfer tax for the following reasons:&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;As the transfer tax is levied only on buyers and sellers of  property, the burden per taxpayer is greater than the burden from a more  broad-based tax designed to generate the same amount of revenue.&lt;/li&gt;
&lt;li&gt;Since public transportation is a benefit that is open to all  members of society, the charge should not be placed solely on buyers and  sellers of property.&lt;/li&gt;
&lt;li&gt;The transfer tax adds additional burdens on first-time home  buyers saving for a down-payment and covering the closing costs and runs  contrary to existing federal, state, and local programs including the  mortgage interest deduction, low interest property maintenance loans,  and grants to first time homebuyers.&lt;/li&gt;
&lt;li&gt;Currently the Pennsylvania Realty Transfer Tax exceeds that of  six neighboring states including Maryland, New Jersey, New York, Ohio,  Virginia, and West Virginia.&lt;/li&gt;
&lt;li&gt;Pennsylvania has one of the highest transfer taxes in the  nation.  This distinction could contribute to the "brain-drain" effect  and is not an attractive way to draw out-of-state homebuyers to the  Commonwealth.&lt;/li&gt;
&lt;li&gt;The transfer tax is an unpredictable source of revenue due to fluctuating economic and housing market conditions.&lt;/li&gt;

&lt;p&gt;Limerick PA &amp;ndash; &lt;span class="ts1"&gt;What's the Difference Between a Short Sale and a Foreclosure?&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;What are the implications to my credit score?&lt;br /&gt; Following a successful short sale your mortgage will be reported on your credit score as either paid or negotiated, lowering your score as little as 50 points and affecting you for only 12 to 18 months. After a foreclosure, however, your credit score can lower as much as 300 and usually at a minimum of 250 points and affects your score for over three years. &lt;br /&gt; &lt;br /&gt; &lt;a name="3"&gt;&lt;/a&gt;What are the implications to my credit history?&lt;br /&gt; A short sale is usually reported as paid in full and is not reported on your credit history. A foreclosure will remain on your credit history for 10 years or more and will remain as public record. &lt;br /&gt; &lt;br /&gt; &lt;a name="4"&gt;&lt;/a&gt;Who decides if my home should undergo a foreclosure or a short sale?&lt;br /&gt; In both short sales and foreclosure, the decision is made by your mortgage lender ultimately. The most important aspects to getting a lender to agree to a short sale, and saving you the more damaging credit implications of a foreclosure, is to prove that you have no other way to pay the mortgage and that the amount received from a short sale is the fair price of the market. Lenders who believe they can receive more by taking possession of the home in a foreclosure and selling it themselves will not agree to a short sale. &lt;br /&gt; &lt;br /&gt; &lt;a name="5"&gt;&lt;/a&gt;How long will I have to wait to buy another home?&lt;br /&gt; After a foreclosure, you may end up waiting another 24 to 72 months before a mortgage lender will offer you an interest rate that is acceptable. Most mortgage lenders report that for homeowners who have undergone a previous short sale they may get a reasonable interest rate in less than two years. It appears that Fannie Mae guidelines allow a short seller to apply for a new loan immediately if payments were kept current and had no 60-day late payments on their record. &lt;br /&gt; &lt;br /&gt; &lt;a name="6"&gt;&lt;/a&gt;What will be the effects on my future loans?&lt;br /&gt; For most mortgage lenders you will not be asked to declare or be questioned regarding a short sale on any standard loan application (1003). In regards to foreclosure, you will be asked on any future standard loan application (1003) if you have had a property foreclosed in the last seven years, therefore affecting your rate. Fannie Mae backed mortgages will be available to you following a short sale after two years. Fannie Mae backed mortgages will not be available to you for at least five years if you have lost your home due to a foreclosure from my understanding. &lt;br /&gt; &lt;br /&gt; &lt;a name="7"&gt;&lt;/a&gt;Does it affect my employment opportunities?&lt;br /&gt; A short sale does not appear on a credit report and will not challenge your current employment status. In comparison, if you have a foreclosure on your credit report, some employers consider it a reason for termination or reassignment since many run credit checks on employees for certain positions. A foreclosure can be extremely harmful to your chance of being selected for a new job if your credit report is taken into consideration. &lt;br /&gt; &lt;br /&gt; &lt;a name="8"&gt;&lt;/a&gt;How does a short sale versus a foreclosure affect the deficiency judgment?&lt;br /&gt; If your short sale is handled successfully, the lender may give up the right to pursue a deficiency judgment against you. If the lender does pursue a deficiency judgment against you after a successful short sale, the amount will be considerably lower because your home was sold at a price closer to market value than that of an REO (Real Estate-Owned) sale. In all foreclosures, with the exception of those states without deficiency, the bank has the right to file a deficiency judgment against you. Since your foreclosed home will have to go through the REO process if not sold at auction for a lower sales price, this results in a higher deficiency judgment against you. We try to negotiate this away.&lt;/p&gt;

    <title>Foreclosures Stopped &#8211; Banks Taking Some Hits</title>

&lt;p&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif; color: #333333; font-size: x-small;"&gt;For many months, we&amp;rsquo;ve been hearing of Courts throwing out lender lawsuits for judicial &lt;strong&gt;foreclosure&lt;/strong&gt; based upon falsified declarations.&amp;nbsp; Now many States are jumping in and  suspending certain foreclosures.&amp;nbsp; Here&amp;rsquo;s the background in what is going  on and what to expect in the future.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif; color: #333333; font-size: x-small;"&gt; &lt;/span&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif; color: #333333; font-size: x-small;"&gt; &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif; color: #333333; font-size: x-small;"&gt; &lt;/span&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif; color: #333333; font-size: x-small;"&gt;Each  State has its own laws for handling defaulted home loans. For example,  California allows both Judicial foreclosures (lawsuit in the courts) and  non-judicial foreclosures (non-court Trustee Sale).&amp;nbsp; Each method has  its pros and cons for lenders, but because of the speed and lower cost  of Trustee Sales, that is generally used for home foreclosures. However,  in California if a lender does do a Trustee Sale, they give up any  right to recover a deficiency judgment on the unpaid balance.&amp;nbsp; It&amp;rsquo;s  different in other States.&amp;nbsp; 23 States only allow Judicial Foreclosure so  their &lt;strong&gt;foreclosures&lt;/strong&gt; are always Court supervised. The  remaining States allow a choice of either method but only a few bar  deficiency judgments after Trustee Sale. &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;&lt;span style="text-decoration: underline;"&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif; color: #333333; font-size: x-small;"&gt;So there are two issues arising in a &lt;strong&gt;foreclosure&lt;/strong&gt;: &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif; color: #333333; font-size: x-small;"&gt;1) loss of home &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif; color: #333333; font-size: x-small;"&gt;2) deficiency judgment risk.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif; color: #333333; font-size: x-small;"&gt; &lt;/span&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif; color: #333333; font-size: x-small;"&gt; &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif; color: #333333; font-size: x-small;"&gt; &lt;/span&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif; color: #333333; font-size: x-small;"&gt;The  problem for lenders first arose in the judicial foreclosure States.&amp;nbsp; As  part of their legal filing, the lenders were required to provide a  sworn statement as to the truth of the facts claimed in their lawsuit  such as that they owned the loan and that the procedures&amp;nbsp;for foreclosure  were properly followed.&amp;nbsp; However, it was discovered that attorneys for  the lenders were falsifying the sworn statements and in many cases  simply having someone sign the form without any actual knowledge of the  facts, so called &amp;ldquo;robo-signers&amp;rdquo;.&amp;nbsp; Presumably the lenders and their  attorneys filing&amp;nbsp;thousands of such lawsuits believed that no one would  pick up on this and they hoped they could get quick results. They were  wrong.&amp;nbsp; Attorneys for some defendants challenged the lawsuits and the  false statements and the Courts have responded by throwing out the  lawsuits.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif; color: #333333; font-size: x-small;"&gt; &lt;/span&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif; color: #333333; font-size: x-small;"&gt; &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif; color: #333333; font-size: x-small;"&gt; &lt;/span&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif; color: #333333; font-size: x-small;"&gt;While  lawsuits get challenged all the time and typically are corrected, the  extent of these falsified Complaints indicated a systemic policy of  lenders committing this fraud.&amp;nbsp; Faced with potentially damning publicity  and possible legal sanctions,&amp;nbsp;lenders stated damage control. Last  month, GMAC admitted that their employees had falsified foreclosure  documents.&amp;nbsp; Recently, Chase and BofA admitted the same.&amp;nbsp; Each has stated  that they are suspending foreclosures until the problem is fixed.  Meanwhile, the States have started to act. On Friday, Connecticut  suspended all foreclosures for 60 days.&amp;nbsp; California&amp;rsquo;s attorney general  has ordered Chase to stop foreclosures or prove the validity of its  process.&amp;nbsp; More are expected to follow as further evidence comes out  showing the corruption in the foreclosure process.&amp;nbsp; However, other  lenders such as Wells Fargo have not made any suspension and have  recently indicated its intent to increase the pace of foeclosures.&amp;nbsp;This  is surprising given indications that Wells Fargo has also filed lawsuits  against borrowers without legal merit.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif; color: #333333; font-size: x-small;"&gt; &lt;/span&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif; color: #333333; font-size: x-small;"&gt; &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif; color: #333333; font-size: x-small;"&gt; &lt;/span&gt;&lt;span style="font-family: Arial,Helvetica,sans-serif; color: #333333; font-size: x-small;"&gt;These  foreclosure suspensions&amp;nbsp;will give affected upside-down owners some more  time but they will not result in loan forgiveness.&amp;nbsp; The lenders will  fix the problem and defaulted loans will eventually be foreclosed unless  an alternate resolution is reached.&amp;nbsp; This means that impacted lenders  will likely be much more receptive to a loan modification or &lt;a href="http://shortsaleblogger.com/" title="short sale"&gt;short sale&lt;/a&gt; without deficiency recourse.&amp;nbsp; The one step that we do not expect to see  is Congress or State legislatures coming to the rescue of homeowners.&amp;nbsp;  They have shown no willingness to date to do anything other than bailout  lenders without recourse for the terrible lending practices that drove  us into this Recession.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;NOTICE TO PHILADELPHIA GAS WORKS&amp;rsquo; (PGW) RESIDENTIAL CUSTOMERS&lt;br /&gt;Dear PGW Customer:&lt;br /&gt;The Governor signed a new law called the Responsible Utility Customer Protection Act (Act 201 or Law) that became effective on December 14, 2004. The Law makes new rules to help utilities keep costs down. To keep costs down, we have new rules for collecting money on past due accounts. These rules also apply to deposits, payment agreements and service accounts that have been shut off. This notice will tell you about the changes we will be making because of the Law.&lt;br /&gt;Shut-Off of Utility Service &amp;ndash; Under the new law there are different rules for winter shut-offs. If your income is more than 150% but less than 250% of the poverty guidelines, PGW may turn off your service beginning January 1 unless:&lt;br /&gt;&amp;bull; A person in your house is 65 years or older;&lt;br /&gt;&amp;bull; A person in your house is 12 years or younger;&lt;br /&gt;&amp;bull; A person in your house has a letter from a doctor;&lt;br /&gt;&amp;bull; You have paid half of your last 2 bills or&lt;br /&gt;&amp;bull; You have paid 15% of your household income in the last 2 months&lt;br /&gt;If your household income is low, we will turn on your service if you join PGW&amp;rsquo;s Customer Responsibility Program (CRP). For example, this means if there are 3-people in your household your monthly income must be below $1,959.&lt;br /&gt;Based on your income, the amount of your deposit may be equal to one or two average bills. If you enroll in CRP, you do not have to pay a deposit.&lt;br /&gt;Shut-Off of Utility Service &amp;ndash; PGW can shut off your service if you fail to do any one of the following: to pay for service, to keep a payment agreement, to pay a deposit or to allow us to get to our equipment.&lt;br /&gt;We will send you a 10-day notice. Once you get this notice, we have 60-days to shut off your service. Next, we will try to talk to you at least 3 days before the shut off date. From December through March, if we do not talk to you, we will leave a notice at the residence 48 hours before we shut off your service. If we shut off your service, we will leave a notice to tell you what you need to do to get service back on.&lt;br /&gt;There are certain times we may shut off your service without giving you notice. These include stealing service, getting service through fraud, tampering with our meter, or if there is an unsafe condition.&lt;br /&gt;The Law now allows us to shut-off service on all weekdays, including Fridays. PGW may also now shut-off your service during the winter (December 1 &amp;ndash; March 31). We do&lt;br /&gt;not need to get Public Utility Commission (PUC) approval first for non-low-income customers. But, we will give you notice. If your income is at or below 150% of the federal poverty guidelines, we must first ask the PUC for permission to shut off your service. For example, this means if there are 3-people in your household your monthly income must be below $1,959 to require PUC involvement before termination.&lt;br /&gt;If you give us a bad check to stop termination, we may shut off your service without any further notice.&lt;br /&gt;Payment to Restore Service &amp;ndash; Depending on your income and payment history, we may require you to pay the full bill or we may make a payment agreement. We may also require you to pay a reconnect fee and a deposit. If you have broken two or more payment agreements, we may require payment of the full balance.&lt;br /&gt;Any adult who lived at a home that we shut-off for an overdue bill may have to pay all or part of that balance if you want service in your name.&lt;br /&gt;Between December 1 and March 31, we will reconnect your service within 24 hours after you pay the bill. During other times of the year, we may take three to seven days to restore service.&lt;br /&gt;Deposits &amp;ndash; You may have to pay a deposit if you do not have good credit. You do not have good credit if you fail a credit test, have a poor payment history with us, or were shut-off for an overdue bill. The amount of the deposit may be equal to two average bills. We will pay 6% interest (simple interest) on your deposit.&lt;br /&gt;Payment Agreements &amp;ndash; The Public Utility Commission (PUC) may make payment agreements between utilities and customers. The Law allows the agreements to vary between 6 months and 5 years depending on your income. If you break the PUC payment agreement, the PUC may set up a second payment agreement only if your income has changed. If you are enrolled in the Customer Responsibility Program (CRP), PGW&amp;rsquo;s customer assistance program, the Law does not allow the PUC to make any additional payment agreement if you fail to make the monthly CRP payments.&lt;br /&gt;Responsibility for Bills &amp;ndash; We may require any adult who lives with you and whose name is on your mortgage, deed or lease to be responsible for bills. We may ask you to prove who you are and who lives with you.&lt;br /&gt;Medical Certificate &amp;ndash; We may delay shut-off if you or someone living with you is seriously ill. We will delay the shut-off if a licensed physician or nurse practitioner states that the shut-off will harm the ill person. You will need to ask your doctor to write a letter to explain your situation.&lt;br /&gt;Complaints to the PUC &amp;ndash; You must first contact PGW to complain about a problem. If you are not satisfied with our answer, you may then contact the PUC. You must pay&lt;br /&gt;any undisputed amounts and current bills while the PUC is looking into your complaint.
